The Forum is conducted under Chatham House Rule which is used around the world to encourage inclusive and open dialogue in meetings. It helps create a trusted environment for dialogue. We ask all participants, in person or online, to respect Chatham House Rule as the basis for today’s dialogue.

The Rule’s guiding spirit is: share the information you receive, but do not reveal the identity of who said it.

與台灣淵源深厚的 Work Better Innovations,早在2022年推出了 本中英雙語的企

業指南,是關於國際勞⼯組織11項強迫勞動指標的在地化。過去超過⼀年的時間, 我們積極促成這場論壇,終於在今年 4 ⽉ 9 ⽇夢想實踐。

我們相信預防勝於治療。該企業指南的⽤意,正是希望藉由傳遞準確的資訊,提升社 會辨識、預防和化解強迫勞動的⾵險。這個轉變的重要性,不僅關乎台灣的供應鏈在 國際市場的競爭⼒,也是為了打造更美好的未來。

當前,國際社會對⼈權和環境盡責調查的期待直接影響了台灣供應鏈的商業模式,⽽ 許多品牌的要求更⾼於台灣國內的法規,台灣必須在這個⼗字路⼝抉擇。

各⽅的發展無不盼望台灣的企業制定⼀套⼈權政策、落實⼈權盡責調職、和補救其已 造成的⼈權傷害。這也包含為了接軌《聯合國⼯商企業與⼈權指導原則》、預期將於 今(2024)年底前更新的《臺灣企業與⼈權國家⾏動計畫》。

藉由匯聚國際和本地企業探討全球公⺠責任,我們期許論壇能成為台灣企業履⾏對⼈ 權責任的推⼿,持續助⻑這股充滿活⼒的在地轉變。企業與⼈權仰賴不間斷地學習和 改善,唯有此,能讓在全球經濟中擁有重要影響⼒的台灣企業,站在「台灣能幫忙 (Taiwan Can Help) 」浪潮的尖端,這也是我們今天⿑聚 堂的原因。

Dear Participants,

Today’s Taiwan Business Forum for Human Rights and Environmental Due Diligence has been more than a year in the making. In 2022, Work Better Innovations, with our deep connection to Taiwan, prepared a guidebook in both Chinese and English on International Labour Organization’s 11 indicators of forced labour that were localised to the Taiwanese context.

Our aim was to bring about accurate knowledge, so that risks can be proactively identified, prevented and mitigated. We believe that not only must we address risks of forced labour in Taiwanese supply chains for the competitiveness of the domestic economy, but that we must do it because we have to do everything possible to realise a better tomorrow.

Message from Organiser

The same is true for Taiwan at this juncture, where global expectations of corporate sustainability due diligence for human rights and the environment have a direct impact on the business activities of Taiwanese suppliers Many global brands operate with higher human rights and environment expectations than the domestic laws of Taiwan.

This calls on all enterprises in Taiwan to institute a corporate human rights policy, implement a human rights due diligence process, and to remediate their negative human rights impacts. Taiwan’s own National Action Plan on Business and Human Rights that is due for revision this year in 2024, to implement the UN Guiding Principles on Business and Human Rights, calls for all these steps.

It is our hope that this Forum, by bringing together international and local business leaders for corporate citizenship, can spur on a sustained and dynamic local movement for the corporate responsibility to respect human rights in Taiwan. At its core this is why we are all here today the business and human rights journey is one of continuous learning, so that Taiwanese enterprises that have such a significant footprint in the global economy can also be a meaningful part of the call of “Taiwan Can Help” internationally.

On behalf of our project team, I thank our funder and our fellow organiser, Institute for Human Rights and Business, and the supporting organisations CommonWealth Magazine, European Chamber of Commerce Taiwan and Target for collaboration.

Work Better Innovations (WBI)

「台灣企業⼈權⽅案」由 WBI 執⾏⻑凌怡華和科技法律學院邱羽凡副教授在 2023 年 9 ⽉創辦,延續當年⼆⽉共同開設的碩⼠班課程供應鏈中的國際⼈ 權,旨在培養和提升台灣企業與⼈權議題的⼈才。

In the months leading to the Taiwan Business Forum for Human Rights and Environmental Due Diligence, Work Better Innovations prepared and released a series of policy briefs (English and Chinese) to accompany each of the three themes for today’s forum.

These policy briefs are available digitally. They can be viewed online as flipbooks and downloaded as PDFs. These are educational materials that we hope would deepen today’s discussions in accurate knowledge and frame this examination of the current state of play of corporate sustainability due diligence in Taiwan in an international context.

These policy briefs were released in February and April 2024 under Work Better Innovations’ collaboration with the School of Law, National Yang Ming Chiao Tung University, the Taiwan Project for Business and Human Rights.

Dr Bonny Ling, Executive Director of WBI, and Law Professor Yu-Fan Chiu founded the Taiwan Project in September 2023 to educate and build the capacity needed for business and human rights in Taiwan, following the launch of their postgraduate class on international human rights in supply chain in February 2023.

Speakers

Ninh Trinh is Director of Responsible Sourcing and Sustainability for Target based in Hong Kong. Target is a US based retailer headquartered in Minneapolis, Minnesota. Target is recognized as one of the best large workplaces to work in retail. Target had revenues of $107 billion and operates over 2000 stores

As Target’s Director of Responsible Sourcing, he manages teams responsible for upholding human rights standards and helping promote environmental practices that minimize their impact on resources throughout Target’s global supply chain. Target manufactures product in over 4000 facilities globally. He has over 20 years of experience in various positions within the retail industry and supply chain developing programs and approaches to support upholding high standards and driving supply chain improvements. Ninh has held leadership roles in multi-stakeholder initiatives aimed at improving conditions and industry approaches including Social Labor Convergence Program as a Board member, Cascale, and industry leading brand groups. He currently resides in Hong Kong and speaks English and Thai.

Dr. Bonny Ling

Executive Director, Work Better Innovations; Research Fellow, Institute for Human Rights and Business and University of Nottingham, Taiwan Research Hub; CoFounder, Taiwan Project for Business and Human Rights

Dr Bonny Ling is the Executive Director of Work Better Innovations, an international social enterprise working on new ideas for a responsible economy, both as a research consultancy and as a community service organisation. The education and training work by Work Better Innovations on preventing the risks of forced labour has appeared in the corporate sustainability reports of Target, Dell and HPE. We received the Community Innovation of the Year Award in 2022 in Portsmouth, UK for our community service work to build a responsible economy from the ground up.

Bonny is also a Senior Non-Resident Fellow with the University of Nottingham Taiwan Research Hub; a Research Fellow at the international think-tank, Institute for Human Rights and Business; a Global Taiwan Institute Scholar and Visiting Professor at the School of Law, National Yang Ming Chiao Tung University, where she teaches a postgraduate course on business and human rights. She is a Co-Founder of the Taiwan Project for Business and Human Rights, a project dedicated to increase knowledge and build the local capacity needed to address business and human rights issues in Taiwan.

She holds a PhD in Law from the Irish Centre for Human Rights, an MPhil in Criminology from Cambridge University and an MA in Law and Diplomacy from the Fletcher School. She has worked for the UN in Bosnia-Herzegovina, Cyprus and Liberia, as well as having served as an international election observer for the OSCE in Eastern Europe. She was an international election observer for the historical referendum in Timor-Leste in 1999. She writes on human rights, migration, business responsibilities, and international development for the CommonWealth Magazine, Ketagalan Media, New Bloom, Taipei Times, Taiwan Insight, and The News Lens.

She grew up in Kaohsiung, Taipei and Atlanta Bonny received the Fletcher Women's Leadership Award in March 2024.

在天下雜誌任職20年,期間歷任記者、主筆、召集⼈,負責路線遍及傳統製造、資訊 電⼦、半導體、汽⾞、房地產等⾏業;2015年,轉任調查中⼼主管,職掌企業、學 校、縣市等各類型問卷與⺠意調查。 ⽬前所負責的調查專案⼤多在台灣具有指標意 義。例如「2000⼤企業調查」(Survey of Taiwan's Top Enterprises)為國內 規模最⼤的企業年度營運表現調查、「天下永續公⺠獎」(Excellence in Corporate Social Responsibility)為國內最具影響⼒的企業ESG評選、「幸福城市⼤調查」 (CommonWealth City Happiness Survey)為國內規模最⼤的城市競爭⼒與縣市 ⾸⻑滿意度⺠調排⾏。

Jimmy Hsiung has been with the CommonWealth Publication Group for over 20 years, during this time he has served as reporter, chief writer, and now as Deputy Editor-at-Large of Taiwan’s largest business magazine. His reporting has covered stories on manufacturing, information technology, semiconductors, automobiles, real estate and other industries. In 2015, he became the head of the CommonWealth Survey Center, which carries out questionnaires and surveys for enterprises, schools, counties and cities.

Jimmy Hsiung’s work has been very influential in Taiwan to drive at corporate sustainability. He and his team are responsible for compiling and awarding “Taiwan's Top 2000 Enterprises," which is the largest annual operating performance survey of domestic companies, and the "Excellence in Corporate Social Responsibility," which is the ESG selection of the most influential companies in Taiwan. Furthermore, the "CommonWealth City Happiness Survey" is the largest domestic poll ranking of urban competitiveness and satisfaction in Taiwan. As the Head of CommonWealth Sustainability League, Jimmy Hsiung works with industry groups and enterprises on responsible business conduct in Taiwan.

江惠櫻⼥⼠在永續歷程上擁有豐富的經驗,為了能更進 步的了解公共政策與產業間 的有效對話與合作,取得了國⽴臺灣⼤學政治研究所公共政策碩⼠學程。2000年加 ⼊惠普公司 (HP) 後,曾任職於惠普科技環保事務處暨台灣公共事務處協理、海關事 務處南亞區經理和進出⼝部台灣區經理。除現任慧與科技亞太區永續環境部協理,負 責亞太區永續相關事務外,更協助積極參與產業與政府間的⼯作,包含台北市電腦公 會企業綠⾊競爭⼒聯盟副會⻑、經濟部國家品質獎審查委員、亞洲⽣產⼒組織 (APO) 諮議委員、⼯業局綠⾊⼯廠審查委員、勞動部勞動⼒發展署桃⽵苗分署⼩型企業⼈⼒ 提升輔導計畫顧問、美國資訊技術產業協會法規與永續委員會亞太區主席,以及台灣 永續能源研究基⾦會常務委員等。

Christine Chiang holds multiple committee positions She is the Committee Chair of Information Technology Industry Asia Pacific Regulatory and Sustainability Committee, member of the APO Advisory Committee, member of the review committee of National Quality Award, member of review committee of Ministry of Economic Affairs’ Green Factory and HP Taiwan Country Manager of International Trade and HP Senior Manager of Environmental Manager / Public Affairs. She received her Master of Public Administration from the National Taiwan University.

Hiroshi Ishida

Executive Director, Caux Round Table Japan (CRT-Japan)

Preceding the CRT Japan, Hiroshi Ishida worked at the Indust (IBJ) for 10 years. After resigning from IBJ in 2000, Ishida was appointed as the Coordinator of CRT Japan, and now he has been working as the Executive Director of CRT Japan. He provides extensive consulting services on CSR and Sustainability for enhanced intangible asset of corporate value, including, (1) disseminating the UN Guiding Principles on Business and Human Rights domestically with global initiative organizations, and assisting government, organizations, and companies in implementing them into their daily operations, (2) assisting companies in developing their global business strategies and corporate structures, (3) initiating a rule making to enhance the presence of Japanese companies globally, (4) organizing seminars and conferences on CSR and Sustainability, and (5) providing trainings to foster global human resources with “human capability” and morality.

Guna Subramaniam

Asia Pacific Representative, Leadership Group for Responsible Recruitment and Asia Regional Manager, Migrant Workers Programme, Institute for Human Rights and Business

Guna has over 20 years varied experience in the nonprofit sector across the Asia Pacific and Central Africa. This includes building partnerships with multiple stakeholders in business and human rights, resettlement programs for refugees, and managing investigations on wildlife trafficking. His work on protected species bycatch and depleting fish stocks led to his Masters (International Community Development, Victoria U) research paper which focused on gaps and blindspots of stakeholders involved in addressing human trafficking and forced labour in the fisheries sector.

At IHRB, Guna manages the Migrant Workers programme and provides support for the Just Transitions and Oceans programmes in the Asia region. He coordinates with businesses, governments and civil society organisations for their engagement with the Leadership Group for Responsible Recruitment (a coalition of global brands, CSOs and UN agencies), and their participation at regional roundtables and the Global Forum for Responsible Recruitment.

John Zhong is the Sustainability Specialist for the IKEA supply area in East Asia. Prior to this, John is the Operations Manager of Ethical Standards for Wal-Mart Global Procurement Far East.

Speakers

Aarti Kapoor is a qualified lawyer in both the UK (England and Wales) and the US (New York state). She also has Masters degrees in 'Law and Economics' as well as 'Systems Leadership and Organisational Analysis'.

Aarti has over 25 years of professional experience, including 20 years working on human rights issues, with a focus on forced labour, human trafficking and child exploitation. She is also a trained Organisational Analyst and has worked in leadership positions in the UK and South East Asia across government, NGOs and corporate agencies as well as undertaken assignments in Eastern Europe and Africa.

Since setting up Embode, Aarti has overseen the growth and strengthening of a broad client portfolio across Asia and Africa in the highly specialised areas of labour rights, child protection and migration. She has directly led Embode's seminal studies such as a series of published assessments called ‘Children at the Heart’ which focused on sector wide issue of child labour in cocoa supply chains in Côte d'Ivoire, Ghana and Indonesia. Aarti also led a comprehensive situational assessment of migrant labour vulnerabilities in the palm oil sector of Malaysia, analysing Nepal as a labour-sending country, resulting in the publication of ‘The Road to Worthy Work and Valuable Labour’. She has led countless other research studies and now focuses on supporting senior leadership teams across corporate business and UN/NGO programmes on effective strategic interventions protecting human rights in supply chains. Aarti sits on a number of expert advisory boards on business and human rights.

Aarti is known in the sector for her analytical mind and capability to think strategically and systemically. She is passionately dedicated to helping organisations reach their highest potential and effectiveness.

許修豪律師專精於聘僱及勞⼯法、爭議解決等領域。許律師榮獲2024年錢伯斯⼤中 華區指南(Chambers Greater China Region Guide ) ⾸選律師和2024年亞太法律服 務評鑑五百強(The Legal Asia Pacific) 推薦律師榮耀。錢伯斯指南和法律服務評 鑑五百強讚揚許律師在跨國企業聘僱契約⽅⾯的雄厚專業能⼒,客⼾均盛讚其處理 案件時快速積極的態度,並且「對勞動市場具有真正深⼊的瞭解及專業知識」。許 律師協助並代表本國與外商企業處理聘僱事務,經驗豐富,包括解決勞動爭議、處 理企業併購 (M&A) 交易引起之僱傭問題、與⼯會進⾏集體談判協議斡旋、⼤量解 僱,及遵循聘僱法規。許修豪律師是美國紐約⼤學法律碩⼠, 臺灣⼤學法律學研究所 法學碩⼠和法律學系法學學⼠。

Howard Shiu is a partner and member of the Employment Practice Group in Baker McKenzie, Taipei. He focuses on trust law and dispute resolution. He was recognized as a Notable Practitioner by Chambers Asia Pacific 2016. Noted as a Band 1 Lawyer by Chambers Greater China Region Guide (2024) and Recommended Lawyer by The Legal 500 Asia Pacific (2024), he is described as possessing strong expertise in employment contracts for multinational corporations and that clients praise his responsiveness and "really, really good understanding and knowledge of the labor market."

He has considerable experience assisting and representing local and foreign corporations in labor and employment matters, including resolution of labor disputes, employment issues in merger and acquisition transactions, negotiation of collective bargaining agreements with unions, mass severance, and compliance of employment regulations. He graduated from the New York University School of Law (LL.M.) and National Taiwan University (LL.M. and LL.B.).

Neill Wilkins is responsible for all aspects of the IHRB Migrant Workers programme and in 2011 helped oversee the development of the Dhaka Principles for Migration With Dignity - a set of human rights based principles that offer a clear framework for understanding the recruitment and employment of migrant workers worldwide. More recently Neill has led much of IHRB’s work around responsible recruitment and the promotion of recruitment models based on the Employer Pays Principle which prohibit the charging of recruitment fees and costs to workers.

Neill also manages IHRB engagement with the modern slavery agenda and speaks regularly at events focussed on forced labour, trafficking and transparency legislation. He has worked extensively with the construction, apparel and hospitality sectors along with participation at intergovernmental events such as the Colombo Process and Global Forum for Migration and Development.

Her stories covering solar power in Taiwan have earned Honorable Mentions from the Society of Publishers in Asia. Moreover, her works on the environmental and human costs of lithium mining in Chile was honoured with 2023 Taiwan’s prestigious Vivian Wu Journalism Award. Additionally, she has served as a pro bono ambassador for Clean Energy Wire, a Berlin-centric media outlet focused on energy transition. She is the editor for CommonWealth's English website and hosts the Taiwanology podcast.

Kuan is Founder of Story Wear. Story Wear is a Taiwanese sustainable fashion social enterprise that uses 100 percent upcycled fabric waste, primarily denim, to manufacture our entire collection. Our garment makers are skilled local seamstress and women from NGO groups that help socioeconomic disadvantaged communities. Story Wear also collaborates with large corporate partners to upcycle their own textiles waste into new products. Past projects have included collaborations with Levi’s, IKEA, L’Oreal and Standard Chartered and more.

Wen has more than 8 years of consultant experience in sustainability and renewable energy. Rebeca Sanchez de Tagle White is an ESG Manager at FMO, the Dutch Development Bank. She has 20+ years of experience working in the ESG space of Development Finance Institutions (IDB, IFC & FMO). First as a Specialist providing Advisory Services in Corporate Governance to Financial Institutions, Private Equity Funds and family-owned private sector companies in emerging markets. Since 2021 she has managed an international team of Environmental and Social (Human Rights) and Governance specialists dedicated to conducting due diligence of financial institutions to identify gaps when benchmarked against international best practices and producing action plans which become commitments connected to a loan or equity transaction.

Ms. Sanchez de Tagle White serves on the advisory board of two Latin American closely held companies. She is an active member of the European DFI Network, a member of the Diversity and the Inclusion Advisory Board at FMO. She has designed and delivered numerous training seminars for Private Equity Funds, DFIs and investee companies of FMO, investment professionals, etc

Rebeca has an M.A. in International Business and Development Economics from The Fletcher School (Tufts University) and has participated in numerous executive education courses on ESG-related topics. She is binational, Mexico & USA and has lived in various countries. She currently lives in The Netherlands with her husband and two daughters.

Global Human Rights Senior Manager, Samsung Electronics

Monique Gerson is a Business and Human Rights Professional with experience in guiding enterprises in promoting transparency, decent work and fundamental principles and rights at work and in global supply chains.

In her current function as Global Human Rights Senior Manager at Samsung Electronics, Monique provides technical guidance to internal core teams to better detect, address, prevent and remediate human rights risks, ranging from policy development, process improvements, internal capacity building efforts, and engagement with external organizations on strategic issues, among others.

Prior to Samsung, Monique has worked on business and human rights on various levels including on NGO level and research in India and Nepal as well as at a consulting firm and on private sector level in the Netherlands. In her previous role at the business association amfori in Belgium, she supported more than 2.300 member companies in their human rights due diligence journey.

Monique holds a Bachelor degree in Anthropology and Psychology, a Master degree in Anthropology with focus on international development and further academic education in socially responsible and sustainable business.
