The Anatomy of a DUI An Overview of Alcohol By Manuel J. Barba, DUI Defense Attorney In my last article on Anatomy of a DUI I began discussing Phase Three- Pre-arrest Screening, and how Phase Three presupposes that the driver will be arrested. Remember, after the officer has observed the suspected vehicle while in motion, observed the vehicle come to a stop, and observed the driver after making personal contact, the officer may have suspicions that the driver may be under the influence of alcohol or drugs. But, as I discussed in my previous article, suspicion of DUI is not enough to arrest a driver for DUI. The officer needs probable cause to make an arrest for DUI. How does the officer develop the needed probable cause?? The officer does so by conducting Phase Three Pre-arrest Screening. The “screening” in Phase Three is a series of field sobriety tests given to the driver suspected of DUI. Also remember that the title “Pre arrest Screening” itself presupposes that the driver will be arrested (screening given pre-arrest). Thus, the question arises “is the officer going to objectively evaluate the driver’s performance when administering the field sobriety tests? OR, is the officer simply having the driver perform the field sobriety tests to use them as probable cause 20
to arrest the driver? Thus, the important question for the driver is: “Do I have to participate in the pre-arrest screening tests (field sobriety tests)? Answer: NO! Remember, up until now the officer has made observations during the vehicle in motion phase, during the vehicle stopping sequence phase, as well as during the personal contact phase. All of these observations made by the officer are independent of the driver, meaning that the driver did not participate. But Phase Three – Pre-arrest Screening (field sobriety test phase) cannot be completed without the driver’s cooperation. If the driver elects to cooperate and perform the field sobriety tests, then the officer has an opportunity to say the driver failed the tests, thus developing the probable cause needed to arrest the driver for DUI. If the driver elects NOT to cooperate with the field sobriety tests, the officer does not have the opportunity to conclude that the driver failed the field sobriety tests. Now keep in mind, if a driver elects NOT to participate in these field sobriety tests, the officer has to decide whether to arrest the driver regardless. More than likely, the officer will make the arrest. Therefore why participate in doing field sobriety tests to give the officer the opportunity to say that the driver failed the tests? Richard Etts, local artist who was featured in a DDG article last March, is sharing a show of his current works with Richard Dennis. Each of these artist have their unique style. Richard Etts works in sculpture as well as painting, and will have examples of each of these displayed at the show. There is also a similarity in the works of Dennis and Etts in the flowing eroticism of their smooth rounded forms that intertwine, providing a flowing fantasy of color and emotion. Richard Etts work demonstrates a further exploration of color in his acrylic paintings of which he has worked in both black and white and color previously. He credits his inspiration from nature, music and architecture. Mr. Etts has an extensive resume of his works being in permanent collections including the Smithsonian Institute’s Cooper Hewitt Museum of Design in New York City, Newport Harbor Art Museum Newport Beach, CA. and numerous other shows and films during the past 4 decades. Richard Dennis’s acrylic paintings exhibit flowing involved landscapes, that creatively combine cool and warm colors that move the viewer through the painting with both a stimulating and casual experience. On Tuesday, a Senate report found Gilead Sciences, which makes a cure for a fatal form of hepatitis, is more interested in profits than patients. The cure was invented under the leadership of a celebrated doctor in the Department of Veterans Affairs, but at $1,000 a pill, even the VA can’t afford to save the lives of veterans who need it. I’ve seen some petty bitches in my life and this is way up on the top of the list. The extra angry person might hit him in the arm or something, but you know you aren’t right in the head if you must go to that extreme. It is just chicken for goodness sake!!! I don’t care if it’s gold or cash! Whatever you feel your reactions should be shouldn’t be any kind of violence. That is petty and I notice MANY petty people in the world. It’s all about them acting all crazy due to pettiness. Even the word Petty isn’t the most wonderful sounding word, so why be it? Selfishness is a good answer. It’s the ME Decade I suppose. All about me! Well you! And well it isn’t, nor will ever be the decade of you. You decided that it’s all about you, but many, many, many people will disagree. Well, because they think it’s their world and we just live on it. So, with everyone deciding that it’s the world according to them eventually it will explode in everyone’s collective area causing a chain reaction of bullshit. Nice work everyone! Once again you fucked up a simple thing with negative behavior. 44

sense to do the tests as they are completely voluntary. You might be thinking: well maybe I’ll pass the tests and the officer will let me go. Statistically you won’t pass the tests because if the officer has already smells odor of alcohol and the driver admitted to drinking alcohol, the officer will find a reason to say that you failed the field sobriety tests. What does the law require the driver to do? Vehicle Code § 23612 provides “a person who drives a motor vehicle is deemed to have given his or her consent to chemical testing of his or her blood or breath for the purpose of determining the alcoholic content of his or her blood, if lawfully arrested for an offense allegedly committed in violation of Section 23140, 23152, or 23153” (DUI). Thus, if a driver is arrested for driving while under the influence of alcohol, the driver is required to submit a chemical test to determine the alcohol content of his/her blood. The chemical test can either be by breath, where the driver blows into a machine, or by blood, where a blood sample is drawn and later analyzed to determine alcohol content. The choice of which test is up to the driver. The law DOES NOT require a driver to submit to any physical tests, i.e. field sobriety tests.
