A little over a year ago, I was in a car wreck and due to financial responsibility laws I had to pay for the accident. (I had no insurance, of course, I've learned this lesson) Recently they've filed suit against me for more money that they didn't receive from the insurance company. I can't afford an attorney and was about to hire a bankruptcy lawyer for all of this, but I recently found out from the insurance company that the case is closed. It's also been over a year as of a couple days ago and due to Tennessee's Statute of Limitations they can't claim any more money. So my question, the insurance company says it's closed and even said the attorney settling with them has closed the case. I call the opposing attorney myself and of course they say they can't discuss the case with me, even though I'm just asking if the case still actually exists.

They wont' give me a court date either so naturally, I'm a bit suspicious. Should I be ready to put this behind me, or do law offices do this sort of thing all the time? They were recently paid out $10,000 from the insurance company I'm making payments to.

Last year around September I made the grave mistake of letting a friend borrow my car to see his girlfriend and he claimed to have just gotten his license and it was supposed to come in the mail within the next week. I believed him and it's my fault, no question about that. He got pulled over and the cops gave him a ticket for no proof of insurance. And because he didn't have a license, they impounded my car for 30 days, but if he had gotten his license within that time, I could've retrieved my car earlier, but he was not cooperating. To make a long story short, I paid 1,500 out of my pocket to release my car from the impound lot, and my car was insured at the time but he was too dumb to find it in my glove compartment and got a ticket for 2,000. He now wants proof of insurance to dismiss the ticket but I'm not giving him it until I'm reimbursed for the impound fees. The driver was apologetic and admitted several times around a number of people that he must have blanked out or was daydreaming from the frustration of the school bus. USAA is saying that they need to make sure that my daughter was not 1% at fault, meaning speeding perhaps.

The officer estimated her speed at impact at around 40 mph and the speed limit is 55mph. She hit the drivers back tire of his Jeep Wrangler (small truck) causing him to rest in a small trench or ditch ion the side of the attempted driveway. The front passenger side above the front tire and the front by the headlight is damaged on her car. She tried to avoid him, protect her younger sister (13) and avoid veering to much left in fear of hitting the school bus. My girls were terrified when I arrived 15 minutes after the accident. USAA stated that she may have had time to instanly stop, but she tried everything that she could do. In my opinion, she should have never been put into that situation. USAA is saying that points of contact are off, but my insurance agent said that she hit the back tire because a Jeep Wrangler is only 5 ft long and he was not towing a boat or driving a common sized vehicle. Plus the driver admitted to pushing down on the accelerator when he realized what was happening. I just need to have someones advice on this matter before hiring a lawyer. Thank you."

So the difference between your premiums and the expected benefits you get back is even more. It seems like a very fit, health-conscious person is really taking it on the chin by buying health insurance in the individual market.
