It gives me immense pleasure to extend my heartfelt appreciation to our partners, past honourees, sponsors, and the SME and Entrepreneurs Business Awards (SEBA) team, all of whom work tirelessly behind the scenes to ensure the accomplishment of SEBA. As the SME and Entrepreneurs Business Award founder, I believe that this platform is essential for SMEs and Entrepreneurs to exhibit their achievements and capabilities in today's fast-paced, competitive business climate.

SEBA was established in 2016 to recognise Malaysian entrepreneurs, SMEs, and conglomerates whose dedication to their professional or personal endeavours has resulted in exceptional achievements in significant contributions to the progress and welfare of the community at large and the advancement of their respective areas of expertise.

By the Ministry of Entrepreneur Development and Cooperatives (MEDAC) 's mission and vision, SEBA seeks to create a platform for Malaysian entrepreneurs to

celebrate their emergence as a superior entrepreneurial country that is prosperous and honourable.

I am delighted to announce that the 7th SEBA and two more editions, the Northern Edition and the Southern Edition, will occur in 2022.

With these two new editions, we aim to recognise and honour Northern and Southern entrepreneurs who have excelled in their respective regions to push them to the next level: the national level. Yayasan Usahawan Malaysia is proud to be paving the way for empowering entrepreneurs and enterprises.

The emergence of COVID-19 strains, along with economic uncertainty, created significant financial woes.

Over the last two years, entrepreneurs and businesses have suffered immensely. We aim to recognise all of their "Rising Up" initiatives despite the adversities presented to them. As a result of the pandemic, entrepreneurs have faced unprecedented challenges. Nonetheless, they

persisted and have now reached the pinnacle of their vocations. The pandemic has altered the economic system.

These entrepreneurs have endured various challenges and setbacks, and they must rise up and come back to propel their businesses to new heights.

Through Yayasan Usahawan Malaysia, we are honoured to be that propellant in encouraging entrepreneurship and businesses. With companies today becoming fixated on a fast-paced environment and sometimes neglecting self-development, we at SEBA attempt to create a semblance of that balance and contribute to achieving it.

New and unforeseen scenarios will arise in the future, but these entrepreneurs must not allow these obstacles to stop them from moving forward but instead constantly persevere to greater heights.

In the words of Steve Jobs, "I'm convinced that about half of what separates the successful entrepreneurs from the non-successful ones is pure perseverance."

RISE UP

RISE UP SEBA is an annual initiative organised by Yayasan Usahawan Malaysia that recognises and honours exemplary South East Asian small and medium-sized enterprises (SMEs), firms, and entrepreneurs who are constantly developing and innovating to make society a better place.

SEBA aims to provide these entrepreneurs and businesses with the platform for recognition, networking, and continuous growth during and post-awards gala dinner.

The award recognises

exceptional companies that excel in their respective fields in business strategies, growth metrics, and best practices.

For the past six editions of SEBA, it has been held in Kuala Lumpur as one comprehensive awards gala, featuring the best of the best awardees and nominees from different business industries from Klang Valley. For 2022, SEBA begins to expand by featuring two different editions, Northern Edition and Southern Edition. The Northern edition will feature entrepreneurs from Kedah,

Pulau Pinang, Perlis, and Perak, while the Southern edition will celebrate entrepreneurs from Johor, Melaka, Negeri Sembilan.

The purpose of expanding SEBA outside of Kuala Lumpur is because we believe there are many entrepreneurs with stellar performances but are not known outside of their regions. With this platform, SEBA aims to recognise and showcase these talents and subsequently bring them to the next level; the national level.

THE BENEFITS The reason for expanding SEBA beyond Kuala Lumpur is that we believe many entrepreneurs thrive but go unrecognised outside of their respective regions. The SEBA platform attempts to identify and recognise extraordinary talent. Following that, SEBA intends to take these remarkable talents to the next level, beyond their regions; the national level.

After discovering these enterprises, SEBA hopes to provide a platform hub where businesses and entrepreneurs may engage, communicate, and share their ideas and experiences with the general public. WHY NORTHERN EDITION?

WHY SOUTHERN EDITION?

The previous six editions of SEBA have been hosted in Kuala Lumpur as a single comprehensive awards gala, presenting the best of the best winners and nominations from various business industries in Klang Valley.

SEBA has chosen Johor Bahru as the location for the Southern Edition, in addition to the Northern Edition and the Kuala Lumpur Grand Gala. The Southern Edition features entrepreneurs and businesses from Johor, Melaka, and Negeri Sembilan.

SEBA begins to expand in 2022 with two different editions, Northern Edition and Southern Edition. The Northern edition will honour entrepreneurs from Kedah, Pulau Pinang, Perlis, and Perak, while the Southern edition will honour entrepreneurs from Johor, Melaka, and Negeri Sembilan.

The rationale for expanding SEBA beyond Kuala Lumpur is that we believe many entrepreneurs have excelled but are under-recognised outside of their regions.

SEBA's platform aims to identify and showcase these talents and bring them to the next level, the national level.

SEBA strives to support the state government's efforts to foster creative entrepreneurship as part of the Penang economy's development, following the Penang2030 vision. In the vision, the state government hopes to establish a platform that will connect entrepreneurs looking for a break with enterprises in need of creative youth and novel solutions to contribute to the future ecosystem.

The Northern region is made up of states with a plethora of resources that allow them to create many high-quality entrepreneurs that are successful in their field. SEBA seeks to recognise and elevate these businesses prospering in that region that fosters creative industries and niche business services.

Owing to the loss of Singaporean visitors due to border closure, countless movement control orders, and economic stagnation, Covid-19 had a significant impact on the Southern region's economy. While the rest of Malaysia remained deafeningly silent on the issue of travel restrictions and business closures, border closures hit Johor especially hard, given the state's long-standing economic links with its southern neighbour.

SEBA strives to honour and nurture these southern entrepreneurs and businesses in support of Iskandar Malaysia's aspiration of becoming "A Strong and Sustainable Metropolis of International Standing" by 2025.

They have successfully conquered the pandemic crisis and reached a professional milestone, and we want to equip them with a platform that will continue to propel them ahead.

The Southern area is made up of states that are rich in tourism pearls, allowing them to produce a large number of high-quality entrepreneurs that are successful in their fields. SEBA wants to recognise and elevate these thriving enterprises in a region that encourages innovative and different business industries.

SEBA GR AND GAL A The SME and Entrepreneurs Business Awards (SEBA) was established in 2016 with the aim of recognising the crème de la crème of Malaysian SMEs and entrepreneurs ac ross a wide range of industries.

It has been a captivating journey in which SEBA has been able to discern Malaysian entrepreneurs, SMEs, and conglomerates whose dedication to their professional or life endeavours has resulted in exceptional achievements in the form of significant contributions to the progress and/or welfare of the community at large, as well as to the advancement of their respective fields of endeavour.

With the passage of time and the continual need to adapt and develop, SEBA strives to be innovative in nurturing and providing the platform and recognition to the awardee each year by leveraging the SEBA branding

and media outreach expertise. The 7th edition of SEBA is exceptionally special this year, with the addition of Northern and Southern editions, in which it aspires to unearth and honour successful entrepreneurs from regions outside Malaysia's capital, Kuala Lumpur. Together, these editions formed a solid representation of the pinnacle of success.

Following the Northern and Southern editions, entrepreneurs and enterprises will have the opportunity to attend our most-awaited and grandiose awards gala, the Central SEBA: RISE UP Gala in Kuala Lumpur.

SEBA strives to be a continuous propeller in assisting entrepreneurs and businesses to grow and reach greater heights in their business expertise and ultimately fostering the Malaysian economy to be the next Entrepreneur Hub.

AWARDS PROCESS Nomination Entry Submit nominations with complete supporting materials and financial documents need to be vetted by Preliminary Vetting Committee across various qualitative and quantitative criteria to validate eligibility, financial strength, individual and corporate achievements, depending on award category. Financial Assessment Rating by appointed financial auditors which may include further interviews with nominees’ administrative and financial teams.

Auditing Process On-Site Audit Inspection and Interview with entrepreneur/company management to uncover leadership caliber and validate long term sustainability rating, a proprietary benchmark created by MyPreneurship and SME and Entrepreneurs Business Awards.

Interview Questions will be prepared by internal team for nominee. The arrangement of the Interview will be set and determined by the internal team to the nominee.

Results An appointed board of advisory will vet through finalised entries and submit their recommendations for the selection of winning recipients and recommended award categories. Final Verification Round by Award Committee and Jury. Confirmation letters are sent out to awardees.

TERMS & CONDITIONS 1. Definition(s) In this document the following words shall have the following meanings: • CUSTOMER means any individual, partnership, limited company, charity and/or organisation that from time to time purchases services and/or products from XHALE ASIA (M) SDN BHD; • PROPOSAL means a statement of work, and/or other similar document describing the services to be provided

by XHALE ASIA (M) SDN BHD and/or its associates; • SERVICES/PRODUCTS means the services specified in the proposal and/or term sheet(s); • The CONTRACT shall mean instructions, confirmed in writing and/or in electronic format, issued and signed by the customer and/or its authorised person on behalf of the customer; • FEE(s) shall mean all charges and expenses that shall be invoiced by XHALE ASIA (M) SDN BHD to the customer for the services provided and/or with consent of delivery of services / products accepted.

• TERMS & CONDITIONS means the terms and conditions of services set out in this document and any special terms and conditions agreed in writing by XHALE ASIA (M) SDN BHD. 2. General • These Terms and Conditions shall apply to all contracts for the supply of Services by XHALE ASIA (M) SDN BHD to the Customer and shall prevail over any other documentation and/or communication by the Customer.

• Any variation to these Terms and conditions shall be inapplicable unless agreed in writing by XHALE ASIA (M) SDN BHD. • Nothing in these Terms & Conditions shall prejudice any condition and/or warranty, express and/or implied, or any legal remedy to which XHALE ASIA (M) SDN BHD may be entitled in relation to the Services, by virtue of any statute law or regulations governing the laws of Malaysia.

• Nothing in these Terms & conditions shall affect the customer’s statutory rights as a consumer.

3. The Service • The service proposal agreed that link to these Terms & Conditions shall remain valid till the event date and/or the delivery of such services / products.

• The Customer shall be deemed to have accepted the Terms and Conditions by placing an order with the supplier within the period specified in the Clause above.

• Letter of Acceptance (LOA) sent to the customers duly signed by the customers is an agreement to the given mentioned Terms & Conditions.

4. Fees- Completion and Payment • The Package fee(s) is as specified in the proposals as released by the Management from time to time.

• The Package fee(s) is to be paid within 15 days of the date of invoice issued.

• If the Customer fails to make any payment within 30 days of it becoming due, the Supplier shall be entitled to charge interest at the rate of 1.5% per month on the outstanding amounts.

• Fees are subject to clause 8 – Cancellation & Termination.

• Payment of the fee shall be in the manner specified in the invoice and send the Payment Advice for payment to finance@xhaleasia.com.

5. Confidentiality & Data Protection • Information disclosed by the customer will be kept confidential and shared only with relevant staff providing the service as agreed. Such information shall be held solely for the purposes of fulfilling the contract.

• XHALE ASIA (M) SDN BHD will not transmit any personal data held on behalf of the client except where a) The transfer is a necessary part of the work undertaken to fulfil the contract or b) There is a requirement to do so by operation of the law.

6. Complaints And Disputes • XHALE ASIA (M) SDN BHD will always aim to deliver excellence. However if the customer has some concerns or complaints he/she may reach out within 5 working days to our Secretariat SEBA 2022 at support@seba.asia • If there is a dispute or discrepancies about the interpretation and/or operation of this contract then XHALE ASIA (M) SDN BHD will make every effort to resolve the dispute when and where it arises, negotiating on the basis of good faith.

7. Limitation Of Liability •XHALE ASIA (M) SDN BHD will not be held responsible for third party costs incurred by the customer for any reason whatsoever.

8. Cancellation & Termination •Confirmation of SEBA 2022 entries and seats is upon full receipt of full payment.

•All payment are non-refundable and non-transferable.

•Full payment shall be received within 15 days of the date of invoice issued failing which your SEBA seats and/or other deliverables will be deemed invalid and void.

•Once payment made no cancellation and/or termination requests shall be entertained.

9. Force Majeure Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension of its obligations.

10. Severance If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect.

11. Governing Law And Jurisdiction Any disputes or claims arising out of or in connection with these Terms and Conditions of Business shall be governed by and construed in accordance with the laws of the land.

12. Acceptable Of Terms By signing and dating the Letter of Acceptance (LOA) you will be accepting the Terms and Conditions of Business.
