When we launched the first edition of the Zangersheide Quality Jumpers Powered by MBA (Melchior - Baackmann - Ahlmann) last year, our aim was to showcase horses of exceptional quality on a stage that truly reflects their potential. Watching that vision come to life and witnessing the first edition confirm everything we set out to achieve, fills us with immense pride and excitement. What makes us especially proud is not only the enthusiasm of our clients, but also the achievements of the horses themselves. Several references from last year’s edition are already making headlines.
The 8-year-old stallion AY CARAMBA Z, who was secured by one of the most trusted partners of Jens Baackmann, had a fantastic season and was placed at the 8-yo Final in Aachen. The also 8-year-old ECLAIRE Z, won recently the Longines Ranking Class at CSI4* Sentower Park with Olympic Champion Michael Jung, and the 7-year-old DOLOMITE Z, who impressed with a win at the British Young Horse Championship, are shining examples. These successes are a true testament to the MBA team’s vision: connecting exceptionally talented horses with riders who bring out their full potential. We are proud to once again open the doors to a collection that reflects our shared values: uncompromising quality in health, training and sport aptitude. Each horse has
been selected with the same care and passion that we devote to our own stables, and we are truly delighted to present them to you in this collection. This year, we have again reserved some of the absolute best horses from our own breeding program, especially for the MBA Auction.
Highlights include BIARRITZ Z, a Grand Prix prospect by Brunetti Z out of Christian’s legendary World Cup mare Comtessa 38; the scopey and talented TALAMANCA Z, a championship prospect from the proven line of Panama du Seigneur; and the outstanding COOL COKE Z, a sporty, competitive mare out of the family of Tabou Z and Corico Z. FLACCO Z marks a milestone as our very first hunter. He combines outstanding movement and natural ba
with elegance and style - a true hunter ring presence. We are also delighted to present the modern and athletic mare SIA M. This charming mare is light-footed, careful, and a true clear-round machine. Horses of this caliber are truly unique — either born and raised in our own stables, known to us since birth, or carefully produced by us. VEILING - VOORWAARDEN KOPER 2025
1. De veiling wordt georganiseerd door Stoeterij Zangersheide NV met maatschappelijke zetel te Domein Zangersheide, B-3620 Lanaken, die de in de catalogus beschreven paarden verkoopt namens en voor rekening van de verkopers.
2. Het deelnemen aan deze veiling impliceert de uitdrukkelijke en voorbehoudsloze kennisname en aanvaarding van deze veilingvoorwaarden.
3. De veiling staat onder toezicht van een gerechtsdeurwaarder, geassisteerd door F. de Backer, de veilingmeester.
4. De paarden worden geveild in de staat waarin zij verkeren ten tijde van de veiling. Kopers worden voor de veiling in de gelegenheid gesteld om exterieur en beweging van de paarden te inspecteren.
5. De paarden worden bij hamerslag toegewezen aan de hoogste bieder. Een bod is geacht te worden gedaan op persoonlijke titel van de bieder; door een bod uit te brengen, verbindt een bieder zich tot betaling van het totaal bedrag, tenzij daarna een hoger bod wordt geaccepteerd. De gerechtsdeurwaarder behoudt zich het recht voor om een bod te weigeren.
6. De biedingen en de betalingen geschieden in EURO.
7. Bovenop de toewijzingsprijs betaalt de koper aan Stoeterij Zangersheide NV een percentage van 10% (exclusief BTW) op de toewijzingsprijs als commissie en voor de tussenkomst in de veilingkosten. Stoeterij Zangersheide NV reikt aan de koper een factuur uit voor deze diensten dewelke contant betaalbaar is en voorafgaandelijk aan de levering van het paard aan de koper vereffend dient te worden op de rekening van Stoeterij Zangersheide NV.
8. De afrekening wordt ten aanzien van de Koper als volgt berekend: de toewijzingsprijs + 10% op deze toewijzingsprijs als koperscommissie = nettoprijs, te vermeerderen met de eventueel van toepassing zijnde BTW, is het afrekeningsbedrag. Met het uitbrengen van een bod verbindt de bieder zich tot betaling van het afrekeningsbedrag, tenzij daarna een hoger bod wordt geplaatst.
9. Het afrekeningsbedrag is onmiddellijk verschuldigd bij toewijzing. De koper ontvangt een uitnodiging tot betaling van het afrekeningsbedrag. Indien de koper binnen de 5 werkdagen na daartoe te zijn uitgenodigd door de veilingorganisatie de algehele betaling niet voldaan heeft, heeft de verkoper de mogelijkheid om zonder voorafgaande ingebrekestelling de koop van rechtswege als ontbonden te beschouwen lastens de koper, met de mogelijkheid voor de veilingorganisatie om desgevallend een forfaitaire schadevergoeding van 20% op het afrekeningsbedrag bij de koper in rekening te brengen.
10. Iedere aansprakelijkheid ten aanzien van de geveilde paarden gaat onmiddellijk na toewijzing over op de koper. Na de veiling én betaling treffen koper en verkoper in onderling overleg de schikkingen voor de levering. Het rechtsverband ligt rechtstreeks tussen koper en verkoper, met dien verstande dat er ten aanzien van de koper, de verkoper en niet de veilingorganisatie aansprakelijk is voor iedere tekortkoming die de paarden na de veiling mochten vertonen. Aflevering zal pas plaats vinden zodra het afrekeningsbedrag zoals gedefinieerd in artikel 8 is bijgeschreven op het rekeningnummer van Zangersheide.
11. Noch de verkoper, noch de koper kunnen enig recht ontlenen aan het feit dat de veilingorganisatie de paarden heeft geselecteerd en desgevallend op haar verzoek aan een veterinair onderzoek onderworpen werden.
12. De informatie in onze veilingcatalogus betreffende de paarden is enkel gericht een indruk te geven over de kwaliteiten van de paarden, zonder de pretentie volledig te zijn en zonder daarmee garanties te geven. Stoeterij Zangersheide NV is niet aansprakelijk voor gebeurlijke drukfouten en/of materiële vergissingen in de veilingcatalogus.
13. De gerechtsdeurwaarder beslecht in laatste instantie alle betwistingen die tijdens de veilingverrichtingen nopens de verkoping zouden kunnen ontstaan.
14. In geval van export zal de koper binnen 3 maanden na levering op Stoeterij Zangersheide een geldig exportdocument voorleggen op straffe van het alsnog in rekening brengen van de verschuldigde BTW.
15. Het veilingcomité zal zich – in geval zich een geschil voordoet tussen de Verkoper en de Koper welke verband houdt met de veiling - inspannen om dit geschil tussen hen middels bemiddeling op te lossen. Mocht 1 van de partijen van mening zijn dat er geen oplossing is bereikt, dan is bij uitsluiting de rechtbank van Tongeren bevoegd. Het Belgisch recht is van toepassing op de relatie tussen verkoper en koper.
16. Elk geschil voortvloeiende uit deze veiling en haar gevolgen wordt uitsluitend beheerst door de Belgische wet met uitsluiting van de bepalingen van het Weens Koopverdrag inzake internationale koop-verkoop. De rechtbank van Koophandel van Antwerpen afdeling Tongeren en de rechtbank van eerste aanleg van Limburg, afdeling Tongeren zijn exclusief bevoegd om kennis te nemen van gebeurlijke geschillen.
17. Bij betwisting geldt uitsluitend de Nederlandse tekst. De vertaling van deze veilingvoorwaarden in een andere taal dan het Nederlands is louter informatief.
AUCTION - CONDITIONS FOR BUYER 2025
1. The auction is organised by Stoeterij Zangersheide NV, Domein Zangersheide, B-3620 Lanaken, Belgium, which will sell the horses described on the catalogue on behalf and for the account of the sellers.
2. Participation in this auction implies the explicit and reservation-free knowledge and acceptance of these auction conditions.
3. The auction will be supervised by the bailiff, assisted by F. de Backer, auctioneer.
4. The horses will be auctioned in the condition they have at the time of the auction. Buyers are given the opportunity to inspect the exterior and movement of the horses before the auction.
5. The horses will be auctioned by knock-down to the highest bidder. A bid is considered to be made on personal title of the bidder; by making a bid, a bidder undertakes to pay the total amount payable, unless a higher bid is accepted thereafter. The bailiff reserves the right to refuse a bid.
6. The bids and payments are made in EURO.
7. In addition to the allotment price, the buyer will pay Stoeterij Zangersheide NV a percentage of 10% (excluding VAT) of the allotment price by way of commission and for the mediation in the auction costs. Stoeterij Zangersheide NV will give the buyer an invoice for these services, the amount of which is to be promptly transferred into the account of Stoeterij Zangersheide NV, previous to the delivery of the horse to the buyer.
8. The settlement of the sales price by buyer is calculated as follows: the allotment price + 10% of such allotment price as buyer’s commission = net price, to be increased with any VAT possibly due, which constitutes the total settlement amount. By making a bid, the bidder undertakes to pay the settlement amount, unless a higher bid is made thereafter.
9. The total amount payable shall fall due immediately upon allotment. The buyer receives an invitation to pay the settlement amount. If the buyer has not paid the total amount within 5 working days after being invited to do so by the auction organisation, the seller has the option to consider the sale legally dissolved at the expense of the buyer without prior notice of default, with the auction organisation having the possibility to charge the buyer a fixed compensation of 20% of the settlement amount.
10. All liability in respect of the auctioned horses shall pass to the buyer immediately after the auction has taken place. After the auction and payment, the buyer and seller shall make arrangements for delivery in mutual consultation. The legal relationship is directly between the buyer and the seller, on the understanding that, with regard to the buyer, the seller and not the auction organisation shall be liable for any defect that the horses may exhibit after the auction. Delivery will only take place once the settlement amount as defined in article 8 has been credited to the account of Zangersheide.
11. Neither the seller nor the buyer can derive any right from the fact that the auction organisation selected the horse and on its request had it submitted to veterinary examination.
12. The information regarding the horses stated in our auction catalogue intends to give an impression of the qualities of the horses, without pretending to be complete and without any guarantee. Stoeterij Zangersheide NV is not liable for any printing errors and / or material errors in the auction catalogue.
13. The bailiff will settle in last instance all and any disputes that may arise during the auction activity in regard with the sale.
14. In case of export of a horse, the buyer will submit valid transport documents within 3 months after delivery at Stoeterij Zangersheide, on forfeiture of a penal sum consisting of the VAT as yet to be charged.
15. In the event of a dispute, related to the auction, should occur between the seller and the buyer, the auction committee will make an effort to settle this dispute by mediation. If any of the parties believes that no solution has been reached, the Court of Tongeren will be exclusively competent. To the relationship between the Seller and the Buyer Belgian law applies.
16. Any dispute arising from this auction and its consequences will be exclusively ruled by Belgian law with exclusion of the provisions of the Vienna Sales Treaty regarding international purchases/ sales. The Court of Commerce of Antwerp, Tongeren department and the Court in first instance of Limburg, Tongeren department, are exclusively competent to take cognizance of any disputes.
