Judge deals blow to Reopen Beach Road A judge has determined the plaintiff in a lawsuit against Sarasota County does not have standing to make a key challenge to the county’s decision to vacate Beach Road.

On April 12, Circuit Judge Frederick Mercurio issued a ruling stating that Michael Consentino, the leader of the Reopen Beach Road campaign, cannot appeal

the county’s 2016 decision on the grounds it violates the county’s comprehensive plan.

The judge stated that the street vacation, which relinquished control of about 200 feet of Beach Road, does not qualify as a development order, which would be required for the court to determine it violated the comprehensive plan.

The decision throws out the primary argument in the lawsuit challenging the street vacation. There are two remaining counts Consentino brought in the lawsuit. They pertain to procedural issues leading up to the approval and Consentino’s affected status as an individual property owner near the vacated segment of road.

A company from Durham, N.C., has acquired the 13-story Sarasota City Center office tower downtown for $36.5 million, marking the third major office sale in the city’s core in the past year.

The Dilweg Cos. plans to spend $4 million to enhance the 245,293-square-foot building’s fitness center, hallways, lobby, restrooms and courtyard, officials say.

Dilweg also intends to create a conference facility and a tenant social space inside the 1819 Main St. building.

City Center and a 23-story office tower in Charlotte, N.C., sold together for $115.5 million, according to commercial brokerage firm Holliday Fenoglio Fowler LP. The 28-year-old property is occupied by financial firms Merrill Lynch, UBS and Wells Fargo, food maker Boar’s Head Provisions Co. and others.

Last month, Githler Real Estate and a New York partner acquired the 11-story Northern Trust Building for $17 million, and in July 2016, the 11-story BMO Harris Bank Building sold for $23 million.

The City Center is 88% occupied.

The new owners plan to make improvements to the building.

THE RINGLING EFFECT Ringling College is expanding even faster than school officials hoped. Residents and business around the campus have mixed feelings about the growth spurt.

looking Whitaker Bayou. Thompson said this project was sort of a shock to him — even if officials planned for this moment, the growth came with some side effects they couldn’t account for ahead of time.

“I’m thinking, I may get a respite here for a moment from construction,” Thompson said.

“And then all of a sudden, a housing and a financial person came to me and said, ‘We don’t know where we’re going to house all these students.’”

Thompson has similar concerns about securing adequate classroom and studio space, which the college is working to address now.

Thompson points out the college has grown its portfolio of property adjacent to the campus, which has the school well-situated to accommodate growth within its 48-acre footprint.

decade ago, Larry Thompson was ready for Ringling College to grow to where is today.

Thompson, the school’s president since 1999, worked alongside other college officials to develop a strategic plan in 2006.

The school had a little less than 1,000 students, and wanted to grow to around 1,500. The plan was to grow incrementally: Start offering new majors such as film, then slowly admit more students as more qualified applicants expressed interest in the budding programs.

Despite the 2008 recession, the plan was on track. About 1,250 students were enrolled in 2010. Then, for reasons Thompson still can’t explain, enrollment declined. And then it did for a second year. Just like that, the carefully developed plan seemed like it was out the window.

“We had invested all the capital in these new majors,” Thompson said. “And then to see, all of a sudden, you don’t get the results from it? This is not a good thing.”

And so, five years ago, Thompson had no idea Ringling College would grow to its present size.

Enrollment numbers quickly recovered after the two-year setback. The unexpectedly small freshman classes are now graduating, with larger classes replacing them. Right now, there are nearly 1,400 students at the school, Thompson said. By next

year, it could be nearly 1,500.

An influx of capital projects has accompanied the new students on campus. There’s the Alfred R. Goldstein Library, built after donors met a $16 million fundraising goal a year early. There’s the Richard & Barbara Basch Visual Arts Center, the plans for which the school is revamping to incorporate more studio classrooms. There’s the city-blocksized soundstage and post-production complex.

Most recently, the school filed plans to build a $22 million, 185-student residence hall over-

Within the communities that border Ringling, there are mixed reactions to the school’s prosperity. Residents in Newtown have expressed skepticism about the campus creeping eastward, fearing gentrification in a historically black community.

This fear arose during the approval process for the soundstage, which is being built along Dr. Martin Luther King Way between Cocoanut and Central avenues. Residents said the project encroached into their neighborhood, using city land that previously served as overflow parking for Dr. Martin Luther King Jr. Park.

At the time, Thompson said the project was intentionally placed near Newtown as an economic stimulus. Today, residents remain dubious of the school’s intentions.

“We knew that was going to be our nemesis,” said Barbara Langston, president of the Amarylis Park Neighborhood Association.

“It is coming in and, in essence, trying to take over Newtown.”

Langston said communication with the college has been spotty.

She said her neighbors fear the college’s next move will be buying the park itself. She doesn’t think that’s the case, but she shares their sinking feeling that the campus will continue to radi-

ate outward.

“We know they damn near own everything,” Langston said.

She doubts projects such as the soundstage will create job opportunities for Newtown residents.

And without the city taking more meaningful steps to stimulate the Newtown economy, she doubts people at the soundstage will venture into the neighboring area to do business.

Thompson staunchly rejected the idea that Ringling was interested in gentrifying Newtown, and reiterated his interest in supporting the neighborhood as a collaborative partner.

“College campuses tend to be very insular,” Thompson said.

“We, on the other hand, are very, very committed to being engaged in the entire community.”

Along North Tamiami Trail, stakeholders agree that Ringling has been an engaged partner.

Business and property owners interested in seeing improvements on the North Trail are supportive of Ringling’s growth, embracing anything that can spark revitalization in the area.

“When people see development, they see good things happening on the trail after a long time,” said Jay Patel, chairman of the North Trail Redevelopment Partnership. “Every bit helps.”

Patel said Ringling was an early supporter of the NTRP when it formed in 2009. He’s hopeful the group can work with the college to enhance promotion of the North Trail. Thompson said he’d like to see even more activity along the North Trail, and said other colleges in the area are working to make the communities around their campuses more studentfriendly.

Eventually, Thompson thinks Ringling’s period of growth will come to an end — he guesses the student body will level out at around 2,000. In the meantime, though, he isn’t ruling out the college doing more to expand the boundaries of its campus.

In the process, he pledges the college will act as an engaged part of the broader Sarasota community. He thinks Ringling has an obligation to enhance the community around it, and he thinks the institution is better off with a two-way relationship, too.

“It benefits, I think, students to see that,” Thompson said. “It benefits the faculty and staff, encouraging them to be engaged — not just in your own little island.”

“I can’t imagine the highest and best use of the property — essentially across the street from the beach — being a parking lot,” Smith said.

But on March 30, an applicant filed documents with the county seeking approval for a 35-space parking lot at 459 Beach Road.

Real estate company Casto is listed as the property owner, and architect John Cavoli of Cavoli Engineering is listed as the representative for the project.

There’s not a lot of other public information available regarding the project. Casto and Cavoli did not respond to multiple requests for comment.

With not much to go on — and still skeptical about the idea — Smith began to walk through the math behind the concept. If the owner charged $5 per hour, and filled the lot 12 hours per day, that’d work out to … $766,500 per year.

“That’s interesting,” he said.

“That’s not bad. That’s actually pretty good. Maybe it makes some sense.”

These are back-of-the-napkin calculations based on the lot filled to capacity 365 days per

year, but it’s enough for Smith to reverse his stance on the viability of the proposal. It illustrates the demand for more parking on Siesta Key — and a potential burgeoning private-parking industry in the area.

The same applicant is seeking county approval to build another parking lot on the island. The second project, located within the Village at 5160 Calle Minorga, would include 35 spaces on a 10,000-square-foot parcel. The land was previously the site of a proposed mini-golf course.

Nearby, a prominent property owner began contracting with a parking company to create his own paid-parking system. Davidson Plaza, located along Ocean Boulevard in the Village, charges visitors $4 an hour to use the lot if they’re not patronizing one of the tenants on the property.

FL Parking Co., based out of Madeira Beach, is managing the lot. So far, the company says the venture into Siesta Key private paid parking has been successful.

“It’s providing opportunity for folks to find a parking space, enjoy the Key, do the things they want,”

said Dan McNutt of FL Parking Co. “Previously, they may have had to circle around, park illegally on the street and face other numbers of challenges.”

McNutt said he helps manage more than 200 properties in eight states. After beginning charging at Davidson’s in February, the company’s already picked up another client in the Crescent Beach Grocery Store. He said there are several other properties that are planning to work with FL Parking Co., and he sees the situation as one in which all parties come out ahead.

“Historically, properties like that sit off-limit to the public,” McNutt said. “People, obviously, don’t feel comfortable using that space — they know they’re not allowed. We’re able to bring in an effective management solution.”

Charging for parking afterhours in existing parking lots is one thing. But is parking really such a valuable commodity that a property owner could forego development and just build a parking private lot instead?

McNutt thinks so.

“There’s just so much traffic,” he said. “Any parking you can create on Siesta Key — the demand is there, and it will certainly sell.”

Still, there’s no guarantee the property at 459 Beach Road will end up as a parking lot. The land is zoned for residential multifamily development. The applicant is scheduled to appear before the county Development Review Committee on Thursday, at which point county staff will explain the steps the developer needs to take before it could build the project.

on the site. The county received complaints about the meter, and issued a code-violation notice, because the commercial activity was not allowed on the residential property.

It’s unclear whether residential property owners in the area would object to the proposed commercial use. Catherine Luckner, a Siesta Key Association board member, speculated that neighboring landlords would be concerned. Bogdan Osipov, a real estate agent with Coldwell Banker Siesta Key, said he could not think of a similar proposal for a residential area.

Even if it’s unconventional for Siesta Key, Smith believes private investment in parking lots could be beneficial for the island. He suggested businesses could partner with private parking lots to satisfy county parking requirements without sacrificing space on-site.

In its simplest form, Smith said, the private parking agreements were an example of increasing supply to satisfy demand. He thinks everyone can come out ahead.

“The visitors have a place to park — they don’t mind spending 10, 15 dollars, knowing they have a space,” Smith said. “The property owner makes the money. Those companies make their money, which is the capitalist thing to do.

I think it’s a great idea.”

Sarasota prepares Pineapple Park plans DEPUTY MANAGING EDITOR

The April 29 Sarasota Farmers Market will offer more than fresh fruit and vegetables — it will also provide the first look at a pair of concepts for redesigning Pineapple Park.

The city is working with design consultant David Conner + Associates to develop a master plan for Pineapple Park and Lemon Avenue. The planning began after the city sold a parcel adjacent to the park for redevelopment, and officials have expressed interest in maximizing the utility of the 6,600-square-foot downtown park.

The timing of the project prompted some questions from the public. The city is separately undertaking a nearly $150,000 improvement project to repair the mermaid fountain within Pineapple Park. That project is scheduled for completion May 19.

But, during the master-planning process, the city is developing two options to present to the public: one that maintains the fountain as-is, and a second that would modify a portion of the fountain. At this month’s Coalition of City Neighborhood Associations meeting, residents bristled at the idea the city would consider overhauling the fountain it is in the process of improving.

Kucharski, the city’s public works general manager, said they’re operating on different timelines.

The fountain was a short-term effort, with funding already in place to restore the artwork. The master planning is designed to provide a long-term road map.

Even when staff presents the conceptual plans to the City Commission — anticipated to take place this summer — there is no funding for the actual improvements at this time.

Kucharski said the fountain is not ideally configured for the current footprint of the park, which has changed in the 24 years since the fountain was installed.

City approves DeMarcay construction changes Despite protests from neighboring residents, the city will not mandate a construction technique for an 18-story Palm Avenue condo project.

The developer of the DeMarcay on Palm, an 18-story, 39-unit condominium, is now free to use whatever construction method it prefers to build the project.

On Monday, the City Commission voted 4-1 to remove a requirement that would force the developer to use precast construction

for a portion of the building. In 2006, the city included the provision in an attempt to minimize the impacts of the construction.

Now, the developer convinced the commission that precast construction would actually be more time-consuming and dangerous than post-tension construction, the standard technique for building high-rises in Sarasota. At the time, a representative for the

developer said precast construction would achieve that goal.

“Any building like the DeMarcay should be built with posttension construction,” said Greg Kveton, whose company, XAC Developers, purchased the site in 2014. “It’s the fastest, most efficient way of constructing a highrise building.”

The project will be built at 33 S. Palm Ave., on the site of the historic DeMarcay Hotel and Roth Cigar Factory buildings. The developer expects to begin construction in spring 2018.

Residents in the neighboring condo at 1350 Main St. strongly objected to the new construction technique. They argued posttension would have a greater impact on the surrounding area, because precast construction involves fabricating some of the pieces of the building off-site before transporting them to the development site.

Residents said the project was controversial when it was initially proposed, and that the assurances about precast construction were an important factor city officials used in their decision-making.

“The only reason this was approved was because of this proffer,” said resident Jay Leonard.

They also questioned the history of the DeMarcay developer.

Tim Litchet, the city’s director of neighborhood and development services, said the developer offered differing takes on whether a contractor was willing to build the project using precast construction.

Attorney Robert Lincoln, representing the 1350 Main residents, suggested the developer was only interested in the new technique because it was cheaper and more

efficient for them.

“They played the city, and they played the city staff to get to a situation where they’re getting exactly what they want,” Lincoln said.

The commission leaned hard on testimony from building official Larry Murphy, who said he had not seen a precast structure built under similar conditions to the DeMarcay project. He said he had concerns about hoisting large pieces of prefabricated concrete in the 20-foot alley between the project site and 1350 Main.

He also disputed claims that the post-tension construction would create more concrete dust than the precast method.

“All construction inherently is dusty and dirty,” Murphy said. “I couldn’t testify if one was ever more clean than the other.”

Commissioner Susan Chapman was the only board member to vote against removing the requirement. She highlighted the building’s approval under the now-defunct Downtown Residential Overlay District, which gave the project a density of 200 units per acre, and said the construction change could not be considered in a vacuum.

“If they want to change the construction method, go back to the original density,” Chapman said. “I think a deal’s a deal. It’s kind of a betrayal of a promise to the public.”

Other commissioners said they understood residents’ concerns, but saw no evidence to convince them post-tension wasn’t the preferable form of construction.

“By denying this, we really don’t accomplish anything,” Commissioner Liz Alpert said.

“They’re going to build the building either way.”

Give this bill an ‘F’ Florida lawmakers can’t help themselves. They love to meddle (too much) in public education.

The latest idea — ‘Schools of Hope’ — doesn’t offer much hope. It’s bureaucracy at its worst.

I

t had to be one of her funnier comments of sarcasm, cynicism and honesty — as only former state Sen. Nancy Detert of Sarasota can deliver.

In an interview soon after she completed her final legislative session in early 2016, Detert reflected with us on her 16 years in the Florida House and Senate. She was lamenting the (declining) quality of freshmen lawmakers elected in recent years, noting — and this was the line — “how they all want to reform the state education system in their first year.”

That comment came to mind this week when we started examining one of the hot education topics in the Legislature this spring: “Schools of Hope.”

They do that in the Legislature and Congress. They make up what they think are catchy names, rather than refer to their bills by number. It sounds much more magnanimous and dramatic to argue on the House and Senate floors how your “Schools of Hope” bill is going to save public education than it is to argue how HB 5105 will save the education world.

Pardon our cynicism here, but it’s deserved, especially when you wade through HB 5105, dubbed the “Education Improvement” bill. The “Schools of Hope” are a substantial part of the bill.

When you read the staff analysis of that bill, it would take you only a few minutes to conclude this is the quintessential, colossal example of how legislators and the state centralized Department of Education bureaucracy always attempt to micromanage how schools are operated at the local level.

And we all know that micromanaging public schools from the state capital is one of the chief inhibitors to having a superior public education system.

Let’s see if we can crystallize what they’re attempting to do: The problem lawmakers are hoping to solve is how to turn Florida’s 103 D- and F-rated public schools (out of the state’s 4,200 public schools) into C or better schools; and how to give the students in those failing schools options to attend better schools.

The House budget, at this point, is allocating $200 million for what are being called “Schools of Hope” — a new type of state-approved charter schools.

Bear with us here. To make the point of this bill’s ridiculousness, read the following requirements the state would impose for a “hope operator,” to be granted permission to operate a School of Hope: First, a “hope operator” must be a nonprofit organization that operates three or more charter schools with a record of serving students from lowincome families. The past performance of this organization would then have to meet or exceed these addi-

The following is from a staff analysis of House Bill 5105: The State Board of Education must adopt a differentiated matrix of intervention and support strategies for assisting failing public schools — schools that are rated D or F. The intervention must address student performance and may include improvement planning, leadership quality improvement, educator quality improvement, professional development, curriculum alignment and continuous improvement and monitoring plans and processes.

In addition, the State Board of Education may prescribe reporting requirements to review and monitor the progress of the schools.

The State Board of Education must apply the most intense intervention and support strategies to schools earning an F. Within a year after receiving the first F, the school district must implement a matrix of intervention and support strategies, select a turnaround option and submit a plan for implementing the turnaround option to the Department of

tional criteria: n Student achievement results at all of its existing schools must exceed the state averages and district averages in which it is to operate. n College attendance rates at all schools currently operated by the entity must exceed 80%. n More than 70% of the students at all of the hope operators’ schools must be eligible for free or reduced-price lunch. n The hope operator must be in good standing with the authorizer in each state in which it operates. n The audited financial statements of the operator must be clean; no signs of financial weakness. n And the State Board of Education can decide whether to impose other requirements and standards.

OK, a couple of those make sense.

But talk about a plan that’s highly unlikely to succeed.

Good luck finding a not-for-profit, charter school operator that can thread all of those needles.

Education.

The State Board of Education must approve the plan.

Upon approval, the turnaround option must be implemented in the following school year.

A school that earns a grade of “D” for three consecutive years must implement the district-managed turnaround option.

Turnaround options include: • Converting the school to a district-managed turnaround school; • Reassigning students to another school and monitor the progress of each reassigned student; •Closing the school and reopening the school as one or more charter schools, each with a governing board that has a demonstrated record of effectiveness; • Contracting with an outside entity that has a demonstrated record of effectiveness to operate the school; or • Implementing a hybrid of the above turnaround options or other turnaround models that have a demonstrated record of effectiveness.

A school earning a grade of F or three consecutive grades of D must have a planning year followed by two full school years to implement the initial turnaround. Implementation of the turnaround option is no longer required if the school improves by at least one letter grade during the planning year.

And, of course, you can see the bias here against for-profit school operators. What’s the difference between contracting with a not-for-profit school operator or with a private group if the cost and results are the same?

At this point in the legislative session, no one can say whether “Schools of Hope” will become law. But this particular effort, especially when you examine what happens when there is a failing public school (see above), reveals one of the fatal flaws of managing schools from the capital: the extraordinary bureaucratic process.

If a business unit of a large corporation is failing, the responsibility typically falls on the unit’s leader. To turn the operation around, you start there.

You don’t take three years and dozens of corporate-office forms to fill out to implement a plan.

If a school is failing, the turnaround should be managed at the local level.

That’s why we have county school boards and superintendents.

This idea doesn’t offer much hope.

MYTH OF SARASOTA: THAT IT IS A BOOM TOWN, HOT BED OF GROWTH If you look at the construction cranes and new apartments, hotels and condominiums in downtown Sarasota, you easily could reach the conclusion Sarasota is a boom town.

But let’s put things in historical perspective.

Take a look at the accompanying population data. On a 40-year timeline, Sarasota County, the city of Sarasota and Longboat Key have been the slowest growing places on the Gulf Coast of Florida south of Tampa Bay. While Florida has added a net increase of 12.7 million people, the city of Sarasota’s population has increased by only 2,842 — a meager 5% growth rate over 40 years. Longboat Key actually has declined in population. And Sarasota County as a whole has lagged behind all of its neighboring counties in terms of percentage growth. Moral of the story: Regulatory policies matter.

LETTER more than a decade, there have been only a handful. Far more common are cases where the project was modified to make it more compatible.

There is one statement Mr. Hament makes on which we can all agree: Certain aspects of the code need to be changed.

If the code is consistently creating buildings that the community does not like, it should be altered. This is why STOP! has proposed that the city adopt standards for wide sidewalks. Our current code is too often creating narrow unpleasant sidewalks that are not pedestrian friendly, as the city claims it wishes to be.

Let’s fix this.

And let’s return to a public approval process for large, new buildings. STOP! is not antigrowth. STOP! is working for quality development that will enhance our quality of life.

Its representatives use misinformation and outof- context remarks to make their case for reinstituting public hearings for downtown developments and to prevent administrative reviews. And they do so by using populist turns of phrase, suggesting that citizens are being deliberately cut out of input into developments.

process were to be based on a city code created after much public debate and to which each applicant knew he must adhere. The happy congruence of our commitment as a city to revitalize our downtown, the development of the new urbanism approach to city planning and the city’s hiring of Andres Duany to teach us about new urbanism has brought our downtown from a hollow and sleepy core to an exciting, vibrant, economic powerhouse generating tax revenue and providing residents with a large selection of cultural, shopping, eating and entertainment entities.

There is a sad naiveté to STOP!’s purpose. Its representatives think only of vehicular traffic when our real need is to find ways of moving people instead of cars. They don’t even talk about our miserable public transit system, which is designed to move people who don’t have cars, instead of developing routes and services that encourage people to get out of their cars.

They have even said that our highly qualified staff reviewers have stopped using compat-

ibility as a review standard, when, in fact, they never stopped, and the requirement continues to exist in the city code.

It is misleading say that if we move back to a public hearing process the public will be able to prevent things it doesn’t like. That would be legislating project by project, which would be unfair, un-American and perhaps even unconstitutional.

If someone dislikes the proposed paint color for the exterior of a building, will that testimony prevent approval of the project? If the architectural style doesn’t suit someone, can he then persuade the Planning Board or City Commission to reject the project?

There is no standard to which developers, lenders, buyers or citizens can then be expected to adhere. Some would certainly call such a situation an uneven playing field.

In last week’s diatribe against STOP!, Gabriel Hament argued that 1) public input has never changed or stopped projects, and 2) public input is bad because it is designed and intended to stop projects. You can’t have it both ways, and what is more, both statements are wrong. We are now deep into the election season, and the facts are taking a beating.

STOP! has argued that we need a public hearing process for new buildings because it increases the likelihood that new buildings will be compatible with existing neighbors and infrastructure. The primary purpose of public hearings is simply to get all the facts on the table. Where is the trash located, and is it adequately screened? Where are the entrance and exit to the project located, and are there arguments for a different, better location? Will the lights shine in my kid’s bedroom? How loud is the generator, and what are the city standards for these items?

Sarasota is a built-out city.

New projects are infill, and they have neighbors already living next door. Furthermore, every parcel is unique and has special circumstances that need to be taken into consideration.

It is extremely rare for projects to be turned down. In

The day after hearing a presentation on an audit of the city’s finances, Commissioner Susan Chapman got a call asking if she missed the $30 million error.

The call was distressing. One, because she had missed the error, but also because $30 million is a lot of money. She went back to the Comprehensive Annual Financial Report produced by consultant Purvis Gray and Co. LLP. On page 235, she found the problem. There were “material weaknesses” related to the city’s three pension funds — an accounting term used to describe a situation in which there is a reasonable possibility that staff will not prevent, detect or correct an error within financial statements.

Two material weaknesses within the city’s general employees, police and firefighters pension plans required adjustments of $30.7 million during the audit, the report said. For Chapman, the discovery was discomforting.

“No money was lost — it was an accounting error,” Chapman said.

“But it’s a $30,671,000 account-

ing error.”

Chapman brought up the topic at Monday’s City Commission meeting. City Auditor and Clerk Pamela Nadalini attributed the errors to the work of one employee. Nadalini said the report was concerning, but this was the first time the plans had these kinds of material weaknesses.

“This was not representative of the overall operations,” she said.

It is the standard and not the process that determines which projects are approved and which are not.

What’s more, public hearings can lead to political decisions rather than legal ones.

What many people do not remember is that the city’s existing administrative review process saved the city from major litigation from land owners whose properties were down-zoned under the New Urbanism code.

Would STOP! back up the city if the city is sued after reneging on its agreement that developers would have more consistency in the review and approval process?

What STOP! doesn’t understand is that our administrative review process has achieved what some considered impossible: It minimized the role lawyers play in the development processes. Developers and architects now manage the process, creating a favorable ratio of process cost to total development cost, thus saving buyers money.

The employee is currently on administrative leave; Nadalini said she relieved him of his duties for performance issues. Chapman said the employee raised concerns about Nadalini creating a hostile work environment before his departure. She said similar concerns arose when the city examined problems with its Information Technology Department in 2015, then under the supervision of the city auditor and clerk.

Nadalini disputed any negative characterization of her office.

“Maybe we have some professional disagreements, but certainly, by no means is it a hostile work environment,” she said.

Nadalini said her office was addressing the issues and agreed to update the commission at a future meeting. City Commissioner Suzanne Atwell said the city needed to thoroughly explore its options for strengthening its pension management.

“I think we have a crisis of confidence within the pension system right now, and we need to figure out what to do about it,” Atwell said.

Legal battles mount over Big Pass

Siesta residents say their legal action isn’t affecting the timeline of the Big Pass dredging project, but Lido residents are combating attempts to block the project.

Residents on Siesta Key and Lido Key are taking legal action to support their stance on the proposed dredging of Big Pass.

When the Siesta Key Association filed a motion in one of two legal proceedings surrounding a proposal to dredge Big Pass, the court received a response from six of the seven involved parties.

The only one that didn’t respond? The city of Sarasota.

When Lido Key residents found out, they were discouraged. Residents who have been involved in the fight over the dredging, which would provide sand to renourish Lido’s shoreline, worried it was indicative of a pattern of behavior.

“I am wondering what the city is doing that the lawyers you have

hired seem to be three to four steps behind,” Lido Key Residents Association member Paul Robbins wrote in an email to City Manager Tom Barwin.

The city’s lack of response does not show a lack of interest in the dispute, but rather highlights the complexity of the multifront legal battle surrounding plans to dredge Big Pass, according to City Attorney Robert Fournier.

There are two separate proceedings. One is in the Florida Division of Administrative Hearings. There, the Siesta Key Association, Save our Siesta Sands 2 and the Florida Wildlife Federation are challenging the Florida Department of Environmental Protection’s decision to issue a

permit to the U.S. Army Corps of Engineers and city of Sarasota for the dredging.

The other is in 12th Judicial Circuit Court of Florida, where the Siesta Key Association has sued the city, seeking an injunction to block the project. The lawsuit says the project, which would use Big Pass as the primary source for a 1.3 million cubic yard renourishment effort, requires approval from the County Commission, because some of the land is within the county’s jurisdiction.

Fournier said the city has recently prioritized the Circuit Court case, as the city is the sole defendant. He said Siesta Key’s motions in the administrative hearing, which sought to amend the allegations challenging the permit, were more procedural in nature, so the city did not feel as compelled to act.

“I know there’s concern and frustration about getting this done posthaste, but I don’t think they have anything to be worried about,” Fournier said.

There’s no imminent conclusion to the legal imbroglio, and all parties are heavily invested in reaching a positive outcome for their side. At an April Siesta Key Association meeting, board member Catherine Luckner made a fundraising appeal to the residents in attendance, stating the organization hoped to raise up to $100,000 for its legal fund.

Luckner was critical of the city’s response to the Circuit Court lawsuit, stating the city’s motion to dismiss the complaint did not actually address the legal issues at hand. The city’s response states the Circuit Court is not a proper venue for the challenge and that the county has not suggested its approval is neces-

sary for the dredging to proceed, among other claims.

Luckner said the substance of the response and the time it took for the city to file it suggested officials aren’t devoting a significant amount of attention to the Big Pass issue.

“It makes me wonder, who’s in a hurry out there?” Luckner said.

“It doesn’t sound like they have been.”

Luckner also suggested that Lido Key residents had been misled about the timeline of the project. Because no federal funding has been allocated for the project, it is unlikely to proceed until 2018, at the earliest. Luckner said Siesta’s legal actions have not delayed the commencement of the dredging, because there was no money available.

“I don’t think the Lido residents really understood that they weren’t going to get a renourishment and a project this year,” Luckner said. “We’ve been sort of made bad people because we’ve gotten in their way.”

The Lido residents are eager to begin the project as soon as possible, and they’re taking an active role in the legal proceedings. In addition to disputing the amendments to the administrative hearing, on April 13, the Lido Key Residents Association filed a motion to intervene in the Circuit Court lawsuit against the city.

Shoffstall acknowledged the unanswered funding question, but still said Siesta’s primary objective is to block the dredge.

“We do understand the timeline,” Shoffstall said. “We do understand that we need sand out there before there’s a hurricane. All they are doing is kicking the can down the road to drag this out.”

After officials spent 18 months to make 13 revisions to the city’s tree regulations, the Planning Board came to a conclusion during its April 12 meeting: Nobody is happy with the changes.

“It seems like everybody’s not satisfied at this point — both residentially and from a development perspective,” said Tim Litchet, the city’s director of neighborhood and development services.

During a two-hour meeting at which the board considered another proposal to change the tree ordinance, neighborhood leaders and building professionals shared their concerns. Residents say the ordinance still isn’t effectively protecting trees during a wave of construction.

The Planning Board was discussing a regulation that would require builders to replace removed trees inch-for-inch with replacement trees, based on trunk diameter at chest height, a common tree measurement.

If a developer were to remove a 21-inch tree, for example, it would be required to plant three 7-inch trees, or some similar variant.

The measure was designed to address residents’ concerns, but a series of speakers at the Planning Board were critical of the proposal as onerous.

“What you’re doing is stymying growth,” said David Smith, a

The board voted 4-1 to recommend that the City Commission reject the proposed changes, but there were questions about what the next steps will be. Planning Board member Eileen Normile recommended the creation of a temporary tree advisory board, wanting to keep the issue on the forefront of someone’s agenda.

“If we don’t do that, my fear is that it’ll disappear,” Normile said.

If the city pursues that option, Planning Board Chairman David Morriss said it should try to get residents with different backgrounds involved — both neighborhood leaders and developers.

Vice Chairman Patrick Gannon, who helped write the rejected changes, said the city still must prioritize accommodating the loss of trees from residential areas.

“Testimony here has addressed the impact on the neighborhoods, in terms of decimating too many trees in certain areas,” he said.

Litchet expressed some caution about the concept of overhauling the tree ordinance, particularly as the city staff is in the process of writing a new zoning code. Still, the Planning Board voted 4-1 to recommend the creation of the tree advisory board.

“It looks like tree ordinances need a de novo (new) look,” Normile said. “They need to be looked at from the beginning, not just Band-Aids.”

City Parking Manager Mark Lyons is proud of the way the State Street parking garage looks from the outside, but he has one word to describe the interior: blah.

That could change soon. The city is in the process of selecting artwork to adorn the walls of the parking garage, a project that Lyons plans to double as a wayfinding system to help people remember where they left their cars.

“Using public art as wayfinding is an excellent service to the community,” Lyons said. “It gives us a great platform for promoting public art.”

Plans for the artwork are not final, but the city has identified a favored concept. On April 12, the Public Art Committee interviewed five finalists who submitted plans in response to the city’s call for artists. The board praised each artist, and only settled on a recommendation to the City Commission after a series of deadlocks.

The winning concept has a working title of “The Life Aquatic,” according to artist Mark Krucke. The proposal is centered on a series of paintings featuring marine wildlife, including octopuses, manatees and loggerhead sea turtles.

“I chose this direction because we have a shared love of the bay,” Krucke said.

His proposal also includes placing about 200 small jellyfish sculptures within the atriums of the garage. In total, the budgeted cost of the project would be $100,000.

The committee initially narrowed the field down to two proposals. The other, from artist Michael Parker, used neighborhood names as wayfinding tools and painted classical sculptures over gradients on the walls of the garage. Lyons expressed some fear about the city’s ability to maintain the larger scale of that concept, and board member Leslie Butterfield questioned its efficacy as a guide for people parking their cars.

Ultimately, the board agreed on Krucke’s concept. Lyons said the city tried to focus on brighter artwork than what’s in the Palm Avenue parking garage, hoping to create a sense of excitement for people using the State Street facility. The board expressed optimism the aquatic artwork would accomplish that goal.

“Knowing what we want, I thought it made sense in almost any place in Sarasota,” said Public Art Committee board member Norman Schimmel. “I think it’s terrific.”

The committee will present its recommendation to the City Commission in May, at which point the commission will make the final decision on the artwork in the garage. The project is scheduled for completion before the end of the year.

wo years ago, the Riverview High boys lacrosse team did not exist.

This year, its first with playoff eligibility, the team finished 11-6 in the regular season, then won the District 17 championship 9-8 over Cardinal Mooney on April 6.

They were not done.

The Rams beat Canterbury 9-6 a week later to advance to the state's Sweet 16. With four minutes to go April 18 against Barron Collier, a program with one loss this season, the Rams found themselves in an 8-8 tie, with an Elite 8 spot at stake. But more on that later.

None of this post-season success would have been possible without the work of SRQLAX, a nonprofit group created to promote the sports in Sarasota County. Rams coach Pete deLisser was involved with the group, along with president Rachel Hautamaki and others. The organization raised approximately $120,000 to sustain Riverview’s boys and girls programs for three years.

The money pays for referee fees, transportation, uniforms, protective gear, field equipment and upkeep, lights, balls, among other expenses.

DeLisser said he believes area club lacrosse is coming to an end.

He wanted his players to have an outlet for the sport once they reached high school, hence the effort to make it a varsity sport at Riverview as a test case. But SRQLAX hopes to eventually get lacrosse set up in all Sarasota County schools.

Once established, the program

improved quickly. The Rams’ three senior captains, attackers Jesse Clark and Cole Hautamaki and defenseman Max Drewett, saw the team had potential, but even they did not expect this level of success. They owe it mostly to the chemistry of playing together previously on youth teams.

Drewett recently took his defenders out for a positional picnic, a thank you for the hard work the group put into the season.

Drewett brought chips and salsa to eat and blankets for lounging.

The goaltending crew brought pizza and brownies. Others brought drinks, like Capri Sun. Corn hole was played.

“It was all very romantic,” Drewett joked.

Clark gave Drewett a hard time for the gesture but called him a “true captain” with as much truth as tongue-in-cheek sarcasm.

DeLisser also pointed out the work done by defensive coach Allan Asselstine, tightening things on that side of the field to give the Rams' prolific offense more time to score.

Hautamaki said while the talent was always there, the team started to believe in itself halfway through the season. Losses to Cardinal Mooney and Maclay, the latter of which saw the Rams blow a fivegoal, second-half lead, forced the team to re-evaluate.

“We were all kind of down on ourselves,” Clark said. “We got together and talked, and decided we were a team good enough to beat whoever we face. We took it upon ourselves to get back into things, work harder every day in practice.”

“We got this grit,” Hautamaki said of the change in attitude.

Not only did the Rams feel they had to prove themselves, but they also had to prove Sarasota in general.

Lacrosse is still trying to take hold in the area. The county is behind other parts of Florida in this regard. According to the National Federation of State High

School Associations, Florida saw a 70% increase in lacrosse participation from 2009-2013, with 8,063 high school athletes playing the sport in 2013. That is the second-largest growth of any state during that period, trailing Minnesota (73%), but Minnesota only had 6,561 athletes participate in 2013. There were 187 high schools with boys lacrosse programs last season (the most recent data available), but just one Sarasota County public school and no public schools in neighboring Manatee County.

Lakewood Ranch is in the process of gearing up.

As the first area public school with the sport, Hautamaki said representing everyone else is “the best feeling in the world.” Drewett mentioned the team has received support from other schools. The St. Stephen’s girls team came out to watch the Rams’ first-round state playoff game. Clark said the team has received recognition from teams in Tampa and Naples.

All three captains were happy to help spread the game in the county. The more exposure they and the sport get, the faster the sport will grow in the county.

Ultimately, the game against Barron Collier, and the high school careers of Clark, Drewett and Hautamaki, ended in defeat.

Barron Collier scored with just under four minutes left, taking a 9-8 lead. Riverview had the ball with a minute left, but could not find a tying goal. No Rams left the field with heads hung low.

They walked off proud of what they had accomplished for themselves, their school, their county, and their sport.

“It was a fantastic season,” deLisser said. “I’m incredibly proud of these guys.”

The cold shoulder (and a whole lot more)

he best part of my job is its spontaneity. Stories can come from anywhere at any time, even, as I recently found out, from a seemingly small detail in a different story.

Two weeks ago, I wrote a column detailing Cardinal Mooney senior wrestler Dillon O’Neill’s path to the state championships (He ended up winning his weight class). As part of that piece, I mentioned O’Neill’s frequent visits to Hydr8, at 1539 2nd St., where he received cryotherapy treatment for a shoulder injury.

O’Neill said it helped him deal with inflammation and swelling.

After that story ran, Hydr8’s CEO, Fernando Vega, MHCM, contacted me and offered to let me try cryotherapy.

I am not one to turn down such an offer.

Vega told me the results of cryotherapy are akin to a 20-minute ice bath, only in three minutes. Hydr8 purchased its cryosauna from Impact Cryotherapy in Atlanta after Vega heard of numerous athletes, including LeBron James, Cristiano Ronaldo and Floyd Mayweather, using the machines daily in their homes.

The cryosaunas engulf users in liquid nitrogen vapors from neck to toe. All users enter the machine wearing gloves, socks and protective shoes. Male users are required to wear underwear.

sauna, Vega said NFL players have come to Hydr8 to use it, though Vega cited confidentiality rules and couldn’t give me specific names. He also told me the machine could help patients with migraine headaches, fibromyalgia, eczema and psoriasis, and arthritis, plus improve users’

energy, mood and melatonin levels, among other things. One patient in particular, who came in with arthritis pain, Vega will never forget.

“She came out of the machine and started crying,” Vega said. “I thought something was wrong.

She told me she could not feel

any pain.”

She then hugged Vega.

My turn in the machine had come. There are three levels to the cryosauna for beginners: minus 90 degrees (Celsius), minus 110 degrees, and minus 135 degrees. Veterans of the machine, like O’Neill, go colder.

Vega said prior to my treatment that by the time it reached minus 135 degrees, or the “get me out of here” level, it would be time to exit.

In my experience, he was mostly right.

Cryotherapy is a cold unlike any I had previously felt, and I don’t mean just in temperature.

It was a dry cold. There’s not the stinging wind accompanying the temperature drop like there is when you step out of a Missouri apartment in early February. In fact, nothing stings.

You feel the cold for while, and then you don’t. You know it’s there, because your body won’t stop shaking and remembering to push the “breathe” button in your brain takes effort. I guess that is to be expected in those temperatures, though.

Vega was talking to me during my session, but honestly, I could not tell you what he said. Every 15 seconds, you rotate to ensure frostbite doesn’t get its grip on any ligaments. By the time three minutes had passed, I was more than ready to throw on Hydr8’s complimentary robe.

Stepping out of the machine

after three minutes was not unlike drinking a glass of red wine and feeling it slip down your throat and into your stomach, leaving a trail of warmth.

The key difference is leaving the cryosauna brought warmth to my entire body, not just one area, though it didn’t convince me dancing to John Mayer’s new album was a good idea, so wine gets the edge there.

After my session, I felt better than expected. I was alert, and that alertness turned into productivity. I slept great that night, and my feelings from the day before remained in effect.

I did not have any injuries, so I cannot speak to the treatment in that regard.

Cryotherapy was certainly a new experience, one that I’m glad I did. As it spreads through the sports world and other people get into it (TV personality Chelsea Handler used it on her Netflix show, “Chelsea”), I imagine you will hear about it more and more. Vega told me he’s in the business of helping people, not making money, and I believe him. An introductory session is $25, with different plans available after that.

Osprey residents Martine and Pierre Filiatrault have decided to leave a legacy of stone.

atrimoine is the French word for a person’s heritage.

It signifies a collective culture, a shared story, and it’s Martine and Pierre Filiatrault’s reason for the for-sale sign in the yard of their Osprey home.

Martine Filiatrault, a French native, and her husband, Pierre, a Canadian, have wintered in Osprey since 1999.

However, in 2013 the couple’s priorities changed. Martine Filiatrault’s cousin Nicole TraverseBoussaguet died, leaving the couple to decide what to do with her estate.

In this case, the estate happened to be a 24,000-squarefoot 14th century castle — the Chateau de Gaujac.

“It was a decision of the two of us that either we take it or the government was going to take it,” Pierre Filiatrault said. “There was not a third alternative.”

Traverse-Boussaguet bought the property in Gaujac, France in 1978. The French would say it was a coup de foudre, which directly translates to a stroke of lightning.

It means love at first sight.

Gaujac is a small town of about 1,000 people just over 400 miles southwest of Paris. Nestled in the hill country, vineyards and fruit trees surround the village.

The castle’s original resident, Monsieur de Gaujac, built the structure on a hill. Buildings dot the slope, building to one central point. While wandering through the town, Traverse-Boussaguet looked up.

“She fell in love with the place … It’s as simple as that,” Martine Filiatrault said.

Its owners had largely abandoned the property for 30 years, but Traverse-Boussaguet had an eye for potential. She was a sculptor by education married to a filmmaker.

Together, they set out to create what would be their final masterpiece, one room at a time.

“They started living in one room and then two rooms,” Martine Filiatrault said. “They did it with so much passion. They had a dream. Unfortunately, it stopped for him earlier than they would have thought.”

Traverse-Boussaguet’s husband died in 1992. After his death, she filled the castle with art, holding exhibitions and concerts in the grand salon.

She died, but her dream didn’t.

“When we saw all the passion and the work, of course, you want to go on with that,” Martine Fili-

So they picked up where Traverse-Boussaguet left off.

It wasn’t an easy decision. The property has historic protection requiring the pair open the castle to the public 66 days a year.

They give tours for 5 euros — $5.35 in U.S. dollars — between the last week of June and the first week of September. They maintain the grounds, restoring windows and rebuilding towers made out of medieval brick.

The pair doesn’t profit off their enterprise. The castle is simply a catalyst to honor their cousin’s passion, and, as Martine Filiatrault puts it, fasten a link to French history.

History, Martine said, is like a chain. Each event, each structure is a link in what becomes a county’s heritage, its patrimoine.

“Everyone brought their stone to that structure and modified it, and it keeps going on,” Martine Filiatrault said.

There are thousands of castles like Chateau de Gaujac in France.

They are passed down to relatives or purchased by people like the Filiatraults. However, not everybody has the means to keep their links in the chain strong.

“The government cannot afford to spend money on so many (castles). So the effort has to come from some people, but not everybody can,” Martine Filiatrault said. “It’s a choice ... Otherwise it can pretty much get destroyed or get left alone.”

It’s an ever-pressing reality for the Filiatraults.

At 57 and 69 years old, Martine and Pierre Filiatrault know their passion won’t last forever. With no children, eventually they will have to find a buyer for their castle on a hill.

“For now, we are in that situation where we are thinking about the future while we keep working,” Martine Filiatrault said. “We still have the energy, and we love that place.”

This could be their last season in Osprey. When their house sells, they will become full-time residents of France.

After a day of work, they’ll sit on their terrace with a view of Mont Ventoux, watching the sun set over the hills, motivated by their shared belief that their patrimoine is worth saving.

“History belongs to everybody,” Martine Filiatrault said.

esidents hopped over to Turtle Beach on April 15 for the Siesta Key Easter Egg Hunt.

Families were greeted with a bunnyhug from the Easter Bunny, who wandered around the event. Eventgoers also enjoyed a mobile aquarium from the Mote Marine Laboratory and Aquarium, tours of county emergency vehicles and face-painting.

In fact, by the time the eggs had been placed for the Easter hunt, many children had bunny noses of their own.

“There’s plenty for people to see and do,” Siesta Key Chamber of Commerce Executive Director Ann Frescura said.

The event, which is put on by the chamber, grew from last year as organizers opted to host the event at Turtle Beach instead of Beach Access 5.

“Or course this space is larger than what we’ve had before,” Frescura said.

“It’s a ready-made, familyfriendly venue.”

Southside celebrates Easter

ven after all the eggs had been collected at the Southside Village Life Easter Egg Hunt on April 15 at Southside Elementary School, the fun wasn’t over.

Children cracked their Easter eggs to find treats and toys inside.

As the excitement faded, there was still lots to do as children collected ice pop and played on the playground.

aster fun was just a hop away on April 16 at Marie Selby Botanical Gardens.

Families filed into the garden for Selby’s Easter brunch at Michael’s on the Bay at Selby Gardens, and there was a lot for kids to get excited about.

Children quickly became enthralled by the eggs hidden in the rows of purple salvia planted outside of the ballroom.

Squeals of delight could be heard from inside the brunch as children found eggs hidden in the bushes outside.

Once they made it inside, there was still more fun to be had. Face paint, balloon animals and visits with the Easter Bunny were waiting for children inside the dining room.

Participants walked a one-mile route down Main Street to Five Points Park, then down Pineapple Avenue to the doors of the Church of the Redeemer.

The walk commemorates the 14 events that took place as Jesus car-

ried the cross to the hill where he was crucified.

It was an early morning for those who make a tradition out of participating in the Good Friday procession. It began at 7:30 a.m., and many people woke up before the sun to arrive on time.

But for those who regularly take part, the early morning is worth it.

Jacki Boedecker of Church of the Redeemer doesn’t remember when she started attending the event, but she has no plans of stopping.

“I would never not do it again,” Boedecker said.

“It’s that meaningful.”
