“Ocean Properties has decided

to go forward as rapidly as possible,” Patterson told the Longboat Observer. “We’re hoping for commencement of construction in May 2013. That’s the end result we have to get to.”

Film could put spotlight on Key Writer/director Michael Maren hopes to begin filming ‘A Short History of Decay,’ an independent film that features a fictional Longboat couple and their son, this fall.

Bob and Sandy Fisher live in a condominium on Longboat Key. Their son, Nathan, is a Brooklyn, N.Y., hipster/writer with no “real” job whose girlfriend, who works as a paralegal but has just published a book, dumped him. He ventured to the Key to be with his parents

They may sound like your nextdoor neighbors, but the Fishers don’t live in your condominium.

They’re characters in the independent film, “A Short History of Decay,” that is both set on and will most likely be filmed on the Key. According to Michael Maren, who

wrote and is directing the film, Nathan Fisher gets a call early on in the film that his father has had a stroke.

His mother, in the meantime, is stricken with early-stage Alzheimer’s

“For him, it’s a learning process,” Maren said. “It’s a middle-age, coming-ofage story.”

“It’s a very warm, funny, family dramedy,” said Jeanne Corcoran, director of the Sarasota County Film & Entertainment Office, who estimated that the office has been working with producers for approximately six months to scout locations.

The idea came to Maren in early 2011 when he was visiting his parents, Bill and Bunny Maren, who have visited Beachplace for the past 10 years. After they had gone to bed one night, he let his imagination wander about what it would be like to live with his parents again. He started on the script that night.

The project is Maren’s first feature film.

He is a former journalist who has written for The Village Voice, Newsweek, The Nation, The New Republic, Harper’s, GQ and The New York Times magazine and has spent the last decade as a screenwriter.

In recent months, he and the others involved with the project have scouted locations on the Key and throughout the Sarasota area. They considered Beach-

place for the Fishers’ condominium but found that the units weren’t large enough for all of the camera equipment. They’ve since looked at condominiums with larger units, including The Player’s Club.

Maren originally hoped to film over the summer; his production team held a teleconference with town officials in May. Recently, however, an investor pulled out, and filming has been postponed. Instead, he hopes to begin filming in September if the project obtains the funding it needs to move forward.

The movie has a budget of just $2 million but has attracted commitments from a noteworthy cast, including Robert Forster, who received an Academy Award nomination for his role in the 1997 film “Jackie Brown”; Jacki Weaver, who also was nominated for an Academy Award for her role in the 2010 film “Animal Kingdom”; Johnny Galecki, of CBS’ “The Big Bang Theory”; Kelli Garner, of the recent ABC series “Pan Am”; and America Ferrera, of the former ABC series, “Ugly Betty.”

Maren described the actors’ commitment to the project as “high,” however, with filming pushed back, he will have to determine whether their schedules will allow them to participate after a start date is determined.

According to Corcoran, Longboat Key has recently generated attention from other filmmakers. Currently, producers

of both a musical and drama have expressed interest in filming on the Key, although a confidentiality agreement prohibits her from discussing either project.

This project would be shot entirely on private property in an “under-the-radar” way, according to Corcoran.

“A Short History of Decay” is unique, however, in that Longboat Key is written into the script. It would feature several local businesses and attractions by name, including Old Salty Dog or New Pass Grill & Bait Shop and Mote Marine Aquarium.

(Maren also was hoping to shoot a grocery-store scene inside Longboat Key’s Publix until he found out it was temporarily closed.)

Maren originally hoped to shoot the film in time for the Sundance Film Festival in January. Instead, he hopes to be able to show the film at the Sarasota Film Festival to generate buzz before releasing it.

According to Maren, although the film has a strong independent feel, it also has a sentimental ending.

Nathan, the lead character starts out with an impression about Florida and its large population of senior citizens. But, he comes to a new understanding of his parents and their lives at the end.

“This film is designed, in a way, to be a love letter to the Sarasota and Longboat Key area,” he said.

If plans for the Hilton are approved, the resort would be the first property to receive additional tourism units from a pool of 250 tourism units available Key-wide that were created in 2008 via a referenda vote. The resort submitted an application to the Planning Zoning & Building Department in August 2009 for 85 additional units, however, the application was never deemed complete.

Berger and Patterson met with town officials to discuss plans in March. At the time, they cited improvements to the hospitality industry and the overall economy as key factors in the decision to move forward.

Ocean Properties Ltd. owns 37 properties in Florida and more than 100 in the United States and Canada. Locally, in addition to the Longboat Key Hilton, it owns the Lido Beach Resort and the Holiday Inn Lido Key. The Longboat Key Hilton was first built in 1972 and currently has 102 rooms.

Proposed overlay: end of discussion?

The clock will be ticking when the Longboat Key Town Commission discusses amendments to the town’s Comprehensive Plan that would allow for a Whitney Beach overlay in a special meeting at 2 p.m. Thursday, June 21.

That’s because the process of amending the Comp Plan began last summer with the Planning & Zoning Board making recommendations that were then sent to the commission for two hearings and then transmitted to state and local agencies for review. The state proposed the changes as an ordinance Dec. 28, which began a six-month clock for the changes.

They went back to P&Z, then back to the commission twice and will continue once more June 21 before the review process expires on June 28.

The amendment would likely have to go through the entire transmittal and adoption process as a new amendment if not adopted by the deadline.

Although the commission took out language allowing for heights of up to 55 feet at its meeting two weeks ago, some Longbeach Village residents still have concerns and believe the commission should hold off.

Village resident Craig Walters sees a lack of clarity in the overlay language.

Acting Village Association President Michael Drake believes that the overlay could prevent the “Village in the Park” concept developed by Walters and other residents from ever moving forward and described the overlay as “putting the cart before the horse” without determining the best use for the property.

Rich Juliani, co-owner of Whitney Beach Plaza, said that establishment of an overlay wouldn’t affect immediate plans for renovations of the plaza but could impact the property’s development in the long term if he chose to expand it.

Town, FDOT to talk crosswalks The liability of the town and other agencies in a recent fatality is unclear, but they’ll talk about ways to improve GMD safety at an upcoming workshop.

The fatal pedestrian crash that occurred in January on Gulf of Mexico Drive was tragic, but also rare: It was the first fatality to occur on the 12-mile stretch since April 2005.

But the death of Jo Schatterman, 73, who was struck by a sport utility vehicle Jan. 27 around the 2200 block of Gulf of Mexico Drive and died at the scene, has reignited a discussion about improving the road’s safety for pedestrians and bicyclists.

Florida Department of Transportation representatives will attend the 2 p.m. Thursday, June 21 Longboat Key Town Commission workshop to discuss with town officials the feasibility of installing additional crosswalks on Gulf of Mexico Drive, along with other options for improving safety.

Currently, Gulf of Mexico Drive has just two officially designated crosswalks, located in the 200 block near Longboat Club Road and at the trafficsignal intersection with Bay Isles Parkway, near Publix and CVS, in addition to a pedestrian-crossing tunnel in the 2100 block that was built by Arvida. The Bay Isles crosswalk is approximately a half-mile away from the location where Schatterman was struck.

Sarasota police determined that the crash occurred just after dusk, when Schatterman and her sister, Myra Sandler, returned on a trolley from St.

Armands Circle. They attempted to cross the road but, because of heavy traffic, waited until the left side of the road was clear, then walked into the middle lane and waited until they thought they could cross the rest of the road. Schatterman was struck by an SUV driven by Petar Sibinkic, of Sarasota. A witness told police that the area was “very dark” at the time of the crash.

Police determined Schatterman to be at fault for stepping into the path of the vehicle; Sibinkic was not charged in the crash.

The town received a notice in March from attorney Gregg Silverstein stating that the victim’s husband, Thomas Schatterman, intended to seek damages for negligence against the town, Sarasota County and Florida Department of Transportation. The notice alleged that the area where Schatterman was struck was poorly lighted and had no crosswalk despite having a bus stop on the east side of the road.

Still, it appears unlikely that placing crosswalks at each bus stop would be a possibility.

In a May 8 memorandum about the upcoming workshop discussion, Public Works Director Juan Florensa wrote that it makes sense to install crosswalks at or near bus stops, but added a point for consideration: “ … there are 46 bus stops along the

northbound lanes of Gulf of Mexico Drive and 43 southbound. How many of these locations could be marked as crosswalks? Additionally, there are other pedestrian crossing generators throughout the town, such as beach accesses and tourism resorts whose facilities are located on both sides of Gulf of Mexico Drive.”

FDOT owns and holds jurisdiction over Gulf of Mexico Drive and would have to agree to the installation of crosswalks or other changes to the road.

An April 30 status report from Gallagher Bassett Services Inc., which handles the town’s claims, described the town’s liability in the crash as “doubtful.”

According to the report, the town isn’t responsible for lighting or crosswalks in the area and doesn’t run the bus/trolley system. Sarasota and Manatee counties operate the trolley system that Schatterman used just before the fatal crash.

Silverstein told the Longboat Observer that his investigation of the case is ongoing and that he hasn’t decided whether to pursue damages against the town.

Florida statutes require six months’ notice before filing a claim for wrongful death, meaning that September is the earliest point at which a suit could be filed.

The statute of limitations for filing a wrongful death suit is two years.

ZBA refuses to ‘sign off’ on CVS request CVS just wants to be seen.

But the Zoning Board of Adjustment didn’t seem to think that would be a problem — even without a second wall sign. The board voted unanimously at its Thursday, June 14 meeting to deny a variance request from the drug-store chain that would have allowed it to place a second 32-square-foot wall sign, facing Bay Isles Parkway, at its new store.

The application for the variance described the site’s lack of visibility: “The trees and shrubbery associated with the site create a visual blockage resulting in site identification hardship. Site identification is of principle importance for this CVS location because of the seasonal population and year-round tourism.”

Patricia Ortiz, of West Central Florida Permits, spoke on behalf of CVS and said that the drug store would get space on a 42-square-foot freestanding multi-tenant sign. But that sign will bear the signature green color of Publix, the Avenue of the Flowers property owner and a competing business that sells many of the same products as CVS. But Town Planner Steve Schield told the board that few variances have been granted to allow departures from the sign code. The only instances Shield recalled involved historic signs for the Colony Beach & Tennis Resort and the former Buccaneer Inn, with the exception of one case in which a height variance was granted due to a conflict with a nearby com-

Schield also said that neither Publix nor CVS would be significantly visible from Gulf of Mexico Drive. Both stores will be more visible from Bay Isles Parkway, he said.

Former Mayor George Spoll, who spoke as vice president of the Bay Isles Association, objected to the place-

ment of the sign, describing the low-impact concept for the shopping center created by its original developer, Arvida.

“The CVS, to the community that I live in, is in your face,” he said.

Board members weren’t convinced that the extra sign was necessary.

“I’m persuaded by the staff report and not persuaded that the signage would significantly enhance the business

potential for CVS,” board member Lee Riley said.

“I think you can find the CVS almost blindfolded,” member Thomas Bijou said.

Riley made a motion to deny the variance request, which passed 4-0. Board member Gaele Barthold was not present at the meeting.

CVS is scheduled to open its new store in September and demolish the existing store, which remains open, in October.

Board weeds through hedge issues The Planning & Zoning Board found that issues involving hedge-height regulations were too complicated to resolve during Tuesday’s meeting.

Trim a stalk on a bamboo plant, and the stalk will stop growing taller.

Cut off discussion about Longboat Key side-yard hedges, and it will sprout back up again. And again. And again.

This time, the discussion took root at the Tuesday, June 19 Longboat Key Planning & Zoning Board meeting. The board voted against a proposed ordinance that would have allowed for the selective enforcement of maximum hedge heights in side yards where waterfront views are impacted.

Board members found that the issues involved in planting and maintaining view rights were too complicated to resolve during the meeting.

The ongoing issues stem, in part, from a town requirement that 75% of landscape areas for condominiums and 50% of single-family homes be planted with trees and shrubs.

The town eliminated its 6-foot height restriction on side-yard hedges in 2008, but continued to enforce 3-foot height limits for waterfront yards.

The issue most recently planted itself, once again, at Longboat Key Town Hall, in March, when Sleepy Lagoon resident Morris Kertzer attended a commission workshop to voice concerns about the height of his neighbor’s 12-foot bamboo plant, which wasn’t regulated by the town because it is considered a hedge.

Bamboo can be aggressive and spread quickly along a property, which is why town staff doesn’t recommend planting it when it could impact neighboring properties.

The commission directed town staff to research the issue further.

The next month, three Marina Bay residents went before the commission to say a 35-to-40-foot shrub between their community and Harbour Oaks is blocking their views.

Town staff proposed limiting hedge heights to 6 feet in portions of side yards involving two properties with different waterfront views.

For example, if one home were located 40 feet from the waterfront and an adjacent home were located 50 feet from the waterfront, heights would be limited in the 10 feet closest to the water for the more landward home to avoid interference with neighboring views.

The ordinance didn’t address the thorny issue of bamboo as a side-yard plant.

Board member Leonard Garner said that there were too many conflicting areas and issues that needed to be address before making a motion to deny passage of the ordinance.

In other news …

The Longboat Key Planning & Zoning Board voted unanimously at its Tuesday, June 19 meeting to approve a site-plan amendment to allow Dry Dock Waterfront Grill owner Eric Hammersand to construct a 1,107-square-foot addition to the restaurant’s existing second-floor dining area.

The plan would reconfigure, without increasing, the restaurant’s existing seating, allowing for enhanced waterfront views.

The Longboat Key Town Commission will hold a special meeting at 2 p.m. Friday, June 29 to vote on the site-plan amendment.

+ Bullock contract on workshop agenda The Longboat Key Town Commission will discuss a more permanent contract with Town Manager David Bullock during its 2 p.m. Thursday, June 21 regular workshop.

Town Attorney David Persson wrote, in a June 13 letter to commissioners, that Bullock has suggested a three-year contract with the potential for two subsequent one-year renewals — an agreement similar to the current contract, which allows the commission the options to renew or not renew. The contract would increase Bullock’s severance pay to 20 weeks’ salary from its current amount of 30 days’ pay if terminated without cause.

Persson wrote that he has received other suggestions from individual discussions with commissioners, including a three-year contract with a three-year renewal and a provision allowing the town manager a cost-of-living increase if other town employees receive a cost-of-living increase.

Bullock’s current contract with the town expires Sept. 15.

He receives an annual salary of $180,000 and retirement contribution of 17.8% of his salary.

Hurricane season runs June through November. But, the time to act is when it is still sunny, according to speakers at the Public Outreach meeting held Friday, June 15, at Longboat Key Town Hall. Police Department, Fire Department and Public Works employees talked about the important issue and how to be prepared.

Public Works

Public Works Director Juan J. Florensa stressed patience. Public Works will be hard at work after a hurricane hits, but it might take anywhere from days to weeks before the island is inhabitable following an emergency.

Florensa suggests that singlefamily home owners turn off their water before evacuation.

He also suggests placing any important documents left behind due to an evacuation in the dishwasher, to keep them safe.

Fire Department

Fire Chief Paul Dezzi had a few simple suggestions on how to get through another hurricane season: “Be prepared,” “stay informed” and “leave in an evacuation.”

He also discussed people with special needs (PSN): This person has a physical or mental condition or limitation; might need help with daily living activities; might be dependent on medications or medical treatment; is bedridden; or may need transportation because they may live alone. Those registered will receive assistance in getting off the island. To register a PSN in Manatee County, call 749-3500; for Sarasota County, call 861-5000.

Dezzi suggests arranging ahead of time a place to stay: with friends, at a hotel or a shelter, as a last resort. Be prepared that in case of an evacuation, hotels can fill up quickly.

Dezzi stresses the importance of leaving early.

Police Department

Acting Police Chief Pete A. Cumming discussed what residents of Longboat Key can expect from their police department in the case of a major storm. The Police Department is in charge of evacuation, security and re-entry. The officers work in 12-hour shifts patrolling the Key and will decide when it is safe to re-enter.

Cumming discussed the reentry policy. Re-entry and location points will be announced and found on the town’s website, longboatkey.org, in case of an emergency. In order to re-enter the island, one must have proper identification that will confirm you are an island resident. This

The Longboat Island Chapel has been hosting guest speakers, as the Pastoral Search Committee begins its search.

Longboat Island Chapel may be in transition, but it has continued to offer Sunday morning services to its members.

Since the resignation of the Rev. Kenneth Gill, Friday, Jan. 27, the congregation has been hearing guest ministers each Sunday morning.

“We’ve had some very interesting ministers come in and talk to us, and we expect quite a few more,” says Pat Joyner, co-chairwoman of the pastoral search committee.

The Rev. Charlie Shook, a retired minister and member of the Longboat Island Chapel, has led some of the Sunday services since Gill’s departure.

“He has given us some continuity, along with Katherine Alexandra, who is the pianist/ organist,” says Pat Joyner.

Guest speakers are determined by the worship committee, and some of them could, potentially, interview for the open position. But the chapel hasn’t started the interview process and is still looking at a variety of options.

The position hasn’t been announced publicly, which will be the first step. The process to select the right person is openended, and there may even be

an interim minister in place first. In late February, the Pastoral Search Committee was formed and is made up of nine individuals who are involved in the church, as chosen by the board.

On Feb. 4, the Rev. Donald H. Ashmall, council minister of the International Council of Community Churches, the umbrella organization for the church, talked to the congregation about how to heal and how to proceed.

Ashmall gave the congregation a manual, called the Pastoral Leadership Guide, that it is following almost exactly.

“One of the first things we did was send out a questionnaire as to what the congregation wanted, and we got a pretty good response,” says Hugh Joyner, co-chairman of the Pastoral Search Committee.

The questionnaire evaluated what the congregation sees as the most important attributes of a future minister. The response suggested that the congregation values a person who will deliver a high-quality sermon each week. Also ranking high on the list were qualities such as leadership and inspiration.

Make a decision

It’s good the Longboat Key Town Commission appears ready to take away the “interim” from Interim Town Manager David Bullock’s title. Offering him a three-year contract is the right move for everyone involved.

Indeed, it didn’t take Bullock long to show his bosses on the commission, as well as show Longboat Key residents and businesses, that he is the right candidate for the job.

We hope for everyone’s sake the commission will craft the contract and — how should we say this politely? — make a decision.

Don’t discuss it anymore. Hire Bullock and be done with it.

That would be a big step for this commission — making a decision.

It’s not our intent to be critical or hypercritical of our current sitting commissioners.

After years of observing one succeeding class of commissioners after another, we get it: Government moves at a far slower pace than the private-sector business world, and there is good reason for that.

When someone lobs a proposal on the dais to, say, change the town’s rules, if you’re in one of those commission chairs, you want to make sure you take the time to do the right thing. You want to hear what your constituents have to say — pro and con. You want the facts. You want context. And you want to think through the intended and potential unintended consequences before you vote to make it law.

You try your best to follow Edward Deming’s first rule of total quality manufacturing: Do it right the first time.

On that process, give our sitting commissioners an “A.” But there also comes a time: Make a decision.

For a commission that recognized the need for a lot of changes at Town Hall, making decisions appears to be an issue. That came more into focus with last week’s front-page headlines in the Longboat Observer: • “Overlay discussion delayed.” That’s the Whitney Beach Plaza issue.

• “On Hold: Cellular talk comes down to the wire.” The report said the commission is unlikely to address the cell-tower issue until the fall.

Imagine being cell-tower applicant Jim Eatrides. If we were he, we probably would have pulled out of Longboat Key years ago.

Likewise, former Longboat Key Mayor Jeremy Whatmough must be tired of keeping that sign — “No 150 Ft. Cell Tower — in his front yard. It’s probably starting to take root.

Go down the list: Pending decisions • Cell tower • Whitney Beach overlay district • Dogs on the beach • Community center committee • Town-employee pension plans • Zoning-code and comprehensive-plan reviews Completed: • Fate of the former planning, zoning and building director.

• Approving the Publix-Avenue of the Flowers redevelopment.

• Seeking the resignation of former Town Manager Bruce St. Denis and the hiring of Interim Town Manager David Bullock.

All but the hiring of Bullock, mind you, came with a level of drawn-out drama. With

The subject of signage is always a ticklish one on Longboat Key. Ask any business owner what he thinks of the town’s sign codes, and he’s likely to launch into orbit about how overly restrictive and anti-business they are.

In contrast, residents will say one of the features they like about Longboat Key is that Gulf of Mexico Drive doesn’t look like Tamiami Trail. Visitors are in between.

We often have heard them rave about the looks of the Key, but they say they can’t find anything — there’s so little signage.

Well aware of the signage challenges for businesses, the developer of the new CVS and Publix stores, Avenue of the Flowers Acquisition Co. LLC, was hoping members of the Longboat Key Zoning Board of Adjustment just might grant it a hadrship variance and allow two red, lighted CVS signs on its new building.

Town codes only allow one.

As originally proposed, the single, permitted lighted sign would be erected on the store’s east wall — facing the new Publix store. But the developer wanted passersby on Bay Isles Parkway and, to some extent, on Gulf of Mexico Drive to be able to identify the store by having a second sign erected on the wall near the front door, which faces southwest.

Noting such facts as the CVS will have its name on the marquee on Gulf of Mexico Drive; that the town codes require factual proof of a hardship; and town staff recommended denial, the zoning board Publix, for instance, the developer of the project essentially told commissioners last fall that he couldn’t tolerate any more discussions. Make a decision, he told them, or we’re out.

Hey, it’s not easy. With most of the commission’s decisions, there are always losers whose concerns frequently are as valid as those of the winners. It’s difficult to disappoint them.

At the same time, a lack of forthright decision making creates an air of uncertainty.

And uncertainty is costly. Look at what tax uncertainty in Washington does to consumers, business and the economy. Publix held off from making a decision to redevelop while it watched for more than two years to see how the Town Commission would re-

rejected the request. The law clearly is on the side of the zoning board — even though the second sign hardly would have been a nuisance. The law is the law.

Based on the new elevation of the Publix and CVS stores, our bet is most everyone still will be able to find CVS without the second sign.

Here is something else CVS and the developer will find out, just as all Longboat Key businesses have: In spite of how annoying the sign code is, you learn to live with it. It’s detrimental to business, yes, but it is what it is. It’s one of the prices of being on Longboat Key.

We would not profess to be a better decision maker on the issues town commissioners face. But the unfinished to-do list reminds us of the advice that business coaches and military leaders frequently dispense: Make your list of to-do’s; prioritize them. Make decisions the best you can — and be prepared to live with the results. You won’t always be right. But at least you made a decision. That’s what leaders are expected to do.

+ It’s just a sign!

Dear Editor: So, the Zoning Board denied a request by CVS for a second sign on its new store. C’mon, get real! Why the denial? Because a second sign is going to create a bad precedent or be too business-like? Hey, we’re not talking about a strip mall with neon signs; this is a sign, which would help people to locate the store. I have to wonder if there is anyone on the board who has any knowledge of business or any interest at all in preserving the few critical businesses that still struggle to exist on Longboat? It doesn’t seem so.

Unfortunately, this is not an isolated example of Zoning Board activity — its heavy footprint has stomped all over proposed changes to the north end and Whitney Beach, to Harry’s parking lot, to expansion of the Longboat Key Club, to ... and do you remember the ridiculous issue about the “too large” sign at Lynches Pub (which led them to move away from Longboat)?

Suggestion to the Zoning Board: Take a look at social media websites and what they are now saying about the Key. Comments such as “snobby,” “unwelcoming to tourists” and “anti-business” are increasingly common. I love Longboat and defend it as best I can, but I am embarrassed by some of the decisions of so-called town leaders. Not only are your present policies destroying businesses, but you are also destroying the reputation of Longboat Key as a great place to live or visit. Please, folks, maybe you could be a little more welcoming and make it easier for a tourist to know how to find the local grocery store and the local drug store. If you want to promote Longboat Key, that’s a no-brainer.

Smoke but no fire 6:51 p.m. — Off the Key. Fire. A woman reported that she could see and smell smoke coming from the mangroves on Jewfish Key. The woman transported a firefighter to the scene by boat. The fire-rescue marine unit response was canceled in route because no fire was found.

June 7 Locked out?

6:11 p.m. — 4400 block of GMD. Property Found. A man turned in a set of keys that his neighbor found in the condominium parking lot.

June 8 VIP treatment 1:10 a.m. — 4500 block of GMD. Disturbance. A man told police that the banging sound he heard while sleeping and initially thought to be thunder was actually the sound of a man banging on doors and yelling for “Bree” to let him back inside. Police found the 24-year-old man in the garage basement wearing jeans and no shirt, yelling into a sport-utility vehicle and smelling like alcoholic beverages.

The man said that he was trying to get his dog out of the SUV and told police that they were harassing him and that he is a very important person. He threatened to get them fired if the ha-

June 10 Don’t text, drink and drive 12:42 a.m. — 6100 block of GMD. DUI/DWI. Police saw a woman drive her car off of the northbound lane of Gulf of Mexico Drive into a church mailbox and leave the scene.

Police conducted a traffic stop, during which the driver said that she left the scene because she was texting and admitted to consuming pinot grigio and prescription pain medication. The woman, whose blood alcohol content was more than twice the legal limit, was arrested for DUI and leaving the scene of a crash with more than $50 in damages.

Two sides to every story 8:22 p.m. — Off the Key. Firearms.

A group on a center console boat told police that a man on a pontoon boat challenged three of the men on board to a fight, claimed to be a Navy SEAL and told a woman on his boat to retrieve his gun after he became angry about their loud music. The man gave police a different account, saying that he waded over and politely asked them to turn down the music long enough so that he and the woman could finish dinner. He said that a man on the other boat displayed a gun that was concealed in his waistband. Police

found no firearms on the console boat and a glock stored with scuba equipment on the pontoon boat. Police found evidence to charge the man on the pontoon boat with disorderly conduct and both the man and woman with improper exhibition of a firearm.

Police forwarded the cases to the state attorney.

JACK BLACK Longboat Key’s Jack Black proves to be famous for much more than his ‘grate’ barbecue skills.

And close in proximity, as well — his sister lives a few buildings over in Tangerine Bay on Longboat Key. But, turning out good barbecue isn’t Black’s only success. In 1958, he was one of five partners who opened a 1.5-mile track called Atlanta International Raceway (now Atlanta Motor Speedway).

“We got together and built a track south of Atlanta, and it finally grew up to be real big,” he says.

In fact, NASCAR President Mike Helton started his racetrack career doing odd jobs at Black’s speedway, and he eventually became manager of the raceway. In his younger years, Black did both stock-car racing and drag racing.

He did runs at Daytona two different years and qualified at the Atlanta Motor Speedway in the late ’60s.

Around this same time, Black got to know a peanut farmer and race fan by the name of Jimmy Carter who “used to bring peanuts by the bushel” to the speedway, he says.

In 1978, Black was invited to serve ribs at the White House and cooked them in a concrete-block pit he built on the White House’s back lawn.

Doing his part at the speedway, running his barbecue establishments and traveling back-and-forth was time-consuming, but it didn’t faze him.

“I know I was working hard, but it seemed easy,” he says.

Longboat Key resident Jack Black has barbecue in his genes — it wouldn’t be surprising to find that his blood runs thick with barbecue sauce. After all, he did own 17 Old Hickory House restaurants in Atlanta and surrounding areas at one point in the late ’80s. And his friends on Longboat Key can’t seem to get enough of his famous ribs.

Black was named after his grandfather, who created the original recipes for the barbecue sauce, ribs and Brunswick stew that became a staple in his family.

“We would have family reunions when I was a child, and all the cousins, aunts and uncles would come to Georgia, and the day before (the men) would kill a hog, dig a pit and build a big fire of hickory wood,” Black says.

After World War II, Black’s father went commercial with the recipe and opened up a barbecue joint with his savings; Black grew up working at the restaurant, in Birmingham, Ala. “I was serving beer before I could even drink a beer,” he laughs.

When Black was 17, his father helped him open his own restaurant in Atlanta. His sister, Snookie (Black) Hornsby, joined the venture about three years later.

“She was an integral part in the whole operation,” he says. “She’s a great gal and we’ve always been real close.”

In order to shorten the transit between his restaurant locations and the speedway, Black learned to fly a plane.

“I’ve owned and flown seven different airplanes in my life, including a P51 — but that was just a toy,” he says. And that wasn’t his only connection with flying. Eastern Air Lines served his ribs as the in-flight meal back when planes offered more than mini-pretzels.

By 2000, he had sold all but two of his Old Hickory House restaurants and turned his focus to family. Ultimately, Black decided to retire and move to Longboat Key. He worked as an assis-

tant dock master at Marina Jack “just to keep busy.” He and his wife, Phyllis, eventually bought Tow Boat U.S. in 2006 from Assistant to the Town Manager Susan Phillips. The couple has been maintaining the business since.

But ribs are not officially off the menu.

In fact, Black’s ribs are in high demand for the Longboat Key Garden Club, Tangerine Bay residents and at the Blacks’ annual Fourth of July celebration.

“It’s been a great, great life,” Black says. “And the barbecue restaurant has always been my main livelihood.”

OBITUARIES Joseph Giusti

Joseph Giusti, of South Dartmouth, Mass., and Longboat Key, died June 7. He was 97.

Mr. Giusti was born in New Bedford, Mass., and lived all of his life in that community, becoming president and chief executive officer of the Giusti Baking Company, a business established in the early 1900s by his father, Cesare Giusti, and John Giusti. Upon reGiusti tiring, he sold the business to Nissen Bakeries, and Mr. Giusti and his wife, Vera, began their retirement, with many years spent between their homes in South Dartmouth and Longboat Key. Mr. Giusti was a past member and president of the New Bedford Rotary Club. He was a member of the Wamsutta Club, the Allendale Country Club and Longboat Key Club and Resort.

During his career in the baking industry, he was a director of the American Bakers Cooperative.

Mr. Giusti was well-known in his younger years for his athletic abilities on the football field for New Bedford High School and subsequently played for several years for the semiprofessional football team, the Murphy Club.

Mr. Giusti also enjoyed his many years on the golf course.

He was preceded in death by his siblings, Angelina Giusti, Cherubino Giusti, Eleanora Figazolo, Stella Allen and Edward Giusti.

Mr. Giusti is survived by his wife, Vera; daughter, Catherine Potter; son, Paul Giusti; four

grandchildren; one great-granddaughter; and many nieces and nephews.

John Knox Hess

John Knox Hess, of Sarasota and formerly of Ohio, died June 12. He was 93.

Mr. Hess was born Jan. 6, 1919, in Giard, Ohio, to the Rev. Charles Bentley Hess and Zulu Eloise Knox Hess. He attended the College of Wooster, in Ohio, and then seminary at Boston University in preparation for a career following in his father’s footsteps.

He served as associate pastor at EpworthEuclid Church, in Cleveland, then as senior pastor at Garfield Memorial, in Pepper Pike, Ohio; Grace Church, in Coshocton, Ohio; First Church, in Poland, Ohio; and First Church, in Akron, Ohio. Mr. Hess also served as district superintendent of the Mount Vernon District.

Before retiring, he and his wife, Ruth, traveled throughout the country assisting local churches with fundraising campaigns. He and his wife moved in 1981 to Sarasota and became members of the Sarasota First United Methodist Church. They have lived at Plymouth Harbor since 1994.

Mr. Hess was a devoted husband, a natural organizer and administrator and had a good sense of humor.

He is survived by his wife of 69 years, Ruth; daughters, Carol, Cathy, Cinda, Janet and Claire; son, Charles; 17 grandchildren; and 18 great-

grandchildren.

A memorial service was held Tuesday, June 19, at Plymouth Harbor. In lieu of flowers, donations may be made to The First United Methodist Church of Sarasota, 104 S. Pineapple Ave., Sarasota, Fla., 34235, and designated either to the Peace with Justice Program or to the First United Methodist Church Music Program, or to the charitable organization of your choice.

Harry Hmura

Harry Hmura, of Sarasota and formerly of Longboat Key, died June 6. He was 93.

Mr. Hmura was born in Chicago. Mr. Hmura had a long and varied career. After retiring to Longboat Key, he pursued his favorite interest of golf.

He is survived by two sisters; two sons, Jeffrey and Daniel; four grandchildren; one greatgrandson; and a dear friend, Marjorie Harper.

A celebration of life will be held at 6:30 p.m.

June 20, on the Floating Chapel at Ramada Waterfront Inn, 7040 N. Tamiami Trail, Sarasota.

Don Snyder, of Sarasota, died June 5. He was 87.

The Economic and Property Damages (“E&PD”) Settlement Class includes people, businesses, and other entities in the states of Louisiana, Alabama and Mississippi, and certain counties in Texas and Florida, that were harmed by the oil spill.

Longboat Key’s white-sand beaches and picturesque sunsets combine for the perfect romantic setting, often for weddings and vow renewals.

Casa del Mar’s general manager, D.M. Williams, has been performing these rituals a few times a year for more than 25 years.

Florida is one of three states, the others being Maine and South Carolina, where notaries, such as Williams, can perform a marriage ceremony.

Three cousins — Nancy Hadgisaba, John Rissman and Susan Kitzsteiner — brought their spouses for a vacation last week on Longboat Key. “We love Longboat Key!” says Kitzsteiner. “(It has) great weather, beaches, people, food and (it is) so relaxing.”

The families have been vacationing on Longboat Key for many years. The couples stayed at Casa del Mar and took part in the vow-renewal ceremony June 13.

The trip was to celebrate each of the cousins’ late fathers and to celebrate life.

Lining the walls of the Plymouth Harbor mezzanine are 56 photos of animals in their natural habitats, captured at the perfect moments. For instance, on display are a white ibis with a newly caught crab in its bill and Alaskan brown bears during a fight.

The opening of “Wildlife Encounters” was held Tuesday, June 12 and will be featured until Oct. 6. Lou Newman, a veterinary pathologist turned hobby-photographer, snaps photos ranging from Longboat Key swans to African black rhinos — each photo is as impressive as the next.

Co-founder and previous President Rusty Chinnis has taken on the role of chairman of the board and will serve as an ambassador for the organization to help in whatever way “furthers the cause,” Chinnis says.

“I think it’s important to keep the organization vital and that we keep adding new board members and changing the composition of the executive committee,” he says.

Three degrees of bacon This week’s hand features an astonishing defense by West — we’ll get to the winning play by degrees.

E-W did well not to compete to 3 (spades) (that contract is down one if N-S get their Diamond ruff). Instead, E-W are required to defeat South’s 3 (hearts) contract.

Will they? West’s lead is a Spade, which is won in Dummy.

In the first degree, you are Declarer. With that running Diamond suit you have loads of winners, but the danger is that E-W will get five tricks first. You can try for a Club ruff in Dummy, but alert defenders will switch to trumps (being sure to hold up the A (hearts) until the second round). Nonetheless, at trick two, you lead a Club hoping that something good will happen.

In the second degree, you are East trying to thwart Declarer. Dummy’s A (spades) wins the first trick, and a Club is led, won by West’s Jack. West shifts to a trump, and you have a dilemma: • If Declarer has the A (clubs), and West the A (diamonds), then the winning defense is to take the A (hearts) immediately and play another Heart, stopping the Club ruff.

• If Declarer has the A (diamonds) and West the A (clubs), then the winning defense is to duck the first trump, win the next Club, cash A (hearts) and then a third Club.

To bring home the bacon, the defense must go to the third degree. This time, you are West, trying to help East thwart Declarer. It is the same start, but instead of routinely winning the J (clubs) at trick two, you do some thinking. Declarer did not play Clubs like someone holding the K (clubs), so East surely has that card. In that case you can afford to squander the Ace! This brilliant stroke solves East’s dilemma, telling him what he needs to know.

How many Wests would find that truly remarkable play?
