A MIDSUMMER NIGHT’S DREAM “Lord, what fools these mortals be!”… In preparation for a royal wedding, a party of pomp and circumstance is planned… Love triangles, plotting, and a little touch of magic aid the guests in their revelry and distraction… And thus the stage is set for the 2015 ANU Law Students’ Society Annual Ball: A Midsummer Night’s Dream Ball. The ANU LSS is proud to announce it’s much anticipated Annual Ball will be held on the 30th July (6.3010.30pm) at the 5 Star Hotel Realm. Tickets will become available on Thursday 28th May at 12pm midday, and will be accessible via a link posted in the Facebook Event page. Tickets are $115 for LSS members and $120 for non-members (plus an online booking fee). The ANU’s oldest and best-endowed students’ society is excited to see one and all at our Annual Ball this year.

What does it mean to be a commercial practitioner? BY ERICA CHAN, GRADUATE, GILBERT + TOBIN Close your eyes. Your Corporations Law notes are fading

away. Take a deep breath and then let them go. Now, open your eyes. You’re in a boardroom high above the city with stunning views or at a client function.

What skills do commercial firms look for? Aside from the technical legal skills you begin learning at university, commercial firms also look for the following:

Wherever you are, there’s a client across from you with a problem. Perhaps one of their suppliers is refusing to deliver on time, which could mean the loss of a key customer. Or maybe their company is about to embark upon a million dollar joint venture, but negotiations have stalled. Whatever the case may be, it’s your mission to help solve that problem as practically and effectively as possible.

*Commercial acumen: being able to approach situations and problem solving from a business perspective is something that develops with time. As a young lawyer, a great place to start is reading up on the news with a view to exploring the political and business landscape in which many of your clients will operate and require solutions within.

What does a commercial practitioner look like? Commercial practitioners can look like anything, ranging from lawyers who excel at telecommunications deals to specialists in international arbitration, energy and resource deals, or project finance. Aside from these specialisations, the main difference lies in whether you are a ‘front end’ or ‘back end’ practitioner:

*Effective communication skills: University education has primed us well for academic written communication about legal principles. In practice, however, these legal principles need to be translated promptly and efficiently into the practical effects on clients and their business. So having highly developed communication and interpersonal skills is a fantastic draw for law firms.

*Front end (or transactional) practitioners help to facilitate a client’s business, transactions and projects. In practice, you will be exposed to a variety of work as a junior lawyer ranging from drafting and reviewing contracts for deals to undertaking due diligence for tenders. You may also research statutory regulations or the interpretation of contractual requirements for clients requiring specialist advice.

*Teamwork and organisational skills: in both front end and back end work, commercial matters are often very complex and fast paced. So it’s important to not only know how to manage your time, but also to be able to work with others in high pressure situations. If you’ve ever worked while studying or devoted extensive time to co-curricular activities, those balancing, organising and teamwork skills will stand you in good stead.

*Back end (or commercial dispute resolution) practitioners specialise in the resolution of disputes through negotiation, mediation, arbitration, or litigation through courts and tribunals. As a junior lawyer, you will likely get involved with procedural processes such as discovery and the drafting and filing of court documents, affidavits, and other pleadings. You may also attend court and assist your team with developing strategies to manage the dispute.

Is commercial practice for you? Being a commercial practitioner isn’t for everybody, but if you decide to give it a shot, it can be a challenging and rewarding career. Take the time to attend events, ask questions, chat to people in the industry, and gain a thorough understanding of what it’s like to become a commercial practitioner.

Some firms and practice groups may specialise in either front end or back end work, and some will combine the two. Whatever the case, both types of commercial law work require similar skills.

Opinion BY PHILIP MATTHEWS Earlier today, I was sitting in an Australian Public Law lecture trying to think of a compelling topic to write about when something caught my attention (which has become an increasingly rare occurrence throughout a semester of APL lectures). The case that caught my attention was Al-Kateb v Godwin. For those unfamiliar with the case, it involved a Palestinian man born in Kuwait (Al-Kateb) who moved to Australia in 2000 and applied for a temporary protection visa. When Al-Kateb’s application was denied he declared that he wished to be removed to Kuwait or Gaza. Kuwait would not accept him and it was too dangerous to have him extradited to Gaza due to the political situation there. Following this, the High Court of Australia it ruled that the Migration Act 1958 was constitutional and applied in full force to persons such as Mr Al-Kateb, allowing his indefinite detention. Australia claims to be one that upholds human rights and it routinely lambasts governments that do not, but how can any regime in the developing world seriously take criticism from a rich Western ‘democracy’ that is known to hold asylum seekers, including children, in detention open-endedly? It’s very easy to look back on past mistakes and decry the heinous actions of our forefathers, but once we are forced to examine what is happening right next to us it is as though we are wearing blinkers. The same could be 12

said for civilian casualties incurred by drone strikes in the Middle East: yes, we know it’s happening, but Obama seems like a cool guy so we’ll let it slide; all these (other) terrorist attacks sure are terrible though. Meanwhile, people all over the world save their money in an attempt to escape the rockets, poverty and other hardships facilitated largely by centuries of imperialism. Bad luck for anyone trying to seek refugee status in Australia, though, because if you don’t make the cut based on some dodgy criterion you may well be in for an indefinite stay at Christmas Island (which as we all know is nowhere near as much fun as its name suggests). Yet somehow Australians are able to conjure up arguments such as, ‘They’re only economic refugees’ or, ‘The queue-jumpers should’ve come here legally!’. Indeed, as if these people were leading rather well-to-do lives in their home countries, but thought they could do a bit better in Australia, so they uprooted their families and risked their lives on rickety boats chartered by ruthless people smugglers purely for economic gain. Likely story. I don’t think many of us who have been fortunate enough to live most or all of our lives in this country could truly imagine the conditions these people are trying to escape, ‘economic’ or otherwise. How we can subject children to what are effectively indefinite prison sentences with no better reason than, ‘It’s the law’ will never cease to amaze and appal. I hope that this is something that will be looked back on with contempt in our history, but until then the lives of those who wanted nothing more than a decent life are ticking away in wholly undeserved cages. In this matter, Australia stands firmly on the wrong side of history.

Possibility in everything What a student can expect from an Allens clerkship – Dana Rechtman, Lawyer. Before completing my clerkship at Allens, clerkships were a mystery to me. I had heard whispers around law school about cocktail nights, the dreaded interviews and students giving up part of their precious (three-month long!) university holidays. However, I had not heard all that much about all the benefits that come with completing a seasonal clerkship. Having completed a clerkship at Allens, I would like to give an overview of why it is an invaluable experience and why you should really consider this option as you head towards the end of your law degrees. A seasonal clerkship really is a great way of finding out what working in a commercial law firm is all about. One of the best things about the clerkship was how welcoming people were and how willing they were to give open and honest opinions about their day-to-day lives at Allens. This was evidenced in the organised event ‘Confessions of a Law Grad’, in which a panel of graduates answered our many and varied questions on their experiences entering into the workforce. They were also more than willing to take us out for coffee to talk more about their personal experiences and to chat about the transition from university to full-time work. It was really great that people were so friendly, that I could relate to so many people who had been in my position and that they really understood why the questions that we were asking were so important to us. This welcoming attitude was also evident throughout other areas of the firm. Working on matters for different lawyers not only exposed me to the type of work that I would be doing at Allens but also demonstrated the approachable nature of the lawyers. Importantly, I really felt that people had time for me. The lawyers I worked with made a real effort to ensure that the work that they gave me was interesting and they were always willing to give me feedback. They also allowed me to sit in on client meetings and attend court so that I could get a real experience of life in a large commercial law firm. Another great thing about the clerkship was the exposure we had to different practice groups and different areas within the firm. Even better, this was achieved through wine and cheese nights, where we effectively went speed dating with members of the different practice groups with wine and cheese provided! These evenings were great – they were very informative and really gave us an insight into the different areas within the firm. We also had interesting and eye-opening seminars on the really amazing work that Allens does in the community sphere, including in the areas of pro bono and reconciliation, and we were also invited to attend the special interest group meetings. If I could leave you with one message, it would be to take up all the opportunities offered to you during the clerkship. Be it putting your hand up to help out on a pro bono matter, attending ice cream runs organised by the grads (that really happened!) or going to a lunchtime talk put on by the Women at Allens committee, the more you get involved and the more people you meet and speak with really enables you to see what your experience later down the track could be at Allens and whether this is the path that you want to take to begin your career. For me, the clerkship awakened me to all the wonderful things that were on offer at a firm like Allens and the insights that I gained made it clear that Allens was a place that I wanted to be.

LSS First Year Rep Profiles First Year Officer (Careers): Freya Willis What is your favourite Youtube video? Although partial to some very bad X Factor auditions, my favourite Youtube videos would have to be Jimmy Fallon’s Lip Sync Battles. If you could invite three celebrities, dead or alive, to dinner, who would it be? Emma Watson, Abraham Lincoln and Ringo Starr (yes, he is my favourite Beatle). If you could only eat one food for the rest of your life what would it be? Smashed avocado on toast with poached eggs (you can take the girl out of Melbourne, but you can’t take Melbourne out of the girl).

First Year Officer (Social Justice): Felicity Brown Where’s your favourite place in Canberra to take an out of town guest? I recently went to the Arboretum with some family. I would highly recommend the Bonsai Exhibition. What’s your favourite Dr Seuss Book? Dr Seuss is one of my favourite authors. My favourite books are 500 hats of Bartholomew Cubbins and Green Eggs and Ham. If you could participate in an Olympic event, what would it be? Hockey, because it’s a great sport and would be my best shot are getting a gold medal. What’s your favourite T2 flavour? Oolong chocolate chai, a good winter blend that goes really well with vanilla soy milk and honey.

First Year Officer (Events): Eden Lim What helps me get through Torts? There’s nothing that gets me going more then a Wonton dumpling noodle soup. What’s your favourite song played at Mooseheads? Wannabe by the Spice Girls is a bit of a groovy tune. Favourite TV Show? Kath and Kim. It’s noice, it’s different, it’s unusual.
