Legislature gives governing bodies authority to meet by electronic means during pandemic The Arkansas General Assembly’s Joint Budget Committee last week tacked on temporary language to a routine budget bill that provides guidance to public entities about how to conduct meetings during the coronavirus pandemic.

The amendment to HB 1082, the Department of Finance and Administration budget bill, was adopted on voice vote by the committee. The full House and Senate are expected to adopt the measure this week as the Legislature wraps up a truncated fiscal session. The amendment gives governing bodies the authority to meet by electronic means in the event the governor declares a disaster emergency. The entity must give notice of the meeting to the public and must record the meeting in whatever fashion it was conducted, whether by audio or video. Those recordings must be maintained for at least a year. The new language establishes in law the practice that most all Arkansas municipalities have began since the onset of the COVID-19 epidemic. It is

also consistent with court rulings over the years about how entities may conduct open meetings via teleconference or video conference.
