Following orders: cities consider impact of judge’s ruling in lake lawsuit

WHITE BEAR LAKE — As the court ponders the Department of Natural Resource’s post-trial motions in the lake level lawsuit, municipalities impacted by the judge’s order prepare to comply.

What does that mean for cities and the township within 5 miles of White Bear Lake? Eleven communities attended a meeting mid-month to address those issues and review draft language that will amend municipal permits.

All have at least one well within a 5-mile radius of

the lake, the perimeter cited by District Judge Margaret Marrinan in her Aug. 30 order: Hugo, Lake Elmo, Lino Lakes, Mahtomedi, North St. Paul, Oakdale, Stillwater, Vadnais Heights, White Bear Lake and White Bear Township. St. Paul Regional Water Services (city of St. Paul) is within the zone but did not attend the Jan. 10 meeting.

Luge run sends sledders flying onto Birch Lake

On the icy shores of Birch Lake early in the morning or late in the evening, a 71-year-old man can be seen flashing onto the lake in an orange sled from his self-made luge run.

“It's great exercise,” said John Abbott. “That's what I do instead of going to the gym.” Shoveling snow to create the luge and adding an ice rink to the run on the lake is also part of his regimen.

“I literally shoveled the lawn,” Abbott remembered about creating the luge just before Christmas.

The luge has become a family tradition; even Abbott's 2-year-old granddaughter takes a ride down.

Extended family members keep personal records of how far they can make it onto the lake. When the ice is clear, you can travel about 160 feet onto the lake, he noted.

No one has ever been injured.

The frame at the top of the run was built out of boards and items Abbott had on hand.

New king hails from lake realm

The new King Boreas is ready for a fi ght.

As the 132-year-old legend goes, the King of the Winds and his four princes discovered St. Paul on his extensive travels and decided to make it the capital of all his domains. Vulcanus Rex, "the god of fi re," vowed to resist him with "heat and roar." King Boreas chose to fi ght fi re with fun by declaring there would be a carnival in old St. Paul.

And so the winter carnival began last week with coronation of the king, Tom Leonard, who was born in St. Paul but now lives in Dellwood.

He joins other kings with local connections: King Boreas of 2008, Bill Foussard, owner of White Bear Country Inn, King Boreas of 2011, Keith LeBlanc of White Bear Lake and the late Don Schoeller of Hugo in 2007.

A panel of former kings is charged with fi nding the successor, and Foussard said Leonard was a perfect choice to lead the royal family and represent St. Paul. When they "nudged" him about assuming the throne, Leonard asked his wife Phoebe her thoughts about accepting the busy role. They have two young children.

"I've always had an interest," Leonard said.

"I've been active in the carnival for half my life. I didn't know if it was the right time until I spoke with my wife. She recommended it would be a good year. On her good counsel, I said 'yes' to the former kings."

Leonard, 51, and his brother Jim own Fury Motors, a Chrysler, Jeep, Dodge Ram dealership headquartered in South St. Paul where they grew up.

The business has always supported the carnival and grassroots community projects. It sponsors queen candidates and royal guards, takes care of the parade units for Prince of the South Wind, a role Leonard played in 1994, and the dealership services the Vulcans' 1930-ish fi re truck, affectionately called "LaVerne."

As King Boreas LXXXII, Leonard hopes to build stronger communities. As his fi rst royal act of community service, he parked a just-released 2019 Ram pickup both at the ice palace and his dealerships. Visitors are encouraged to donate hats, coats, mittens and gloves for needy neighbors in the back of the trucks.

"Our motto at the dealership is to build stronger communities and to coincide with Winter Carnival, we're adding 'one ice block at a time,'" he noted. "We will also be going into communities during 2018 to support those who are doing great things; to recognize organizations doing work for their community."

Leonard is pretty excited about unveiling the 2019 Ram truck at the ice palace. No one outside of Detroit has seen the anxiously awaited model, he said. Fury Motors is a major sponsor of the castle at Rice Park. "A cool factor for us is to have

Since it coincides with the Super Bowl, this year's Winter Carnival ends Feb. 10, seven days longer than usual. Normally, on the 10th day of celebration, Vulcanus Rex and his Krewe storm the ice castle and confront the King’s Guard.

Super Memories

I

t is pretty cool that the Super Bowl is here in the Twin Cities. As a community, we can experience the sights and sounds of an event that will be televised worldwide. With over a million people expected to visit the Twin Cities for the game, we need to give every visitor that “Minnesota nice” welcome that we are known for — on the roads, at the mall, at restaurants. Remember to be accommodating as you merge on the highways or help those in need of directions even if they are wearing an Eagles jersey.

Fun events going on include activities at Nicollet Mall, a zipline across the Mississippi, snowmobile stunts, sleigh rides, Winter Carnival Ice Castle, Publisher’s the ice shanties, ice fishing, and live music events. The Twin Cities has View countless things to offer; from Carter Johnson the Mall of America, numerous micro breweries, theaters, music clubs and museums. A few big name concerts include Imagine Dragons and Dave Matthews Band.

A fi rst-ever event at Bethel University is the “Super Bowl Gospel Celebration” concert on Feb. 1, featuring artists like Snoop Dogg, Sheila E. and Sound of Blackness, along with NFL players. The White Bear Lake drumline will perform twice leading up to the big event.

This is a once — or maybe twice — in a lifetime event for many of us. A limited number of cities ever get to experience this kind of event. The world will see coverage of events from our area, so let’s hope they capture the essence that attracts people here. Let’s make sure Minnesota stays on the map as a great place to live, work and raise a family.

Take your family into Minneapolis to see the massive effort, or go to an NFL-sponsored event. And don’t forget to get celebratory at the local events that are happening this weekend. The Bear’ly Open golf on ice event to raise money for the food shelf is Saturday, and the Lions Club and VFW are hosting the “Holes for Heroes” ice fishing event that includes ice fishing, an opportunity to kick a ball through a goalpost, and a fish fry at the White Bear Lake VFW. Build a few memories around this huge undertaking. This is an investment in the Twin Cities and our great state and we should all share something about our heritage and the great culture here so that others will also want to invest. Get out, help out and be friendly to the Eagles fans you encounter.

Snowshoeing at night Last Friday night my wife was invited for a snowshoe trek on the lake with three friends. The hike sounded fun, especially with the destination being a local watering hole. I was a little fearful knowing they would be walking in the dark on an active lake and warned her about cars, trucks, ATVs and snowmobiles. She felt I was being overly cautious.

Our son loaned her two sets of head lamps, and off they went, successfully hiking the two miles in just under an hour. She said the snowshoes were a must with the snow depth and ski poles were helpful for balance. As you set out hiking in our parks, trails or on the lake, be sure to wear bright colors, use lights for safety, and always let a friend or family member know where you are going. In every situation, be aware of your surroundings.

The following day we heard about the tragic accident on Chisago Lake where a snowmobiler ran into a father and son setting up an ice fishing house. It’s a good reminder that snowmobilers should take safety refresher courses and understand that the rules that apply to them. We have a lot of rules but little incentive to continue to get training about them. Your life can change forever with a bad decision or dumb mistake. Be aware, stay informed and get out and enjoy this great state we call home.

Infrastructure: the bipartisan job creator rural America needs

I

nfrastructure is one of the smartest investments we can make in our country. It allows businesses to grow and compete. It keep us safe. It creates millions of jobs—good paying jobs that cannot be outsourced overseas. And, it’s bipartisan. It’s one of the first things President Trump said he wanted to get done after he was elected.

The time has come to work together to get Legislator this done, and get it done right. We Lingo cannot let another Amy Klobuchar year go by without action.

The good news is, there are bipartisan solutions already on the table. As a member of the Commerce and Agriculture committees, I have long supported leveraging direct funding and public-private partnerships to rebuild and reinvest in our infrastructure. One bipartisan idea I’ve been working on is to create an infrastructure bank that would help increase private sector infrastructure spending. It would also direct funding to projects in rural areas so that smaller communities can make much-needed infrastructure improvements.

This type of innovative financing tool could jumpstart critical projects in Minnesota and across the country.

But we can’t rely on public-private partnerships alone to fund projects. Direct federal funding is essential, especially in rural America. In many parts of our country where communities are spread out and not as densely populated, it can be difficult to attract private investment. These communities depend on federal dollars to maintain and upgrade their infrastructure and stay competitive. That is why I will not support proposals that are unfair to rural communities.

One area that relies on direct federal investment is rural broadband. Broadband is the perfect infrastructure investment. It creates jobs, opens new economic opportunities for the communities we connect, and keeps America competitive in an increasingly digital world. Just this week, as co-chair of the Senate Broadband Caucus, I led a bipartisan effort to get dedicated, stand-alone funding for broadband deployment in an infrastructure proposal to ensure telecommunications infrastructure is prioritized alongside needed upgrades to our roads, rail, waterways, and bridges. A serious plan for the 21st century is not a complete without addressing the broadband connectivity issues facing rural America.

I know we can work across the aisle to invest in America’s infrastructure because we’ve done it before.

In 2012, Congress passed bipartisan legislation I worked on to

allow the St. Croix River bridge project to move forward after 30 years of delay, and this past August the new bridge was completed. After more than 50 years, Windom and other communities along Highway 60 will soon be able to travel on a four-lane highway to get to the Twin Cities. And Highway 53 on the Iron Range now features a new four-lane bridge—the tallest in the entire state--that connects Eveleth and Virginia.

We also recently passed the Fixing America’s Surface Transportation (FAST) Act, a bipartisan bill that increased transportation funding—including giving Minnesota more than $4 billion in funding over five years—and helped provide certainty to local governments planning critical projects across the country. This is a good start, but we can’t stop now. In an increasingly competitive global economy, standing still is falling behind.

We can’t leave infrastructure—something that has always been an area for bipartisan agreement--on the side of the road for another year. When it comes to roads and bridges and rail, you either build them or you don’t. Talk isn’t enough.

There are good bipartisan ideas out there that we can take action on right now. Let’s get to work.

A t off ki Act kindness d iin llastt week’s snowstorm I would like to write a heartfelt thank you to the kind young man (Justin P.) who rescued me the morning after our biggest snowstorm in seven years. I was trying to get to my job at the Veterans Hospital and the downtown White Bear streets had not been plowed. I was completely stuck on Second Street at 4:45 a.m.

This incredible young man appeared, saying, "There, you are number 10".

He was out to rescue 10 people and I was his number 10.

In a time of too much hatred and negativity, he was spreading kindness. He would not give me his information because he did not want any reward. If anyone knows this young man, please tell him he made a difference. I told his story to friends, family and everyone at work. We all agreed that knowing people like

On minimum wage increase Gene Johnson’s piece from Jan. 10 bemoaned Minneapolis’ minimum wage increase, warning that it will eliminate employment opportunities for young people and deprive them of important early work experiences.

While that experience can establish important career foundations — my teenage reporting job covering prep sports did — it is important to understand that low-wage work is not primarily the domain of teenagers.

This past summer only 35 percent of 16- to 19-year-olds nationwide entered the labor force, down from a high of nearly 60 percent in the summer of 1978, according to the Federal Re-

serve B Bank St. L Louis.

Today’s k off St i T d ’ high hi h school students have eschewed summer jobs for summer classes, college courses and unpaid internships.

Meanwhile, despite being the most highly educated and credentialed labor force in history, over 40 percent of Americans make less than $15 an hour, according to the National Employment Law Project. These are not teenagers in the food court, but the child care workers, home health aides, nursing assistants and retail salespeople in our communities. I agree with Mr. Johnson that Minnesota must invest in apprenticeships and trade schools, but we must also accept the realities of today’s economy.

Fortunately, no law of economics says working in these industries must consign one to a life of poverty. Long before service-sector jobs dominated the ranks of low-wage work, there were scores of factory

workers k ttoiling ili iin unsafe f conditions diti for low pay. Manufacturing did not become home to steady pay, health care and retirement benefits until workers banded together to fi ght for their rights and change public policy, whether they were striking barrel makers in the 1880s or flour and grain mill workers in the early 1900s.

Workers fi ghting for a higher minimum wage today are following in the footsteps of the working people that established America’s great postwar middle class. These efforts are not about creating barriers to a teenager’s employment opportunities, but reasserting the power of working people after decades of decline. It is possible a city’s minimum wage might not be the right solution, but neither is allowing working people to continue suffering from a rigged economy.

Estelle Elizabeth Bradshaw January 25, 2018 Estelle Elizabeth Bradshaw, affectionately named “Tiger” by her sister, was born an Angel on January 25, 2018. She is the beautiful daughter of Elizabeth and Justin Bradshaw, both of White Bear Lake.

Estelle will forever be loved and missed by her mom and dad, big sister Piper, and furry sister Selby. Estelle will also be missed by her grandparents Robyn and Jim Sandahl, and Jim and Jayne Bradshaw, all of Stillwater; her aunts and uncles: Rebecca Bond of New York, Troy (Pam) Bradshaw of Stillwater, Jason (Brea) Bradshaw of Somerset, Mark (Georgia) Sandahl of Stillwater, Richard Sandahl (Hans Kraft) of Saint Paul, and many cousins.

A special thanks to the American Academy of Neurology, Ecolab, and the Minnesota Army National Guard for their incredible support to Estelle’s parents and sister during this difficult time. There will be a private memorial for the immediate family with interment at Fairview Cemetery in Stillwater.

Janet O. Gilkeson, age 99, of North Oaks, passed away peacefully and gracefully January 11, 2018. Born in Rochester, New York, July 28, 1918, she was preceded in death by her husband of 67 years, David, in 2009.

A resident of North Oaks for over 50 years, she was also an active member of First Presbyterian Church of White Bear Lake and proud owner of The Other Side Consignment shop in White Bear Lake from 1980-1985. She is survived by her children, Janet Chambers (Bob), Margaret Vernon (Laird), David Gilkeson Jr. DDS, John Gilkeson (Peggy), 11 grandchildren, nine great-grandchildren, and two of her five siblings, Elinor Lerner and Douglas Otto.

Private interment at Lakewood Cemetery. A memorial and celebration of life for both Janet and David will be held near her birth date in July 2018. All friends and family will be welcome. She was an amazing wife, mother, grandmother and friend and will be dearly missed.

Memorials may be made to First Presbyterian Church of White Bear Lake.

Robert Montbriand, of Naples, Florida, died peacefully with his family at his side, on January 18, 2018 at the age of 88.

He is survived by his wife, JoAnn Caryl Montbriand (née Knaeble) – they were together for 66 years; his children, Renée Jensen (Michael Sr.) of White Bear Lake, and Joel Montbriand, MD (Susan Goodnature) of Boulder, Colorado, 7 grandchildren and 8 great-grandchildren, sisters-in-law, Mary Prince (Shawn Grimsley), and Jeanie Trudeau (Dan). He was preceded in death by his mother Bernice Montbriand, his brother Ray Cronk, and sisters Diane Schmidt, Darlene Hiebert and Lynne Molacek.

Jean Alys West Jean was born in Waseca in 1920. She lived in St. Paul, and then became a longtime resident of White Bear Lake, after many moves as an Army wife. She passed away in Birchwood Health Care Center, Forest Lake on Jan. 25, 2018. She was preceded in death by her husband James W. West, son John, and granddaughter Cynthia Kelly.

She is survived by her five children; Marcia Kelly, James West, Mark West, Julie Hamilton, and Michelle Domagall, along with 11 grandchildren and several great-grandchildren. Jean was the eldest of 10 surviving siblings.

Yard hit-and-run leaves wake of debris, damage A black Dodge Charger charged through a yard on Koehler Road in Vadnais Heights Jan. 18.

Resident Steve Gaida said he heard tires squealing about 9:30 p.m. as he was watching TV and caught a view of the vehicle as it fled the scene.

The vehicle careened through about 100 feet of his yard, smashed two pine trees, bumped into his garage damaging the brick siding, and ran over two bushes.

The vehicle left behind parts from the crash. Gaida said he brought them to a dealer, who identified the vehicle as a 2014-2015 Dodge Charger.

Gaida said vehicles have crashed into his yard three times previously. Once, he said, a vehicle pushed two 3,000-pound boulders 20 feet into his yard.

He said he has requested the city install a guardrail at the intersection but the request was denied.

Mahtomedi man charged with criminal sexual conduct

MAHTOMEDI — A fire department captain was charged with sexually assaulting a 15-year-old girl earlier this month.

Joshua Allan Buck, 25, was arrested Jan. 22 and charged with third-degree criminal sexual conduct for an alleged incident Dec. 29.

Buck allegedly assaulted the 15-yearold girl in his home, according to court documents. Two other girls, 12 and 13, were also in his home at the time. Buck had a relationship with the 13-year-old girl's mother and had been taking the girl and her two friends on outings

since November.

The day of the alleged assault, Buck said he needed to stop by his Mahtomedi apartment to do laundry, reported the victim. The girls decided they would stay at his apartment Joshua overnight; they played Play Allan Buck Station. Their parents believed they were at each other's houses.

Buck allowed the minor girls to drink alcohol and the 13-year-old passed out in the bathroom.

The 12-year-old and the 15-year-old victim laid down in Buck's bed and he got into bed with them. The 12-year-old fell asleep. Buck then sexually assault-

ed the 15-year-old while covering her mouth. The 15-year-old kicked awake the 12-year-old, who turned on the lights and yelled at Buck.

The girls demanded he take them home.

The 15-year-old victim and 12-year-old also reported Buck had been sending them explicit text messages since the incident. He also sent text messages to the victim apologizing to her.

When arrested, Buck admitted to touching the victim inappropriately and said that he knew what he did was wrong. He admitted to being attracted to young girls.

The White Bear Lake Area Triad Seniors Against Crime will hold a session on cold water rescue at the White Bear Lake public safety training facility from 10:15 to 11 a.m. Feb. 12. Cmdr.

Eric Bradt of the Ramsey County Sheriff's Office will present the program. The training facility is located at 4701 Hwy. 61 at the Third Street entrance.

Woman found guilty of 6 drug-related charges A White Bear Lake woman was convicted earlier this month for selling drugs in Moose Lake last summer. Christina Vanda Garza, 38, was found guilty by a jury for six drug-related charges Jan. 12, according to court records. She was found guilty of two fi rst-degree drug sale charges, two fi rst-degree drug possession charges, one fi fth-degree drug possession charge and one charge for introducing drugs into a jail. Officers worked with a cooperating witness to intercept 1 pound of meth that was sold by Garza and another person June 22. Garza also attempted to smuggle 2 grams of meth into the jail.

• A St. Paul man, 21, was arrested for third-degree DWI test refusal charges near Highway 61 and Lake Avenue Jan. 20.

• A person was arrested after fleeing police on foot while a possible domestic situation was being investigated in the 3500 block of Century Avenue Jan. 20.

• A Lino Lakes woman, 58, was arrested for third-degree DWI near Centerville Road Jan. 21. Her blood alcohol level was 0.19.

• A White Bear Lake man, 30, was arrested on suspicion of third-degree DWI in the 4800 block of Highway 61 Jan. 21.

• Theft of a '98 silver Nissan Maxima was reported in the 3900 block of Linden Street Jan. 21.

“No one expects something like this from someone they know,” Fischer said. The department does background checks, psychiatric assessments and physical assessments on its candidates.

The psychiatric assessment was added three years ago after Mahtomedi firefighter Bailey Garcia killed a bar owner in a drive-by shooting in 2015.

Since Buck was hired before then, he did not undergo a psychiatric assessment. Buck, and Garcia, did have background checks but Fischer noted that the “books are shut” on any juvenile run-ins with the law. Both Buck and Garcia were hired as teens.

• A White Bear Lake man, 41, was arrested for DWI near County Road E and Auger Avenue Jan. 22.

• Theft of license plates was reported in the 1700 block of Commerce Court Jan. 22.

• Cocaine was confi scated in the 4900 block of Highway 61 Jan. 23.

• A resident in the 400 block of Mahtomedi Avenue reported speakers and sunglasses stolen from a vehicle overnight Jan. 7-8.

• A resident in the 700 block of Griffi n Court on Jan. 8 reported the Stillwater Police Department for not resolving issues pertaining to her ex-husband's possible domestic abuse no contact order violations quickly enough.

• An employee at the District Center in the 1000 block of Mahtomedi Avenue on Jan. 10 reported his car keyed while it was in the parking lot.

Vadnais Heights • An employee at a bar in the 3800 block of Labore Road called 911 around noon Jan. 17 to report a patron had just fled the scene with her purse. A deputy caught up to the suspect at Labore and Edgerton Street and arrested the Little Canada woman. The 40-year-old, who did not do well on FSTs and whose blood-alcohol level was double the legal limit, was charged with second-degree DWI and booked into jail. No word on the purse.

• A St. Paul woman was caught red-handed leaving Walmart the afternoon of Jan. 19 with $133 worth of groceries, clothing and arts and crafts items she had not paid for. The 52-year-old was cited for misdemeanor theft and released.

• A Farmington man was arrested in the Walmart parking lot after another motorist complained about his driving.

The 39-year-old was cited for careless driving and booked into jail to insure his appearance in court. The scofflaw had failed to appear in court more than 20 times in the past 12 years on various warrants and charges.

• A woman nabbed for shoplifting electronic items valued at $118 Jan. 20 at Target on County Road E was also found to be in possession of 13 syringes com-

monly used to inject heroin. The 19-yearold out of Oakdale was trespassed from the property for one year and booked into jail on the possession of drug paraphernalia charge.

• House sitters, 51 and 52 on Suzanne Avenue, got into a squabble the afternoon of Jan. 20 with a 30-year-old St. Paul visitor who had found medical marijuana “gummy bears” in a couch and ate them, causing friction between the adults. The 30-year-old man then threatened the housesitting couple with a frying pan causing the 52-year-old man to call 911.

The gummy bear consumer was jailed on a pending disorderly conduct charge.

• A Centerville Road couple arguing at 3 a.m. Jan. 22 about whatever, as couples are often wont to do, when the 51-year-old boyfriend hit the 49-year-old girlfriend in the head. She called 911, reporting that the boyfriend was in possession of a knife. Deputies arrived with a K9 partner to find the boyfriend on his way into the attic. Seeing the K9, the boyfriend threw in the towel. The boyfriend, noted by a deputy as uncooperative, was jailed on an obstructing the legal process charge. No knife was found.

• A man appearing “confused and disoriented,” attempted to enter a private office the morning of Jan. 23 at a medical clinic in the 3600 block of Talmage Circle. The man told clinic employees that he spoke no English. A

Spanish-speaking deputy arrived and the man said he was “running from the cartel.” The drug addled 19-year-old Shakopee man, who was wanted on a Scott County warrant for his arrest for a traffic offense, was in possession of a white powder that tested positive as meth. He was jailed on the warrant and the drug charge.

White Bear Township • A man attempting to return items at Cub Foods on Meadowlands Drive the evening of Jan. 17 was found to be in possession of fake receipts. Later that day, the same man tried to return other items to a different employee using fake receipts, and this time was successful.

Video showed the suspect leaving in a vehicle owned by a 35-year-old local man. An investigation continues.

• A juvenile, age, sex and hometown not released according to the state data practices act, assaulted a female staff

member at the Bellaire Education Center in the 2500 block of County Road F on Jan. 17. The 29-year-old victim, who was punched in the head, required several stitches and is being checked for a concussion. The suspect was booked into the county juvenile detention center to await possible charges.

• A prowler broke the window of a vehicle parked in the 4800 block of Constellation Drive the morning of Jan. 17 to get at a pack of cigarettes visible on the passenger seat. The damage was estimated at $500, according to the vehicle’s 58-year-old owner.

• A 46-year-old man was collared walking out of Cub on Meadowlands Drive the afternoon of Jan. 23 with a cart filled with an undetermined amount of merchandise. The St. Paul resident, who was wanted on Dakota, Hennepin and Scott County theft warrants for his arrest, was booked into jail.

ORDER: DNR begins process of prepping municipalities on compliance FROM PAGE 1A

• A residential irrigation ban.

According to the judge’s order, when the lake is below 923.5 feet, residential irrigation is banned until it reaches 924 feet.

City Engineer Mark Burch noted that in the last 58 years, watering would be allowed in 17 of those years. The lake hasn’t been that high in 13 years.

The ban applies only to residential use.

“That is how we interpret the ruling,” Richter said.

• A reduction in per-capita residential water use to 75 gallons per day. White Bear Lake is already below that number.

The court order requires that all existing permits include enforceable tools to ensure implementation. Enactment of the order will be completed within six months.

• A plan for partial or total conversion to a surface water supply.

Richter said the city intends to work with other communities to mitigate costs on developing a contingency plan, due to the DNR by Aug. 29. The plan must include a schedule for funding design, construction and conversion. The court noted that the DNR has ignored state statute requiring conversion plans for issuance of permits.

• A water supply plan submitted in March must include water conservation goals and collaborative efforts with other northeast metro communities.

The court ordered that all groundwater permittees in the 5-mile radius report annually to the DNR on collaborative efforts to develop plans to reduce water use.

“We’re happy to continue to look for ways to conserve water,” Richter said.

Other communities are looking at how to implement an irrigation ban.

Just thinking about implementing the order gives Township Clerk/Treasurer Bill Short indigestion.

“A residential irrigation ban will be impossible to enforce,” he maintained.

“I get an upset stomach when I think about having to deal with imposing this order and prohibiting our residents from watering their lawns and, if it’s a dry month, watching their lawns dry up.”

The city of White Bear plans to consider an amendment to its irrigation ordinance in February. Richter said the city is compelled to have language in place by the end of February — six months after the ruling.

The first reading will include all irrigation, regardless of source.

Councilman Doug Biehn asked the city

attorney if the court can tell the council how to vote on an irrigation ordinance.

Attorney Andy Pratt said “no, I don’t think they could. You still have legislative power under city charter and state law to enact ordinances.”

A residential watering ban will include all sources, Burch noted: private wells, municipal water supply, a sandpoint, pumping from a pond. “All would be restricted under this ordinance,” he said.

“The DNR is required (to amend our permits) by the court. If they don’t change the conditions in our permit, they are in contempt of court. They explained that to us very carefully.”

Biehn commented that nothing is preventing the city from expanding the watering ban to include other entities.

Councilman Dan Jones felt it only fair that if residents can’t water, than the city should go dry and so should the school district. “If we have that power, why not treat everyone the same?”

Meanwhile, Short says it’s the duty of the municipalities to respond to the DNR’s amendments to appropriation permits. “The DNR has adopted her order verbatim. I don’t think the lawsuit was meant to go this far.”

The city of Hugo is also within the arbitrary 5-mile radius, yet feels it has little impact on the lake.

City Administrator Bryan Bear points out a graph in the DNR’s transient model (shown here) that identifies municipal permits that have the most influence on the lake. Hugo’s is “very small,” he said.

Many of the permits are being regulated by court order but, according to the model, show very little ability to influence lake level, Bear pointed out. The model also indicated that irrigation is not a meaningful factor in lake level.

Bear maintains that Hugo is already doing “an extraordinarily good job” managing its resources and conserving through stormwater reuse.

He finds the irrigation ban “curious” since it only appears to apply to residential users connected to the city water supply.

As for finding an alternative water supply per the order, Bear noted that Hugo has no viable surface water source for total replacement. “It’s not possible for us without being completely reliant on someone else for water and that makes us uncomfortable,” he told council earlier this month.

The city of Hugo has lots of questions about this ban, added Bear. “It’s not practical and is counterproductive. It may discourage conservation. This makes very little sense to city staff.”

Studio apartment has new meaning at Cerenity Senior Care

A colorful palette of markers sets the mood in a 90-year-old's art studio where he creates colorful interpretations of the center's stained-glass chapel.

The art studio fills a corner — more like the entire living room — of Don Bendickson's Cerenity Senior Care apartment in White Bear Lake. Filling every available wall space are watercolor and acrylic paintings done by the artist when his hands were a bit more nimble.

Bendickson now makes marker art for other residents for birthdays and bingo prizes. He creates motifs of the stained glass in the center's chapel, flowers and abstract marker pieces. Each piece takes him about three to four hours to complete. He makes two to three each week.

“It keeps me busy,” he said.

Bendickson moved into Cerenity in 2017 and set up a studio right away.

“My son helped me,” he noted. Bendickson also jumped into a fall craft show and sold $200 worth of marker art. He had started doing marker art at his

Much of his artwork will be displayed and for sale at Taste of Scandinavia in North Oaks during the month of March. His son Joel will also show some pieces in the display, he noted. Bendickson has won several awards from the NorthStar Watercolor Soci-

ety and Gallery 96.

Bendickson studied art at Luther College and had a 50-year career in retail display and exhibit design. He has had a studio for nearly 70 years. When he retired, he started painting more often and took a watercolor class. A year ago, Luther College used one of his art pieces as a Christmas card.

LUGE: A winter tradition for snow lovers FROM PAGE 1A

“This is like the septuagenarian playground,” said his wife, Lynne Abbott, who enjoys occasional luge runs herself.

John met Lynne in Australia and they lived there during their younger years. They would visit Minnesota in the winter when their three daughters had summer vacation in Australia.

It was during one of those trips 30 years ago that John first created a luge

run at his parents' house on Lake Johanna. He has built a luge run almost every year since. He also creates an ice hockey rink. John played hockey at Mounds View High School.

He always built a snowman at the bottom of the run to guard the ice rink.

When he moved to White Bear Lake five years ago, he built a bear out of snow instead. This year he added a kangaroo in honor of Lynne.

The family came to love winter and now all three of his daughters and their families have settled in Minnesota.

White Bear Lake weatherman Frank Watson measured 9.0 inches of snow in White Bear Lake from the Jan. 22 storm. The seasonal snow total thus far is 26.8 inches with 14.5 inches of that falling in January, he reported. Watson is optimistic for “some nice snows” before the end of the season. The announcement that the Men’s Club of St. John’s Episcopal Church is to give a second entertainment on the first Monday in February, is not surprising in view of the success they met with in presenting their first just before Christmas. The St. John’s Men’s Club felt greatly encouraged by the appreciation shown by White Bear people of their efforts and decided to do all in their power to live up to the standard in any future undertaking.

The 1967 Cadillac ambulance...providing a much needed service for White Bear Lake residents, is paid for from the proceeds of the annual Lions Club Show.

This model ambulance represents in excess of $13,000 of the most modern equipment available. It is the fifth ambulance purchased by the White Bear Lions Club in a continuing effort to improve and modernize the equipment.

1943 Corporal Allen Buckbee, son of Mayor and Mrs. C. E. Buckbee, enlisted in the army last April, and was sent to Camp Robinson, Arkansas, for basic training.

Later he went to Fitzimmons general hospital, Denver, Colorado, for special X-ray study and was graduated an X-ray technician and a corporal. He was then sent to Borden general hospital in Chickasha, Oklahoma to assist in installing

CHURCH BRIEFS Ice block party for Super Bowl Redeemer Lutheran Church will hold an ice block party 9:30 a.m. to noon Saturday, Feb. 3. A professional ice carver will design works of art, and ice blocks will be available for families or children to make their own creations. Church expanding ministry to Hugo The Saint Paul Area Synod of the Evangelical Lutheran Church of America (ELCA) announced the exploration of a new ministry in Hugo in partnership with St. Andrew's Lutheran Church in Mahtomedi. In 2015, the synod voted to explore ministry possibilities in Hugo. St. Andrew’s in Mahtomedi felt called to partner with this exploration as it connects deeper with the community. The church's Family Shelter is set to open in Hugo in 2018.

“We are excited to partner with the synod for this opportunity,” said the Rev. Brian Norsman, mission developer for the Hugo ministry and pastor with St. Andrew’s. He will be leading the exploration team. “We have a strong connection in the community already, and believe our message of hope is a natural fit as we explore new ways to live out our mission.”

Teacher/coach earns state Breaking Barriers award

Sue Wurl confesses to being a bit sheepish about the recognition she’ll soon be getting publicly.

As tributes go, she prefers them one-on-one.

“When somebody tells me they appreciated the help I gave them as a kid, that means a lot to me,” Wurl said. “That’s more personal. Public accolades? A little embarrassing.”

Nonetheless, the longtime White Bear Lake special education teacher and cross country assistant coach — and accomplished marathoner — will have to buck up and accept her Breaking Barriers award.

She will be one of 21 women honored (13 for Breaking Barriers, eight for other recognition) during the 32nd annual Minnesota National Girls and Women in Sports Day Celebration on Feb. 7 at Minnesota History Center in St. Paul.

Wurl, nominated by fellow assistant coach Shannon Grant as a positive role model, has served on the District 624 faculty since 1981. She works with 9th and 10th graders at North campus and has helped the cross county program since the early 1980s.

Asked why she picked special education, Wurl said, “It’s a lot like coaching,” because in each Sue Wurl you start working with a student who’s at a certain level and nurture them to reach a designated higher level.

The Duluth native was cross country MVP and team captain at University of Minnesota-Duluth, qualifying for nationals in 1979. She moved into

marathons after college, along with competitive races of various lengths.

Her sports highlight was qualifying for the U.S. Olympic Trials twice in the 1980s: “Including the fi rst year they had it at the Olympics (for women, 1984). That was in Olympia, Washington, and it was really exciting.”

In her 14 marathons, Wurl fi nished as high as seventh at Grandma’s Marathon and ninth at the Twin Cities Marathon. She ran Boston once, 1984, and placed 18th. Her lifetime personal bests were 2:47:52 in the marathon, 4:58 in the mile, 10:42.2 in the two-mile, 16:50 in the 5K, and 35:55 in the 10K. She has also coached basketball and track in the past but gave them up because of her devotion to competitive running.

“I started running when I was 16 and I’m 49 now and still running,” she said.

The Zephyrs are ranked No. 2 in Class 2A, behind Hermantown.

Coach Jeffrey Poeschl regards depth as the team’s best feature. The Zephyrs utilize four forward lines and six defensemen while alternating two capable goalies in Bailey Huber and Josh Campbell.

“We have eight forwards with 10 or more points,” he assessed. “Our defensemen have been rock solid on the blue line and have also contributed offensively.

“Our goaltenders give us a chance to win every night with a collective goals-against-average of 1.59 and a save percentage of .932.”

Last week, the Zephyrs were upset by North St. Paul 3-1 and bounced back to beat Simley 4-2.

The Zephyrs lost to the Polars (8-7-1) despite outshooting them 54-14. Noah Skillings had the lone goal while Polar goalie Max Rossman stopped the other 53 shots. Nathan Conroy, Austin Vandell

“Their goalie played extremely well and we had some trouble finishing,” Poeschl said. “Sometimes you have games like that.”

At Simley, the Zephyrs took a quick 2-0 lead as Nikolai Dulak punched in a rebound at 3:17 of the first period and Kory Pilarski connected on a slap shot on a power play at 7:12. Colin Hagstrom and Joe Paradise had the other goals and Huber made 21 saves. Simley scored twice on seven power plays.

The Zephyrs hold second place in the Metro East Conference behind St. Thomas Academy, with Tartan third. St. Thomas Academy is 7-0, Tartan 8-2 and Mahtomedi 7-2. Under conference rules, because St. Thomas chooses to play the other teams once rather than twice, their wins count for four points. For the teams that play each other twice, wins count for two points each.

“STA leads the conference, and the rest will have to wait until the dust settles at the end of the regular season,” said Poeschl, referring to the formula for the standings.

Mahtomedi Middle Schooler Ava Kaiser is one of the best junior racquetball players in the world. Third in the world to be exact. She medaled once again at the Junior Racquetball World Championships, not once, but twice this year.

Kaiser, of Lake Elmo, is just 12 years old, but represented the United States and competed in the International Racquetball Federation Junior World Racquetball Championships for the second year in a row. The event was held at Lifetime Fitness (Target Center) in November. She was the only athlete from Minnesota to qualify for Worlds, playing in both singles and doubles for Girls 12 and under.

was awarded the Mike Beugen Junior Athlete Award. This racquetball honor is presented annually to the junior athlete who best exemplifies the attributes of character, integrity, and sportsmanship in the prior year. The seventh grader is also a straight A student who trains five times per week for two to three hours.

Noah Skillings, Mahtomedi hockey senior defenseman, is one of the main reasons the Zephyrs are 13-4-1, ranked No. 2 in Class A, and allowing just 1.6 goals per game. Skillings has a plus-29 rating, meaning that the Zephyrs have outscored opponents by 29 goals when he’s on the ice.

Offensively, Skillings has three goals and seven assists for the season, and scored a point in each of three games last week.

Zephyr gymnasts break 30-year-old team record On Jan. 24, the Zephyrs beat North St. Paul in a conference dual 140.225-130.6. At the three-team Eagan Invite on Saturday, Jan. 27 they won big with a 147.1, putting to rest the former record from 1988 (146.9).

Sophomore Kate Ryan’s all-around score (35.4) took first in the North St. Paul meet. She captured firsts on beam (9.375), bars (9.0), and floor (9.375).

Caylee Greeder, sophomore, placed second on vault (8.95).

A team effort and career highs resulted in a new school team score record at Eagan. Veteran head coach Debbie Driscoll said, “I knew early on with the talent on this team the potential was there to score big and break the school record. I am very proud of the team’s hard work and their determination. It was a fun day.”

A stunning floor team score of 38.2 helped eclipse the gymnastics record. Senior Maria Wagner posted a career high 9.75, followed by Ryan (9.55), senior captain Haley Oswald (9.5), and senior captain Olivia Hurt (9.4). Wagner also won vault (9.4) while Hurt took second with a 9.3. Ryan (9.35) and Oswald (8.9) placed 1-2 on beam, and sophomore Olivia Meger amazed with a personal best and first place on bars (9.5), followed by Ryan (9.35) for second place. Once again, Ryan took first in the all-around with a 36.5.

This week the Zephyrs take on Simley, hosting their last regular home conference meet on Thursday, Feb. 1 at 5:30 p.m. It is also senior night.

Their 67-38 win over St. Anthony Village was led by Annika Sougstad with 16, Emma Grothaus 12, Saley Underwood 10, and Josey Underwood and Eve Farrell nine each. Second chance for man who supplied fatal heroin

WHITE BEAR LAKE — A Mahtomedi man was put on probation for 25 years earlier this month for giving heroin to a woman who died from an overdose last March.

Adam Christopher Guzman, 40, supplied heroin to Megan Burkard, 28, who was found dead in her White Bear Lake apartment March 25, 2017, according to court documents. Guzman was charged with third-degree drug-related murder and pleaded guilty to the charges in November.

Guzman received probation at his sentencing Jan. 9 instead of prison time for a variety of factors, said public defender Bruce Wenger.

“He accepted responsibility, he showed remorse, (and) the victim's family supported the sentence he got,” Wenger noted.

Burkard was a friend of his with whom he shared a gram of heroin when they met outside her apartment last March.

“He was devastated by the death of his friend,” Wenger explained. “This was absolutely a horrible accident. There was no criminal intent of any kind.”

Guzman was shocked by her death and said he couldn't believe she died from using the half gram he gave her.

“He was a daily user and she was a weekly user, so he had built up an immunity that she did not,” Wenger explained.

“They both took the same amount of drugs and she died and he didn't.”

The Ramsey County Medical Examiner's Officer determined Burkard died due to acute heroin toxicity.

Burkard was found dead the morning of March 25 when officers responded to a suspected overdose. Officers attempted chest compression, and medics tried to save her life as she was still warm even though she had no pulse. She was pronounced dead about half an hour after officers arrived. MARINE ON ST. CROIX — Only the hardiest turned out for the Northeast Suburban Audubon Christmas Bird Count (CBC), which took place Dec. 31 in Washington County this year. In its 118th year, the CBC invites volunteers to venture into their communities to record observations of bird species to contribute to data about bird populations.

Temperatures on Dec. 31 ranged from -14 degrees F to -7 degrees F, which inspired a number of birders to stay indoors during the count. Those who were able to join the annual count spent much of it hiding from the freezing wind inside their cars while they drove from feeder to feeder. This year's potluck at Lee and Rose Warner Nature Center, where all the volunteers come together at the end of the day to share results, was canceled due to the cold.

“You can really see the difference, because it was so cold,” said count coordinator Jim Howitz. “Historically, we have had very few days below zero, and that's made a difference.”

The St. Croix River had very few spots of open water, which reduced the chances of observing waterfowl and wetland-dwelling species such as Wilson's snipe.

Usually counters who visit the open water at the Allen S. King plant in Bayport are able to find interesting ducks or gulls, but the warm water in combination with the extreme cold created a steam too thick to see through.

“Because of bad weather and lack of people looking, this will be lowest count of individuals since 1967. We only had 24 people out in the field in nine parties,” Howitz said.

Unusual sightings Among the more unusual sightings this year was a rusty blackbird, a species Howitz said is in decline all over the country. This jet-black bird is recognizable by its bright yellow eyes, and is related to orioles, grackles and meadowlarks. It breeds in wooded swamps in the north, and winters in the same type of habitat.

“No one knows why it's not doing well,” Howitz said.

Northern species such as pine grosbeaks and red crossbills haven't showed up on the count for quite some time, likely due to the effects of climate change, Howitz said.

Counters noticed several sightings of tufted titmice around the Twin Cities area, which were common in the counts until the late 1970s, and then disappeared until the last few years.

Abundant species Other trends show that woodpeckers, cardinals and turkeys have been increasing in recent years.

“As the trees get old, that's good for the woodpeckers,” Howitz said. “Suburban areas are good for cardinals, so for a lot of species the habitat has been getting better for them. ”

Another notable observation were the higher number of common redpolls, and along with them, at least one hoary redpoll, a larger and rarer cousin.

Howitz said that Minnesota reported more redpolls this year than any other North American location.

“That's one of the few birds that increases as the winter goes on, so we're likely to have more in the Twin Cities in February than we have now,” Howitz said.

“They're nice little birds because they're very tame, and that event is not likely to happen again in our lifetime.

It's hard for Minnesota to be number one in anything, except for maybe the owls.”

The Christmas Bird Count takes place each year between Dec. 14 and Jan. 5; the date is set by the coordinator. In Washington County, it usually takes place the first Saturday after Christmas. Dean opts out of governor’s race Rep. Matt Dean (R-Dellwood) dropped out of the governor’s race Thursday morning, Jan. 25.

During his announcement at the State Capitol, Dean endorsed Jeff Johnson, Hennepin County Commissioner and the party’s 2014 nominee.

Dean did not score as well as he’d hoped in a recent poll and felt Johnson was a candidate who could unite the party. Dean said he does not plan

to seek another term in the House of Representatives where he served seven terms, including the onetime position as majority leader and current chair of the Health and Human Services Finance Committee.

The process to nominate a gubernatorial candidate starts at precinct caucuses Feb. 6, where participants will vote in a straw poll for their

gubernatorial choice. The caucus is the beginning of a long process to select delegates to the June state convention where the party endorses a candidate for governor. The party’s nominee will then be selected during the Aug. 14 primary election.

WHITE BEAR LAKE CITY COUNCIL NOTES The City Council took the following action at its Jan. 23 meeting: • Authorized purchase of four cardiac monitor/defibrillators.

The purchase is unexpected, but money is available in the budget for handheld radios that are no longer needed ($91,000), plus a savings realized through low bids for the new dump truck, noted City Manager Ellen Richter.

The city purchased its current monitors, HeartStart Mrx, for its four ambulances in 2008. The Federal Drug Administration has decertified these particular monitors due to electrical issues and requested they be removed from service. Since they are “a critical piece” of equipment, the city is

replacing the devices at a cost of $124,000.

• Approved the 2018 Pay Equity Compliance Report.

The city must submit the report to the state Department of Administration every three years confi rming equitable compensation to employees, regardless of gender.

Councilman Bill Walsh asked Richter if White Bear Lake would be paying an equitable salary without this requirement? She replied, “yes.”

“Then it's an unfunded mandate we don't need,” Walsh said. Councilman Doug Biehn pointed out that equity compliance is an issue in outstate Minnesota.

Surviving a home renovation Homeowners invest large sums into improving their homes to make them more comfortable living spaces or to increase their odds of selling quickly. The Remodeling Futures Program at the Joint Center for Housing Studies of Harvard University predicted U.S. spending on home renovations and repairs to peak at $327 billion in 2017.

Whether one is doing a large renovation or a small remodel, life may be turned upside down during the project. Furniture may be moved out of the room, walls may be demolished, water or electricity may be turned off, and appliances may be missing or not hooked up. Home improvements often drum up dust and disarray. Such projects can try the patience of any homeowner, and things may get worse before they get better.

Even though remodeling can be taxing, the end result is often worth it. Here’s how to look forward to the silver lining and come out unscathed.

Discuss the project before it starts.

All family members should be in agreement before the first hammer is swung. Decide on as many details as you can ahead of time and have a firm plan in place.

Establish back-up choices for tiles or color schemes in case the items you want are out of stock. Trying to make decisions under duress may result in bad choices.

Do one project at a time.

It’s tempting to want to improve as much as possible at once to maximize motivation and renovation materials.

However, having no place in which to escape the mess can elevate stress levels. Do not think about renovating kitchens and bathrooms all at once, or you will not have any working fixtures for tasks like washing up.

Have everything in place …

Before demolition even begins, have building materials bought and stored, contractors and subcontractors lined up, and see what you can do to minimize the time workers need to spend in your home. … but expect delays.

In a world where things move at lightning speeds, renovations have not gotten the memo. Home projects take lots of time and will likely take longer if you are doing the work yourself in your free time. Build lots of extra time into the project so you are not disappointed when delays happen — even when you’ve done your best to avoid them.

Plan an escape zone.

Construction environments can be messy, loud, smelly, and a host of other unsavory adjectives. The chaos that ensues when life is turned upside down can be overwhelming, particularly for the person who spends the most time in the home while work is being done. Build escape moments into the plan and make sure everyone else at home is on board. During the real grind of the project, a night or two at a hotel may be a welcome respite.

Lipovetz, a Hibbing native, will take over as head of the division from Tom Stoneburner, PE, who will become president and CEO of TKDA when Bill Deitner retires in April.
