SOME EXAMPLES OF OUR INTELLECTUAL PROPERTY DISPUTES WORK…

We have a vast amount of experience across the team. Some recent examples that give an idea of the level of work we regularly undertake are:

• Successfully settling a claim against a medical indemnity insurer, in respect of an alleged infringement of database rights and an alleged misuse of confidential information by a former employee of the claimant, another medical indemnity insurer.

• Assisting the subsidiary of a major manufacturer of automotive chassis and body components to undertake proceedings in the Company Names Tribunal to order a competitor to change its name to a name that is not confusingly similar to our client’s name.

• Advising a leading engineering research and development business in connection with proceedings against a professional sports team which had sought to exploit the client’s patented technology without licence terms and achieving a satisfactory settlement for our client before trial.

• Acting for a major business software reseller in a substantial dispute with a blue-chip former customer relating to subsistence and infringement of intellectual property rights in a legacy database and system.

• Representing a major leisure operator in a passing off dispute with a parking operator who held themselves out as the official off-site car parking provider for major events taking place at our client’s facility.

• Continuing to represent a leading manufacturer of measurement instruments in a long-running dispute concerning claims in relation to unauthorised use of its proprietary software.

• Advising a client in relation to the defence of a claim for the alleged infringement of copyright and design right of a high value, award-winning lighting system.

• Assisting a technology services provider to the telecommunications sector to satisfactorily settle a dispute about the ownership of and rights to exploit its technology platform.
