WHITE BEAR LAKE — The highbacked chair next to the mayor in the council chamber will no longer be occupied by City Attorney Roger Jensen. The longtime counsel is retiring from the job he’s held almost 40 years. Well, not quite 40. For full disclosure, as is a lawyer’s way, there was a hiatus during the 80s. Jensen was replaced between 1981 and 1987 when a disgruntled councilman, mad about losing a court case to the city, got in a new appointee when an election shifted the majority vote. The case against the councilman, whom Jensen preferred not to name, went all the way to the state Supreme Court. It started when the city granted a conditional use permit (CUP) to build new commercial docks next to Lions Park. Also approved was a request to keep a 15foot trailer on shore as an office. Only the guy parked a 40-foot trailer on the site instead and then refused to move it. The city attorney was tasked with getting an injunction and the legal battle began. The city prevailed every step of the way. “The result,” Jensen said, “was a high court decision that held you are bound by what you submit to a city in your plans when you get a CUP.” That wasn’t the only case to reach the high court. A lawsuit filed by Home Depot when a rezoning request was denied on Centerville Road was heard by the Supreme Court. Again, the city prevailed. The Press sat down with Jensen over gazpacho at a downtown restaurant to talk about his tenure with the city. He came prepared with a handwritten list on, what else but a yellow legal pad, that included highlights of his incumbency. Among them: • A ban on cigarette vending machines. White Bear Lake was fi rst in the country back in the 80s to approve the ban; Jensen wrote the ordinance. The story made the front page of the New York Times. • Acquisition of the marina triangle property. “That was a big deal and very controversial,” he said. SEE CITY ATTORNEY, PAGE 8A

WHITE BEAR LAKE — In a letter to the City Council just prior to a decisive vote, area hockey association leaders implored members to build a facility that “reflects a program that has taken generations to develop.” They were talking about the cityowned Sports Center, aging and obsolete. Putting its money where the puck is, the White Bear Lake Area Hockey
Association (WBLAHA) pledged to commit $2.5 million towards renovation of the 28-year-old ice arena. The skating community had originally agreed to pony up 50 percent of the project, or $2 million, but then the cost jumped to $5.5 million. The extra million would pay for a bigger refrigeration system for a second sheet of ice, improvements for the disabled and a project contingency.
