And in a matter of days, Sarasota County will be on its way to the same kind of transportation renown with a fleet of rainbowcolored commuter swan boats.

The region is expecting delivery this week of 125 of the pedalpowered vessels as part of its new Water Wings for Sarasota pro-

gram designed to alleviate traffic jams, especially during the high season.

By next fall, 250 of the whimsically winged crafts will form the basis of the largest publicly operated fleet of swan boats in the world. Organizers justified the size of the fleet after a pilot program earlier this year, which appealed to the 9-to-5 crowd eager to get off the road.

New city development rule: ‘One at a time’ When it comes to new projects in downtown, city officials will use the same policy as a crowded nightclub: one in, one out.

Responding to concerns about the rate of growth in the heart of the city, local leaders are taking decisive action to slow development. This week, the City Commission voted 4-1 to approve new regulations that will limit downtown to one development at a time — from conception to completion.

Under the ordinance, once the city receives plans for a new project, all other development proposals will be placed on a waiting list until that first project is complete.

“The city recognizes the need to give every proposal undivided * attention,” the ordinance states.

The regulations come with a more rigorous process for evaluating the merit of proposed developments (see right).

Although growth advocates decried the policy, some residents believe it doesn’t go far enough.

“Even one new condominium could be the tipping point that transforms Sarasota from a quaint town to some sort of a Miami-on-steroids nightmare,” resident Willie Dustice said.

Responding to concerns about plans for roundabouts on a narrower Fruitville Road, the city has developed another option for the street: making it one-way only.

City documents reveal that staff is debating whether the city should only allow eastbound traffic on Fruitville Road, reducing the street to two lanes between U.S. 301 and U.S. 41.

“This would maintain the current capacity headed from the barrier islands toward Interstate 75 — which is most crucial for evacuation purposes,” the proposal states. “And it would achieve our goal of widening the sidewalks and making Fruitville more pedestrian friendly. We anticipate everyone will be satisfied.”

City staff is also considering creating a dynamic oneway system, which would allow Fruitville Road to handle eastbound traffic in the a.m. hours and westbound traffic in the p.m. hours.

“It might sound confusing at first, but eventually, people should be able to figure it out,” the proposal states. “The only problems we project arising would take place at noon and midnight.

HIGH TIMES Investor group sees marijuana as a cash crop that could light up commerce in the lethargic east end of downtown — but will Sarasota residents and city officials harsh their buzz?

s the city attempts to sort out its regulations on marijuana dispensaries, a group of investors sees the new industry as a high-value investment — and they plan to sow their seeds on Main Street.

This week, Long Beach, Calif.based entrepreneur Bradley Nowell filed a preliminary application for a new business in the former Herald-Tribune building at 1741 Main St. Nowell’s application proposes a new use for one of downtown’s most iconic buildings: a marijuana grow site and dispensary.

The plans are an early challenge for Sarasota in the wake of the approval of Amendment 2 in November. Although the law is designed to provide relief for individuals suffering from illnesses, residents and city officials have expressed concern that a rapid spike in marijuana-related businesses could spark a bad reputation for the downtown core.

“What we’re talking about is the distribution of powerful, mood-altering chemicals on Main Street,” downtown condominium resident Nark Dugnutt said. “Imagining something like that is, quite frankly, frightening to even consider as a hypothetical.”

But Nowell sees the marijuana industry as an opportunity to blaze a new trail on the lethargic east end of downtown. He was originally attracted to the Main Street property for its glass win-

dows — the perfect site for a urban grow operation, he said. But there were other factors that sealed his decision to move forward with the proposal.

“We’ve done our research, and the data showed that Sarasota was the best city in the state to begin this new enterprise,” Nowell said in the preapplication documents.

“The demand alone from residents stressed out by nearby construction and searching for a way to decompress — it’s a potential gold mine.”

And property owners seem to be embracing the proposal, with other similarly minded businesspeople prepared to roll out their own plans if Nowell is successful.

Leaked documents show a plan to overhaul the former World of Beer site at 1888 Main St., although the new concept isn’t a radical departure from the former tenant.

Miami-based firm Dank Developments Inc. hopes to transform the property into “World of Weed,” a craft dispensary that advertises its offerings of 420 different strains of marijuana.

“Quite frankly, it’s immature to paint all marijuana sellers and users as the lazy weed-loving stereotypes you see in pop culture,” said Ross Taman, CEO of Dank Developments.

He straightened up behind his desk, staring contemplatively at his “Bob Marley: Legend” poster and adjusting his long, blond dreadlocks before he continued.

“This is a serious business,” Taman said. “Anyone who would try to make light of that should do some real self-reflection.”

The eyesore that is the Siesta Key wastewater treatment facility is on its way out, and a flashy new development is slated to drop anchor in the Grand Canal.

Cribbing the name of the majestic birds featured in island folklore, Atlantic City, N.J.-based Double Down Development Co. aims to debut the Grand Parakeet Riverboat Casino & Hotel in early 2018. The proposed 103,000-square-foot vessel will hang partially over the old wastewater site at 5200 Oakmont Place, which will include a dog park — as Siesta Isles neighbors requested.

“It’s a win-win-win in my opinion,” said Double Down Chief Action Officer Karl Dandleton.

“Sarasota gets more hotel rooms and a steady stream of tourist taxes, Siesta residents will finally be free of that unsightly sewage plant and — since it’s on the water — we won’t have to go through the

onerous comprehensive plan process with the county.”

The proposal comes on the heels of plans for a hotel on the island that sparked concerns about traffic and high-rises blocking views and diminishing residents’ quality of life.

“The Grand Parakeet will do neither,” said Dandleton, noting the boutique hotel’s guests will likely remain on the boat for a majority of their stay in Sarasota.

Double Down is planning to offer guests the opportunity to

swim with the manatees that populate the canals to graze on seagrasses, and lounge on the artificial beach area of the boat, which will include genuine Siesta beach sand. The casino will take up roughly 60,000 square feet of the boat, and a 20,000-squarefoot theater will bring international acts and shows — “Hamilton” will kickoff the inaugural schedule. Dandleton said his firm would consider expanding the project to include a conference center.

Siesta Isles resident Todd Bonzalez said he’s equally excited about the plans for a dog park for his two bichon frises as he is about the casino and hotel.

Now, that’s what I’m talking about.”

Although county staff have no say about the development of the casino, they have started vetting the proposal for the 450-squarefoot dog park next to the canal.

Double Down will need to amend the county’s comprehensive plan, as well as work through a sixmonth rezone process before it can be built.

“I can’t believe how difficult it is to work through the county’s development codes,” said Bonzalez. “At least I’ll be able to play some blackjack in the meantime, though.”

The boats will initially be based at five sites along the waterfront: Bayfront Park, the Van Wezel Performing Arts Hall, Phillippi Estate Park, Ted Sperling Nature Park on Lido Key and the Bayfront Park Rec Center on Longboat Key. Use of the boats is free but will require a swipe of a driver’s license or state ID to unlock the pedals and steering mechanism. The swipe will also activate a tracking beacon, allowing users of a mobile phone app to find an available boat near them to travel waterways within Sarasota and Manatee counties. The same tracking software will automatically turn the boats around north of State Road 64, west of the gulf beaches and south of Turtle Beach.

ing positions, plus a small area for cargo, the boats are capable of about 5 mph. There is no provision for sun or weather protection, so riders are encouraged to dress appropriately, consider sunscreen and stay hydrated.

City and county leaders began discussing the plan about a year

ago after sitting through hours of presentations by men in sea captain’s hats, promising to have ferry boat service operating within six months.

The swan boats require no city, county, state or federal permitting and, as of 12:01 p.m. Jan. 20, no environmental impact stud-

ies need be done. The boats are expected to be popular with tourists, but the program is squarely aimed at commuters.

Among the early adopters of the program, during a six-week pilot program involving 12 of the boats last fall, were professionals who frequently shuttle between Sara-

sota’s downtown and Longboat Key or Lido Key. “I look forward to the day I can do this daily,” said Sandy Michaels, a Longboat Key-based attorney. “Sure, it takes two hours to cross the bay. Visitors can now get around downtown with the aid of a new transit option called i-Ride Sarasota.

The on-demand transportation service launched Wednesday. The service offers free rides that users can access via an app, telephone number or by hailing a vehicle on the street.

In February, the city committed up to $338,747.50 to subsidize the private service in its first two years. The

Gotcha Group, a Charleston, S.C.-based company, operates the transit service. The company will sell advertising on the sides of vehicles, with the goal of becoming selfsustaining once the subsidy runs out.

The service includes a fleet of seven six-seat electric vehicles. The boundaries of the service are 14th Street, School Avenue, Mound Street and the bayfront. Vehicles will operate

from 11 a.m. to 11 p.m. daily.

Parking Manager Mark Lyons said even before the service began, residents were already inquiring as to how they could get a ride.

“People are ready to use it now,” Lyons said. “That’s good.”

As Ringling College of Art and Design expands its academic footprint in north Sarasota, the school is pitching a $22 million project to accommodate more students.

Ringling has filed a site plan with the city for a threestory, 50-unit residence hall overlooking Whitaker Bayou on the east side of campus. The building is slated to house as many as 185 students and includes a pedestrian bridge connecting it to current student housing across the waterway, according to the site plan application.

The school aims to finish the project before the fall semester in 2018. It will cost prospective students roughly $8,550 per school year to live in the coming residence hall.

The college is pursuing a plan for growth, with admission rising accordingly. Last year, Ringling saw its largest freshman class, and applications are up 20% this year.

This year’s school body has 1,341 students.

BLUEPRINTS FOR SUCCESS By helping residents learn more about design, local foundations are giving a whole new meaning to Sarasota school of architecture.

C

onsidering the diverse array of work the Center for Architecture is coordinating — public exhibits, lectures and discussions, walking tours, historic preservation, collaboration with educators — it’s easy to forget the organization held a grand opening just two years ago.

And yet, founder Cynthia Peterson and the board of directors are not content. In February, the board hired Peterson to serve as its CEO. The transition from volunteer to full-time leader — Peterson previously chaired the board — reflects the group’s growing ambitions. Peterson said she wants the Center for Architecture to be a premier design organization — not just locally, but nationally.

“If someone comes to our community and wants to know what’s going on in that realm, we want to be the destination where they come,” Peterson said.

So what does growth look like for an organization with such a broad mission? Peterson already has a to-do list. It includes expanding the Center for Architecture’s children’s programming, working with local educators. She also wants to draw on her archival experience to develop a collection of key historical architectural documents.

“Many times, that history is

destroyed — way too often, in Florida,” she said. “Our history itself has been a frangible history.”

But the organization isn’t just dwelling on the past. Peterson sees the center as an opportunity to learn from the past, apply it to the present and figure out how people can come together to affect the future.

Bringing people together is one of the primary missions of the Center for Architecture. Peterson guessed that 90% of the attendees at the group’s events were not architects. This is an exciting opportunity, she said. The center can serve as a venue for designers to engage with the people who will use their work, or for residents to share their thoughts on architecture before a building is constructed.

“We’re the organization that highlights, emphasizes and distributes this information to the community,” Peterson said.

“We’re not the architects. We’re not the designers. We’re not the city. We’re this neutral place.”

She uses the redevelopment of the city-owned bayfront land around the Van Wezel Performing Arts Hall as an example of how she envisions the center fitting into the larger civic picture.

bayfront should be redeveloped.

The Center for Architecture displayed the models to the public, hoping to get residents thinking about the possibilities for the project. Peterson wants to keep that energy going as the planning process evolves — and to foster similar conversations for other high-profile projects.

So far, Peterson said, residents have shown an interest in having those conversations. The Center for Architecture has more than 500 members. The public interest in architecture isn’t surprising to Peterson. It’s a natural subject for people to feel strongly about, she said, even if they’re not experts.

“Design affects every aspect of our humanity,” Peterson said.

“It’s there from birth to death.”

THE MODERN AGE

For more than 15 years, the Sarasota Architectural Foundation has been undertaking its own education and advocacy efforts, albeit with a narrower focus.

The foundation was born out of a five-day symposium on the Sarasota School of Architecture, the midcentury modern movement that became a defining part of the region’s design legacy.

Today, the Sarasota Architectural Foundation still largely focuses on preserving and promoting that modern style.

The foundation is also transitioning from an all-volunteer group to one with a paid leader.

In March, the group hired Tammy Hauser as executive director.

Hauser, the CEO of arts nonprofit consulting firm Blue Sky Thinking, came aboard to help take the organization to the “next stage.”

Janet Minker, chairwoman of the foundation’s board of directors, said the group’s highestprofile work involves tours of noteworthy local structures — but her passion is preservation. She joined the board in 2012 to help preserve the Sarasota High School Addition, designed by Sarasota School icon Paul Rudolph.

She hopes hiring Hauser will help the board do more work with people who own historic homes, preserving and rehabilitating the city’s midcentury architectural legacy. As the Sarasota Architectural Foundation has promoted that legacy, Minker has found

homeowners are eager to participate in those efforts.

“Our experience, especially recently, is the people who buy these houses understand and appreciate them and do their best to try to bring it back,” Minker said.

An example is Bob and Anne Essner, residents who purchased and restored the Rudolphdesigned Umbrella House on Lido Shores, one of the most important Sarasota School structures.

The Essners work closely with the foundation — Anne Essner is on the board of directors — and offer the home for regular tours.

Giving the public firsthand experience with premier examples of midcentury architecture helps illustrate the value of the design, Minker said. Actually walking through the houses gives you a sense of the minimalist ethos, on the relationship between the built space and the natural environment. Even longtime residents come away from a tour with a renewed appreciation for local architecture.

“You just have to keep talking about it,” Minker said.

The foundation also isn’t just looking backward — the group works with local architects to discuss how midcentury concepts can be applied to modern design.

Javi Suarez, an architect with Apex-Studio Suarez and president of the American Institute of Architects Gulf Coast Chapter, said the public engagement these groups foster helps the design community work more effectively.

“It’s obviously quite helpful to architects in our profession to have more people educated, in terms of what we do and the quality of our work,” Suarez said.

Both Peterson and Minker said the interest in architecture is particularly potent as Sarasota goes through a period of growth, and many residents fear losing the connection to the past. In pursuing their missions, both organizations hope to serve as a conduit linking the region’s architectural history to its architectural future.

“We don’t want to tear these down,” Minker said. “It’s a heritage for Sarasota — we’re famous for it. We just need people to be aware.”

In the May 9 nonpartisan race for two at-large City Commission seats, two political parties have pledged to support candidates based on their party affiliation — and one party is dealing with internal divisions on whether that support is merited.

With two registered Democrats and one registered Republican in the field, local political operatives are letting voters know who’s affiliated with what party in hopes of winning votes.

For the Sarasota County Democratic Party, which didn’t get involved in the March 14 election, the foray into the city race has come with controversy.

Kevin Griffith, vice chairman of the local Democratic Party, said that the party isn’t making a formal endorsement. Primarily, it will inform its members of the registered Democrats in the race.

Even that level of support has rankled some local Democrats.

Hagen Brody and Jen AhearnKoch, the registered Democrats in the race, have offered opposing viewpoints on how the city should approve new developments.

Ahearn-Koch wants to eliminate the administrative review process, which allows city staff to approve projects without public hearings. Brody said the public’s role in shaping new development should involve rewriting the regulations in the zoning code.

Party members, including Gabriel Hament, who worked on City Commissioner Liz Alpert’s 2015 campaign, have suggested Ahearn-Koch’s stance should disqualify her from receiving Democratic support.

“My objective is to protect the Democratic Party from Trojanhorse candidates like Jen AhearnKoch, who are Democrats in name only with regard to municipal issues but are attempting to advance policy initiatives that are in direct contradiction to the progressive policies of the Democratic Party,” Hament said.

Ahearn-Koch has bristled at the assertion that her views run counter to working-class values that would stymie economic development and the production of affordable housing. She believes her views can be reconciled with the city. She said the

“I’d love to hear how many affordable housing units are available in the Vue,” AhearnKoch said, referring to the 144unit downtown condominium.

Hament isn’t the only one questioning Ahearn-Koch’s bona fides. Former City Commission candidate Patrick Gannon sent a strongly worded email to Democratic Party leadership that also criticized Ahearn-Koch’s development stances. Despite receiving concerns from party members, Griffith said the Democrats are welcoming to — and supportive of — people with opposing perspectives.

“People of the same party can differ on different issues,” Griffith said. “That’s for the candidates themselves to explain where they stand on different issues.”

The conflict within the Democratic Party reflects the shifting dynamics as the field of candidates shrinks from eight to three.

Leading up to the May 9 election — where residents will be able to vote for two people — there has already been a greater effort to package candidates together as prospective commissioners.

The partisan divide is one way to define the candidates in the race. Another is growth.

Martin Hyde, the lone registered Republican in the race, is leaning on that for support, casting Ahearn-Koch as an outsider and tying himself to Brody.

“I’d much rather sit with Hagen Brody than Jen Koch,” said Hyde, who finished third in the first election. “Not on a personal level, but on the basis that empirically, I’m opposed to the narrative she’s

used throughout.”

Both Hyde and Brody have criticized STOP!, the resident activist group Ahearn-Koch helped found that opposes the use of administrative review. But there are distinctions to be drawn between Hyde and Brody’s perspectives on growth, as well. Brody has advocated for a clearly defined, Main Street-centric downtown with strong regulations in the zoning code. Hyde has pushed for a more laissez-faire approach in the core.

“I think it’s as simple as: Who should decide how I live?” Hyde said. “I think I should decide how I live, not the government.”

If Democratic officials are concerned about Ahearn-Koch’s party loyalties, Hyde doesn’t necessarily fulfill their wishes.

Hament said he planned to cast a single vote for Brody, but no matter how individuals vote, two of

“I hope they look at me as a candidate from a comprehensive level, and that they don’t take one issue and say, ‘This one issue is important, and it’s the only important issue,’” she said.

She said her perspective on development is nuanced — she’s not trying to block growth, but she does want to produce highquality projects. She wants to give residents more chances to engage in the development process, and she thinks requiring more public hearings is the best way to do that.

As the campaign continues, Ahearn-Koch is hopeful voters will filter out attempts to reduce her positions to a talking point.

“I don’t want it to be flattened out,” she said. “I don’t want people to say things like, ‘She’s against development.’ Of course I’m not against development.”

Brody did not respond to requests for comment.

Despite some criticism from individuals, there hasn’t been a united effort to oppose STOP! and the policies for which it’s advocating. Opponents say AhearnKoch’s candidacy may serve as a flashpoint for people to band together and defend the administrative review process.

If Ahearn-Koch is optimistic voters will consider the nuances of the race, her critics are determined to paint a starker picture about her stance on development.

“The concerns are widespread,” Hament said. “They just haven’t been formalized and vocalized.

That’s coming.”

Critics call Fruitville Road projections into question The city is considering adding a series of roundabouts to major roadways, but the plans to overhaul Fruitville Road remain contentious.

State transportation officials tried to make residents more comfortable with roundabouts at a meeting Tuesday, but the traffic features remain controversial on Fruitville Road and U.S. 41.

In a series of emails to the city, Lasche says the city is underestimating growth. The projections fail to incorporate several developments in the downtown core, Lasche said, as well as any projects that have not been announced.

The project also does not incorporate any increase in traffic on Fruitville Road after 2028.

City staff has said the volume of traffic has not increased on Fruitville between 2000 and 2015, but Lasche is skeptical about using that as a baseline.

“We think it is dreaming to assume that there will be no back-

ground increase in traffic from our area’s strong population growth,” Lasche wrote in a March 21 email.

Longboat Commissioner Jim Brown asked if the city considered making Fruitville Road oneway going east, switching a road like 10th Street to one-way going west. Brown theorized this would allow the city to improve the aesthetics of Fruitville Road while maintaining the flow of traffic.

The City Commission is expected to make a decision regarding the future of Fruitville Road next month. As the discussion at last week’s Longboat Key meeting wrapped up, Brown offered Sarasota officials one last friendly suggestion.

“I would just urge you, when your presentation is over, wait until 5 o’clock and then drive home,” Brown said. “It really is a nightmare.”

Stancel presented the roundabout plan, Longboat Mayor Terry Gans reaffirmed his stance on the project. Gans has been a vocal opponent of the proposal, saying the idea does not take into account the needs of residents of the barrier islands, who use Fruitville Road as an east-west route.

In response, Stancel said the project is designed to handle future traffic, which is based on staff and consultant projections through 2038. Bicycle and pedestrian advocate Mike Lasche has questioned the validity of those projections.

In response to criticism of a plan to shrink a portion of the roadway on Fruitville Road, city staff has pointed to 20-year traffic projections as proof the plan can work.

But as the city prepares to decide the future of Fruitville Road, opponents remain skeptical about the real-world application of those projections.

Opponents include Longboat Key officials, who discussed the plans with Sarasota officials last week at a workshop.

The most contentious proposal for redesigning Fruitville Road includes reducing the street to a two-lane road between North Lemon Avenue and Cocoanut Avenue. The plan would add roundabouts at those two intersections as well as Central Avenue. Bicycle lanes would be removed, and sidewalks would be widened to 16 feet along the three-intersection stretch.

The other alternative includes widening sidewalks to 10 feet and removing bike lanes.

The Florida Department of Transportation held a workshop Tuesday to gather feedback regarding the intersection of Gulfstream Avenue and U.S. 41.

The state is considering two options. One would add a roundabout, while the other would make improvements while maintaining the traffic signal.

More than 100 residents came ready to fight Saturday night — Saturday night, mind you! — over in Palm Coast.

At a town hall meeting, residents unleashed their opposition to shortterm vacation rentals on state Rep. Paul Renner.

Down in Miami Beach 10 days ago, the other side came out. While Miami Beach Mayor Philip Levine and Miami Mayor Tomas Regalado held a news conference at Miami City Hall highlighting negative impacts short-term rentals are having on neighborhoods and constant complaints they’re receiving about Airbnb users, two dozen Airbnb hosts carried signs reading, “These mayors are Innsane.”

Then, at 8 a.m. Tuesday in Tallahassee, both sides came face to face and unloaded on state lawmakers over House Bill 425, one of two bills this legislative session that has escalated this fight. The other is Sarasota Sen. Greg Steube’s Senate Bill 188.

The battle lines are clear: n The homesteaders and city and county commissioners are fighting for the authority to govern and regulate the use of residential property in their communities — home rule. n On the other side, Airbnb, VRBO (Vacation Rental by Owner), vacationrental owners, Steube and Rep. Mike La Rosa, R-St. Cloud, are fighting to keep local governments from regulating the vacation-rental business and for these residential property owners to have the freedom to do what they want with their properties — make money.

As each day goes by, Home Rule Florida, an organization birthed in Anna Maria, is receiving reports from around the state from homesteaders expressing their dismay at what’s happening to their neighborhoods. Here’s one from William Teat in Fort Lauderdale: “Just last year, we had homes in our subdivision rented to people who used

the rental to throw large all-night parties. These people were charging for entry, and were attracting not the best elements to our quiet neighborhood.”

George Pezoulas of Palm Coast sent this to state senators: “… [W]e have one of these rentals across the street … After we moved down and into our home, within the first week we could hear what was the beginning of a long season of cars, endless noise when they were in the pool and an endless stream of renters walking out of the front door.

Our neighbor to the right side of them had to finally sell his house and move…”

And tell me this doesn’t make you take notice: On Anna Maria, an eightbedroom home is advertised that it “comfortably sleeps 28.” How would you like that next door to your twobedroom beach bungalow?

On the other side of the battle line, of course, are the defenders of freedom and property rights (their right to benefit from what they own). Last week, in our sister paper, the Business Observer, Adrian Moore, vice president at the free-market think tank of Reason Foundation, asked: What’s the problem? He says he lives happily and peacefully on a Siesta Key street whose homes are almost entirely vacation rentals.

Moore argues against the state giving cities and counties home-rule regulatory powers over vacation rentals. “We have an extensive body of nuisance and other laws designed to prevent one homeowner from imposing harms on others via noise, smells, parking, trash, what have you,” he writes. “After all, we all have family and friends who visit us, staying for various lengths of time.

Some people have lots of family and friends who stay with them … [H]ow is that different from vacation renters? Why not let homeowners use their homes as assets however they like?”

To that point, of protecting property rights and the free use of their properties, over the past two years in Anna Maria, upset vacation-rental homeowners have filed 80 lawsuits against the city of Anna Maria, with claims totaling more than $30 million. These property owners say Anna Maria’s 2015 ordinance regulating vacation rentals with myriad rules and requirements, including occupancy limits, has diminished the value of their properties.

Invoking Florida’s 1995 Bert Harris Act, they want to be compensated.

In Miami, Levine and Regalado heard vigorous protests from Airbnb hosts who said they wouldn’t be able to afford the payments on their homes without the income from their overnight renters.

And Steube argues that unless local governments are prohibited from enacting regulations on short-term vacation rentals, which his bill would do, local governments will go overboard

and severely damage an important source of Florida’s biggest industry, and deny owners “the right to own and enjoy” their property.

To be sure, this is a difficult dilemma for all of Florida. Both sides have valid arguments.

The fundamental principles of “liberty” and the “pursuit of happiness” for centuries have carried the idea that your property is yours. And you have the right to benefit from what you own — be it from your own effort and talents, from the crops you grow or from providing shelter to a vacationer — as long as you don’t harm your neighbor.

As Steube and La Rosa see it, less regulation and more freedom are far better than onerous local regulations designed essentially to confiscate people’s benefits in favor of protecting a few cranky neighbors.

But flip the coin. At the same time, vacation rentals are a business. Airbnb hosts are part of a business enterprise — operating in residential neighborhoods. Why should they be exempt from the rules, regulations and taxes that are imposed, say, on six-unit vacation resorts and other local businesses?

Talk to the general manager of Casa del Mar resort on Longboat Key, and he’ll likely bristle that his resort is required to collect bed taxes from weekly vacationers while the “underthe-table” weekly renters at the condo down the street pay no business taxes.

What’s more, most local governments indeed have had the long-standing right to create zoning classifications for compatible property use. What, then, is the justification for the state to “pre-empt” home rule on this one classification of property use?

Here’s a kicker: If you gave citizens a vote on which level of government is best for decision-making at the local level, it’s a safe bet that nearly 100% would say government closest to the people is best; the state should refrain from meddling in local affairs.

Think of it this way: State lawmakers and governors always chafe at the federal government telling them what to do. They invoke what the Founding Fathers envisioned when they created the United States: That whatever powers were not enumerated in the Constitution were left to the states.

The states were viewed as laboratories of democracy where people had the freedom to try different ways to address their unique challenges.

So it is with local government. We all have learned that whenever government imposes a one-size-fits-all regulation the ill-effects are worse than the benefits. Innovation is stifled.

Let the marketplace at the local level address short-term, vacation-rental homes. Let home rule prevail.

American ingenuity is remarkable at responding to the market’s needs and desires. And the marketplace is remarkable at finding equilibrium.

Excesses never last. Indeed, we all have seen how too much regulation is destructive. In this instance, the Bert Harris Act counterbalances. And we all have seen how an oversupply of product and bad behavior is destructive of value as well.

Eventually, the market corrects; rational minds reach a balance. But that takes work, experimenting and making a persuasive case to find that balance.

If Steube and La Rosa learn anything about this volatile subject affecting all of Florida’s coastal communities, they might see a few word changes in state statutes aren’t going to settle this dispute.

This challenge should be settled at the local level. Not in Tallahassee.

Heidi Brown, co-owner of Brown’s Grove Citrus and Produce, has seen a lot of change at the Sarasota Farmers Market.

She’s been a part of the market for 18 years. In that time, she’s seen the market relocate from and move back to its current location on Lemon Avenue. She’s seen the ownership change hands.

And despite all that change, the market has persisted as a leading attraction in downtown Sarasota on Saturday mornings.

There’s one consistent throughline that has allowed the market to succeed even during times of uncertainty, she said.

Which is why she said it’s a good idea to relocate a segment of the market from State Street to First Street to avoid the effects of construction.

struction is going on — and that the move should only take place if it’s deemed necessary in the future.

Peter Burkard, a market board member, suggested the organization could make preparations as if it intended to move. His produce stand is located south of Main Street, and he’s already spoken with Pagano about where he would be stationed if the market moved to First Street. He suggested other vendors could do the same, and if the conditions warranted it, the market could swiftly relocate.

“If it doesn’t get bad enough — and clearly the merchants are willing to bend over backwards to keep it from getting that bad — then we don’t have to,” he said.

Those in attendance expressed sympathy for State Street merchants in the wake of a potential relocation, but several speakers said the market needed to prioritize its own well-being.

Terry Hart, another board member, highlighted the amount of money vendors had invested into the market since they assumed control of the event in 2009.

He said the potential negative side effects of construction — including the risk of debris falling from the building site — would jeopardize the work the vendors have put in. He said the board needed to act in the best interest

After Tuesday’s meeting, the market board still hadn’t made a final decision on a move. Deputy City Manager Marlon Brown said the city did not have an opinion regarding whether the market should stay, but he implored the board to take more time before confirming its plans.

“There’s nothing happening immediately that should be a concern to any vendors,” Brown said. “There’s no crane going up in May, June or July.”

Merchants on State Street are searching for a way to accommodate the market in its current location, a plea they brought to Tuesday’s meeting. Pagano remained unconvinced of the market’s ability to function effectively during construction of The Mark, an 11-story condo at 1400 State St., citing safety and logistical concerns.

“We’re not looking to move to First Street for the rest of our lives,” Pagano said. “We’re looking to move until construction gets taken care of and we can get back there.”

But some vendors were receptive to a pitch from Wayne Ruben, owner of the commercial property in the ground floor of the State Street garage. Ruben asked the market to wait to see if its needs could be addressed while con-

PARK PLACE 7:02 a.m. — 2500 block of Hillview Street Misc. officer: A woman complained about a neighboring homeowner parking multiple vehicles on the street. The woman said another neighboring homeowner also parks his car across the street at the same location, and it blocks traffic both ways. While an officer responded to the complaint, several other residents approached the officer to report the same problem. The road was not blocked when the officer arrived on the scene. The officer spoke to the homeowner in question and informed him about the complaints.

MISTAKES WERE MADE 2:46 a.m. — 0 block of South Tuttle Avenue Trespass: An employee at a convenience store reported a theft in progress. She said she saw a man put malt liquor into his pocket and walk past the register without paying.

She tried to stop the man as he walked out the door. A customer tried to help the employee, and the two were

Another customer saw the scene, and thought the customer helping the employee was the individual committing the crime. The second customer punched the first customer in the face.

He said he was also intervening to help the employee, and he thought he was making a citizen’s arrest on the first customer. The actual

suspect fled the area, but an officer found him nearby. The officer told the suspect he was not welcome on the property anymore. The customer who got punched declined treatment and did not wish to prosecute the customer who punched him.

A woman said the security for her apartment complex had cut her phone lines. She said she was unable to make any calls because the phone indicated the line was in use. An officer told her the problem was likely with her phone service. The officer spoke with the security employee, who said he had not been to her apartment and did not know why her phones were not working.

Campaign Against Summer Hunger kicks off fourth year

It was March 17 — St. Patrick’s Day, a big day for businesses on St. Armands Circle — and a film crew descended on the high-end shopping district to grab footage for a new TNT dramedy.

Although the crew got positive receptions from other local locations used for filming, it wasn’t a laughing matter for St. Armands merchants. At a March 21 meeting of the St. Armands Business Improvement District, St. Armands Circle leaders shared frustration with the intrusion on a Friday in the height of season.

“It was extraordinarily disruptive,” said Michael Valentino, a BID board member and owner of Island Pursuit.

In addition to generating some complaints, the filming also raised questions about the special event regulations on St. Armands Circle. In 2014, the City Commission approved special rules for St. Armands Circle Park, restricting events during peak season.

Merchants asked for those regulations because they didn’t want any distractions during the busiest time of the year. But the restriction didn’t prevent the film crew from getting a permit to use public space on the Circle.

ll Faiths Food Bank CEO Sandra Frank painted a poignant picture of child hunger on March 29 during the Campaign Against Summer Hunger Kick Off Breakfast.

“When you see children on the school bus, on the soccer field, hitting a baseball, one out of every two of those children are hungry,” Frank said.

Representatives from dozens of community organizations gathered at Michael’s On East to launch the fourth annual Campaign Against Summer Hunger to mitigate the effects of food insecurity after school dismisses for the summer.

All Faiths Food Bank estimates there are 40,000 children in Sarasota and DeSoto counties and their younger siblings who won’t have a reliable source of enough food this summer.

Campaign advertisements throughout the Michael’s On East ballroom reminded community partners “hunger doesn’t take a summer vacation.” However, the resources available to children suffering from food insecurity do.

City staff said the procedure for getting permission to film on public property is relatively easy.

The city and the Sarasota County Film & Entertainment Office work together with the crew to make sure the necessary permitting and insurance is in place. As long as there isn’t a high-profile effect — gunfire or pyrotechnics — approval is mostly a formality.

“There really isn’t any requirement to notify folks in the area,” said Toni Welicki, an employee in the city’s special events office.

But that doesn’t mean film crews ignore residents and businesses. The filming in question was for the upcoming TNT series “Claws,” which focuses on employees at a fictional Manatee County salon. Jeanne Corcoran, director of the film office, said production coordinators made sure businesses were aware the filming would be taking place.

“I’ve gotten a lot of very positive feedback from the locations they did use,” Corcoran said.

And Deputy City Manager Marlon Brown organized a meeting before the shoot to make sure the crew could coordinate effectively with Circle leaders.

“At the end of the meeting, it was all love and kisses,” Brown said.

Still, St. Armands officials expressed a desire to discuss the filming policy with the city to see if restrictions could be established during season.

Making hay Sarasota High freshman overcomes fear of riding horses to discover talent.

ianna Russ was scared to get back on the horse — literally.

She had been thrown off a quarter horse after trying her hand at barrel racing, where riders direct horses in a cloverleaf pattern around barrels in the fastest time possible. After that, the young rider (she was 6 at the time) feared the larger equine, and was in search of a smaller creature to train.

That’s when Russ, now a Sarasota High freshman, found miniature horses, which are just like regular horses but 38 inches tall or less, according to the American Miniature Horse Registry. It was at a 2013 summer camp at Fallen Pine farm. They were just the right size for Russ, she said. She no longer felt fear when climbing on top of the animal. She felt more in control. She felt safe. Even if she fell, the ground was only a few forgiving feet away.

She started slowly with weekly practices covering showmanship, jumping, carting, obstacle- and halter-class events, among others. After a while, Russ began showing horses again, leasing them for competitions. This time, she was confident, and she showed natural talent. She began entering and winning local competitions, accruing points that would allow her to qualify for the American Miniature Horse Registry Nationals.

Her mother, Stephanie Russ, who used to ride quarter horses, decided to buy her daughter a miniature horse of her own. She bought one online from a woman in Oklahoma whom she had become friends with over time, so she knew she was getting a good horse.

It played out like a scene in a movie. Russ knew the horse, named Bug Hill Farms Unmistakably Buckaroo, or Bogey for short, was coming. She counted down the months, then weeks, then days. On arrival day, Russ put on her fanciest gear and headed out to a family friend’s farm, where Bogey was being delivered. He was waiting for Russ at the gate of a pasture when she arrived.

“I went in there and he put his neck around me, hugged me,” Russ said. “I loved him. I hated leasing horses and having to put them back. I was like, ‘Oh, he can live in my house now!’ I could wake up and eat breakfast with him, which I did. I sat in the stall with him and just ate.”

That was the catalyst for Russ’ career. Having finally reached her desired point total, she qualified for the 2014 Nationals in Tulsa, Okla., and captured the National Reserve Championship in the 8-12 division of both showman-

ship and hunter, a jumping event, and placed in the top 10 in 10 other events, including halter class, roadster and versatility. In 2015, she repeated as National Reserve Champion for her age group.

There would be no three-peat.

Russ was unable to attend the 2016 championship for personal reasons, and while she hopes to return for the 2017 championship in September, it is no sure thing. Stephanie Russ estimated costs to attend the championship with just one horse to be around $8,000.

The younger Russ has added another horse to her stable since the 2015 championship, this one named Silver Meadows Jets of Fire, or just Fire.

Fire is more difficult to train than the calm and collected Bogey was, Russ said.

Fire bites sometimes, and is generally a bit cranky. Russ admits

to having a love-hate relationship with the horse she sometimes calls “The Toddler” behind his back. But with Bogey retired from competition, Russ is determined to make it work.

She has won a few local events with Fire, but never a national championship. That is on the short list of her future goals.

In the meantime, the pair's relationship is getting better.

They took first place March 18 in the Sarasota County Fair. Not among Russ' goals: obtaining a scholarship.

Colleges do not give those out for miniature horse success, though some do for quarter horses, Stephanie Russ said. That does not bother Russ too much. She is not in the sport for extrinsic rewards.

“It is just what I do,” Russ said.

“It is what I love.”

Stephanie Russ said she has seen her daughter’s self-esteem go from “zero to 60” since starting to show miniature horses.

Being the center of attention for those few minutes provides a confidence boost, as does winning.

The most difficult part of the sport is keeping up relationships with the horses and teaching them to cooperate, she said. The key is to stay positive. Talk to them. Work on voice commands.

Eventually, their comfort level will rise.

With her newfound confidence, and having conquered her fear of riding, Russ said there is a possibility of her trying quarter horses again one day.

For now, she is perfectly content with where she is. After all, there is nothing miniature about what she has accomplished with her equine friends.

When did you start running?

I started in fourth grade, but I took a lot of time off and started again in seventh grade.

Did you play any other sports growing up?

I played badminton, but that was only for a short time. I played a little bit of soccer when I was really young. I did basketball.

What is the appeal of running to you?

It’s that adrenaline you do not really get anywhere else, other than taking a chemistry test (laughs).

It releases a lot of pent-up emotion I have in the classroom.

Do you have any personal goals for yourself?

Yeah, I want to hit an 11 (seconds) in the 100 (meter race), which I have not been able to do yet, but I have been really close. I’m excited, hopefully next meet I will hit it.

What is the best piece of advice you have been given?

One time we were practicing starts, and the coaches said, “Run like you have low self-esteem.”

Talent of local stars on display in All-Star basketball games

I

have now covered a full season of high school basketball in Sarasota. I know there is talent here, in terms of scoring and playing tight defense.

The second-annual SarasotaManatee Boys and Girls AllStar games, played March 18 at Sarasota High, proved me right in both categories — though not at the same time.

The first half of the girls game was full of tight defense — players did not want to take too many shots themselves, opting to pass to teammates instead. There was some rust to shake off at first, too. Most of the Sarasota County players had not played a competitive game in more than a month, because no area girls teams went too deep into the playoffs. The second half was fun to watch, especially Booker’s Cellexia Foster, who simply popped through Manatee County’s defense. Her efforts made for an intense game throughout, but ultimately Foster could not get enough scoring support from her teammates, and Manatee County pulled away to win 77-67.

The boys game went the opposite direction. Ninety-five percent of the game was played with lackadaisical defense, and that is putting it mildly. Players were able to get off any shot they wanted, more or less. They took full advantage, opting to play “hero ball” on most open

possessions, even throwing up some shots under the rare case of defensive coverage, just because they could. It was not always the most efficient offense, but it made for an extremely fast pace, which is always fun. It is not basketball at its most refined,

but it does allow the true explosive talent of its stars to shine.

Two players in particular shone even brighter than the rest. Riverview senior Brion Whitley scored 44 points and was named the game’s Most Outstanding Player. He scored

from all over the place: nailing three-pointers, converting ‘And-1’ opportunities and even slamming home a vicious alleyoop from Rams teammate AJ Caldwell that brought the crowd to its feet. Whitley is committed to North Carolina-Wilmington, and said on Twitter recently that he will honor that commitment despite the loss of UNC-W coach Kevin Keatts to NC State.

His motivation for playing so aggressively was simple: He refuses to lose.

“I always come in trying to win it,” Whitley said. “I do not like losing. I never like losing. A coach once told me, ‘Any game you play anywhere, play it as hard as you can. Even if everyone is playing around, you go as hard as you can.’ That is what I wanted to do out here today, get good shots up.

“I’m a competitor, so I like if someone’s up in me, playing hard. But it is fun.”

The other standout performer was Booker senior Eunique Arnold. He racked up 26 points, but a lot of those came in the final few minutes with Sarasota County trying to mount a comeback. He put the team on his back and, alongside Whitley, led them to victory, including getting the go-ahead steal and dunk with less than 10 seconds to go in the game. Sarasota County would win 120-118.

Unlike Whitley, Arnold does not as of this writing have a college commitment. This game tape should help his case when college scouts throw on the film.

His scoring ability is for real.

I’d be remiss to not mention the reason for the two games existing. They benefit the Kyle Jutras Scholarship Foundation, which assists and gives scholarships to graduating seniors in Sarasota, Manatee and Charlotte counties. Jutras was a first-year teacher when he was diagnosed in 2014 with a rare form of cancer. He died that year.

Rob Jutras, the father of the foundation’s namesake, hinted at the game he was unsure if there would be a third iteration of the All-Star games, but later clarified that he is planning on continuing the series into the future and making it the primary fundraising event for the foundation.

I, for one, hope that is true.

When money is raised for a great cause, and players have the opportunity to showcase themselves, it’s a win-win for everybody involved.

F

or 40 years, former Sarasota County Public Schools S u p e r i n te n d e n t L o r i White’s business was to teach the children well.

Now an endowment fund bearing her name will work to help other teachers do the same.

White, 62, retired from the district in February. She had been superintendent since 2008.

But she’ll be the first to tell you being an educator is rarely easy.

“It has to be something that you’re passionate about and you love first and foremost, because the work is hard,” White said.

But she would also be the first to tell you the work is rewarding — a lesson White learned firsthand.

“I think the best times of my life were when I was actually teaching students,” White said.

She taught kindergarten through fifth grade students with special needs at Ashton Elementary School.

“These were students that had some severe learning and emotional issues,” White said.

But even then, White believed that despite the challenge of the job, every student deserves to have their potential nurtured.

She remembers one student who thanked White by requesting a song on the radio.

She doesn’t remember the

name of the song or the artist, just a handful of lyrics — “put you on a pedestal.” The student said it reflected the way White treated her in the classroom.

It’s a moment that has stayed with White, and a testament to a truth that defined her service to Sarasota students.

“You don’t think you are making a difference and then the students show that you are,” White said. “We always have to be committed to finding the keys to making a difference to all students.”

HONORING A LEGACY

As White’s tenure as superintendent was coming a close, Education Foundation of Sarasota County CEO Jennifer Vigne had a hunch.

“I think that we live in a world that when solid leadership is in place, no one really recognizes or values that,” Vigne said. “As soon as you are absent from leadership, you realize how important that is.”

She thought community members and White’s colleagues would want a way to honor her leadership and continue her legacy — and she was right.

“She led with a steady hand, quiet confidence and a very gracious ability to collaborate with

the community at large,” Vigne said. “We just felt that there would be a place to honor and recognize Lori for simply being Lori.”

And thus was born the Lori White Endowment Fund.

Fundraising for the endowment exceeded its goal of $150,000, which it wanted to raise by March 31. It hit that mark on March 24, which triggered a capping grant of $50,000 from the Charles and Margery Barancik Foundation. As of March 28, the endowment fund stood at $201,130.

Although she carries with her a level of name recognition because she was superintendent of education, she never sought the limelight.

“I am uncomfortable with the spotlight even though I have had to suffer through that for the past few years, because it’s not about me and it has never been about me,” White said.

But in this case, White reluctantly accepted the recognition in hopes of accomplishing an end she said is more important than her comfort. The fund will offer Sarasota County educators extended learning opportunities, which White says is an indispensable resource to continue student excellence.

“The magic happens in the classroom, so the more we can support our classroom teachers the better the results are,” White said.

Vigne hopes the endowment will remain active, a living legacy of White’s 40 years of service.

“It all starts with the investment of educating our students,” Vigne said.

hile beachgoers settled in for a day of relaxation March 25 on Lido Beach, another, more active group gathered at the pavilion.

Dressed in neon-colored shirts and carrying trash bags and buckets, city of Sarasota staff scattered along the coast to pick up trash. The project was one of several projects held around Sarasota County as part of the Keep Sarasota County Beautiful cleanup initiative.

RC Car Open races into second year

T

here was only one rule on March 25 at Suncoast Science Center’s Faulhaber Fab Lab: Have fun.

More than 200 teams of middle and high schoolers gathered at the Fab Lab to test their racing skills at the second annual RC Car Open.

Teams first tried their hand at blindfolded competition before moving to the obstacle course. The driver was blindfolded and sat in chair facing away from the course while a teammate directed them through the doublehelix shaped course.

Not every team successfully navigated the course, but even those that didn’t made sure to follow the primary rule of the race — have fun.

Mayors’ Feed the Hungry celebrates 30 years

ommunity leaders and philanthropic supporters came together March 22 to celebrate the 30th anniversary of the Mayors’ Feed the Hungry Program.

Since it was founded by former Sarasota Mayor Fredd Atkins in 1987, the organization has collected and distributed more than 200 tons of food and given more than $2 million in food gift cards to hungry residents of Sarasota and Manatee counties.

The anniversary event began with opening remarks from Master of Ceremonies Scott Dennis of ABC-7 News and Mayors’ Feed the Hungry Chairman Joel Swallow, a prayer

and blessing from Pastor Dan Minor and Rabbi Howard Simon and a performance by singer Sheaquess Mapps and keyboardist Sheldon Graham.

Guests then enjoyed their Sonny’s BBQ lunch — with dessert provided by Der Dutchman Restaurant — before perusing the silent auction table, which included items ranging from a jersey autographed by Tampa Bay Lightning player Anton Stralman to a two-night stay at The Ritz-Carlton, Sarasota.

After lunch, guests enjoyed another performance by Mapps before listening to keynote speaker Manatee County Sheriff Rick Wells.
