special services Andre’s Advice brought to you by LabourNet The Basic Conditions of Employment Act (BCEA) of 1997 confirms that an employee is entitled to three weeks annual leave for every 12 months worked. However what is the situation if the employee resigns and leaves the company's employment prior to taking any of his annual leave?

In terms of section 20(11)(a) of the BCEA an employee is only entitled to be paid for annual leave when the employment relationship ends.

However in Ludick v Rural Maintenance (Pty) Ltd [2014] 2 BLLR 178 (LC) the employee had been with the company for 27 months (employed January) and had not taken any annual leave.

The employer only paid him pro-rata leave for his last 3 months of employment.

Rural Maintenance argued that he had forfeited his right to annual leave payment for his first and second leave cycles since Ludick had agreed in his employment contract that he was required to take his annual leave by no later than 30 March of each year, which he had failed to do. The judge ruled that employees are

required to take accrued annual leave at the end of each annual leave cycle as the very purpose of the Act is to ensure that employees have a yearly rest period. Annual leave is not to be accumulated like a savings account, to be paid out when an employee leaves.

The purposes of annual leave would be frustrated if this were allowed. The Judge ruled that section 20(3) of the BCEA allowed an employee to take annual leave within 6 months of the completion of each leave cycle. However as Ludick failed to do so for the first annual leave cycle he was not entitled to leave pay.

However the employee was entitled to leave pay for his second annual leave cycle as the 6 month period was still in operation when he left.

tides involve the rise and fall of sea levels but vary according to the lunar, solar and atmospheric forces at work. There are 3 basic types of daily tides and a fourth type that encompasses atmospheric variations.

A diurnal tide has one episode of high water and one episode of low water each day.

A semi-diurnal tide has two episodes of equal high water and two episodes of low equal water each day.

Mixed tides, like the semi-diurnal tide, can have two episodes of high water and two episodes of low water per day. However, unlike a semi-diurnal tide, mixed tides are unequal, meaning they do not rise and fall to the same levels. Mixed tides can either include both sets of unequal high and low waters, or only one set of unequal high or low waters. religion matters Is your reality - truth?

Most people are where they are in life, because of who they are? They keep wanting their circumstances to change, but don't want to change “self”. What makes up YOU! Unless you take a hard look in the mirror and begin to conceptualize your DNA, for what it really is – your choices will not change. You need to ask yourself, what can I do differently in order to get a different result in my life. Patterns emerge in families and you could be first to break those negative patterns and change the destiny of the generation to come. If you are not getting anywhere in life, stop blaming those around you and the circumstances around you. This is a cop out for you just to remain where you are. Get counsel in the area you are struggling in! No man is an island!

Imagine you are in a plane, as the aircraft climbs up into the clouds, familiar landmarks become more difficult to recognize. The world looks different from this perspective. We get a systemic perspective – we get a sense of the whole and how the parts relate. All these units of interconnectedness are now seen as parts of larger whole, ie rivers, towns etc. Maybe you need to stop looking at what is just in front of you, the problem that is overwhelming you and look at the bigger picture. How you perceive self will influence those in your system around you!

An aeroplane has a black box with all the recorded info regarding the operations of that aircraft. What is in your black box? If protocol has been breached there are consequences for the pilot.

What is not lined up in your life to the word of God? This deception will steer you off course of what Gods plan are for your life, as it affects the choices that you make. You will crash!

What if a pilot does not have visual access to the outside world – dark outside – what does he rely on – his instruments – What do you rely on to get you to a safe landing.

We tend to create our own realities and then

either ignore scripture, or make scripture fit with where we are. We thus evade the truth about ourselves and believe a lie.

Why do we battle to see the truth according to what really is portrayed in the mirror, so that we can align it with the word of God. I believe that they are formulated in our minds, because of events in our lives, and then act out faulty perceptions portrayed as truth.

Possible areas of deception in our lives: 1. How we view God 2. How we view ourselves 3. How we view our relationship in our marriage 4. How we view our other relationships familial and friendships 5. How we view our work 6. How we view our finances 7. How we view our weaknesses We do have a Father in heaven, that we can learn from and can guide us – if you are willing to hear and to change.

Shake the foundations of your life and begin to rebuild on solid principles that will positively influence your choices in life. Your choices determine where you land up? Don't take them lightly.

Remember that God has great plans for you life!
