FORECLOSURE SALE Notice is given under section 3212 of the Revised Judicature Act of 1961, 1961 PA 236, MCL 600.3212 that default has been made under the terms and conditions of that certain Mortgage made by Kelly Darby and Valaree Darby as mortgagor (jointly the “Mortgagor”), to Byline Bank, an Illinois banking corporation, as mortgagee (“Lender”), dated March 15, 2018 and recorded March 27, 2018 as instrument 2018-0010123, Ottawa County Records, Michigan (the “Mortgage”) and that the Mortgage referenced below will be foreclosed by a sale of the Mortgaged Property (as defined below) at a public auction sale to the highest bidder for cash or cashier’s check at the time and place set forth below.
The amount due on the Mortgage may be greater on the day of the sale. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the Mortgaged Property. A potential purchaser is encouraged to contact the county register of deeds office or a title insurance company, either of which may charge a fee for this information.
The amount due on the Mortgage as of the date of this Notice is $976,597.18 inclusive of certain costs and expenses paid by Lender to collect the debt and to protect its interest in the property, all of which is due under the terms of the Mortgage.
The Mortgage contains a power of sale and no suit or proceeding at law or in equity has been instituted to recover the debt secured by the Mortgage, or any part of the Mortgage.
