“As a local furniture manufacturer, knockoffs are a constant and growing challenge.

We must work together to see stronger protections for Australian designers, manufacturers and distributors.

We had no idea how much work goes on behind the scenes to lobby and change legislation to protect designs!

The relationships the ADA has developed with Government agencies must be applauded.”

ACKNOWLEDGEMENT OF COUNTRY

Authentic Design Alliance respects all Aboriginal and Torres Strait Island people, past, present and emerging, and acknowledges them as the traditional custodians of the lands we occupy.

We recognise their continuing connection to the lands, waters, culture and communities on and within which we work and acknowledge that Sovereignty has never been ceded.

Welcome

It was a thrilling start to the year for arts organisations as the world swung back to the new normal with the return of IRL connections at trade events, design weeks and exhibitions.

If the past two years have given us one thing - it’s a renewed appreciation for lived experience and direct connection with people, places and things.

DENFAIR

At Denfair (now Design Show), the first trade show in two years, the excitement of face-to-face engagement was palpable amongst the 7,000 visitors! We delivered two installations and presented a talk on lighting design to a standing-room-only audience.

We also showcased the ADA Design Futures Award Winners from the Design Fringe program - Kirby Burke, Kathleen Prentice, Lauren Haynes, Jill Stevenson and Marta Figueiredo. Meet our new 2022 winner on p.5

MELBOURNE DESIGN WEEK

‘Futures Collective’ at Villa Alba Museum was the standout event of the festival! With Spence & Lyda and Fiona Lynch Office, we joined Broached Commissions for a spectacular 10-day takeover of the historic mansion.

Our collaboration with designer-maker Ash Allen CAGED, a series of one-off functional sculptures graced the circular lawn at the entrance. This month, see CAGED at Design Show, Sydney, details p.5.

ADA AWARD PROGRAM

The ADA Award of Merit at vivid design competition went jointly to Georgia Weitenberg and Billie Civello, with Marlo Lyda taking the Judges Choice Award (seen on p.5).

ADVOCACY & POLICY CONSULTATION

Last year we concluded a two-year consultation with the IP Australia Designs Review, a research phase that informs policy amendments. From November through April, we joined a roundtable series to flesh out the nuances of legislation amendments.

Supported by Banki Haddock Fiora lawyers and the ADA Stakeholders who generously joined these forums, we’re very thankful for the input and support.

This year introduced a 12-month ‘grace period’ of automatic protection for Australian products. Learn more about what’s next in our ADA news on page 4.

When we inherited the ADA® in 2015, we embarked on a ninemonth fact-finding mission to understand how ‘design theft’ damages the furnishing industry to inform our remit.

At the same time, we discovered the Federal Government was conducting an enquiry into design protections.

Soon after, the Productivity Commission inquiry into Intellectual Property (PCIP 2016-18) became our baptism by fire. Straight in the deep end with the lengthy processes required to change laws.

A two-year review of Design Systems became our next project immersion.

Throughout that time, we have collaborated closely with IP

So here we are seven years down the track, with one significant win yet much more to achieve!

The next round of policy changes will likely open for public consultation in early 2023. From there, it’s another 18-24 months before finalising the next round of legislative changes.

As we’ve said many timesit’s a very complex and involved process. But we’re here for the

and automatically protected by copyright.

Why are furniture designs and architectural accessories treated differently?

There’s also the elephant in the room. Australian import laws allow container loads of replicas and knockoffs to enter the country. A seemingly unstoppable problem. Territories across Europe have criminalised the replica industry. And the US work closely with border forces to stop unlicensed goods at the port - where they’re promptly destroyed!

We remain committed to creating a more robust future landscape for designers, manufacturers, makers, importers, retailers and distributors of genuine products. To support everyone who works with or specifies original design.

Image Makers Association & ADA® Unite

We’re proud to announce our affiliation with the newly minted industry body representing Australian photographic professionals.

Image Makers Association Australia exists to counter copyright infringement and

long haul as there are other things to address outside what’s currently on the table.

IP Australia are not responsible for copyright, and it’s critical that copyright for our sector is overhauled. But that’s a very complex conversation we will share soon.

Other creative disciplines like photography, art, music, film and literature are freely

to lobby for respect for image licensing.

Led by Dianna Snape, an experienced advocate and lobbyist for photographic copyright and moral rights, the foundation members are funding ongoing education that we at the ADA are committed to supporting. Head to their website to learn more. imagemakersassociation.com.au

If you are keen to support us, please consider becoming an ADA member. We have big plans and need to build a team to achieve our vision. A vision where the word ‘replica’ is eradicated from the industry.

And an environment where ‘fast furniture’ is clearly understood to have the same irreparable effects on our world as the ‘fast fashion’ industry inflicts.

It’s time to end the ‘disposable decorating’ culture and value genuine products.

“The furnishing sector is indelibly linked to photography. We commit to supporting the Image Makers Association by promoting appropriate image attribution and respect for copyright.

By shared intelligence, our independent associations can jointly work towards a more robust landscape for the creative practitioners we support and represent.”

MELBOURNE DESIGN WEEK

Melbourne bounded back to life in March, and the event highlight was undoubtedly the Spence & Lyda and Fiona Lynch-driven exhibition ‘Futures Collective.’ Expertly curated by David Harrison, contemporary design breathed new life into an original Victorian-era mansion.

Spanish designer Álvaro Catalán de Ocón debuted Plastic Rivers, a series of rugs made from recycled PET plastic bottles, each depicting the Google image of where the plastic used to craft the rugs were salvaged. The collaboration with rug brand GAN spotlights the global crisis of plastic waste in world river systems

ADA, ASH ALLEN: Caged at Villa Alba.

Photography: Fiona Susanto.

“After experiencing Melbourne’s lockdowns and seeing metal grids everywhere from tram stop barriers to roadside retaining walls. To me, the repeated grid began to reflect many things from social media vanity to fake news; and ultimately, the hollowness of the replica furniture industry.”

DESIGN SHOW SYDNEY:

ADA® Presents ‘CAGED’

Whilst in lockdown, Melbourne designer-maker Ash Allen began exploring handmade metalwork. Starting with Michael Thonet’s bentwood chair No.14, possibly one of the most copied chairs in history, he reimagined 13 famous furniture icons that showed at ‘Futures Collective’ for Melbourne Design Week.

CAGED has been made possible by CocoFlip, Tomek Archer, James Richardson Furniture, Euroluce, Living Edge and Cult.

The remaining pieces are available to purchase. See them at Design Show October 22-22nd, we are at stand 844.

ADA® Talk

Unpacking the four pillars of lighting design, we share the perspectives of a specifier, lighting distributor, independent lighting design brand and commercial lighting designer.

VIVID DESIGN COMP

Continuing our event partnership, this year, we jointly awarded Georgia Weitenberg for the ‘Bent Wood Chair,’ (1.) an overscale rustic chair made from heritage timber salvaged from the family home. The project takes a wry swipe at how the intent isn’t conveyed when products are copied.

Billie Civello (2.) won our second Award of Merit for a solid cast aluminium made entirely from recycled aluminium collected from scrapyards across Melbourne. The mould for the casting was shaped from discarded polystyrene found on the side of the road from fridge packaging.

DESIGN FRINGE EXHIBITION:

Until November 27th

A highlight of the Melbourne Fringe Festival, the Design Fringe exhibition (formerly Fringe Furniture) shows at two new locations, Linden New Arts and Carlisle Street Art Space (CSAS), both exhibitions open until the end of November.

Early-career designer Bolaji Teniola (3.) is the recipient of the ADA Design Futures Award for Timber Shaving Vessel.

Inspired by the manufacturing techniques of Akari lamps and the paper mache process, timber shavings are transformed into vessels using homemade organic adhesive and found objects acting as moulds.

FRINGE KEYNOTE

In October we led a keynote talk at Victorian Pride Centre for Fringe, our panellists included designer Ella Saddington, weaver Lis de Vries and futurist Bridgette Engeler, moderated by Anne-Maree Sargeant where we unpacked how designers must rethink the notion of waste as part of the creative process.

LE BAMBOLE

After fifty years of continuous production, Mario Bellini’s Le Bambole has had a 2022 upgrade, with a deeper sofa and a new bed for the series. spacefurniture.com.au

Class of 72’

1972 marked the arrival of David Bowie’s alter-ego Ziggy Stardust; Nike’s first track shoe, the Cortez; the hand-held calculator and the advent of the McMuffin breakfast burger. Ok, perhaps the last one may not be so memory-worthy, but as a timestamp, that’s where we were fifty years ago!

It was also a massive year in the design world. This year celebrates many half-century milestones and we nod to these enduring design classics that are destined to bask in a resurgence of popularity.

Il MAESTRO

Among a slew of reissues and special editions, 87-year-old Italian Maestro Mario Bellini is undoubtably the most celebrated designer of the year with a rebooted Le Bambole and relaunched La Mura sofa collections.

The curvaceous, feminine lines of Le Bambole (the dolls) has been in continuous production since its 1972 launch and won the most prestigious design award, the Compasso d’Oro (Golden Compass), in 1979.

Now, Bellini has worked with B&B Italia to refresh the collection by leaning into newer sustainable technologies. The 98% recycled polyethylene structural shell has a hollow

internal roto-moulded form wrapped in recycled PET sheathing. With recyclable internals, all components can easily be disassembled, further extending the life of this classic.

LE MURA

Another Bellini design from the same year will join the list of cult classics by the master with the Le Mura modular sofa freshly re-editioned by Tacchini. Inspired by ancient walls, the bulbous collection is presented classically in leather or sings peak ‘70s vibes in jumbo corduroy upholstery. With hinges in copper or nickel, Le Mura will undoubtedly join other Bellini designs, Le Bambole and Camaleonda, as a sofa du jour.

BOHEMIAN 72

Born in 1922, Italian artist and designer Gabriella Crespi moved with European royalty and the Hollywood jet-set, living the high life yet exploring the serenity of emerging ‘70s philosophies. The year she would have turned 100, Gubi has launched Bomenian, a collection conceived on her Milanese balcony in 1972. Defined by repeated layers of vertical rattan vines, a new decorative technique for that era, the refined yet relaxed series elevates indoor or outdoor living.

BOHEMIAN 72

Designed half a century ago, Gubi has now bought Bohemian, the ‘70s inspired rattan indoor-out, outdoor seating collection, to life for the first time.

LA MURA

La Mura, another Bellini design, celebrates 50 years since its debut, and Tacchini has reintroduced the bulbous, buckled modular sofa collection. stylecraft.com.au

PACHA’S CURVACEOUS COMFORT

French designer Pierre Paulin’s (1927–2009) first sketches for what would become the Pacha Collection were simple pencil outlines that resembled clouds.

Without constraint of legs, the Pacha heralded an era of lowlevel living and introduced a new style of lounge comfort when it launched in 1975. This small footprint series was shown in Milan by Gubi as outdoor seating with fixed or swivel bases. cultdesign.com.au

“The strong nautical connection is intentional. Even down to the way the woven rope detail provides tension to the seat and backrest, it reminds me of the rigging on a yacht.”

AN AUSSIE DESIGN CLASSIC

Trace by Adam Goodrum delivers plush upholstered comfort framed in distinct wire detailing. Contemporary, original and considered, it launched in 2017 and now includes high and low tables, bench seating, a drinks trolley and outdoor planters and screens.

If linear minimalism is more your style, the Carlo Colombo ‘Cloud’ collection that launched in 2010 now also joins the new Arflex outdoor offering.

A black or white stainless steel floating frame supports synthetic rubber webbed upholstery, and the seating is available as sofas, armchairs and a daybed.

MARENCO OUTDOOR

Established in 1947, Arflex was a pioneer of highend Italian furniture, and in the early 1950s they began making seats for cars like the Fiat Topolino.

Working with designer Marco Zanuso to explore how this automotive technology was applied to furniture manufacture, the experimentation developed the injection moulding process is still used today to manufacture high-quality sofas.

Among the Arflex stable of world-famous designers is Marco Morenco, who presented his now iconic, eponymous series in 1970. Reissued in 2007 and receiving the Wallpaper Design Award for best release, the classic series can now be used for outdoor residential and hospitality living.

Artisanal lighting brand Articolo has extended its collection to exterior illumination. Signature mouth blown Murano glass melds with bespoke metal structures and detailing; it’s a yes for these architecturally driven pieces to subtly elevate gardens, pathways and courtyards.

A PORTABLE DANISH CLASSIC

Born from the famous semi-domed Vernor Panton-designed pendants, the Flowerpot VP9 series is a slightly smaller, deliberately lightweight lamp that can move between indoor and outdoor settings. Reimagined by Danish brand &tradition, now you can recharge the light via a USB charging cable. cultdesign.com.au

UNPLUGGED

In Vitro Unplugged is the latest addition to Flos’ Philippe Starck outdoor lighting collection. The wireless, rechargeable, batterypowered lamp is portable and perfect for home or hospitality use. Whilst the glass shade typically exists to protect a bulb, the light source is concealed, creating a go-anywhere minimal object of desire.

BANKSIA LANTERN

The Banksia oil lamp by Zachary Hanna hosts a glass diffuser within a spun aluminium frame, the sculptural cage doubling as a handle for ease of portability. An affordable, accessible, great Australian design.

A tool fulfils a very concrete function, and its form explains the function. That’s what makes a tool so beautiful.”

MAYDAY UTILITY

The handheld Mayday utility lamp by Konstantin Grcic (Flos, 2000) produces direct light whilst also acting as a diffuser. Grcic created the conical light to go anywhere as needed. Placed on the floor, table, or hung, the hook/handle works as a cable winder to contain any excess cord. It was this flexibility that won the highest of all design accolades - Compasso d’Oro - for being an affordably priced, portable functional design.

“It is the lamp I wanted to have for myself, a lamp that I felt should be something like a tool.

PHILIPPE STARCK

Authentic Design Alliance was founded in 2010 by a group of leading distributors who united to counter the replica furniture industry. The ADA founders represent some of the most influential, iconic and innovative contemporary furnishing and lighting brands.

ADA 2.0 relaunched in 2016 as a social enterprise to lobby for improved intellectual property protection for the furnishing sector. But changing laws is far easier said than done, so it’s a long game.

Europe Criminalises Replicas

Over the past ten years, many territories across Europe and the UK have criminalised the replica industry. Penalties include enormous fines and even jail time.

In the USA, industry advocates work with border forces to identify counterfeit products; and port authorities destroy pirated furnishings at the port of entry. In 2017, 38 seizures prevented around $25 million of cheap furniture copies from e ntering the US market.

Copyright is the most accessible protection in the USA, costing $55 plus attorney fees to file. Copyright is also recognised across the EU, protecting works for the duration of the creator’s life and 70 years after death.

Australian Design Registrations

Unlike the EU or USA, copyright doesn’t protect new designs in Australia. Without a design registration, anyone can legally copy a product.

It’s possible to apply for registration with IP Australia for products that are less than twelve months from being released. Once granted, the protection only lasts ten years.

It takes around two years to create and launch a product. Add to that the enormous expense of establishing manufacturing, marketing and distribution; ten years is not nearly long enough to recoup a reasonable profit.

Unlike fashion, furniture and lighting designs have remained in the market for many years. Decades even. So, ten-year protection goes nowhere when considering how long the work will be available. After ten years, anyone to legally copy it.

Get Real, Don’t Be Fake

Original designs have a meaning beyond the cost price. There’s an emotional connection. Users care for products that last a generation (or more). This furniture is also in high demand in the secondary market, which is booming.

So when purchasing or specifying, stop and question: Who made this? How was it made, and will it last? How are the materials sourced? Is my choice ethical and environmentally sound?

A trusted retailer, importer, or designer-maker will stand by the products they import, make, and sell. The products they represent are covered by warranty and can be repaired, restored and even resold.

Don’t support design theft

Please ensure you are part of the solution and not feeding the problem. Educate others. Purchase and specify responsibly.

Be original. Only buy authentic designs from trusted retailers, makers and distributors.

"To me, the fact that you can buy a Tom Dixon replica as easily as a Big Mac in Australia is deeply embarrassing.
The more significant issue for me as a creative is the viability of design and creative culture (here). I hope our Government protects creativity and innovation in Australia and falls in line with the rest of the world."
