BEST INTEREST OF THE CHILD

A rule that means we want to reduce pain & increase what is good for the child in any action affecting them.

• ‘In this situation, what will reduce pain and harm for the child?’

• ‘In this situation, what will be good for the child?’

Child-Protective Prosecutions

• Approaching cases with the BEST INTEREST OF THE CHILD in mind is known as child-protective prosecutions.

• Upholding the best interest of the child is a duty under Philippine law; we refer to it as the DUTY OF CARE for child victims.

• This duty of care must go hand in hand with BURDEN OF PROOF in prosecution of cases.
