Members of the local transgender community, along with other LGBT activists and local residents will gather on Friday, November 20, from 5 to 9 pm, in Ruth Hardy Park to commemorate the lives of transgender individuals who have died this year. Organized by the Transgender Community Coalition and Transgender Day of Remebrance (TDOR) Palm Springs, the event is held in November to honor Rita Hester, whose murder on November 28, 1998, launched the “Remembering Our Dead” web project and a San Francisco vigil the following year. of each year at Ruth Hardy Park. Once again the venue will be the Spa Resort Casino in downtown Palm Springs, California A Queer Carol Nov. 20 to Dec. 20 funny gay take on Charles Dickens’ tale of a miserly old man who finds redemption on Christmas Eve through a series of ghostly visitations. It will surley jingle a few bells, Performances are Fridays & Saturdays at 8 PM, Sundays at 2 PM. The annual Palm Springs Festival of Lights Parade features lighted floats, equestrians, bands, autos, and celebrities. The Anatomy of a DUI An Overview of Alcohol By Manuel J. Barba, DUI Defense Attorney In the last article I continued the discussion of Phase Two of a DUI stop – personal contact – focusing on the on the officer’s use of sight, hearing, smell during the personal contact phase as well as the officer’s pre-exit interview techniques. Here I will continue that discussion with the exit sequence and the law relating to reasonable suspicion to detain and probable cause to arrest. Remember, Phase Two focuses on the officer’s observation and interview of the driver which begins as soon as the suspect vehicle and the patrol vehicle have come to complete stops. Face-to-face observation and interview of the driver allows the officer to use his senses to determine if evidence of driving under the influence of alcohol and/or drugs exists. After the initial contact with the driver, the officer decides whether he/she will instruct the driver to exit the car. The officer’s decision to instruct the driver to exit the car usually is made after he/she has developed a suspicion that the driver may be under the influence. (Note that often times an officer will ask a driver to exit the vehicle for officer safety reasons). Nevertheless, even though the officer’s suspicions may be very strong at this point, usually the driver is not yet under arrest, but is only detained for further investigation. 20
When the officer instructs the driver to exit the car, the officer is trained to observe how the driver steps out and walks from the car and any other actions or behaviors during this exit sequence that may provide further evidence of being under the influence of alcohol and/or drugs. For instance, a driver may exhibit anger or other unusual reactions, the driver may not follow instructions, the driver may not be able to open the door, the driver may leave the car in gear when he/she tries to exit, the driver may try to get out of the car with the seat belt still fastened, the driver may lean against car to maintain his/her balance, and the driver may keep his/her hands on the car to maintain balance. A trained officer will observe any of the above and note it in his/her arrest report. After the officer has asked the driver to exit the car, he will usually have the driver stand on the sidewalk or some other safe area. Now, up to this point, the officer has only gathered “clues” from phase one – vehicle in motion, and from phase two – personal contact. These clues raise the officer’s suspicion that the driver may be under the influence of alcohol and/or drugs. The clues from phase one and phase two provide the officer with the reasonable suspicion necessary to detain the driver to further conduct a DUI investigation. Here’s the law: “A temporary detention requires a reasonable suspicion the person detained may be involved in criminal activity. Reasonable cause demands some minimum level of objective justification, but considerContinued on page 45

LEATHER REALM by Dave Murdock “And the new Mr. Palm Springs Another Palm Springs Pride Weekend is in the history books, and what a great weekend it was. Ron DeHarte and his dedicated team outdid themselves again this year! Somewhere between 100,000 and 140,000 people attended the myriad of festivities over 3 days, starting off with a new event, OUT PSP, sort of a mini Taste of Palm Springs, the event was held “to recognize and honor Evan Wolfson, National Grand Marshal and the Grand Marshals Randy Johnson and Paul Campion. Wolfson is widely credited as the mastermind behind the legal strategy that won marriage equality for all and Johnson and Campion are two plaintiffs in the historic Supreme Court case who were married in Palm Springs in 2008.” Great food was served up by many of the best area restaurants and Desert Regional Hospital (their lobster mac and cheese was the talk of the evening), as well as libations from many distributors of wine and spirits including one, Rex-Goliath wines, that was the talk of the entire weekend because they had a large cock walking around (their mascot’s a rooster, get your mind out of the gutter). From that point on, for yours truly at least, the weekend was a bit of a blur. As some of you know I wear several hats in the community and one of them is as a singing board member of the Palm Springs Gay Men’s Chorus. We not only had a booth at the festival, we also performed on Saturday night, AND we were in the parade on Sunday which meant that we had 2 really full days. I’m really proud of Raul Valenzuala, our membership chair, for organizing our weekend, he did a fantastic job! But that was only a part of my weekend be-

cause PSLOD also had a booth and marched in the parade. And all of that brings me to the point of this article, which is that it truly does take a village, working in cooperation, to accomplish a weekend like the one that just ended. All the way from the organizing committee down to the guys who picked up the last traffic barriers Sunday evening. Over the years that I’ve been here I’ve marched with The Barracks, I’ve marched with the Sisters of Perpetual Indulgence, I’ve marched with PSLOD and I’ve marched with the Palm Springs Gay Men’s Chorus, 4 pretty disparate groups, but all four have one common goal, serving their community. And those were only 4 of the 200 groups that took part in the parade! Take a moment to think about that. 200 entities all came together to celebrate Pride! In and of itself that’s a pretty fantastic accomplishment and something we can all be proud of but it got me to thinking (dangerous, I know) about what happens next? We’ve had 2 weekends back to back celebrating Leather Pride and then Gay Pride, all great fun, all worthy of our collective attention. But what happens next? Sure, PSLOD and PS Pride will go back to planning next years festivities (in fact the planning committees have already started!), the Sisters will go back to spreading glitter and joy, the Desert Winds Freedom band will go back to practicing for their next event, PSGMC will continue rehearsing for their holiday concert (with a brand new sound system thanks to some very generous donations by Harold Continued on page 34 Matzner and Jeremy

I don’t know what’s in the water, but suddenly most these queens have become obsessed by some satanic god of drag. Maybe he was buying souls for fame and success. Of course with all deals with the Devil you end up paying at the end.
For the people who truly know me know that I stray from that crap. I WILL speak my mind and speak up and defend myself if need be. I actually don’t “defend” myself because that would mean that what they are mentioning is hardly true and blown out of proportion. I just got into a blow out with some dumb queen telling me where I can and can’t be on Pride. When it’s not her decision and she doesn’t know her fact because I am in a WHOLE DIFFERENT place. It’s just plain jealousy. I get what I get because I put the work in. Instead of being a backstabbing dough bag get off your egotistical ass and wonder what am I doing correctly and learn. Two or three years of drag makes you an expert, right!?!? I’ve been seeing this same pattern reoccur over and over and over. ALL 44

They were holding hands and were called “faggots” and the aggressor got into an altercation with Chris. After stating that he did not want to fight, Chris released him. The instigator then came back with two buddies and snuck up and hit Chris on the back of the head with a bottle. Chris suffered a concussion and was knocked partially unconscious and needed staples in the back of his head and stiches to his lip.
