A Simple Guide to Hiring Your First Employee

Are you overwhelmed in your chiropractic practice? It’s time to delegate.
Running your own business is rewarding, but can leave you scattered, tired, and hitting an income ceiling. If doing everything on your own is impacting your home life and bottom line, it’s time to make a change. And your first hire is worth doing thoughtfully.
That’s why I spoke with Nicole McCance. She knows all about taking the first step with intention.
Nicole, a retired psychologist and business coach, scaled her practice from solo practitioner to 55 practitioners in just three years. She’s also a mom to twin toddlers, a loving partner, and now helps therapists grow into group practices.
Nicole realized she needed to expand her practice when she had two young kids and too much on her plate, but she didn’t act right away. “We weren’t taught the business side in school. There were no mentors. I didn’t want to make the wrong choice,” she says.
She finally made a move when her discomfort was too high to ignore. “I was home at 7:00 pm every night, only seeing my kids for half an hour. Finally, I hit a wall and decided, ‘I’m starting a group practice. I don’t care if I don’t know what I’m doing.’”
Nicole’s first step was hiring an intern to grow with her, but your first move might look different. Her advice? Let your problem guide you.
Nicole’s problem was knowing she needed help but not where to start, so she hired someone eager to learn alongside her. If you’re unsure what your first step should be, here are some Nicole-approved brainstorming questions:
• What’s not getting done because I’m just one?
• What am I saying no to?
• What do my patients need?
Nicole has so much good advice that we distilled it down into five steps. Here’s how to make your first-hire journey as smooth as possible:
Î Step 1: Understand your problem
What’s not getting done because you’re just one? Start by listing tasks you can’t get to because it’s just you.
Then ask, “What am I saying no to?” Nicole constantly turned away patients. If a waitlist isn’t your issue, what are you missing out on? Learning new techniques? Time with family? If another hand could change this, it’s time to hire.
Î Step 2: Determine what you want in an employee
Your first hire should feel like a version of you. “People expect you, or at least a flavor of you,” Nicole notes. List the qualities and values your patients appreciate in you. “Find someone who reflects your energy and quality,” she says.
Î Step 3: Screen applicants first, then interview “Don’t waste hours on Zoom until candidates are screened.” To find a good fit, trust more than your gut. Nicole used The Big Five Personality Test to find highly conscientious candidates. Also, ask yourself: overall, are you impressed? The right person should inspire confidence.
Î Step 4: Write an attractive job listing
Your job posting is your main sales tool. Write directly to your ideal team member, focusing on their dreams. Many job posts read like corporate descriptions. Don’t do that. Show them why they want to work with you. Highlight any perks, like office plants or the ability to control the playlist.
HOT TIP: Check your job posting. Compare how often “we” is used versus “you.” If you find “we” twice as much, rewrite. It’s about attracting them, not restating your business profile.
Î Step 5: Be proactive in hiring
Keep your job posting up year-round. Nicole kept her posting on Indeed to have a bank of resumes ready whenever she needed someone. Keeping options open lets you meet high-quality candidates even when you’re not in urgent need.

Rep. Clint Moses Reelected to the 92nd Assembly District
State Representative Clint Moses (R-Menomonie) was reelected to the Wisconsin State Assembly last month beating his opponent former State Rep. Joe Plouff 53%-47%. Moses is the first chiropractor elected to the Wisconsin Legislature and won reelection to his third term in the Wisconsin State Assembly.
“We congratulate Rep. Moses on his re election and look forward to working with him during the upcoming legislative session,” said John Murray, WCA Executive Director.
Republicans Retain Slimmer Majorities in Both Houses of the Wisconsin Legislature
Wisconsin voters once again showed their purple colors by voting for Republican Donald Trump for President, reelecting Democrat Senator Tammy Baldwin to the US Senate and reelecting all incumbent members of Congress.
Republicans lost 10 seats in the Wisconsin Assembly but still have a 54-45 seat majority. Senate Republicans lost 4 seats but still have an 18-15 seat majority going into to the 2025-2026 legislative session. Democrat Governor Tony Evers has two more years on his current term and has yet to indicate if he will run for a third term.
“The WCA has worked hard to build relationships with elected officials of both political parties and we feel confident we can navigate the partisan split in the State Capitol during the upcoming legislative session,” said John Murray, WCA Executive Director.
Boundaries and Ethics Training Will Be Required Starting in 2025.
Wisconsin chiropractors will be required to complete 2 hours (of the 40 total required hours) of training in the area of boundaries and ethics. While clearinghouse rule 22-066 was approved by the Wisconsin Chiropractic Examining Board in 2023, it will not go into effect until the 2025-2026 license renewal period. The text of the rule reads as follows:
SECTION 1. Chir 5.01 (1) (i) is created to read: Chir 5.01 (1) (i) The requirements in this paragraph first apply to the renewal period beginning December 16, 2024. Of the 40 continuing education hours required in par. (a), 2 hours shall be on the topic of professional boundaries and ethics approved under s. Chir 5.02. Professional boundaries and ethics courses may include any of the following subjects:
1. Sexual misconduct as defined in s. Chir 6.02 (7).
2. Ethics in billing or business management practices.
3. Risk management.
4. Professional boundaries in clinical practice settings.
5. Any other topic that the Board or the Board’s designee approves as being related to the subject of professional boundaries and ethics.
SECTION 2 EFFECTIVE DATE. The rules adopted in this order shall take effect on the first day of the month following publication in the Wisconsin Administrative Register, pursuant to s. 227.22 (2) (intro.), Stats.

Stoffel and Court Elected to Represent the NW District on WCA Board of Directors
The WCA Board of Directors has two new board members. During the November 2024 NW District meeting held at Optima Vitality & Health in Eau Claire, Dr. Jacob Stoffel and Dr. Michael Court were elected to represent the NW District on the WCA Board of Directors. Dr. Jenny Waidelich who represented the NW district for six years is stepping off the board and has retired from practice.
“On behalf of the WCA Board and our membership, I want to thank Dr. Jenny Waidelich for her service representing the NW district,” said John Murray, WCA Executive Director. “I also want to welcome Dr. Court and Dr. Stoffel to the WCA Board.”

I’m seeing the opportunity that it's never had before, where the sky is literally the limit. DCs being successful, in clinical cases, in solo practice, integrated settings, hospitals, in ethical business models (cash, in or out of networks, they are both capable of making a living!), its amazing!
Meet Dr. Michael Court
I've been in practice for over 35 years. Over that time, I have realized the impact that chiropractic has had on improving the lives of countless people. I have a deep respect for the chiropractic profession and the future growth in Wisconsin.
I owe my personal success to standing on the shoulders of the giants who came before me and wish to see our profession grow and prosper in the future. I believe that the WCA is instrumental in doing just that.
But I also see many areas where the profession is in danger; it's complacent, the burnout, the cultural battle that's ongoing, the current state of the educational institutions and state regulations and their variances and the scene students and new providers have to navigate and consider. That in particular could impact WI in a significant way if we are not proactive in that regard. If we indeed let these things go and not do something to keep expanding and capitalizing on these opportunities, what is a boundless future will be relegated to a singular "complementary" side service with a severely handicapped future where we are considered as nothing more than technicians instead of the doctors we are trained to be.

Be Cautious: Improper Billing Could Result in Significant Financial Penalties

Recently, Healing Place Medical, P.C. and its owner, chiropractor Dr. Gregory Thomas White Jr., had to pay $170,000 to settle allegations of improper billing. The issue? They were accused of billing Medicare for treatments involving the Sanexas device, which weren't covered. This situation is part of a more extensive, ongoing national investigation into how these devices are being billed—and it serves as a big warning to chiropractors everywhere. (U.S. Attorney's Office, Eastern District of Pennsylvania, 2024)
What Happened?
Healing Place Medical, like many chiropractic clinics, used the Sanexas neoGEN-Series device to treat pain and other issues. Sanexas is an electric stimulation machine often used for patients with chronic or acute pain conditions such as edema. In this case, patients were treated with the device twice a week over 12 weeks, and each session lasted around 30-40 minutes. To enhance the treatment, the clinic also administered vitamin injections.
So, what's the problem?
According to the U.S. government, Medicare doesn't cover these treatments when used as Healing Place was administering them. Specifically, rules such as National Coverage Determination (NCD) 160.7.1 don't reimburse electrical nerve stimulation treatments provided in a chiropractic clinic or similar settings. Despite these guidelines, Healing Place billed Medicare for over 27,000 claims related to Sanexas, vitamin injections, and other tests that weren't covered.
Testing: More Is Not Always Better
In addition to the treatments, Healing Place was also billing for extra tests that weren't necessary, such as ENFD (nerve damage testing) and T.M. Flow (a type of screening for underlying conditions). While these tests may sound good on paper, Medicare found them to be overkill. The Sanexas device isn't FDA-approved for nerve regeneration, so testing to see if nerves were healing after treatment was pointless—and billing Medicare for it was a no-go.
The TM Flow tests, used to screen patients before starting Sanexas treatments, also raised concerns. The clinic needed the right expertise to perform and interpret these tests, and they were using them on patients who didn't even show symptoms of the conditions the tests were meant to screen for. Medicare rules require specific training and symptoms for these tests to be covered.
What Chiropractors Need to Know
This case should be a wake-up call for chiropractors across the country.
The government monitors how specific devices, such as the Sanexas, are being billed and cracking down on improper practices.
The message is clear:
If you're billing Medicare, ensure you follow the rules to the letter.
Improper billing can lead to serious financial consequences, as this case with Healing Place Medical shows. It's not just about the fine—it's about the potential damage to your reputation and the risk of being excluded from Medicare altogether.
Chiropractors play a crucial role in patient care, but part of that responsibility includes ensuring that billing practices are ethical and compliant.

The annual deductible for all Medicare Part B beneficiaries will be $257 in 2025, an increase of $17 from the annual deductible of $240 in 2024.
Do you treat Medicare QMB Patients? CMS Releases REMINDER of Rule
CMS released a memo reminding all Medicare providers, that you may not bill Medicare beneficiaries in the Qualified Medicare Beneficiary (QMB) eligibility group for Medicare Part A or Part B covered services. This includes Medicare Part B deductibles, coinsurance, and copayments for covered services. You can check the status of your Medicare patients online to see if they are a QMB status or the EOB will alert you if they are a QMB. Federal law prohibits all Original Medicare and MA providers and suppliers (not only those that accept Medicaid) from billing QMBs for covered services. Violators of this rule may be subject to sanctions if they don’t follow QMB billing prohibitions (even when Medicaid pays nothing). Sections 1902(n)(3)(B), 1902(n)(3) (C), 1905(p)(3), 1866(a)(1)(A), and 1848(g)(3)(A) of the Social Security Act have more information.
FinCEN Beneficial Owner Information (BOI) Requirement on Hold
The WCA previously alerted members to the FinCEN BOI reporting requirements under the Corporate Transparency Act. This regulation would have required small businesses, including healthcare practices structured as corporations or PLLCs, to file reports containing information about the individuals who own or control them to the Financial Crimes Enforcement Network (FinCEN), a bureau of the U.S. Treasury Department. However, a Texas court just issued (December 3, 2024) a Preliminary Injunction (Texas Top Cop Shop, Inc. vs. Garland) stating that FinCEN cannot enforce the Corporate Transparency Act and "companies need not comply with the CTA's January 1, 2025, BOI reporting deadline pending further order of the Court." As a result, chiropractic businesses are not required to complete the BOI report to FinCEN, at this time.
This preliminary ruling is subject to the court's final ruling. However, in its ruling, the court made the following broad, sweeping statements: "CTA is likely unconstitutional as outside of Congress's power. Because the Reporting Rule implements the CTA, it is likely unconstitutional for the same reasons." The court added that the "extent of the constitutional violation Plaintiffs have shown is best served through a nationwide injunction." The full court ruling document can be found here.

The term “wellness” has become a buzzword used across the nation by physicians and lay people alike. As the world has become more focused on wellness, innovations emerging from the world of aesthetics are being reimagined and revolutionizing medical treatment paradigms in orthopedics, neurology, spinal surgery and more. “Wellness” has been defined as a holistic approach to overall health and well-being, going beyond the absence of disease states and into more idealized functionality of the mind, body and spirit.1 In parallel with the growing awareness and uptake of this approach, the global market for health and wellness is projected to grow from close to $4 trillion in 2023 to more than $8 trillion by 2033,2 with a reported 82% of U.S. consumers considering wellness a top priority in their daily lives.3
Beyond Body Shaping
As documented repeatedly in articles and anecdotes, the HIFEM. plus radiofrequency (RF) technology in Emsculpt Neo. from BTL Aesthetics (Marlborough, Mass.) provides functional improvement above and beyond body shaping. With new FDA clearance, Emsculpt Neo is intended to be used under medical supervision for adjunctive therapy for the treatment of medical diseases and conditions and indicated for use in stimulating neuromuscular tissue for bulk muscle excitation in the legs or arms for rehabilitative purposes. HIFEM technology provides thousands of isometric contractions, in thorough patterns generated by Emsculpt Neo’s software algorithms, creating an enormous amount of muscle strength and stability without physical movement.” According to Dr. Lou, “These also reverse the polarity of the muscle contraction in a way that causes the removal of lactic acid, as opposed to the painful buildup we expect with exercise. Even without the pain and swelling, patients simply cannot voluntarily move adequately, or enough, to have anywhere near this effect by their own willpower,” he noted. “It is simply impossible. Even pro athletes cannot work like that. There are also other benefits, such as improvements in local circulation.”
Dr. Lou used this technology to treat two major league baseball pitchers. “What we saw were two young professional athletes at peak conditioning who, between injuries or off-season surgery, had reduced functionality and retarded progress with no end in sight. They not only came back healthy, their numbers – in the most empirically documented sport on Earth – showed obvious improvement. One was virtually unhittable as a closing pitcher during the World Series that following season. We are talking about pro athletes here, but we are also talking about physical and physiological demands that the normal person generally does not have.”
Mohamed Abdulhamid, MD, founder of Royal Spine Surgery (Scottdale, Ariz.), turned to Emsculpt Neo to enhance his surgical outcomes. “In my spinal surgery patients, I noticed a significant trend: Those with stronger back and leg muscles tended to recover more smoothly and experience better long-term results,” he recalled. “Although I initially incorporated physical therapy, it had limitations. During my search for solutions, I came across Emsculpt Neo, reached out to the Company and learned about its mechanisms. After trying it, I not only observed the improvements I had hoped for in post-surgical recovery, but I also saw benefits for patients who were not yet surgical candidates. For them, Emsculpt Neo offered a safe, nonsurgical option to build strength and stability, effectively expanding my treatment capabilities.”
Research Behind the Protocol
The new protocol rests on the backs of two studies,9,10 together including more than a total of 70 patients from six centers across the U.S. Research centers included multiple relevant specialties in wellness, orthopedics, neurology and spinal surgery. Drs. Lou and Trokhan were involved in the musculoskeletal and joint study9 in which patients (n=31, age range 23 to 78 years, BMI 25Å}4 kg/ m2) with a history of musculoskeletal and joint issues underwent four weekly, 30-minute sessions of Emsculpt Neo on the upper or lower extremities. Substantial improvement was noted in the scores from two scoring systems recognized in the specialty, with remarkable increases in range of motion and improvement in overall mobility and strongly reported reductions in discomfort and pain. “We saw impressive improvement in upper or lower extremities, with all patients reporting very little discomfort during treatment,” Dr. Lou noted. “What I saw were results that were physiologically not possible before Emsculpt Neo using this functional wellness protocol.”
Dr. Trokhan was equally impressed. “Our results show that Emsculpt Neo is a wonderful non-invasive, nonsurgical way to treat issues that plague a lot of patients. It seemed as if all the patients I enrolled were satisfied and raved about the technology, results and ease of treatment. Both those who undergo it and those who administer it are amazed by what we have experienced.”
Dr. Abdulhamid was lead investigator of the strength study.10 Patients (n=30, age range 32 to 76 years, BMI 27Å}4 kg/m2) with atrophied muscles due to surgery, refrained physical activity or injury were recruited and split into active (treatment) and sham groups. The active group underwent four weekly, 30-minute sessions of HIFEM+RF. “Muscular strength was measured by dynamometer pre-treatment, immediately after the last treatment, and at one- and three-month follow-up visits,” Dr. Abdulhamid explained. “Dramatic increases in strength were noted in the active group compared to sham.” Almost all active group patients reported improvement in comfort during physical activity, improvement in atrophy/weakness, restored muscle engagement and better movement; many reported feeling less prone to injury, and more than half reported improvement in flexibility.
“When all is said and done this will totally validate the idea that improving muscle strength using this protocol with Emsculpt Neo has great potential to improve overall functional wellness and quality of life.”

Success in Patient Care & Engagement: Taming the Sugar Beast

As Chiropractors, educating our patients about the 3Ts (toxins, traumas, and thoughts) and guiding them through how to address them is the basis of care.
Most Chiropractors are great at addressing traumas, but one thing we’ve found at The Wellness Way is when we educate on all 3T’s, our patients have better clinical results. When it comes to toxins, one of the biggest offenders is the food our patients eat.
At The Wellness Way, we’ve designated the month of January as “No Sugar Challenge” for the past several years. And the results were amazing! We know many of our patients tend to indulge in extra treats, beverages, and holiday “cheer” starting in late October and through December. That’s why we kick off the year with this challenge! It started with a couple of us docs in the office, then staff joined in, before long, our patients got into the spirit. Now we have a social media group with over 27,000 members joining our challenges through the year; the No Sugar one is by far our most popular. Why do we do this?
Most people consume foods that affect their health, even if they are “healthy.” When glucose levels are too high for too long, the body has to adapt, and that usually leads to inflammation.1,2 Those adaptations are frequently discomforts and life-affecting consequences that can lead to dis-ease. In this way, sugar and foods with an impact on blood glucose levels may be acting like a toxin in the body. We’ve found that helping patients retrain their food habits and tastes to avoid sweets, even grains, starchy vegetables, and fruits for a time has helped them make better long-term decisions.
What about from the perspective of traumas? Inflammation often impacts joint health and pain like arthritis and injuries. Consuming excessive sugars can also impair calcium absorption, weaken bones and connective tissues. Stable blood sugar levels help mitigate inflammation and supports joint and bone recovery. When patients see how this approach complements chiropractic care, allowing them to heal more efficiently, they are often more diligent in getting their adjustments because they see the benefits!
Now consider the third T, thoughts. Chronic blood sugar fluctuations from high-glycemic foods negatively affect the nervous system. Brain fog and feeling of anxiety and depression are often tied to these dietary patterns. Stabilizing blood sugar levels through a low-glycemic approach has been shown to improve mental clarity and mood.3 By addressing the mind-body connection, chiropractors can help patients achieve a more balanced state of physical and emotional health.
There is so much more we can say about how sugar and the glycemic response can affect our patients’ health, but for now, I just wanted to share with you some of the ways we support our patients clinically and through our digital community.

Clinical Compass is a 501c3 nonprofit, apolitical, evidence -synthesis think tank. We conduct a variety of systematic literature review s, develop best practice recommendations, maintain a resource Evidence Center that highlights research relevant to chiropract ic stakeholders , and provide rapid response letters to the editor to combat inappropriate and misplaced criticisms against the chiropractic profession and interventions used by chiropractors .
Originally known as Council on Chiropractic Guidelines and Practice Parameters (CCGPP), Clinical Compass was formed in 1995 through efforts of ChiroCongress (formerly Congress of Chiropractic State Associations) as a path way to equip the profession with evidence to engage in discussions with payers, legislators, and other stakeholders on matters relevant to chiropractic. To date, literature generated by Clinical Compass has primarily been utilized by national and state chiropractic associations for practicing chiropractors . Clinical Compass is an established leader in the chiropractic scientific community and is dedicated to supporting the profession through adherence and reliance on evidence and interprofessional collaboration. Some of our long-standing partners include the NCMIC Foundation Inc., ChiroCongress, the American Chiropractic Association, the American Public Health Association, Chiropractic Future, the Association of Chiropractic Colleges, and numerous state associations .

Practice Appraisals
When buying or selling a practice, consider an appraisal. We conduct appraisals and the process involves familiarizing ourselves with the nature of the practice including staff, equipment, hours, payor mix, and services provided. We study historical tax returns, current P&L and statistics, and lease terms. Within this process, income and expenses are examined on a line-by-line basis in order to normalize the income.
Market comparisons are then drawn from our successfully completing over 475 chiropractic practice sales. A final report is determined and formatted into the report.
