Five Divorce Myths In answering questions for many clients considering divorce, I found there are a number of myths that need to be dispelled. This article is an attempt to address some key divorce myths I regularly encounter: 1. It matters if they cheated. In California, infidelity has no relevance to pursuing a divorce action. In 1971, California law was modified to allow either party to seek a divorce based upon irreconcilable differences, which can mean anything to anybody, including just drifting apart. Unless the parent’s behavior is out of control, it is highly unlikely that the court would consider any claim that a parent’s time with the children should be restricted. 2. You just need to fill out a few forms and submit them to the court and the court does the rest. While it is true that California prides itself on simplifying the Judicial Council forms that are submitted for processing divorce actions, properly completing those forms is not just an “add water and stir” event. An accurate understanding of the law and how it applies to those forms is crucial to properly proceeding on your family law matter. 3. Everything must be split equally. Division of property doesn’t have to be exactly penny for penny. The parties can even agree to an unequal division for many reasons. Sometimes an unequal division is adopted by the parties and approved of by the court for the purposes of making compromises on support amounts, satisfaction of community debt and for other equitable justifications.

4. It’s best to start hiding things. Any attempt to hide assets from the other spouse will only turn into bad news for the bad actor. If the court determines that there’s been a concealment of an asset, the person committing this offense could lose their share of the property to the other spouse as well as pay attorney’s fees and sanctions for their misconduct. 5.The kids always go to the mother. Family law courts have caught up with the concept of joint parenting and blended families. The result of this more modernized appreciation of both parents playing a significant daily role in a child’s life produces many different custody arrangements where both parents can maintain an active role in the child’s life. Western Railway Museum’s

Pumpkin Patch Festival

Weekends: October 12 - 27

Each Saturday and Sunday from October 12 - 27, the Western Railway Museum presents its annual Pumpkin Patch Festival. This classic harvest festival is a highlight of autumn, and for many, a family tradition. The Museum opens at 9:30am. The first express train leaves the Museum at 10am, with departures every half-hour until 4pm. Visitors can ride on a historic life-sized electrical-powered train going back in time 100 years on a scenic five-mile trip to Gum Grove Station, a wooded glen far from the trappings of modern life. At Gum Grove, guests can experience the huge hay bale fort, food, tractor rides, music, games and of course, pumpkins for sale, just in time for Halloween. It’s a real community effort, with three individual Rotary Clubs (Fairfield-Suisun, Cordelia, and Dixon), and 100 Museum volunteers all rallying together to make the event a success. All proceeds from ticket sales benefit the Western Railway Museum (a nonprofit educational institution) and the local Rotary Clubs who re-grant thousands of dollars to our community and youth activities each year. REVE BISTRO While a trip to Paris may not be in the cards for me anytime soon, an excursion to Lafayette’s Reve Bistro settled my craving for French cuisine. It’s starting to feel like comfort food season, so my date and I started with crocks of house-made French onion soup topped with Gruyere and croutons. The rich broth coupled with sweet onions was just what I needed to combat the end-of-summer blues. While we generally end up with a favorite entrée, it was a toss-up between boeuf bourguignon and poulet basquaise. SABIO ON MAIN Drawing inspiration from the bounty of farm and produce provisions available in the Bay Area, Chef Francis and owner Jim McDonnell have created a chic dining experience at Pleasanton’s Sabio on Main. Having been to Italy on a cooking tour, I was excited to sample the tempura squash blossoms made with local chèvre and oyster mushrooms. Although a little different from the ones I’m used to, I would definitely recommend trying these. If you’ve got Oktoberfest on your mind, order the Jagerwurst sausage. It has a smoky flavor and comes with sides of sauerkraut, grits and for a hint of sweetness, baked apple. Mother Nature may have waited until the end of summer to crank up the thermostat this year, but despite the unseasonably toasty days, the calendar says fall. This can mean only one thing: it’s time to plan your Halloween outings. If you love fall festivals, a trip to Dell’Osso Family Farm should be on your agenda. This is not the pumpkin patch of your youth where you wandered around a field of orange before finding a hard-to-lift pumpkin, took obligatory photos, slurped down some apple cider and then headed home. Dell’Osso Family Farm, which began as a working asparagus farm in the 1920s by three Italian brothers, is a fall family adventure destination. Your admission fee provides access to a wide variety of fun, including the pumpkin patch, corn maze, a haunted

castle, an express train, hayride, mystery tour, carnival-style rides in kiddie land, an animal zoo, a Walkthe-Plank activity and more. With all the exciting activities to choose from, it’s hard to know where to begin. Dell’Osso Family Farm suggests you start by getting lost in their pumpkin maze. The massive corn maze labyrinths are part of a Dell’Osso tradition that has been going strong for 23 years. Initially, the Dell’Osso family designed the mazes by hand and plowed them using farm equipment. Today’s mazes are created using computers and GPS, bringing this traditional attraction into the digital age. Pick an entrance and see how long you take to find your way out. Also, be sure to check out Dell’Osso’s website to see aerial views of the mind-blowing mazes they’ve devised. Anyone with a sweet tooth will

want to visit the Country Store/ Bakery. Here you’ll find a variety of locally made goodies and apple spiced donuts. Before you head out the door, there are a couple of things to keep in mind. Although it may be sandal weather, thrill-seekers who want to walk the 30-foot high plank before dropping to the ground (in a harness) need to wear close-toed shoes. For safety reasons, all Walk-the-Plank participants must fit into the safety harness and weigh between 60 and 250 pounds. It should also be noted that the mystery tour and haunted castle are not recommended for small children. After all, pumpkin patches are intended to be fun, not nightmare-inducing. Pig races take place twice a day during the week, and at regular intervals during the weekend. Check
