WHAT DO I NEED TO WORRY ABOUT NOW? You have your MMJ card. You followed the rules. You should be in the clear, right? Unfortunately, there are still things you need to know to protect yourself. The police presume you are violating the law if a police officer smells the odor of marijuana. He can presume the law is being broken and you can be stopped, detained and even searched. Although the AMMA is supposed to shield you from prosecution, punishment, and penalty as a result of your medical use of marijuana, the truth is that you have to affirmatively advocate for your own protection. For example, a doctor "recommendation" for medical marijuana is not afforded the same weight as a "prescription" would be in legal defense of a DUI or boating under the influence crimes. Instead, you have an added burden to prove the marijuana present in your system was insufficient to impair, something a "prescription" holder would not have to prove. Even though the state of Arizona allows people to possess 2.5 ounces every two weeks, that right does not come without qualification. If you possess more than the allowable amount, you lose the protections of the AMMA in its entirety and you can be prosecuted as if you had no card at all. That is particularly concerning for the cardholder with cultivation rights who harvests a successful crop yielding more usable product than he is allowed to possess even though it was harvested from the otherwise permitted number of (12) plants. The federal government still believes you are violating their law even though the state of Arizona has authorized your medical use of marijuana. If a cardholder owns or is in possession of a gun or firearm, he can be federally prosecuted because federal law defines a "prohibited possessor as "an unlawful user of a controlled substance."

The Arizona legal cannabis industry was in a frenzy last month as the Department of Health Services (DHS) accepted applications for the remaining 31 medical marijuana (MMJ) dispensary licenses. In Arizona, an MMJ dispensary license is “vertically integrated”, meaning it allows for cultivation of cannabis, extraction of resins, production of infused products and consumer sales. Under the DHS rules, the process was driven by potential dispensary locations. All acceptable locations were in the Phoenix and Tucson areas. Combined with the recent relocations of rural dispensaries to the Valley, there will be large swaths of the state that will be more than 25 miles from a dispensary and again allow home cannabis cultivation. Rural readers should confirm whether they have cultivation rights before they renew their MMJ patient registration cards. Proposition 205 (Prop 205) has made the ballot and survived various court challenges from our prohibitionist “friends”. If it passes, Prop 205 will legalize cannabis sales to anyone over 21 and allow home cultivation of 6 plants per person or 12 per household. The Secretary of State still managed to omit that schools will benefit from cannabis taxes generated by Prop 205. Probably an “honest mistake”, but the Campaign to Regulate Marijuana Like Alcohol will need to educate the public. If you are reading this, you should get out and vote. Looking ahead: DHS should award the dispensary licenses next month. That may go smoothly. Also, California is preparing to regulate the largest and oldest medical marijuana market in the world. Their newly renamed regulations will kick in next year. Considering the importance of the California market to the US and Arizona, the regulation of that market will be very influential to the cannabis industry.

Ryan Wells and Mark and Ben Myer were at a place where they didn’t love the jobs they had, they saw the up-and-coming marijuana industry in AZ and the opportunity to open a dispensary. They all came from different backgrounds and experience - finance, marketing and construction, and once Mark and Ben’s father, Bill Myer, saw the healing effects of this plant he got on board and brought real estate experience to the table as well. During that time, the team set out to learn everything they could. Ben went to Colorado to learn about the industry and what was already working up there. Mark dove into learning everything about the legal issues. The team named their business Arizona Organix. In the November 2010 election, Prop 203 passed by about 4,000 votes and the use of medical marijuana became legal in Arizona. It was a narrow win for what was considered by many as a “shady business.” Bill went to work looking for a landlord who was willing to rent space to them, in an industry that isn’t legal at a federal level, and with a law that had dispensaries on-hold. During this time, the team also got their caregiver and personal cards, and started growing. Next, all of the rules, regulations and policies had to be established so there was a framework to build this new program. There were a lot of implications and Governor Jan Brewer took issue with all of them. She went to court to get the law reversed, keeping everything at a standstill while they appealed it. Over the next year, potential dispensary owners who had leases, zoning approvals and medical directors had to bide their time. A lot of investors backed out and businesses were giving up. The Arizona Organix team was able to hold out a little longer and when it came time for the lottery, they got lucky and were approved as

one of the 120 possible AZ dispensaries. And throughout this time the state was taking money for patients to buy medical marijuana cards, but there was no place for them to use them. Finally, with all the licenses, inspections, a secure lease, a medical doctor to write prescriptions and a small staff, the store opened in December 2012. Arizona Organix would be the only dispensary open in the state for another six months. They were breaking new ground in a new industry, and loving their new jobs. These days, Arizona Organix is still expanding - in space, in products and in staff. They currently employ 55 people and expect to hire another 30. They’re creating newer, safer and better products with medicinal values, in other forms than smoking it. They expanded their growing facility to a 30,000 square foot building, which was a lot easier to rent than five years ago. Now, landlords come to them to rent their spaces. Arizona Organix and the team are poised for the future and believe in this wonderful plant that they see helping people in so many ways.

A Deeper Look into Residual Solvents

While organic solvents are commonly known to be poisonous it really depends on the intake as not all solvents are equally toxic and many of them are even produced by natural processes. Solvents are used in the extraction of spices, essential oils, pharmaceutical production, and cannabis. So what happens to the solvent during processing? In the same way that further processing can concentrate the cannabinoids for potency, these solvents can also be concentrated during that processing. The Food and Drug Administration (FDA) requires residual solvent testing on any food or drug that has been exposed to solvents. The FDA divides the solvents into Class 1, 2, and 3. Class 1 solvents are to be avoided. Class 2 solvents have potential toxicity. Class 3 solvents – including acetone, ethanol, isopropanol, pentane, and heptane – are low risk when present at less than 0.5% of the sample (5000 ppm). With that being said, the use of lower-quality solvents such as “lighter-fluid” butane can contain hazardous levels of dangerous compounds. Currently, residual solvent regulations used by the pharmaceutical industry has yet to be recognized, this leaves states in charge of developing their own regulations and limits on residual solvents presence. Limits can vary widely from state to state, with Arizona currently having no set regulation. Complicating the issue further, is the fact that ethanol, methanol, acetone, and isopropanol are commonly formed in nature. Some are a product of terpene degradation, while others are released during the trimming process. The critical thing to understand is that most of these components are rarely present at concerning levels, and can be destroyed. Testing for these contaminants is a valid quality measure, as these compounds can be potentially dangerous when ingested. Until federal guidelines are created for Cannabis products, know where your meds are coming from, ask for test results, and “meducate” yourself.

Within four years I had three back surgeries, a craniotomy for an aneurysm, worsening fibromyalgia, and most debilitating of all, I suffered from chronic intractable migraines that the myriad of prophylactics and rescue meds I received from a few different neurologists could resolve, and which caused more side-effects than positive results. Because of the aneurysm (which the neurologist could only wrap due to its location), taking certain migraine meds can be very dangerous for me, so I would often try to wait the migraine out without meds, leading to severe migraines that led to dehydration and several emergency room visits. One of my cousins, a fellow chronic migraine sufferer, suggested cannabis to me several times over the years when I was on pain meds, muscle relaxers, and useless migraine meds; but like many people, I was reluctant due to the stigma associated with cannabis. By the end of 2015, I’d had enough with the ineffective meds that were only doing more harm than good (constant drowsiness, insomnia, horrible fatigue, & rebound headaches), and decided to give cannabis a try. It took several months (and experimenting with many different strains) before my loved ones and I noticed a real difference. Cannabis significantly shortened the duration of my migraines. They went from anywhere between a horrifically painful 12–72+ hours to a dulled-down 2-6 hours—huge difference, as anyone with severe migraines can attest. Cannabis also helps with my back pain and cramping in my legs, as well, if not better than the combination of opioids and muscle relaxers I was once on, but without all of the negative side-effects. There is, however, a downside to cannabis and that is the cost. Medical insurance doesn’t cover cannabis, and many doctors still frown upon its use. Cannabis has allowed me to literally come out of the dark (migraines were so severe I had to spend the worst moments in a dark, silent room) and be more “present” for my children and husband. I’m even trying my hand at writing a novel, something I never could have fathomed while on pharmaceuticals. My health problems haven’t gone away, but cannabis has helped me to obtain a better quality of life. My only regret was that I didn’t start using it sooner.

So when facts come to light about a topic, citizens have the responsibility to learn as much as they can so they make decisions based on truth. It’s too easy to be a sheep and follow the crowd…it’s too easy to let others tell us what to think. Isn’t it time for us all to learn the truth about marijuana so we can take back the power? I recently attended a Scottsdale Area Chamber of Commerce debate regarding Proposition 205. I was welcomed to a breakfast buffet in a banquet hall at the Double Tree by Hilton, surrounded by a few hundred well dressed and eager members of the Chamber of Commerce. The topic of legalizing recreational marijuana is a hot one so the atmosphere in the room was a little tense. The pro team consisted of JP Holyoak, owner of Arizona Natural Selections dispensary and Laura Bianchi, partner at Rose Law Group. The con team consisted of Bill Montgomery, the current Maricopa County Attorney and Seth Leibsohn, representing Arizonanas for Responsible Drug Policy. Like any debate, both sides stated the “facts” as they knew them. Were questions responded to truthfully based on knowledge by both sides? No, especially when statements were made by Bill Montgomery who claimed that children who use marijuana grow up to be useless adults who can’t attend college or hold jobs. Were allegations made that would undoubtedly grab the attention of any sheep in the crowd? Yes, especially when fear of employees being negligent at their jobs due to marijuana use is introduced. Luckily truth was also at this debate and explained how employers have the right to hire and fire based on THEIR drug policy, which is stated in the bill. Truth also discussed the societal impacts of marijuana prohibition as well as the lies that create the stigma around its use. Knowledge IS power. I welcome forums where true facts about marijuana can be shared…the legalization movement is gaining power because we are taking the time to share knowledge.

Two nights of ghosts, s’mores and good food…. oh yeah, and medicated camping! We had a chance to talk to Errl Camp founder James Morreson about the Errl Camp and what was on the menu for the event. This is James’ third “Errl” event, the first two being errl cups where all of the cannabis and cannabis extracts from the local dispensaries were gathered, sampled, tested, judged and winners were picked. The Errl Camp will be two days of fun filled activities planned for the attendees by James and his team. “Patient appreciation is what we are doing now, it is time to give back”, said James Morreson. The VFW and American Legion here in the Valley have been supportive of the Errl Events in the past, hosting both prior events. Veterans have been suffering from mental and physical medical conditions that are treatable with cannabis, so the VFW and the American Legion wanted to get involved. The year James need needed a spooky venue so he reserved the Casa Grande Haunted Domes, October 29th and 30th Halloween weekend. The Errl Camp is free to enter but, if you want to bring your own tent you can purchase a pass for $5 to camp, $25 for RV parking, or you can $195 to splurge on the VIP camping area for you and a friend. Daytime activities are from 11am – 6pm and will include a ton of games with a chance to with some cash. If you are not spending the night the gates close at 11pm, so we suggest purchasing a camping pass. Night activities include the Monster Mash party with live bands and DJ’s from 9pm – 2am with a medicated s’mores session sponsored by Rosin Press. We have all become comfortable with the term “the times are changing”. Though the struggle is still very real for cannabis supporters, we see a unilateral movement become bilateral. The argument has become so strong for medical benefits that one has to eventually ask the question “what’s wrong with preventative measures (AKA getting stoned)? The times are changing and we have an emerging economy of new professionals and older, more matured professionals becoming experts. The best compliment I ever gave my mentor was to follow his advice. I love writing reviews for books that inspire! Once again, I have the pleasure of evaluating Ed “Guru of Ganja” Rosenthal’s latest publication Big Book of Buds- Greatest Hits. I have been a longtime admirer of Ed’s, for his courage in being a known source of cannabis wisdom. He was known for this long before most felt gutsy enough to post Instagram or Facebook pics of them cheefing. Accordingly, I dedicate this review to the solemn and wise Mr. Rosenthal. My attention was first captured just beyond the cover page. The book is dedicated to Nikolai Vavilov, a Russian scientist from the early 1900’s who was executed for his cannabis research. This is deep and important to me because I started the book with a deep appreciation for the very real struggle that people have had with their support of the cannabis and hemp plants. Ed might as well start a new magazine titled Playbuds! I’m mesmerized by the clarity of the trichomes and brilliant, mature buds in a way that brings me a level of pleasure. They are...satisfying. The Big Book of Buds - Greatest Hits is the perfect guide to what cultivators have been busy breeding. This easy to follow copious work of cannabis data is the contemporary coffee table book, education and or visual stimuli.

It reminds me of my Alton Brown cookbook, it’s just filled will all sorts of scientific goodies! This page-turner provides decades of research all in one place. The charts allow you to have quick access to understanding which strains fall under Indica and which fall under Sativa, which is important so you can have the experience you are looking for. I also found a great five-page explanation in how cannabis gets a person high and how it interacts with them. Hand this thing to your mom and read it with her; it’s not intimidating at all. We all need to look for the gems provided to us. Gems can be a few words of wisdom or they can be in the form of a well laid out, made simple, book that eases that seemingly futile conversation about what cannabis is, where it comes from and how and why it is beneficial to the human body. Arizona Cannabis Conference & Expo Saturday and Sunday, October 15 and 16 Phoenix Convention Center “In Arizona and many states across the nation, voters have an opportunity to end prohibition and begin proper and just regulation of cannabis in their communities.
