Sarasota County is preparing for residents to ride in style. The county has purchased 125 rainbow-colored swan boats to be delivered this week for use not only among tourists but also for business traveling. The pedal-powered boats will be available at five Sarasota County locations including Bayfront Park on Longboat.

The boats are a part of the Water Wings for Sarasota program designated to alleviate traffic jams. Using the boats is free, but the swipe of a driver’s license is required.

It’s The Dating Game, live from Longboat The Dating Game (Senior Edition) is coming in May to Longboat Key’s Aging in Paradise Resource Center.

Just like the classic TV game show, contestants will question three potential dates from behind a wall. Based on the risque answers, contestants will choose a date for an all-expenses paid night at a Longboat Key restaurant. Would you like to play?

Family decides on coastal spot after daughter picks New College of Florida.

America’s most celebrated freshman-to-be has changed her mind about the college she’ll attend this fall, based largely on lessons learned during her year off after high school and her family’s choice of retirement home.

Malia Obama this week announced she will join the Class of 2021 at New College of Florida as a commuter student instead of attending Harvard. And following her to Southwest Florida: the entire former first family.

Barack and Michelle Obama, Malia’s younger sister Sasha, and Bo and Sunny, the Portuguese water dogs, are house-hunting on Longboat Key, hoping to find that special spot for their golden years while sticking close to their 18-year-old daughter.

Obama was reported to be “blown away” by the Key’s golf, court and watersports options and is said to be enlisting the real estate help of Sir Richard Branson, a fellow lover of parasailing, Jet-Skiing and the founder of the multibillion-dollar Virgin Group and licensed Realtor in Florida.

after a round at the Longboat Key Club’s Harbourside course and a few drinks at the Tavern and Whiskey Bar. “I hear you have a lot of exCEOs around here,’’ Obama said.

“Yeah, OK. Do any of them have the nuclear launch codes? So that was a 3 on Number 5, right?”

The Obamas initially began their search on the south end of the Key, with an eye toward Malia’s morning and afternoon

commutes across Sarasota Bay. They have since broadened their circle to include the entire Key as they consider homesites large enough to include a helipad, from which Malia can be flown to class.

Longboat Key leaders were polite but a bit surprised by the Obamas’ interest in the area.

While honored to be considered by such potentially extraordinary neighbors, more mundane concerns surfaced during a recent

Town Commission meeting.

“He can’t take the helicopter to Publix,’’ said resident Bob Nimby.

“He’s a one-man traffic jam.”

“But maybe he can get the drawbridges to stop opening for nothing,’’ someone else yelled from the back of the commission chambers.

One property the Obamas toured, but have ruled out, is the $19.5 million Ohana home, which has been on the market for years.

Though the rhyme is catchy and hard to resist on a Christmas card when combined with the traditional Hawaiian greeting, “it wouldn’t send the right message to the American people,’’ Obama said through a spokesman.

The spokesman said the family is looking for at least four bedrooms and three baths though is leery of waterfront property, given the possibility of sea-level rise “especially in the next four years.’’

Malia’s decision to take a year off after high school touched off nationwide debate over the wisdom of such a break. The New York Times called the so-called “gap year” a growing and expensive trend, and other critics called it just another case of lazy young people putting off their entrance into the real world.

In her case, Malia’s time off wasn’t all movies and video games. She interned in New York at The Weinstein Co., a movie studio run by Obama supporters Bob and Harvey Weinstein.

Malia said her year off from school taught her a lot about the business world and the importance of staying close to family.

With that, it made sense to enroll at Sarasota’s liberal arts college.

“They had me at ‘liberal,’” she said.

Sasha will finish high school at Sarasota Military Academy, the first member of her family to show an interest in the armed forces.

Big project takes aim at sidewalks, bike lanes Undergrounding contractor said he was told to avoid tying up traffic.

T

he survey teams working around Longboat Key’s neighborhoods are harbingers of bad news for the Key’s pedestrians and cyclists: The Key’s project to bury utility lines will bring with it more than a year of closed sidewalks and bike lanes.

In documents obtained by the Longboat Observer, the town’s general contractor for the longawaited utility undergrounding project has laid out the process by which the work will be done.

Although the completion of the project by the end of 2018 means Longboat Key will be a more picturesque community that will have a higher level of telephone and internet service, the construction for the project means the popular sidewalk and bike lanes along Gulf of Mexico Drive face broad closers.

Piles O’ Dirt LLC, the coordinating contractor for the $50 million project, is planning to relocate the overhead cables directly under pedestrian and cycling stretches along GMD. Reached this week, company officials said it’s possible they might have misunderstood a request passed down from Town Hall, via the utility company that is authorizing the work. But now, unless the town wants to push the work back to 2020, the plan is too far along to reset. Digging will likely begin on both ends of town

by January 2018.

POD president Digg Hier said he was told initially by Florida Power and Light, which is designing the underground conversion, the town was interested in avoiding traffic tie-ups as the work progressed.

Because the overhead cables had to go somewhere, sites immediately alongside the roads made the most sense, Hier said, conceding he made that call on his own, after lunch on a Friday.

“Ohhhh, I see ... now. But it’s not like it’s a road or anything,” he said. “It’s just a sidewalk.”

Pedestrians and cyclists will find the going tough for a while but are advised to begin now planning detours and alternate routes that avoid not only the construction zones, but also uneven ground and plush St. Augustine turf, which can be hard for the unsteady to navigate.

“I think I’ll buy a treadmill,” said Buttonwood Drive resident Russell Sprout as he took a recent stroll along GMD. “That, or I’ll

start walking in the grass now to get used to it.”

Cyclists were particularly incensed, saying they had fought long for their roadside lanes, only to hear they will soon be torn up.

“State of Florida says I’m a vehicle just like a car or truck,” said 87-year-old recumbent bike enthusiast Mildred “Gears” Ryder. “Outta my way Mr. Benz.”

Longboat lands top rank for leisurely travel Slow pace, hardly moving traffic a big selling point, magazine says.

With its ingeniously underbuilt road system and picturesque, out-the-car-window scenery, Longboat Key landed the No. 1 world ranking this week in Stop & Go magazine’s list of “Most Relaxing Places to Get Around.”

The travel publication, known for its dedication to unhurried lifestyles, rolled out the international list as part of February’s annual “Yawn 2017” issue.

Machu-Picchu, with its burros; Venice, Italy, and its famous gondolas; Walt Disney World’s Tomorrowland, featuring the popular Wedway Peoplemover, and Colonial Williamsburg, Va., completed the top 5.

“I see something new every time I’m out here,” said Uber operator Speenround Andropov, gesturing to a nearby street sign while angry text messages about his late arrival blinked across his phone screen. “I believe that osprey nest has a few more, how you say, twigs than last time I drive this way.”

Stop and Go’s editorial board gave Longboat strong marks for its residents’ patience and welltanned left arms, along with the ability of bicyclists to regularly overtake exotic sports cars on Gulf of Mexico Drive.

Editors said the go-ahead difference for the top award was the island’s two, traffic-calming devices built to exacting standards to resemble ordinary drawbridges, which open for no apparent reason.

Waiting travelers often have no choice but to take in the surrounding vistas.

“Sometimes there’s a boat, sometimes, nothing,” said S&G

magazine’s lists editor Pete Stopp.

“They just work.”

While some of the magazine’s other relaxing locations rely on centuries-old methods of moving vacationers from place to place, Stop & Go said Longboat deserved extra consideration for pulling off a serene atmosphere for homeowners, workers and sightseers alike with modern-day transportation needs.

Through the years, local businesses have accommodated the slowed-down pace. Publix on Longboat, for instance, has built in a 20-minute delay in its online-

deli ordering system, with not a single complaint or spoiled order.

While some Longboaters grouse about traffic and others work tirelessly with authorities both on the island and mainland to facilitate a speedier and, admittedly more stressful system, others are either happy with the current state or blissfully unaware of more hectic possibilities elsewhere.

“I bought this car three years ago with ‘cruise control’ as standard equipment,” said Ashley Wilkes VI, a recently retired chief executive officer of CEOs R Us. “Evidently, it works. The wife and I haven’t touched that button or been on a cruise since we brought the damn thing home.

‘It’s a no-density proposal ... for the living’ New Jersey businessman proposes resort-style cemeteries on Longboat.

A New Jersey entrepreneur next week will formally propose a new plan for some of Longboat Key’s hardest-to-redevelop properties, one that he says won’t affect density one single bit.

Above-ground density, that is.

Vito Tomaino, a businessman and developer from Bayonne, is scheduled to appear before the Town Commission on Tuesday to deliver his proposal to bring a “five-star cemetery” to the Key. “This is a no-density proposition,” he said. “For the living, anyways. Hey, Longboat, you ain’t getting any younger.”

On a recent visit to see an ailing relative who has lived on Longboat Key for many years, Tomaino said he read Longboat Observer stories leading up to the recent Colony referendum vote, and it gave him an idea.

doesn’t have much more time on Earth, said she would love to spend as much time as possible (on Longboat),” he said. “I told her, ‘Grandma, you can stay here forever.’ But it’s got to be the right place. Only the best.”

Though Tomaino hasn’t speci-

fied what properties he has in mind, he said the Mote Foundation’s land on Gulf of Mexico Drive, which is already zoned for a commercial use, is a possibility, as is the site of the former Colony Beach & Tennis Resort.

The latter would be a challenge

worth taking on, Tomaino said.

“You gotta think big,” he said.

“No one has ever done a resort cemetery.”

Among the amenities: n A 64-foot high, multilevel mausoleum. “You guys got rules about that height stuff down

here, right? Feet, stories, whatever. We can deal.’’ n A trolley service for visitors, running from St. Armands Circle.

Tomaino said he might consider offers for some kind of partnership with merchants. “Let’s face it, a visit to a grave can only last so long. Then you gotta do something for you, am I right?” n Preferred “slumber” sites that could make use of existing features on the Colony property.

Tomaino said he could envision a premium charge for plots under the tennis courts, for fans of the sport. “Maybe even with your doubles partner.”

The word “cemetery” appears nowhere in town codes, ordinances, rules or the charter.

It’s not immediately clear if city leaders could do anything to stop such a plan from moving ahead.

Or if they’d want to.

A quick survey of shoppers coming and going from the Longboat Key Publix indicated some support for a resort cemetery.

“If it keeps one new person and everything that comes with them from messing up my view of Longboat, I’m all for it,” said resident Iva Gotmine.

The Longboat Key Town Commission has hired a Tallahassee lobbyist to voice the town’s concerns to Florida lawmakers over pending legislation that local officials say could interfere with the town’s plans to bury power

lines and hide from sight other utility equipment.

The legislation — House Bill 687 and Senate Bill 596 — would restrict local governments from regulating or prohibiting the placement of small wireless facilities in public rights of way.

Commission names Charter Review members The committee will recommend changes to the town charter for the consideration of Key voters in 2018.

WHAT HAPPENS NEXT? The Charter Review Commission will meet soon to choose a chair and vicechair. From there, the panel will decide on a schedule for meetings.

Blending newcomers to town governance with experience, commissioners have selected the Charter Review Committee to consider changes to the town’s basic framework.

All seven applicants for the job were accepted by commissioners.

Members of the committee are former vice mayors Dave Brenner and Phill Younger, former commissioners Pat Zunz and Randy Clair, and newcomers to Longboat Key government Bill Cook, Ted Salisbury and Alan Pryor.

The committee will consider refining portions of the town’s charter, which serves as a basic document under which the municipality operates, much like the constitution of a state.

Those changes can be small, like tweaking language or deleting sections already covered by state statutes, or large, such as altering election day or Town Commission term limits or districts.

It’s a process that takes place every 10 years. Ultimately, Longboat Key voters will decide in March 2018 whether the commission’s recommendations will take effect.

Town Manager Dave Bullock said it would be ideal if the committee can finish its work

by October for inclusion on the March 2018 ballot.

Applicants had the opportunity to speak with commissioners about their qualifications and intentions before commissioners made their selections.

Brenner said he would like to explore options for increasing voter turnout, while Clair floated the idea of finding ways to make commission elections more competitive, especially district elections, to encourage public interest.

The three newcomers spoke of how their experience will aid the process.

Salisbury spent three decades in municipal government, including a tenure as city manager of Brantford, Ontario, while Cook discussed his time working in quality control, assisting large companies, like Kraft General Foods, in making decisions.

Pryor has spent 40 years in financial services, noting that he has started companies and served as a chair on various boards.

WHO ARE THEY?

“My work, apart from the managerial aspect, always involved deep considerations of very complex accounting, finance, tax, legal and regulatory issues,” Pryor said.

At Commissioner Irwin Pastor’s recommendation, all seven were approved to serve.

“We’re very fortunate to have seven very highly qualified, experienced people that are willing to serve this community,” Pastor said.

Committee members will be tasked with selecting a chair and vice chair for the group.

Assistant Town Manager Mike Hein said the committee will work out a meeting schedule in the coming weeks, and town staff will be available to support the group.

By way of example, Hein said if the committee considers an alteration to the charter regarding finance, the town’s finance director will be available to advise.

Though Hein was uncertain how soon the process will get started, he said one thing is for certain.

“What’s clear is everybody has great interest in getting this under way,” he said.

fter about a year of deliberations about building height on Longboat Key, the Town Commission is heading toward a vote that would keep the maximum at 65 feet above elevation, which is currently the town’s standard.

At a meeting in February, the Planning and Zoning Board approved an ordinance that would have allowed additional height — up to 80 feet over elevation — for new buildings, as long as buildings were set back 2.5 times the height of the building from Gulf of Mexico Drive. In other words, an 80-foot building would have to be no closer than 200 feet from GMD. But at a workshop last week, the Town Commission rejected that 80-foot recommendation and returned to the 65-foot benchmark. The ordinance will have its first reading and public hearing at the April 3 Town Commission meeting.

“I have never heard a criticism of the 65-foot number,” said Commissioner George Spoll, who also serves as the president of the Federation of Longboat Key Condominiums. “But I’ve heard an incredible amount of pressure on going to 80 feet.”

Spoll’s sentiment was supported by recently re-elected Commissioner Jack Daly, who spoke of hearing the concerns of the public while campaigning. He said voters questioned whether increasing the town’s height limit is necessary.

“I share their concerns,” Daly said.

One of the central issues driving the discussion is a feeling around the Key of avoiding a so-called “canyon effect” of tall buildings close to the town’s main northsouth artery. Throughout the election campaign, during which Unicorp Developments Inc. proposed a revamped Colony Beach & Tennis Resort with taller than existing structures, residents spoke up about building heights and the character of the community.

Former Commissioner Pat Zunz addressed the commission,

stressing the height regulations in question do not include the base heights required by the Federal Emergency Management Agency, adding the actual height can be deceiving.

“In reality, you’re talking about 80 feet and 95 feet,” she said.

“That’s very different.”

Planning, Zoning and Building Director Alaina Ray explained that the first residential level on new construction along GMD must be built about 14 feet above ground because of existing flood laws. The first story cannot house living space, but can be used for parking and storage.

The required height of the first story is based on the property’s relation to the mean high waterline, Ray said, so the necessary height varies depending on what section of the island the property is being built.

Ray confirmed that height regulations, regardless of whether the limit is 65 feet or 80 feet, does not take into account this nonlivable first story.

Though the height limit has been decreased by the commission, Ray said the ordinance will still require buildings be set back 2.5 times the height of the building from GMD. The Planning and Zoning Board’s 80-foot recommendation came as part of the conclusion of about a year of discussions about planned-unit developments, or PUDs, which are designed to encourage redevelopment of old properties through a voluntary zoning process.

The ordinance also includes adding more distance from neighboring properties and providing plans to show no effects on the shadowing from taller buildings, planting vegetation to minimize the “canyon effect” from GMD, and even a determination from the Town Commission that the proposal is “consistent with the character of the surrounding area.”

Ray added that, under the proposed PUD process, developers would be allowed to redevelop buildings up to their existing heights, meaning a building that is 120 feet could be rebuilt to that same height.

However, any additional buildings on the property would need to comply with the 65-foot height limit, Ray said.

WHO IS DEAN CANNON? Dean Cannon, recently employed by the Town of Longboat Key to lobby on its behalf over House Bill 687 and Senate Bill 596, served in the Florida House from 2004-2012, and was Speaker of the House in his last two years. According to his official biography, Cannon’s legislative and executive branch lobbying experience includes representing private clients and local government entities.

The town agreed to pay a flat rate of $20,000 for his service.

At a special meeting of the Town Commission last week, commissioners approved an agreement with lawyer and lobbyist Dean Cannon of the firm Gray Robinson to oppose the proposed legislation as it is being considered in Tallahassee. Cannon was speaker of the Florida House of Representatives from 2010-2012. The town agreed to a flat rate of $20,000.

Town officials are concerned these bills have a good chance of becoming law, said Town Attorney Maggie Mooney-Portale. The Senate approved its version 5-1 in the Governmental Oversight and

Accountability Committee. In the House, the companion bill was recently approved in the Energy and Utilities Subcommittee.

“There’s a very real possibility this may make it to the finish line,” she said.

Mooney-Portale said the town’s “minimum objective” is to have language established in the legislation to allow an exception for the Key, along with towns in similar positions regarding burying utilities.

Town staff hopes to begin construction on the referendumapproved $50 million undergrounding project next year. The plan includes moving communication utilities underground, along with power cables. The project is intended to enhance the community’s safety, appearance and protection from stormrelated outages and recovery from damage.

Assistant Town Manager Mike Hein said should the legislation pass unchanged, wireless companies could choose to place their utilities on poles as appendages, rather than hidden on the inside of the structure, as with a SmartPole.

Hein added that one objective of the local project is to meet telecommunications requirements under the most current technologies, as well as technologies of the future. He said the proposed legislation is attempting to do the same.

“What we’re trying to explain (to the Legislature) is that our system is being designed embracing the very things that the bill is trying to accomplish,” Hein said.

Hein said he understands the intent of the legislation is not to target the Key and other Florida towns in similar positions.

“Our goal is to get the Legislature to understand our unique situation,” Hein said.

In an email to Sen. Greg Steube, Planning and Zoning Board Chairwoman B.J. Bishop requested assistance in creating provisions for such towns as the Key. “The unintended consequences of the legislation can be resolved and we need your help to provide the protection our community needs,” Bishop wrote.

“There’s a very real possibility this may make it to the finish line.”

ALSO OF CONCERN IN TALLAHASSEE Longboat Key has also joined the Florida League of Cities in opposing another pair of bills: House Bill 17 and Senate Bill 1158.

With this legislation, if passed as written, local governments would be barred from regulating businesses, unless they were specifically allowed under state law.

Therefore, local governments would have no control over regulating the placement of certain businesses, such as medical marijuana dispensaries.

Though the town is voicing opposition to the legislation, a lobbyist will not be engaged to oppose it.

At the special meeting on Wednesday, Town Manager Dave Bullock was frank in his summary of why the town opposes this legislation.

“It is strongly opposed by every local government representative in Florida on the basis that it makes no sense,” Bullock said.

The Senate version of that bill is in committee.

Earlier this year, town officials also said they were concerned about Senate Bill 330, filed by Steube, that would cap local business-tax receipts at $25.

At the time, town officials said such a rule could cost the town about $95,000.

That bill is in the state Senate’s Appropriations Subcommittee on Finance and Tax.

THE STATE VS. HOME RULE The question of who has authority to regulate short-term vacation rentals is intensifying all over Florida. Our own senator is championing property rights. But one size does not fit all.

t’s on the verge of becoming Florida’s coastal civil war.

Cities against the State. Local commissioners against state legislators. Homesteaders against tourists.

Neighbors against neighbors, or, shall we say full-time homeowners against vacation-rental homeowners, investors and big business.

More than 100 residents came ready to fight Saturday night — Saturday night, mind you! — over in Palm Coast.

At a town hall meeting, residents unleashed their opposition to shortterm vacation rentals on state Rep. Paul Renner.

Down in Miami Beach 10 days ago, the other side came out. While Miami Beach Mayor Philip Levine and Miami Mayor Tomas Regalado held a news conference at Miami City Hall highlighting negative impacts short-term rentals are having on neighborhoods and constant complaints they’re receiving about Airbnb users, two dozen Airbnb hosts carried signs reading, “These mayors are Innsane.”

Then, at 8 a.m. Tuesday in Tallahassee, both sides came face to face and unloaded on state lawmakers over House Bill 425, one of two bills this legislative session that has escalated this fight. The other is Sarasota Sen. Greg Steube’s Senate Bill 188.

The battle lines are clear: n The homesteaders and city and county commissioners are fighting for the authority to govern and regulate the use of residential property in their communities — home rule. n On the other side, Airbnb, VRBO (Vacation Rental by Owner), vacationrental owners, Steube and Rep. Mike La Rosa, R-St. Cloud, are fighting to keep local governments from regulating the vacation-rental business and for these residential property owners to have the freedom to do what they want with their properties — make money.

As each day goes by, Home Rule Florida, an organization birthed in Anna Maria, is receiving reports from around the state from homesteaders expressing their dismay at what’s happening to their neighborhoods. Here’s one from William Teat in Fort Lauderdale: “Just last year, we had homes in our subdivision rented to people who used

the rental to throw large all-night parties. These people were charging for entry, and were attracting not the best elements to our quiet neighborhood.”

George Pezoulas of Palm Coast sent this to state senators: “… [W]e have one of these rentals across the street … After we moved down and into our home, within the first week we could hear what was the beginning of a long season of cars, endless noise when they were in the pool and an endless stream of renters walking out of the front door.

Our neighbor to the right side of them had to finally sell his house and move…”

And tell me this doesn’t make you take notice: On Anna Maria, an eightbedroom home is advertised that it “comfortably sleeps 28.” How would you like that next door to your twobedroom beach bungalow?

On the other side of the battle line, of course, are the defenders of freedom and property rights (their right to benefit from what they own). Last week, in our sister paper, the Business Observer, Adrian Moore, vice president at the free-market think tank of Reason Foundation, asked: What’s the problem? He says he lives happily and peacefully on a Siesta Key street whose homes are almost entirely vacation rentals.

Moore argues against the state giving cities and counties home-rule regulatory powers over vacation rentals. “We have an extensive body of nuisance and other laws designed to prevent one homeowner from imposing harms on others via noise, smells, parking, trash, what have you,” he writes. “After all, we all have family and friends who visit us, staying for various lengths of time.

Some people have lots of family and friends who stay with them … [H]ow is that different from vacation renters? Why not let homeowners use their homes as assets however they like?”

To that point, of protecting property rights and the free use of their properties, over the past two years in Anna Maria, upset vacation-rental homeowners have filed 80 lawsuits against the city of Anna Maria, with claims totaling more than $30 million. These property owners say Anna Maria’s 2015 ordinance regulating vacation rentals with myriad rules and requirements, including occupancy limits, has diminished the value of their properties.

Invoking Florida’s 1995 Bert Harris Act, they want to be compensated.

In Miami, Levine and Regalado heard vigorous protests from Airbnb hosts who said they wouldn’t be able to afford the payments on their homes without the income from their overnight renters.

And Steube argues that unless local governments are prohibited from enacting regulations on short-term vacation rentals, which his bill would do, local governments will go overboard

and severely damage an important source of Florida’s biggest industry, and deny owners “the right to own and enjoy” their property.

To be sure, this is a difficult dilemma for all of Florida. Both sides have valid arguments.

The fundamental principles of “liberty” and the “pursuit of happiness” for centuries have carried the idea that your property is yours. And you have the right to benefit from what you own — be it from your own effort and talents, from the crops you grow or from providing shelter to a vacationer — as long as you don’t harm your neighbor.

As Steube and La Rosa see it, less regulation and more freedom are far better than onerous local regulations designed essentially to confiscate people’s benefits in favor of protecting a few cranky neighbors.

But flip the coin. At the same time, vacation rentals are a business. Airbnb hosts are part of a business enterprise — operating in residential neighborhoods. Why should they be exempt from the rules, regulations and taxes that are imposed, say, on six-unit vacation resorts and other local businesses?

Talk to the general manager of Casa del Mar resort on Longboat Key, and he’ll likely bristle that his resort is required to collect bed taxes from weekly vacationers while the “underthe-table” weekly renters at the condo down the street pay no business taxes.

What’s more, most local governments indeed have had the long-standing right to create zoning classifications for compatible property use. What, then, is the justification for the state to “pre-empt” home rule on this one classification of property use?

Here’s a kicker: If you gave citizens a vote on which level of government is best for decision-making at the local level, it’s a safe bet that nearly 100% would say government closest to the people is best; the state should refrain from meddling in local affairs.

Think of it this way: State lawmakers and governors always chafe at the federal government telling them what to do. They invoke what the Founding Fathers envisioned when they created the United States: That whatever powers were not enumerated in the Constitution were left to the states.

The states were viewed as laboratories of democracy where people had the freedom to try different ways to address their unique challenges.

So it is with local government. We all have learned that whenever government imposes a one-size-fits-all regulation the ill-effects are worse than the benefits. Innovation is stifled.

Let the marketplace at the local level address short-term, vacation-rental homes. Let home rule prevail.

American ingenuity is remarkable at responding to the market’s needs and desires. And the marketplace is remarkable at finding equilibrium.

Excesses never last. Indeed, we all have seen how too much regulation is destructive. In this instance, the Bert Harris Act counterbalances. And we all have seen how an oversupply of product and bad behavior is destructive of value as well.

Eventually, the market corrects; rational minds reach a balance. But that takes work, experimenting and making a persuasive case to find that balance.

If Steube and La Rosa learn anything about this volatile subject affecting all of Florida’s coastal communities, they might see a few word changes in state statutes aren’t going to settle this dispute.

This challenge should be settled at the local level. Not in Tallahassee.

Winning candidate did address issues

Editorial missed one key element

In reference to the Letter to the Editor last week from Douglas Pascal, I must assume he did not attend any of the candidate forums or read any of the materials Jack Daly put out regarding the issues he believed were important to Longboat Key. If Mr. Pascal had done his due diligence as a voter he would have known that Mr. Daly has worked tirelessly at the regional transportation authority for the last two years on behalf of the citizens of LBK dealing with the myriad transportation issues that impact our community. Furthermore, Mr. Daly repeatedly addressed transportation issues at the candidate forums and what he would continue to focus on as he continues to serve the citizens of LBK. It was clear in my review of Mr. Daly’s statements that he understands traffic is a major issue for the citizens of our island and that many of the problems that create our traffic are not on Longboat, but on the south and north end of the island and he is working on a regional level to solve those issues.

Thank you for explaining the Bert Harris Act in your editorial titled “At What Point is it a Taking?” The problem with your editorial regarding the vote on Longboat Key is that the argument presented ignores one major element of the Harris Act — the fact that the “investment-backed expectation” is for the “existing use of the real property or a vested right ...” That statement in the Bert Harris Act is important.

Developers buy properties with a known existing and future use but usually want a different use. They somehow believe their “desired use” or “wants” supersedes the vested use of a property. If a developer buys a residential property with a maximum density of 13 units per acre in its current and future land use plans, their existing or vested right is a residential use at 13 units per acre. Not one unit more. The fact the developer wants 1 unit more or 25, 50 or 100 units per acre is irrelevant. The developer does not have any legal expectation to have anything more than what is the current and future use of the land he purchased. To be denied for a wanted or desired use is not a “taking.”

In a free market, the developer is responsible for knowing what properties to buy. If he wants to build residential units, he should purchase property zoned residential in the current or future land use

properties or of a de facto “taking” of the property if there is no viable economic use of the property. Comprehensive plan updates consider whether the future land use map needs to be amended to reflect changed conditions such as the lack of demand for commercial uses and whether the town is overzoned for commercial uses.

In that case the town could initiate comp plan amendments to rezone commercial properties to residential or the property owner could seek such comp plan and zoning amendments as a private initiative based on competent and substantive evidence justifying such changes.

The density referendum provision in the Town Charter denies both forms of remedy, which are afforded property owners throughout the USA.

Comp plan changes could fix ‘taking’ On March 23, the Observer wrote an editorial on the effect of Longboat Key’s density referenda requirement (no density increases without affirmative vote via referenda) as constituting a possible taking of property rights. Yet no property owner has challenged this provision in the Town Charter despite the fact that property owners seeking a density increase have now repeatedly been denied their ability to even be granted an increase in density of only one unit.

For all that physicians do to help our communities grow healthier and stronger, we honor them on Doctors’ Day. Their perseverance, knowledge and compassion make a difference in their dedicated drive to serve others.

At a Town Commission workshop meeting last week, Town Manager Dave Bullock thanked Sarasota officials for “coming into the lion’s den.”

The officials attended the meeting to present an overview of the city’s development plans and how they will affect the regional transportation network, including barrier islands.

Sarasota Deputy City Manager Marlon Brown, City Engineer Alex DavisShaw and Chief Planner Steve Stancel attended.

A point of contention arose with the commission when Stancel presented options for the redevelopment of Fruitville Road.

into account the needs of residents of the barrier islands, who use Fruitville Road as an eastwest route.

In response, Stancel said the project is designed to handle future traffic, which is based on Sarasota’s projections.

Though Bullock conceded he’s not a traffic engineer, he said, in his experience as a driver, there’s always a backup, or “choke point,” when two lanes reduce to one during high traffic times.

Stancel said engineers will need to make sure the transition area is long enough be able to handle the traffic coming off Orange Avenue.

As an alternative to the plan, Commissioner Jim Brown asked if any consideration had been given to making Fruitville Road a one-way road going east, while switching a road like 10th Street to a one-way going west.

Brown theorized this option would allow the city to improve the aesthetic aspects of Fruitville Road while taking into account the flow of traffic.

DavisShaw said the idea had not been explored for this project, adding that a residential area on 10th Street removes the street as an option.

After the exchange, Brown offered the officials a suggestion.

“I would just urge you, when your presentation is over, wait until 5 o’clock and then drive home,” Brown said. “It really is a nightmare.”

The officer contacted the homeowners, who were out of town.

The officer reported he has had previous encounters with the neighbor, who always says that taking pictures is not against the law.

The woman told police the man threatened to “knock her upside her head” when she told him he was rude. The man fled before the officer arrived. WHY DOES THE REC LEASE MATTER?

In July 2014, Colony Lender paid $15.2 million for an 80% interest in the 2.3-acre slice of recreational property at the Colony Beach & Tennis Resort. That brought its ownership on that property to 95%.

With the land, Colony Lender claimed it had also acquired a recreational lease slated to expire in 2072.

Unit owners paid former Colony owner Dr. Murray “Murf” Klauber for use of the resort’s amenities through this lease while the property was still in operation.

Shortly after acquiring the property, Colony Lender ordered unit owners to pay $5.1 million in back rent and damages on the lease.

Concurrently, Unicorp National Developments sent letters to owners with offers for their units and a warning: They could face more than $42 million in liabilities for accrued and future rent if they don’t sell.

The Colony Association has denied these claims, with attorney Jeff Warren saying in an interview Tuesday that the association technically controls the rec lease — which it says has not been active since around 2008 or 2009.

“Once the fat lady sings, our intent is to record a formal termination of the rec lease to remove any contention that it remains in force,” he wrote in a March 17 email to stakeholders.

Two days after Longboat Key voters rejected a referendum that would have laid the groundwork for redevelopment of the Colony Beach & Tennis Resort, legal issues underlying the proposal came to a close in court — for now.

On March 16, U.S. District Judge Steven D. Merryday affirmed a bankruptcy judge’s ruling that Colony Lender LLC — the firm that sold a 2.3-acre portion of the property it acquired through foreclosure in 2014 to Unicorp National Developments last year — had not acquired a recreational lease associated with the property. Colony Lender sued units owners in 2014 seeking more than $5 million in damages and back rent on the lease.

In a July 2016 ruling, U.S. Bankruptcy Judge K. Rodney May ordered Colony Lender and Unicorp to pay about $70,000 for allegedly violating an automatic bankruptcy stay for filing that lawsuit. May also determined the rec lease was not transferred in the 2014 foreclosure sale.

“This dispute cannot benefit from the issuance of another legal opinion, which could accomplish little or nothing to improve on Judge May’s July 20, 2016 opinion, which is entirely affirmed,” Merryday wrote in the March 16 order.

“We’re pleased with the decision and we believe that the judge did the right thing,” said Colony Association President Jay Yablon.

Still, the sanctions remain under appeal in the U.S. District Court for the Middle District of Florida, and Colony Lender principal David Siegal said he has filed a notice of appeal in the U.S. Court of Appeals for the Eleventh Circuit challenging Merryday’s ruling. He said Colony Lender

Dezzi called it “the Longboat way of doing things.”

Even though firefighters receive

a basic level of training as part of their pre-application certification process, every department is different and there is a lot to learn, said Falcon.

“We’re very much a customerservice fire department,” he said.

“We really try to take our time with patients. Help them out.”

Longboat Key’s demographics dictate the kind of typical emergency calls the department receives.

In 2016, the Longboat depart-

ment responded to 1,604 calls for help, an increase of nearly 12% from 2015.

The top call was for falls and lift assists, while calls for boating incidents, gas leaks and public assistance also rose.

Fires were also up, but at a Town Commission meeting earlier this year, Dezzi said that wasn’t indicative of a fire-prevention problem.

Cutting said she was attracted to the profession by a call to serve.

She said she enjoys helping people “on what could be the worst day of their life.”

“Everyone is so nice and so appreciative,” she said. “This is nothing like anywhere I’ve been.”

Franklin is no newcomer to the profession.

He served various roles in the Central Florida town of Lake Placid for years before coming to the west coast. He said he was looking for a department that matched his preferences.

“It fit my small-department mentality,” he said, adding he has

“I ask you to wear this badge with pride and honor,” Fire Chief Paul Dezzi told the group.

St. Armands BID debates director hire St. Armands Business Improvement District is divided on whether it should pay a professional to help manage the group’s activities.

Colleagues have described Marty Rappaport, founder and former chairman of the St. Armands Business Improvement District, as an irreplaceable member of the community.

Now that Rappaport is settling into retirement, though, the BID is tasked with replacing him.

To get someone to take on that responsibility, the group might be willing to pay.

The BID discussed hiring an executive director to oversee the taxing district at its March 21 meeting. Although the board agreed it could not accomplish the same amount of work as Rappaport in a volunteer role, two members were split on whether a director was the best use of the BID’s money.

The objection came from BID board member Michael Valentino, who owns Island Pursuit on St. Armands Circle. Valentino said his concerns developed recently because of a meeting with the St. Armands Circle Association.

Valentino said members of the merchants association expressed strong opposition to using BID resources to pay a director, whom they believed would only be useful sporadically.

“They feel the monies could be spent much, much better elsewhere,” Valentino said.

Gavin Meshad, the other BID board member present at the meeting, advocated for the value of an executive director. He listed a number of projects the BID might take on with the help of an executive director, including managing the landscaping on the Circle, addressing traffic and pedestrian issues and navigating the change to a new form-based code on St. Armands.

“The (Downtown Improvement District) has an executive director, and quite honestly, we got the benefit of Marty’s time as executive director,” he said.

With board member Matt Rosinsky absent, the board couldn’t take action. Still, Meshad expressed a sense of urgency for replacing Rappaport’s work.

“We’ve fleshed out a lot of good ideas, but we don’t have someone to take the ball and run with it — and were running out of time,” Meshad said.

Longboat accepting resumes for vacant commission seat Applications are being accepted at Town Hall for Longboat Key residents interested in serving in the Town Commission seat vacated last week by District 1 Commissioner Armando Linde’s resignation.

The remaining six commissioners will meet at 7 p.m. April 3 to select someone to serve until the March 2018 election.

According to a news release from the town, the candidates must be registered voters and live in District 1.

Resumes and cover letters are being accepted by mail at Town Hall, 501 Bay Isles Road, Longboat Key, 34228 and should be sent to the attention of Town Clerk Trish Granger.

Linde resigned March 21, effective immediately. In his resignation letter to Mayor Terry Gans, Linde said the decision was unrelated to his work on the commission.

Instead, his resignation was inspired by his and his wife’s desire to be closer to family.

Construction begins on bank at Bay Isles Construction of a branch of JP Morgan Chase is underway at 545 Bay Isles Parkway, located in the Shoppes of Bay Isles center.

It’s planned to open in the fall.

The 3,113-square-foot building will feature two drive-thru spots, as well as 34 parking spaces.

The project was approved by the Planning and Zoning Board in September 2016, and the Town Commission in November 2016.

A building permit was issued for the property on March 14, and construction began last week.

Construction value is listed at $1.4 million.

The new Longboat Key location is part of an ongoing JP Morgan Chase bank branch expansion in Florida. The company plans to open 11 banks in the state this year.

Since 2008, Chase has added nearly 250 branches in Florida and now has 398 in the state.

Turtle-lighting workshop is next week The Sea Turtle Conservancy, in partnership with the Town of Longboat Key, will host a lighting workshop in the Town Commission Chambers at Town Hall at 1 p.m. Wednesday, April 5.

The hourlong workshop will be geared toward the public as part of the town’s education efforts for the upcoming sea turtle nesting season, which runs from May 1 through October.

Code Enforcement Officer Chris Elbon said the workshop will include a discussion about how to best comply with the Key’s lighting ordinance during turtle nesting season.

The ordinance was updated last year and now requires that lighting fixtures and bulbs meet the standards of the Florida Fish and Wildlife Conservation Commission, Elbon said.

Elbon said he hopes to dispel some misconceptions regarding turtle lighting. Other topics will include biology of sea turtles.

A turtle-friendly lighting station is also set up at Town Hall, providing information about how Key residents can prepare.

I

t’s a Friday night, and Amore Restaurant is bustling.

Over the clank and clatter of plates and silverware, a cackle of laughter erupts. It’s Eddie Tobin mingling with various customers. A few minutes later, another round of laughter erupts. This time it’s Judy Renaud chatting with patrons.

Their banter with regulars is a testament to the legacy they will leave when Amore closes in late May. Tobin and Renaud have been performing at the popular restaurant for the past two years.

As they perform — Tobin sings and plays piano, and Renaud jumps in on vocals — some couples get up and dance. Others listen in awe as Renaud’s voice smoothes over the hustle and bustle of the restaurant. And, when Tobin performs “Sweet Caroline,” the whole room joins in, seemingly forgetting that they are dining at an Italian restaurant.

Amore owner Howard Rooks, who is hoping to relocate the restaurant to downtown Sarasota, called Renaud’s voice fine and said Tobin was a prize. The two have helped Amore expand beyond an eatery.

“It’s become more than a restaurant,” Rooks said. “It’s just a nice gathering place for people where they can connect with their friends.”

Renaud got her start singing jazz as a child in church and in school plays, but it wasn’t until she raised her family that it really took off. She took her first singing

“I’m a club singer basically, and I love it,” Renaud said.

When Tobin was 5, his uncle gave him an accordion, and though he just played it for fun, it showed he did have some musical talent. After studying music at the University of Miami, Tobin traveled around the country playing with various artists.

“When I sit at the piano, if I have a headache or I’m tired, as soon as I sit down, everything feels good,” Tobin said.

Last February, the two paired up to record at Sarasota’s Spirit Ranch Recording Studio. Their second album, “Something Cool,” was released March 24.

Tobin calls Renaud the catalyst of that project. Renaud calls Tobin one of the best, if not the best, piano players she’s worked with. For her, the CDs represent her legacy. All the songs on both CDs are covers except for two that Renaud wrote herself — “When Love Came Around the Corner” is on the first album and “Sand and the Sea” is on the latest album.

fill. As for their next steps, the two have different plans. Renaud plans to take a step back and have some time off until fall, though she plans to continue performing regularly at Euphemia Haye.

She’s looking forward to “spreading her wings” to write more songs and improve on the piano.

Tobin, who also plays regularly at Euphemia Haye and The Terrace At Surf Shack on St. Armands, isn’t worried about

filling his time with performances to replace his ones at Amore. In his words, he’ll cross that bridge when he gets there.

Both, however, are sad to see Amore go.

“I am so sad because it’s been there in so many incarnations for so long, from The Plaza to Mattison’s Steakhouse,” she said. “I just love the building. I love performing there.”

Locals celebrate ‘Women of Maidan’ filmmaker Olha Onyshko

B

efore Olha Onyshko, a native of Ukraine, could premiere her film at Selby Public Library, some local Ukrainian-American women took her in as their own.

On March 13, Longboater Anisa Mycak, with Oksana Bashuk Hepburn and Romana Rainey, hosted a lunch in honor of Onyshko to promote her film, “Women of Maidan.” About 16 other women, almost all of Ukrainian descent, attended the luncheon.

The 66-minute documentary, which won “Best Documentary” at the Fort Myers Film Festival, describes the role women played in the 2013-2014 Revolution of Dignity in Ukraine. The revolution began small, as a student demonstration to demand pro-European Union foreign policy and to protest pro-Moscow agreements, but quickly gained international attention.

The demonstrations took place mainly on Maidan Square in Kiev.

The two-month-long vigil attended by thousands, many of whom were women, ultimately focused attention on human-rights violations, including laws that banned public assembly and free speech and the arrests and killings of demonstrators, Onyshko said.

And while Onyshko said the movie is about women’s key role in the revolution, luncheon guest Luda Murphy said it’s just as much about the actual revolution. Murphy found through the film that people shouldn’t assume they won’t make a difference.

“Each individual is definitely a part of it and makes a difference,” she said.

“Each person gives support to another.”

On March 15, the complex held its annual gathering. Partygoers enjoyed hot dogs and barbecue classics while playing horseshoes and bean bag toss, among others. Dan Crawford, a songwriter, vocalist and entertainer, performed.

Town Hall exhibits local artists’ masterpieces

L

ongboat Key Town Hall got some new, vibrant additions on March 21.

The annual artists’ reception celebrated the hanging of new artwork by eight local artists.

Every few months, the artwork hanging on the hall’s walls changes to display local artists’ work.

Artwork by JoAnne Curtain, Renee DiNapoli, Barbara Jendrysik, Mary Lou Johnson, Bob Parrish and Mariarosa and Roger Rockefeller is featured until the end of May. Four photographs by former Mayor Ron

Johnson, who died in June, were hung for the reception.

This exhibit marks the 62nd since its inception. In total, the exhibits featured artwork from more than 105 locals artists.

During the reception, assistant to the town manager, Susan Phillips, introduced the artists. She mentioned how much talent they bring to the Key, even if they aren’t considered professionals.

“They’re just your neighbors who have amazing talent,” she said.

Christ Church welcomes Booker High Gospel Choir

hrist Church, Presbyterian, of Longboat Key members had a special way to work off their dinner on March 22.

Following the church’s monthly Wednesday night dinner — it was pasta this month — the Booker High School Gospel Choir Club performed several songs for the members. Their first song, “Cry Holy,” had the audience members on their feet and clapping.

The choir was formed in 2006 for students to express their love of music. The choir has performed locally and around the country at various events, including weddings and graduation ceremonies.

argaritas greeted Seaplace residents March 15 as they walked into their clubhouse.

Gino Del Pup and Darryl Jelinek, along with some fake parrots atop their shoulders, welcomed guests as they arrived for a night in Margaritaville with, of course, margaritas.

Seaplace’s monthly party brought some extra sunshine to the residents as the annual pool party was moved indoors because of cold weather.

After mingling, guests enjoyed cheeseburgers in paradise and other dishes and sides.

Later, they danced the night away on the club’s patio.

Key of Sea hits high note at The Players Club

T

he clubhouse of The Players Club was filled with harmonious voices on March 23.

This year, 26 women sang in the performance that included Broadway hits and classic songs. The choir opened its performance with “You’re the Top” from the Broadway musical “Anything Goes.” The singers followed with a medley of songs about Chicago, New Orleans, Hollywood and New York.

After the show, the performers and guests enjoyed some light refreshments. The Key of Sea choir performs throughout the area and is celebrating its 19th year.
