School, Town, County Confront Vaping Recent county and town legislation to restrict access to vaping implements such as e-cigarettes and Juul are responses to a growing community concern about not only the physical health of students in school who participate in the behavior but also about their social behaviors into the future. While vaping, the administration of nicotine into the lung via aerosol vapor using a vehicle such as an electronic cigarette, is being cautiously touted of as a means to help otherwise decades-long heavy cigarette smokers get weaned off of the cigarette smoking habit, it is also considered the latest “fad” school districts such as the Wantagh High School District have been proactive in countering not only because of its effects on the lung but because of the “gateway” behavior it engenders.
FIRST LINE OF DEFENSE
Education at the high school level can break the “gateway” behavior many
confront at the college level by stopping the behavior at the high school level– and not carry it forward. But educators often carry a compact with parents, who must be the first line of defense against questionable social behaviors now and into the future, such as vaping. A letter from Wantagh School District Superintendent John McNamara and high school Principal Carolyn Breivogel to all parents in the district implores parents to have conversations at the dinner table with their students to discern their awareness of the vaping issue. “Our students’ safety and maintaining an appropriate environment for learning is our top priority. We know that by working together with our parents, we have the best chance for success. Please have a conversation with your child about the dangers of electronic cigarettes.” Programs and initiatives the school district has instituted as vaping has become causè célèbre among students are clearly proactive measures to get out
and in front of the issue by encouraging students’ parents to be the most effective line of protection. Such meetings and discussions have resulted in the district developing a no-tolerance policy toward vaping implements in school or outside on the school grounds. Town councilpersons and county legislators attending meetings have heard the concerns, which have translated into recent laws passed restricting or curtailing sales of vaping implements such as e-cigarettes and Juul, a more modified e-cigarette that looks like a flash drive, from students
under the age of 21 from getting them. A Hempstead Town law adds a new Subsection "D" of Section 121-4 of Chapter 121 of the Town Code, in relation to enacting enhanced signage requirements for retail sale of electronic aerosol delivery systems. It states that “all business establishments selling age-restricted product at retail shall post a conspicuous sign at all points of purchase within the establishment, stating: ‘Warning: Vape contains nicotine. Nicotine product is an addictive chemical.’–U.S. Food and Drug Administration; and ‘Vaping can be hazardous to your health.’–U. S . Surgeon General. Posted by order of the Town of Hempstead.” Nassau County’s legislation adds to the signage to further restrict the pointof-sale advertising of JUULs and e-cigarettes inside convenience stores. The legislation, sponsored by county Legislator Steve Rhoads (19th LD) “forbids these products from being displayed [CONT. ON PAGE 8]

Assemblyman McDonough Names Women of Distinction DANIELLE C. BRANCIFORTI

Domenique is a unique individual within the Wantagh community, and was a perfect choice as Wantagh’s Woman of Distinction. The great coach Vince Lombardi’s words that “It’s not whether you get knocked down, it’s whether you get up” are wrapped like a flag around Domenique, who has endured heart surgery, lung surgery and, more compelling, was at death’s door from her addiction - and has persevered to survive through them all. Now gladly free from addiction, she continues determinedly at detoxifica-
tion and has been clean for six months as of this prestigious award. She has so impressed counselors as an outpatient in her challenges at remaining clean she has been offered a position at the outpatient clinic. Domenique continues to get back a life she once knew before her addictions took hold and is looking to enroll in college toward a career. To Assemblyman McDonough, she is a living example that determinations and perseverance are essential guideposts along the road to overcoming challenges and finding a smooth pathway in life.
Heidi Felix is known among her large circle of friends as ‘selfless,’ and embued with an “optimism and enthusiasm” for life. Heidi volunteers much of her free time to the Wantagh PTA, Wantagh High School events and scholarship programs, the Wantagh Key Club, the Wantagh Girl Scouts and Boy Scouts, the chamber of commerce, the Episcopal Church of St. Jude, St. Michael and All Angels, and the John Theissen Foundation – to name a few. Heidi Felix is single working mother who works full time for her son and daughter to help them grow to become outstanding citizens within the community. New York Assemblyman Dave McDonough chose her as a Woman of Distinction because she is a role model within the community, and especially to all the young women of Wantagh.

Danielle’s deeply thoughtful actions continue to make a positive impact on scores of children, making her Woman of Distinction.

Jill is publisher and advertising director who, with assistance from editor Doug Finlay, publishes Your NewsMag, a community publication that has recently entered the Wantagh community to present community news, school news, and chamber and business news. Jill helped work on the now- defunct Wantagh-Seaford Citizen for several years, and now brings the same passion to serve the Wantagh community once again. She has also published the Bellmore-Merrick edition of Your NewsMag for five years , with Mr. Finlay as editor, and is a member of the Chamber of Commerce of the Bellmores, serving on the Board of Directors. Previous to her publishing experience, she was marketing manager for Springs-Wamsutta General Foods International, and group director of Rowland Promotion and Design, specializing in grassroots promotions and marketing campaigns.
Wantagh Chamber Commerce Names Small Businessperson of the Year Mitchell J. Rich is being honored as the Small Business Person of the Year by the Wantagh Chamber of Commerce and the Nassau Council of Chambers of Commerce. Mitchell has been a solid and steadfast member of the Wantagh chamber. His guidance is valuable to all in the chamber, heading up several committees, as well as the annual Snowball Run. You may have even seen his commercial for the Law Office of Mitchell J. Rich Law on television. He chamber is honored to have Mitchell and his expertise as part of the community. Mitchell J. Rich has been providing the highest level of personal service to victims of accidents and medical malpractice for
over 30 years at the Law Office of Mitchell J. Rich. After litigating cases with a major Manhattan law firm for 20 years, he established the law practice in 2007. In January, 2010, the Law Office of Mitchell J. Rich, moved its offices to 3535 Jerusalem Avenue in Wantagh. His office has expertise in litigating all types of accident cases including, construction accidents, trip and fall cases, dog bites, automobile, motorcycle and trucking accidents and medical malpractice cases including delayed diagnosis, surgical errors and birth defects. Rich, a life-long resident of Long Island, received his J.D. degree from Touro College School of Law in 1985 and has been admitted to the New York State bar since
1986. He is an active member of the New York State Academy of Trial Lawyers and the New York State Bar Association. It was a gorgeous fun day looking at cars, listing to great music and dining from a variety of food trucks. There were raffles and even a visit from special guest, Giants’ former running back Ottis Anderson. John Theissen Children’s Foundation is a year-round foundation that helps sick and underprivileged children across Long Island.

This year’s honorees include Fran Fernandez and Danielle C. Brantiforti of Seaford, Heidi Felix and Domenique T. Ralla of Wantagh and me, Jill Bromberg, from Merrick. We are all sincerely humbled to be considered for such an honor, and proud to be in the company of these wonderful community minded women. The Nassau Council of Chambers of Commerce honors a small business person from each town in Nassau County recognizing their success and contribution to the community. This year Mitchell J. Rich, owner of Law Office of Mitchell J. Rich, was one of the recipients along with me, Jill Bromberg, publisher of Your NewsMag. We are grateful and appreciative of the recognition. Twin Preserves Get TLC from Helpful Library Patrons Wantagh Public Library provided one of the more ambitious outings across Nassau County during the Great Giveback Day in mid-October, sponsored by the Nassau County Library System. The focus of the Great Giveback was to give libraries an opportunity to develop a program that could bring to life a day of service that patrons of the library could enjoy participating in, for the benefit of the community. And what a program it was: cleaning up the Twin Lakes Preserves. While a mild morning rain dampened the occasion for many who had signed up, over 15 residents along with librarians were still able to scour the preserve trails in search of unsightly debris cluttered among the low-brush and on the water. Maylani Lee, a seventh- grade student at Wantagh Middle School who writes for the school’s “Smoke Signals” newspaper and is a member of Girl Scout Troop 3573, said she likes the “idea of cleaning up the environment.” Her mother, Melissa, was particularly surprised by all the plastic straws she
saw along the trails. Mia Monniello, sixth-grader a Wantagh Middle School, said “I think the cleanup is good for the community.” Meanwhile, her mother Stephanie found the trails to be “cleaner than I thought they would be.” Stephani Mucci, studying occupational therapy at Farmingdale State College, commented on the cleanup plan as a “great idea.” Librarians Tina Barberie, head of circulation, and Caitlyn Wrigley, adult reference, both commented on the preserve being cleaner than they had expected. Carly Hablenko, from the children’s department, called the cleanup program “absolutely essential in bringing the community together.” She maintained they were learning what other types of tools may be needed in any future clean ups of the preserve, because “there’s garbage in the water that’s hard to get to.” Library Director Joan Morris said the aim was for the group to work its way around the northern section of the pre-

serve to “Coors Beach,” the ad-hoc name for an area many who visit the park like to spend their time. Not much was found in the way of soda cans, bottles and other beverage containers, however. “That can only be a good thing,” she said. County Legislator Steve Rhoads also participated in the cleanup, while town Councilwoman Erin King Sweeney joined the group for bagels and coffee prior to the group taking on the preserve.

near candy or toys and requires them to be sold from behind the counter. These dangerous products have been marketed towards children, with flavors such as bubble gum, cotton candy and others. By displaying them next to candy, trading cards or toys, they are encouraging children and young adults to think they are harmless when it is becoming increasingly apparent that the truth is very much to the contrary.” The fine for stores violating this policy starts at $250. Chris Ferro, Nassau County Police Department inspector and commander of the county’s major case bureau, which includes the narcotics/vice squad, told Your NewsMag “We get ‘intel’ every day on vape shops” and where questionable activities are taking place. He says vape shops have popped up everywhere, including gas stations. He said vaping has reached a crisis level, and the police department is investigating vigorously the many claims it receives. He noted a recent Federal Drug Administration letter to major e-cigarette manufacturers and tobacco companies requesting information on how they
plan to address what the FDA sees as a major health crisis for at-risk youth. Inspector Ferro said the FDA also reports that teenage use of nicotine is up 900% in recent years, due in large measure to vaping.
HEALTH CONCERNS
Chief among vaping’s health concerns is its administration of nicotine into the lungs of a vaper, a chemical long known as an addictive substance. But under the radar are chemicals designed to enhance the flavor of the aerosol being inhaled. The major flavor designed to give the aerosol a creamy, buttery flavor, is diacetyl. The federal Centers for Disease Control warns that “Diacetyl and its substitute, 2,3-pentanedione, are flavoring compounds that are used extensively in the food flavoring and production industries. Occupational exposure to diacetyl has been associated with severe respiratory impairment and obliterative bronchiolitis [popcorn lung], a serious lung disease that is irreversible.” However, the website headoverhealsinhealth.com downplays the statistical certainty of vapers getting the

disease, and instead leans on vaping’s proven ability to wean adult heavy tobacco smokers off the more toxic cigarette: “For the vast majority of people, using e-cigs has allowed them to avoid or at least minimize exposure to a much greater threat: the massive amounts of toxic chemicals in smoke from combustible tobacco cigarettes. Reports that ignore this fact are, at best, very incomplete.” A recent “60 Minutes” TV news broadcast included a woman, a heavy smoker, who took to vaping, which stopped her coughing first thing in the mornings and increased her lung capacity once more to be able to exercise again. The website smoketastic.com asserts that nicotine doesn’t cause irreparable harm to the lung, the tar in cigarettes does–and vape aerosol contains no tar.
LEGAL ISSUE
Of paramount concern to Inspector Ferro, however, is a legal law-enforcement ramification in which vaping implements enable teens to smoke marijuana without presenting tell-tale signs of the pungent odor. “Teens are smoking during bathroom breaks and when driving” or congregating socially.
The school district letter asserts that “ … beyond using vaporizers for nicotine, there is also an increase in the use of vaporizers for the inhalation of THC, the active ingredient in marijuana. Unfortunately, Wantagh is not immune to this trend. We ask for your assistance to help combat this dangerous situation and to alert you to the dangers that e-cigarettes and vaporizers pose to the health of our youth.” Inspector Ferro remarks that it’s not the same marijuana from earlier decades, but cannabis oil that is at least three times more potent that is being smoked through vaping implements. It is this precise issue that keeps law enforcement focused on enforcing new vape shop legislation. The programs such as those at the Wantagh High School District to combat not only vaping but its “gateway” behavior are designed specifically as proactive tools to catch and prevent poor behaviors before they lead to the more serious consequences of lung disease – and possible addiction. As Legislator Rhoads concludes: “If you are aware of a vape shop selling to underage students, tell the police.” DOUGLAS FINLAY

ELECTIONS: NYS 8th SENATORIAL DISTRICT
Incumbent John E. Brooks is running for his second term as a candidate for the state’s 8th Senatorial District seat, a seat won for the first time by Democrats in 50 years. What is the current State of the State? The state of our State is strong, but we also need real tax relief and major infrastructure investments. We need our fair share of education aid and support. And we need mandate relief and ethics reforms to ensure our tax dollars are spent wisely. I am proud of my efforts during my first term in the state Senate, but we need our fair share of state aid, investment and tax relief to achieve it. Do you support the NY-SAFE Act? And do you support more ‘common-sense’ gun laws as proposed by the nation’s students? I support common sense firearm safety legislation, and I am outraged that the Senate Republican majority has blocked all meaningful gun safety bills. Issues like banning bumpstocks, implementing effective background checks and having “red-flag” laws have all been blocked by the Senate Republicans. These bills enjoy wide support from Long Island and New York voters, and have even passed in states like Vermont and Florida. The Governor believes persons who have served criminal sentences and paid their debt to society should be allowed once again to vote. Do you? I have serious concerns with convicted felons being allowed to vote again. I have been clear with that position and I will continue to discuss these concerns with my constituents and with my colleagues in government. But we must also work harder to help citizens access the polls because New York ranks embarrassingly low compared with other states. Why has Long Island been the leader in the ‘opt-out’ movement, in contrast to other regions of the state? Schools now teach to the new curriculum, for example. I think local parents and public education stakeholders were extremely upset with how Common Core was shoved onto Long Island schools and how local control of these critical issues was taken over by Albany bureaucrats. There was a bill in the state Senate this year that would help ensure students are no longer taught to high-stakes exams, and yet the bill was blocked by the Senate Republican majority. How is your 2010 proposal to gain more state aid to the schools by focusing on income taxes rather than property taxes going in the Legislature? Are there other ways to reduce property taxes? The biggest roadblock to progress in the state Senate has been the Republican majority. From tax reforms, to mandate relief, to the
Child Victims Act, to firearm safety, to women’s rights and so much more, the Senate Republicans have stopped progress at every opportunity. There are many ways to reduce taxes, but we need to remove the Senate Republican majority to take meaningful action on these issues. What does the new federal tax code limiting state and local deductions for Long Islanders mean for the region? I have been sounding the alarm on the disastrous federal tax plan and how it is going to harm Long Island families, and that is why I introduced the Brooks Property Tax Relief Plan as a response. Our property owners are already overburdened, and with the federal decision to cap SALT at $10,000, Long Island families will be hardest hit and Senate Republicans have blocked all efforts to provide relief from that. Has the 2% tax cap helped rein in spending within schools and government agencies? The tax cap certainly has helped contain spending, but we need to ensure that schools are not overburdened by unfunded mandates from Albany. I have worked hard to fight against additional mandates. While costs have been contained statewide, including in Oyster Bay, we have still seen egregious wasting of taxpayer money by the Oyster Bay administration. From no-show, patronage jobs such as the nearly $100K position given to my opponent, Jeff Pravato, to the lucrative contracts given to corrupt officials, we need to clean up Oyster Bay government. The best way to limit increases in spending is to keep the 2% cap, but we also need to implement real ethics reforms so wasting taxpayer money like we see in Oyster Bay comes to an end. What are your accomplishments in the Senate so far, and why do you think residents will continue to benefit from you as Senator? I have been proud to fight for, and secure, additional state school aid and infrastructure aid for my constituents. I have also worked tirelessly to make sure state government takes the tax crisis seriously, because Long Island families are going to be severely hit by the federal tax code changes and New York State government needs to address this situation. I will continue to fight for overburdened Long Island taxpayers and I will continue to achieve results.
Jeff Pravato, Republican and former mayor of Massapeua, is challenging John Brooks. What is the current State of the State? New York State politicians have taxed residents too high, spent too much and reformed too little. Our tate leads the nation in terms of high property taxes, population loss and has the worst business climate around. Corruption has run rampart and reforms have been placed on the back burner. We must stop new entitlements, deliver property tax relief, support law enforcement with the resources needed to crackdown on MS-13 and heroin dealers, and limit future spending by State government. Do you support the NY-SAFE Act? And do you support more ‘common-sense’ gun laws as proposed by the nation’s students? There should be enhanced background checks that include greater access to mental health records. The Governor believes persons who have served criminal sentences and paid their debt to society should be allowed once again to vote. What are the pros and cons of such a sweeping approach? The Governor’s decision to pardon 51,000 felons and sex offenders is wrong for New York. The Governor has endangered our children by allowing these convicts to vote in local schools. Our school districts must be given the ability to refuse voting booths within school buildings as to protect students. Why has Long Island been the leader in the ‘opt-out’ movement, in contrast to other regions of the state? There should be less emphasis on testing and more emphasis on learning. This year, the State Senate had an opportunity tackle APPR thereby completely removing the State and SED from any involvement in APPR. The bill’s key provision addresses concerns raised by teachers, the “Opt-Out” movement, and others since the beginning of the standardized testing mandate. It takes a comprehensive approach to decoupling the APPR from standardized tests by requiring performance evaluations to be determined on the local level through collective bargaining – not test scores. However, my opponent John Brooks voted against this legislation. If elected as Senator, I will fully support leg-

islation to decoupling APPR no matter what. Does Senator Brooks’ 2010 proposal, to gain more state aid to the schools by focusing on income taxes rather than property taxes, a sound one? If not, what other ways can be considered to reduce property taxes? John Brooks has failed to earn support for any of his proposals as they are simply written for political cover rather than to deal with reality. Long Islanders earn some of the highest salaries in the state and John Brooks’ proposal would cost every Long Islander dearly as it would funnel education money to New York City and Upstate New York. The property tax cap is important and has saved taxpayers hundreds of millions of dollars and we need to make the property tax cap permanent. What does the new federal tax code limiting state and local deductions for Long Islanders mean for the region? New York must reduce property taxes for Long Islanders. The State can accomplish such a task by taking over the local share of Medicaid and by capping property taxes at $10,000 for residents earning under $500,000. The State could then pickup these costs by eliminating entitlements and giveaways, such as the $450 million tax break given to the TV and movie production industry. Has the 2% state tax cap helped contain spending within school districts and government agencies? In what ways has it worked in the Town of Oyster Bay, for example? The property tax cap is important and has saved taxpayers hundreds of millions of dollars. My opponent opposed the property tax cap and refuses to make it permanent. My first priority will be to make the property tax cap permanent and stop new entitlements. Rather than spend more money, homeowners should be given greater property tax relief. What are your accomplishments so far, and why do you think residents will benefit from you as Senator? As Massapequa Park Village Mayor, I held property taxes flat for five straight years by forcing government to live within its means and by implementing efficiencies. I improved local roadways, built playgrounds, strengthened our shoreline and tackled anti-Semitic crimes. I am running for State Senate to lower our property tax burden and get Long Island’s fair share of education funding. I will also take on the culture of corruption by introducing bills to enact term limits and ban all State contractors from making political donations.

ELECTIONS: NYS 14th ASSEMBLY DISTRICT
Incumbent Assemblyman Dave McDonough is running for the 14th Assembly District seat for the 10th time. Do you support the NY-SAFE Act? And do you support more “common-sense” gun laws as marched for by the nation’s students? The NY Safe Act, after it was amended, is one of the strongest in the nation. However, the background checks have to be more comprehensive to include, in addition to criminal background checks, better mental health investigations before allowing purchase of firearms. The Governor believes persons who have served criminal sentences and paid their debt to society should be allowed once again to vote. What are the pros and cons of such a sweeping approach? The governor’s recent order to allow released convicted felons who have served their time of incarceration but not completed their full sentence, which includes the parole and probation periods, increases the voter pool by almost 30,000 former inmates. That is not what the current law provided for and appears to be just to increase the voter turnout. There is much concern from schools that are used for polling places to have convicted sex offenders access to their schools where students are present. The opioid crisis continues to take lives at an alarming rate? What is the state doing to reduce this crisis? I am a member of the Opiod Awareness Task Force and we conducted forums throughout the state to help combat the problems. Also, the state has made some significant steps, including the I-Stop program, and limiting initial prescriptions to seven days rather than 30 days. Law enforcement has increased its efforts to battle this crisis but we also need more comprehensive education programs in schools. What is the current state of the state? The current state of New York State is that
we are still the highest taxed state in almost all forms. Property Tax is the second highest in the nation and other taxes labeled as “fees” and “regulation” continue to impact our residents and small businesses, which are driving some out of the state. Also, the new federal tax code limiting the deductibility of state and local taxes to be implemented next year will have more residents considering leaving. That will impact local revenue and also the real estate market. What does the new federal tax code limiting state and local deductions for Long Islanders mean for the region? State school aid should be apportioned based on the number of students in each region. Long island has approximately 17% of the students in the state and has traditionally received only 13-14% of education aid, thus driving local school taxes higher. Has the state’s education department been able to solve many of the protests from parents who have lead the “Opt Out” movement, or will the region continue to see more opt-out measures until more is accomplished? The Opt Out movement was a direct result of Common Core being implemented without any input from educators on how best to proceed, and I predict that it will continue to grow until the State Education Department listens to educators and parents. The 70% opt out rate on Long Island is too important to be ignored any longer. Why do you think residents will continue to benefit from you as an Assemblyman? My job as an elected official is to listen to and represent constituents at both the state and local level. My practice has been to respond to them and listen to all sides of an issue. I will continue to do that as I am not only their representative but, in reality, their employee!
Challenger Michael Reid, a former Merrick Fire Department commander, is running for a second time in with the hope of unseating incumbent New York State Assemblyman Dave McDonough What is the current state of the State? Apprehensive. The number one issue for every Long Island resident is the high cost of living. Housing (including property taxes), medical expenses and transportation costs top the list. While unemployment has declined, and wages have slightly increased, we are still losing ground each year. The average resident is just barely able to keep up with their bills. Young adults just starting out can’t find affordable housing. Many of our seniors, particularly those on fixed incomes, are in financial trouble. Has the 2% tax cap helped rein in spending within schools and government agencies? Yes. Schools account for the largest share of our local taxes. At times, voters may wish to pierce the 2% cap to fund a proposal, but it would need a supermajority of 60 % of the voters in the district to do so. The 2% cap serves as a check point to ensure that tax dollars are well spent. What does the new federal tax code limiting state and local deductions for Long Islanders mean for the region? The loss of SALT [state and local tax] deductions will have significant impact to many here on Long Island. We already struggle with the high cost of living and this new federal law will make it even more difficult to own and maintain a home. Longer term, the real cost will be in the ripple effect through our local economy. I believe there will be a loss of skilled workers and good-paying jobs, such as nurses, from being able to live here. Do you support the NY-SAFE Act? And do you support more “common-sense” gun laws as marched for by the nation’s students? I support the need for common sense gun laws in New York State. Responsible gun ownership, and the right to own a gun, needs to be protected, but the key word here is responsible. I don’t think anyone will disagree that any individual deemed by the courts to be a danger to themselves or others should not have access to a gun. When we hear of a shooting at a mall, or a school, or a church or any place where people gather; when we hear of another suicide with a gun; the question is always why the shooter was not identified before it happened. With common sense “Red Flag” gun laws, we create a new law needed to

proactively take action to stop a tragedy before it happens. The Governor believes persons who have served criminal sentences and paid their debt to society should be allowed once again to vote. What are the pros and cons of such a sweeping approach? If you have served your time and reformed your life, then the criminal justice system has worked. The current state rules are very clear on voting rights after a felony conviction; you may vote if you are on probation, completed your prison sentence, were discharged from parole; or were pardoned. You may not vote if you are currently incarcerated for a felony conviction or on parole supervision for a felony conviction. I think these rules are reasonable for a first offender. But I do not agree with our governor that voting rights should be restored while on parole for a felony. Are additions to the Jones Beach environment, such as the new Boardwalk Café and The Landing restaurant, designed to improve the overall economic health of the region? If so, how? The recent additions to Jones Beach State Park provide additional dining options to the park that have been too long absent. The secret to Jones Beach is that it never feels like a tourist trap. Visitors can enjoy miles of pristine beaches without a carnival atmosphere. Tourism is a major industry and job source for many on long island. Investing in the park and its infrastructure is an investment in the future of Long Island that will pay for itself many times over. Why do you think residents will benefit from you as an assemblyman? Simply stated, it is my dedication to community service. It is, quite literally, the story of my life. I began at the age of 14 as a junior firefighter with the Merrick Fire Department and am still active with nearly 40 years serving. I am proud of my career as a paramedic in New York City. I am proud of my many years serving as a delegate to the state Department of Health EMS Council (SEMSCO). I am proud of my community service to the children in the district as a member and now a past president of Kiwanis. I am proud to have been recognized for serving on several community-based groups dedicated to ending the opiate epidemic. I am proud to be an advocate for those with special needs or disabilities. I was raised in Merrick and now watch and worry about the future my children and grandchildren will have on Long Island.

When Do I Need a Will?

One question that many attorneys repeated get asked by potential clients is whether they need to have a Will. The answer to this question is “it depends.” Do you have minor children for whom a guardian or trustee needs to be appointed? Do you wish for your assets to be divided in a manner different from that in which they would be divided if you had no Will? Do you intend to move out of New York State? The answers to these questions are what determines the need for a Will. The first thing to be explained is the New York “Intestacy” law, which is the legal manner in which property of those who died without a valid Will is distributed. Under current New York law, the following will occur: 1. With a surviving spouse and a child or children of any age, $50,000 and one-half of the balance after that payment go to the spouse and the balance is divided equally to all surviving children. 2. With a surviving spouse and no surviving children, everything goes to the spouse. 3. With no living spouse but with surviving children, the children divide everything equally.
4. With one or two surviving parent(s), no spouse and no children everything goes to the surviving parent(s). 5. With surviving aunts/uncles, no surviving parent, spouse or children, everything in equal shares to the surviving aunts/uncles. There are contingencies if the family tree is more bereft of living relatives, but due to space limitations, they are not printed here. If the above is completely in agreement with your wishes and all of the people who would receive a portion of your estate are adults, and you do not plan to move out of the state, you probably do not need a Will. The reason for the residency issue is that every state has its own “Intestacy” provision, and the law of the state to which you move may not be the same as New York’s law. The law of your state of residence when you pass away will apply. With regard to the issue of any minors who might benefit from your estate, under New York law, a guardian must be appointed to represent their interests and to keep their share of your estate from being used for any purpose other than their benefit until they reach the age of 18 years. You may also

choose in your Will to set an age higher than 18 before a beneficiary can inherit. A typical teenager may not have the financial skills to wisely use any funds rather than waste all of it on splurges. Therefore, many people put provisions in their Wills setting 21, 25 or some other age as a requirement for a person to receive their share. Another common request from those who make their Will is to give such a beneficiary their share in installments, such as one-third at age 21, one third at age 25 and one third at age 30. If you choose a later age or installments, a trustee must be appointed to take care of these funds until final distribution. The trustee can also be given the authority to give the inheritance at an earlier time if, in his/her judgment, good reason exists, such as, for example, the purchase of a home, college or graduate school education, etc. The trustee can also be given the authority to make certain investment decisions to attempt to grow the funds prior to their final distribution. These are things that you should discuss with an attorney before making any final decision. Beside the issue of a court-appointed guardian to watch over the funds due to a minor beneficiary, if both you and your spouse are involved in a fatal accident or if you are
the sole living parent, the court will need to appoint someone to have physical custody of your minor child or children. Obviously, this is something that people would like to decide for themselves rather than leave to the discretion of a Judge. Additionally, if you wish to make any charitable contributions from your estate, this can only be done through a Will. Finally, if you are a person who is fortunate enough to be a high net-worth individual, you may wish to establish a trust either through a Will or during your lifetime. One advantage of placing your assets into a trust during your lifetime is that it can operate in lieu of a Will to distribute your property as you see fitm and without the need for any filing in the New York Surrogate’s Court. The Surrogate Court hears estate matters and thereby avoids anyone other than your trustee and beneficiaries learning of your private matters. So, if you do not have any children who are unable to properly manage their share of your estate, wish to distribute your property as directed by the “Intestacy” law and do not plan on moving out of New York, you probably do not need a Will. ELECTIONS: U.S. 4th CONGRESSIONAL DISTRICT
Ameer Benno is challenging incumbent Kathleen Rice for the U.S. 4th Congressional District. Congresswoman Rice’s campaign did not respond to several requests to answer these questions by press time. What is the current State of the Union? Factors including de-industrialization, the hidden devaluation of the dollar, open borders, social fragmentation, unnecessary wars and a lack of bi-partisanship in the House and Senate are edging our country to the brink of catastrophe. The current administration is addressing these issues, but obstructionists are slowing progress on correcting many of our crisis points. The Union is strong; it just needs to be made stronger. Is this country in a constitutional crisis, heading toward one, or are the institutions of the country working as the founding fathers envisioned? For decades, the Democrats have sought to impose their social policies on the country through judicial fiat, rather than by legislation. This is not exactly what the founders envisioned. We currently see a coordinated effort by the Democrats, the media and members of the permanent bureaucracy in Washington to reverse the outcome of a fairly won presidential election.This represents an assault on, and a disdain for, our constitutional order.
The economy is said to be robust at the moment. Will expected revenues from new jobs and new businesses be enough to pay down the deficit, expected to be over $1 trillion by 2019? Increased revenue will help to bring down the deficit, but there are other factors. America was once the greatest manufacturing powerhouse the world had ever seen. For the last 30 years, our leadership in both parties has been in thrall to the dogma of unfettered free trade. The predictable result is that millions of manufacturing jobs have gone overseas. Along with open borders, this has brought despair to our communities, as entire American towns and cities have been hollowed out. The administration is renegotiating unfair trade agreements and putting in place new agreements that offer win/win outcomes for both sides. Outcomes that protect our trade, protect our jobs and protect the dignity of American workers and families. With cybercrime thought of as the warfare of the 21st century, will larger increases in military spending focus on fighting this new type of war, rather than building new military hardware? The United States made a mistake in ceding control of the internet in 2016, under President Obama, to an international body. Ameri-
ca must maintain a decisive edge in military superiority both in conventional terms, and in new areas of warfare and anywhere else potential threats arise. We need to be forward- thinking about possible threats that have not yet been realized, such as attacks on the power grid and water supply, chemical and biological threats and EMP attack. We are living our lives in cyberspace and that space must be defended just as our physical borders must be defended. Did an FBI investigation called for by the President for Supreme Court nominee Brett Kavanaugh result in a fairer and more impartial hearing? The Democrats attempted to destroy an honorable man and his family through scurrilous false accusations of being a gang rapist. Then they complained that he appeared emotional and angry about these accusations. Then they said he was unfit because he wouldn’t be able to be fair to them. We can expect more of this if the Democrats are handed power again. Is there long-term risk to the country in pulling out of - or rewriting - previously agreed-to treaties, such as the

Paris climate agreement, the Iran nuclear deal and NAFTA? Under the Iran deal, Obama guaranteed that Iran – the world’s largest state sponsor of terrorism, and one that has repeatedly pledged Israel’s destruction – would eventually acquire a nuclear weapon. The Paris agreement was a feel-good measure that many climate change experts viewed as being an unrealistic document. Through NAFTA, Bill Clinton destroyed American manufacturing jobs, betraying the union families the Democrats claim to value. If a deal or an agreement is bad, it should be renegotiated. How will the lives of your constituents be different if your party maintains the House this fall? If the Democrats capture Congress in the fall, expect two years of gridlock, vitriol and poison like we recently saw with the Kavanaugh hearings. A Republican House, on the other hand, will allow us the chance to enact new policies that finally put America first in healthcare, jobs, infrastructure, public safety, social security and first in the rights of individuals and recognition of our veterans.

Town’s Landmarks Commission Sets Second Hearing A second hearing on the status toward land marking the historical St. Matthias Episcopal Church at 2356 Jerusalem Avenue has been set for Tuesday, November 20, beginning at 4:30 p.m. in the Old Town Hall. The Town of Hempstead Landmarks Commission granted the hearing after the Episcopal Diocese retained an attorney who requested the hearing in a letter to the commission. While the diocese appeared adequately represented at the first meeting by a member of the diocese in charge of all Long Island church properties who argued eloquently that the church would lose much-needed revenue to help with its ministries across the island, one member of the commission said the letter broke no new ground in the diocese’s defense against land marking the 118 year-old church. Your NewsMag covered the church’s position in the September issue. The commission said at the time of its
initial granting of landmark status that there was significance to the design of the structure to make in meaningful to the community, that historical value does not mean it needs to be an old structure, and that the structure has a “unique” chemistry within the community. The commission granted In favor of those three criteria. Meanwhile, the diocese recently cleared away dead trees and other brush on the property, as well as garbage being dumped at the back of the church property.

MILES TO GO: The Mandalay Milers have set a goal to run enough miles to cover their trek to California during a physical education unit at Mandalay Elementary School in Wantagh Mandalay Elementary School students in Wantagh are collectively running the same amount of miles it would take to reach California from Long Island as part of a physical education unit called the Run Across America Challenge. The students, called the Mandalay Milers, are running laps in the playground each day of their scheduled physical education classes to reach their goal by the end of the 2018-2019 school year. In addition, physical education teacher Robyn Pastuch has encouraged the students to run or walk at home to gain miles for the school. As the miles are tracked, the students receive a toe token for every five miles they run or walk.

make homemade croutons in the oven with a loaf of Italian bread (drizzle with olive oil, salt, pepper and garlic powder) bake at 400 degrees until golden brown) then add crumbled bacon, pepita seeds and croutons and enjoy!
BUTTERNUT SQUASH SOUP
Stephanie Mione Two butternut squashes peeled, and cut into 1-inch cubes. Lay out on a baking sheet and drizzle with extra virgin olive oil, salt, pepper and garlic powder. Roast in the oven at 425 degrees for about 30-40 min. until golden brown and soft. Make sure you turn a few times while cooking. Sauté diced onion, carrots and celery and two cloves of garlic in a stock pot until tender. Add 2 large cans of chicken stock and let simmer until squash is out of the oven. Take all roasted squash and put into the soup. Using an emulsion blender, blend it until it is smooth and no bits of squash or veggies. Add 1/2 tsp. nutmeg, 1 tsp. of cinnamon and 1/2 cup of heavy cream. Use emulsion blender again until all smooth and creamy. I

Patti Mandel-Birnbaum 3 cups veggies and bunch of carrots roasted at 425 degrees for 20 min. Saute 1 onion, 2 celery stalks, 1 apple in a pot with evoo. Add chicken stock and simmer. After veggies cool, puree in blender, then add to soup. Mix ‘n’ simmer. Thick and hearty without cream! Add a dash of nutmeg, pumpkin pie spice and apple pie spice. Top with pumpkin seeds.
SLOW-COOKER CHICKEN ENCHILADA SOUP
Beth Feldman Chernick (serves 10) Ingredients: • 2 cups red enchilada sauce • one 15 oz. can pure pumpkin • one 15 oz. can black beans, drained and rinsed
• 1 cup frozen sweet corn kernels • 1 finely chopped onion • One 4 oz. can diced green chilies (not drained) • 3 cups low sodium chicken broth • 1 lb. raw boneless skinless chicken breast • Optional toppings: shredded reduced fat cheddar cheese, light sour cream or fat free plain Greek Combine all ingredients except chicken in a slow cooker. Mix until uniform. Add chicken. Cover and cook on high for 4-5 hours or on low for 8 to 9 hours, until chicken is fully cooked. Transfer chicken to large bowl. Served with two forks. Return chicken to the slow cooker and mix well.

8 cups chicken stock 1 large can plum tomatoes, chrushed 1 1 4 oz can fire roasted tomatoes 1 can chick pea EVOO Bunch parsley Thyme 2 bay leaves Salt and pepper Saute onions in EVOO until soft. Add crushed garlic. Add potatoes and saute for a few minutes. Add carrots and celery, saute for a few minutes. Add the broth, tomatoes, chickpeas, parsley (in cheesecloth), and spices and bring to boil. Add the zucchini and string beans. Reduce heat to simmer. Then add peas and spinach. Simmer until the carrots are firm yet cooked through, about 30 – 40 minutes.
