Tax Codification - Factors and Instructions Presented by the American Academy of Actuaries Life-Risk Based Capital Committee’s Codification Subgroup to the National Association of Insurance Commissioners Life Risk-Based Capital Working Group June 2001 – New Orleans, LA The American Academy of Actuaries is the public policy organization for actuaries practicing in all specialties within the United States. A major purpose of the Academy is to act as the public information organization for the profession. The Academy is nonpartisan and assists the public policy process through the presentation of clear and objective actuarial analysis. The Academy regularly prepares testimony for Congress, provides information to federal elected officials, comments on proposed federal regulations, and works closely with state officials on issues related to insurance. The Academy also develops and upholds actuarial standards of conduct, qualification and practice and the Code of Professional Conduct for all actuaries practicing in the United States. Codification Subgroup James F. Reiskytl, F.S.A., M.A.A.A., Chair Joseph L. Dunn, F.S.A., M.A.A.A. Robert F. Herbert, Jr., F.S.A., M.A.A.A. Mark C. Rowley, F.S.A.,M.A.A.A. Harold Summer, F.S.A., M.A.A.A.

William C. Weller, F.S.A., M.A.A.A. Bill Wilton, F.S.A., M.A.A.A. Michael L. Zurcher, F.S.A., M.A.A.A.

Summary: The following spreadsheets update the RBC instructions and the disc to implement these recommendations. One adjusts Total Adjusted Capital (TAC) to reflect codification including Deferred Tax Assets and Deferred Tax Liabilities in the TAC. The other adjusts the RBC calculation. The latter includes the new separate tax factor calculation required to calculate RBC. The spreadsheets also provide instructions to implement the new Tax Sensitivity Test--showing results on a pre-tax basis that may in turn be adjusted by the NAIC’s LRBC Working Group to vary the degree of tax recognition appropriate for the specific company that potentially is weakly capitalized.
