Nonpartisan transparency coalition works to enshrine sunshine into Arkansas Constitution A group of Arkansas transparency advocates from all corners of the state, and of varied political affiliations, are working to protect the state’s Freedom of Information Act with a ballot initiative for a Constitutional Amendment.

In addition to maintaining the strength of the state’s existing FOIA, the group has also proposed in the draft amendment defining a public meeting, an area of the law that has been vague for some time. The amendment also proposes stricter penalties for those who violate FOIA.

The text of the proposed amendment , on which the group is seeking public feedback, was released October 11. The members of the Drafting Committee also released the following statement:

“It has become clear in recent years that it is critical to enshrine government transparency in Arkansas, regarding public records and public meetings, in our state constitution. Arkansas has been a national leader in government transparency since 1967, when Gov. Winthrop Rockefeller led the way for the enactment of the Arkansas Freedom of Information Act. We, the undersigned, believe strongly that Arkansas should maintain, and even strengthen, our position of leadership on this vital issue. We further believe that having an open and transparent government is a right, and rights belong in the constitution. For that reason, this group has come together—in spite of our varied, and in some cases fundamentally opposed, political perspectives—to propose the Arkansas Government Transparency Amendment.

In preparing this Amendment, our goals have been to: 1)

Enshrine the Arkansas Freedom of Information Act, as it existed on September 1, 2023 (before the September 2023 special session), into the state constitution;

2)

Ensure that any further changes to the Arkansas Freedom of Information Act that reduce government transparency may only be approved by a vote of the people of Arkansas, while providing that laws that increase government transparency may be passed by the General Assembly;

3)

Change as little as possible in the existing Arkansas Freedom of Information Act, with the primary exception being to provide a definition for “public meeting,” which has been a hole in the Arkansas Freedom of Information Act for some time;

4)

Safeguard the ability of any citizen of Arkansas to enforce the Arkansas Freedom of Information Act by protecting their ability to recover attorney’s fees in the event that a Freedom of Information Act request is wrongfully denied;

5)

Create a penalty for bad actors who knowingly violate the Arkansas Freedom of Information Act;

6)

Account appropriately for the security of public officials and their minor children, balanced with the public’s right to know how our tax dollars are spent; and

7)

Keep the amendment language as simple as possible, while taking into account the vast number of laws existing in the Arkansas Code affecting government transparency.”

Interlink CEO Hill to present at ArkLaMiss Audience Development Conference next month in Vicksburg Interlink CEO Brad Hill is set to present two sessions, “Understanding Periodicals: All Things Mail Entry” and “What Postal Changes Brad Hill Mean for Your Newspaper,” on Thursday, November 9 during the ArkLaMiss Audience Development Conference at the Ameristar Hotel and Casino in Vicksburg, Mississippi.

Interlink is a leading provider of circulation and customer service management software and serves more than 1,500 daily and weekly newspapers nationwide. Hill was named CEO of the company in 2018.

His history with the company began in 2001 when he was hired as a technical contractor. He later became Director of Customer Services for the company before moving into the general manager role in 2011.

In 2017, Hill was named a National

Newspaper Association representative on the Mailers’ Technical Advisory Committee, joining colleagues from NNA in the important postal issue-related group.

ANF grants available to attend ArkLaMiss Conference The Arkansas Newspaper Foundation has made available three grants of $200 each to help defray the cost of APA members attending the upcoming ArkLaMiss Audience Development Conference next month in Vicksburg, Mississippi.

Grants will be awarded one per media group, with priority given to first-time attendees.

Information and an application form can be found beginning on page 21 of this week’s Arkansas Publisher Weekly.

The deadline for application is Tuesday, October 31.

Proposed new 2024 postal rates called “punitive” by NNA The proposed Jan. 21, 2024, postage increase for community newspapers is nearly four times the rate increase proposed for other users of the mail, according to the National Newspaper Association.

The United States Postal Service announced on October 6 an expected 7.3 percent increase for the local Within County mailing rate for newspapers.

The average proposed increase for FirstClass mail is 1.9 percent, even though the First-Class stamp rate would rise by two cents to $0.68. The proposed increase for advertising mail is also 1.9 percent, though the increase within that mail class used by local newspapers to distribute shoppers and other advertising mail increases ranging from 2.1 to 3.9 percent, depending upon mail density. The rate for Periodicals mail destined for outside the publisher’s Arkansas Publisher Weekly

county would settle at a more modest 1.59 percent. That rate is also used by national magazines and other national publications.

National Newspaper Association Chair John Galer, publisher of The Journal-News in Hillsboro, Illinois, said the dramatic rate increase for local newspapers was a shock.

“It certainly seems as if the Postal Service wants to discourage newspapers from using the mail. At a time when local journalism is already in peril and more newspapers are using the mail to reach subscribers, this increase is simply punitive,” Galer said. “We expect both our subscribers and other stakeholders in our community to push back at the subscription increases that will be made necessary by the Postal Service’s action.”

Leonard Woolsey, president of Southern Newspapers and president and publisher of The Daily News in Galveston, Texas was elected vice-president. Matt McMillan, CEO of Press Publications in White Bear Lake, Minnesota, will serve as treasurer.

Cameron Nutting Williams, chief revenue officer of Ogden Newspapers, becomes immediate past president.

Arkansas State Archives receives additional funding for digitization of historic territorial-era newspapers The Arkansas State Archives recently announced it has received grant funding from the National Endowment for the Humanities for continued participation in the National Digital Newspaper Program, a partnership with the Library of Congress to digitize historic Arkansas newspapers.

With this award, the Arkansas Digital Newspaper Project team will digitize an additional 100,000 pages of newspaper content from newspapers across the state.

The Arkansas State Archives has received $951,828 since entering the project in 2017.

According to the Arkansas State Archives, the Arkansas Digital Newspaper team has successfully added 318,000 pages of newspaper content since it began the project six years ago. The team has previously emphasized newspapersof-record from across the state, but in this funding cycle they will focus on titles documenting the evolving relationship between the economy and the environment, from Arkansas’ territorial period from 1819 to the mid-1930s.

This curated selection of newspapers, combined with the previously digitized newspapers-of-record already available on Chronicling America, will help to tell the story of Arkansas by giving researchers free access to primary source material from the territory’s formative years through 195758.

“The National Digital Newspaper Program is doing important work,” said APA Executive Director Ashley Kemp Wimberley. “Until recently, you had to physically access a newspaper, either bound or on microfilm, from a library or archive in order to search for a particular item or article. The Arkansas Digital Newspaper Project will benefit students, researchers, genealogists and historians, not just in Arkansas, but nationwide.”

The Arkansas Digital Newspaper Project team is made up of seven archivists and microfilm technicians; two staff members are dedicated to the project full-time. The full-time project staff includes Project Director Katie Adkins and Project Archivist Chelsea Cinotto. Arkansas State Archives staff members on the team include: Curator Julienne Crawford, Microfilm Division Manager Terra Titsworth, Microfilm Coordinator Darren Bell, Outreach Historian Brian Irby, and Director and State Historian David Ware.

Chronicling America, a service of the Library of Congress, offers access to digitized historic American newspapers from 17701963. The website currently hosts over 20 million pages of legible, searchable content with new content added daily.

Guest Column: Be responsible in exercising rights to public information

A divorce is finalized, but it is not recorded in the newspaper until four months later.

Someone appears in court for a domestic assault, but the sentence isn’t reported until weeks after the fact.

The subjects naturally raise two questions: What constitutes these items as news? Why is there such a delay in the report?

These instances, and many more, occurred during my tenure as editor of the Red Wing (Minn.) Republican Eagle. Other editors can likely relate.

Our simplest answer to readers is that divorces and court news are public records under Minnesota law. That is probably the case in most jurisdictions. Ambulance runs, marriages and divorces, traffic tickets, court fines – they all fall under the realm of public information and their publication regularly raised the eyebrows of readers, especially of those directly affected.

Individuals often will challenge publication of a specific record and present what they consider justification for withholding publication. Some arguments may have merit.

From our newspaper’s perspective, however, we strived to treat all public records the same. As we explained, it’s

difficult to place a newspaper in the position of being judge and jury – trying to determine who has a valid argument for withholding information and who does not.

Yes, individuals may disagree with the fact that newspapers choose to print public records. But editors should expect readers would be much more critical – and legitimately so – if records were selectively published. A policy riddled with double standards is no policy at all.

Any right to publish records has an accompanying responsibility. Readers should expect newsrooms to do everything possible to ensure timely reports.

Public records often are of sensitive nature – a divorce, a bankruptcy, a court sentence.

The circumstances can be stressful for individuals and the report of the item draws more attention. Delayed publication can unnecessarily aggravate a situation.

Ensuring punctual reports involves two steps. Newspapers, unfortunately, have varying degrees of control.

First is the release of the information from the appropriate agency. The process often has built-in delays, and it’s something that is out of newspapers’ hands. Newsrooms should work with officials to get the

information as soon as possible.

Editors do, however, control how soon the information gets published once received.

Most newsrooms can likely improve on the turnaround.

It’s common for readers to ask newspapers why they stand firm on access to and publication of specific public records.

It’s much like the proverbial “if you give an inch, they’ll take a mile.” If the press agrees to one concession, all too often an individual or agency will try to stretch the rules. Soon laws are enacted with additional restrictions on what once was routinely public data.

2023 ArkLaMiss Marketing & Audience Development Conference Arkansas Newspaper Foundation Continuing Education Grant Application

Arkansas Newspaper Foundation (ANF) has available three (3) continuing education grants in the amount of $200 each for the 2023 ArkLaMiss Conference, to be held Nov. 9 and 10 at the Ameristar Hotel and Casino in Vicksburg. MS. Each grant of up to $200 will help defray the cost of registration and hotel expenses for one attendee from a qualifying Arkansas Press Association member newspaper/media group.

There will be one grant awarded per Arkansas media group, with priority going to first time attendees. If all grants have not been awarded based on this criterion, the remaining grants will be awarded on a first- come-first-served basis.

Criteria • Application is required. Grants will be awarded to one person within one media group.

• Grantee must be a current employee of an Arkansas Press Association member newspaper in good standing, and must be a resident of Arkansas.

• The Continuing Education Grant will be funded up to $200 for Conference costs, for the reimbursement of registration fees, food, lodging and/or mileage.

• Attendance at the Conference is required for grant recipients. Should a recipient become unable to attend, ANF should be notified no later than November 6.

• Receipts are required for reimbursement, including conference registration receipt. No monies will be disbursed without a receipt.

• Applicants are encouraged to retain conference receipts up to 30 days after attending the Conference. In the event a grant recipient becomes unable to attend, the award will move to the next eligible applicant.

• Grantees agree to write a summary of the Conference for publication in the Arkansas Publisher Weekly.

• Receipts, verification of attendance, and summaries must be turned in no later than December 8, 2023. Once receipts have been received and reviews, disbursement of funds will be made within 10 business days.
