The helmets may come off, but the hockey hair is ready for prime time as players lace up for the first ever Flow-a-thon, a fundraiser that celebrates Mahtomedi’s finest hair while supporting future improvements to one of the outdoor rinks at the District Education Center (DEC). From mullets to playoff-ready curls, skaters are showing off their best f low — and asking the community to vote with donations. This fall, the Mahtomedi Youth Hockey Association launched a fundraising effort with the goal of raising $1 million by February 2027. “Those rinks at the DEC are all we have, so why wouldn't we make them the best they could possibly be?” asked Kristina Lucius, the hockey association’s fundraising director. “They are unique in that they are a school facility that is designed to be enjoyed by everyone in our community. From toddlers taking their first glide, to pickup games of all ages, figure skaters practicing their best twirl, and grandparents enjoying the echo of laughter … the DEC is truly a place for everyone. The goal is to have more consistent open ice for all in our community to enjoy.” From now until Jan. 25, the hockey association is raising funds for what it calls the “rink of dreams.” Improvements will likely be done in phases and could include expanding one of the rinks to

The Mothers Band goes on record at McNeely Music Center BY LOGAN GION CONTRIBUTING WRITER
Local teen trio The Mothers Band is recording a studio album at the McNeely Music Center (MMC) in the White Bear Lake Arts District. The members—White Bear Lake Area High School seniors Freya Sanders, Luisa Maruyama and Holly Flood—have invited their friends and families to observe the recording process using MMC’s built-in educational technology. “It’s shocking; I feel really blessed,” said Sanders. “Little freshmen staying together led to this crazy opportunity.”
The Mothers Band began five years ago, when the trio sang together for their middle school’s awards ceremony. The following year, their school separately asked Maruyama and Flood to perform for the talent show. Neither wanted to perform alone, so they convinced Sanders to recreate their trio. “We hadn’t come up with a band name,” Maruyama remembered, “and then we were like, ‘The Mothers Band—because our mothers are always telling us to sing songs together.’” How does it feel to have a band named after you? Shop local challenge
n January, we know our small businesses, especially local retailers, will feel the post-holiday sales slump. The “shop local” campaigns prior to the holiday season, such as Black Friday and Small Business Saturday the weekend after Thanksgiving, mark the time that retailers and small businesses get their annual budgets into the “black”, meaning they are finally making a profit for the year. This also means that many businesses are operating at a loss all year until November. We can make a difference. The first few months of the calendar year are particularly difficult for local small businesses, including ours. Historically, we strive to manage the losses of the first few months with the hope that sales and income will pick up as summer approaches. Many businesses such as a ours have moved to an October year-end schedule, so that first months of our annual budget, Publisher’s the November and December, are profitable and we have built up a little income to View float our operating expenses through Carter Johnson the rest of the winter. My point is to build awareness of shopping locally at other critical times of the year outside of Black Friday and Small Business Saturday. At a recent management meeting here at Press Publications, we came up with an idea to challenge our employees to support shopping locally during the month of January. We have put out a box where any employee who shops locally can enter their receipt to win local gift cards in weekly drawings. The goal is to keep our local employee's wages spent with our local businesses to support our local economy. Studies have shown that around $.67 of every dollar spent locally continues to circulate in the local economy. This is in contrast to only about $.43 of a dollar that stays local from a purchase at a chain store. I encourage you to think about this the next time you go online to order something from a company that does little to support our local economy, doesn't provide protection from fraudulent products being sold, and sends vehicles up and down our streets to drop off products that cost less than the fuel it takes to deliver them. Invest in the community you live in by shopping locally all year long. If you need new tires to drive your car safely this winter, check out a locally-owned tire store. Go to local HVAC experts, plumbers and electricians for home repair needs, where you are also likely to get the best service. As you plan your trips to the grocery store, consider those who reach out to you with sales and specials by advertising in our paper. When you can, get your prescriptions filled at the local pharmacy. If you need to buy a gift or update your wardrobe for the new year, visit the locally-owned shops and check out their new products. When you schedule a lunch or dinner with friends, remember our local selection of great restaurants.
Give more grace
As we enter the new year, all of us could work toward giving more grace. At the paper, we often talk about how readers who call with complaints and share frustrations with us are citizens who care about our community and the paper. Otherwise they wouldn't bother to say anything. Our staff can choose to take it personally and become jaded, or give a little grace and use the feedback to work toward improvement. An example applicable to all of us is to give more grace to other drivers around you by moving over and letting someone merge in front of you when they have their turn signal on. Another is to show grace by forgiving someone who has wronged you or a loved one; or show grace by being respectful to those with whom you disagree. Ephesians 4:32 reminds us: “Be kind and compassionate to one another, forgiving each other, just as Christ God forgave you.” Or take the advice of Muppets creator Jim Henson: “Please watch out for each other and love and forgive everybody. The power of 3s: ‘We make a life by what we give’
T
he "power of threes" is a principle that suggests things grouped in threes are more memorable, satisfying and effective. It's used in various fields like writing, design, presentations and psychology because humans are naturally wired to remember patterns of three. My message is threefold: • Realties of the nonprofit space • Our community nonprofit excellence • Your engagement potential First, nonprofit Movers & trends illustrate Shakers challenges they face: Jim • A modest 3.7% increase in total Rathburn dollars raised, yet number of donors decreased • 11% decrease in smaller dollar, steady donors, reflecting engagement challenges • 2/3 of staff seek to leave after one year, citing limited support, limited pay or professional development, lack of sustained management direction Demographics offer hope. People over age 60 are now more engaged than before. It is essential for nonprofits to identify individuals who can contribute their time, financial resources or expertise, and to effectively maximize one or more of these valuable assets. People tend to give more as they near age 67. Baby boomers were born between 1946 and 1964. They are aging into a growing “giving pool” at a steady rate. This will continue through at least 2030. Beyond financial or treasure sharing, they are key to volunteer pools. A non-
profit must demonstrate creativity and adaptability when developing safe and enjoyable experiences. It must develop strategies to nurture younger new helpers as they near age 50. Second, our community is thriving. The diversity of giving and grants to and from the Greater White Bear Lake Community Foundation is one example. The breadth of the nonprofits they touched in 2025 was amazing. Our White Bear Area Food Shelf has achieved sustained giving. New first-time donors joined, and the organization provides excellent service through its dedicated team and volunteers. Clothing drives from churches, schools, and civic organizations (e.g., Rotary) saw increased donations, keeping those in need warm this winter. Individuals have dug deep to help. For our community and the general nonprofit space, increasing financial giving is a continuing challenge. Be creative in giving. For example, you may find you have no extra or gently used clothes for a clothing drive. You may not have the specific needs of the nonprofit. They will usually accept a Target or Walmart gift card to use as they see fit to better match up to needs. You can also give in other ways, such as donating items you currently own for silent auctions or similar events. If giving cash is difficult due to budget or cash flow, individuals may use wills and estate plans instead. Examples: • Bequests gifts in a will (cash, property, IRA). • Charitable Remainder Trusts (CRTs): Income to you/heirs, remainder to charity. • Charitable Lead Trusts: Income to charity for a term, then back to family.
• Donor – Advised funds: Allow for quick deductions, professional management, legacy naming. There are other options. All have tax benefits and other advantages. Meeting your financial advisor for an hour to explore options is a proactive step to reflect your commitment to helping nonprofits. Third, at the end of the day community and individual “action” fuels nonprofit growth and stability: • Can you encourage individuals to consider careers in the nonprofit sector as rewarding and meaningful opportunities? If "retiring" from another lifelong job, consider joining a nonprofit staff? • Can you “step up” your own gifts of time, treasure and talent? • Can you offer advice to nonprofit leaders on improving hiring and retention? • Invite a neighbor to join you in volunteering? • Can you volunteer to join a nonprofit development committee to offer your experience and creative thoughts? • Can you regularly thank staff during your volunteer work to boost their job satisfaction? Creative ways to do this? It is my hope your reply to one or more of these questions is “Yes.” Winston Churchill stated: “We make a living by what we get. in 2022 it was 8,481. The WBLAS website states grades 9-12 enrolled 1,359 in 2025, and 2,700 in 2024 (www.niche.com/). The National Center for Education Statistics shows WBLAS employing 1,160 including teachers, administrators and support staff, which is similar to Edina. However, Edina’s public schools are ranked third and WBLAS 88th. Population: Neilsberg.com states that between 2018 and 2025 White Bear Lake’s population declined by 5.29%; Hugo’s increased by 1.38%; and Vadnais Heights’ remained about the same. Return on investment: Minnesota’s Department of Education Report Card shows in 2025 the math, reading and science test scores at grade level remain dismal at best: math, 32.3%; reading, 44.7%; and science, 25.8%, while fewer than 76% of all students attended school regularly. Taxpayers fund each student to the tune of $19,000+/year and the board just passed an additional $73 million tax levy. The school board and superintendent need to address the reasons for the discrepancy in enrollment. The taxpayers, as major stakeholders, deserve an answer with objective data to support it. It is rare, in a short amount of time, that enrollment projections would be off by this much. If the policy of the school board is to hear and respond to public comments, then please review and respond. Answers are needed.
December 17 marked the Royal Credit Union's Test Drive, a next stop reality financial education event at White Bear Lake High School. I was a volunteer, among many, who worked directly with the students. I wanted to give a job well done to all teachers and parents. I visited with approximately 50 students and was so proud to have adult conversations with our future. They were smart, polite and ready to tackle what their future would bring. Where are the students? To gain approval by the taxpayers for the $326 million bond referendum in 2019, student enrollment for White Bear Lake Area Schools 2024-2025 school year was projected to be 10,948 (https://resources.finalsite.net/images.) With the new high school campus (rivaling many universities) and district upgrades complete, where are the students? Why is enrollment lagging? During the school districts’ truth in taxation meeting Dec. 8, Assistant Superintendent Wald stated, “Those numbers (on enrollment) have not come to fruition.” WBLAS enrollment history: 2025-2026 enrollment is 8,012. Public dialogue our business I want to respond to the White Bear Press article titled “Different commenters request different comment scenarios” dated Dec. 24 regarding public dialogue at school district meetings. Contrary to commenters in the article, public dialogue at school district meetings supports good governance. Their notion that these public meetings are to conduct the district’s “business” by the board is an attempt to cloud transparency and justify the silencing of the public. The school district’s business is serving the community — without public dialogue, why do we have an elected school board? The other attempts by the district cited in the article at transparency fall short. “Coffee with Dr. K” and newsletters merely serve as lip service to create an appearance of transparency while ignoring our challenges around enrollment, costs, academics and attendance. Dialogue between the public and the board should be encouraged at the open public meetings to bring more accountability to elected officials. Fire crews battle garage fire day after Christmas Multiple fire departments responded to a structure fire just before 10:30 a.m. Friday, Dec. 26, in the 1800 block of Richard Court in White Bear Lake. When fire crews arrived on scene, White Bear Lake Fire Chief Greg Peter-
son says crews found an attached garage with heavy fire coming out of the door and through the roof. “Two vehicles were in the garage at the time of the fire, which contributed to its intensity,” he said. Maplewood, Mahtomedi, Vadnais Heights, North St. Paul, Little Canada and Oakdale assisted the White Bear Lake Fire Department. Peterson stated that there were no injuries, and the cause of the fire is currently under investigation.
Vadnais Heights woman charged with felony child endangerment Kyla Monae Denise Vinson, 28, of Vadnais Heights, has been charged with
three counts of endangering a child. According to the criminal complaint, on Nov. 2, 2024, at approximately 5:45 p.m., the Ramsey County Sheriff’s Office received multiple reports of a fire at a townhome located on County Road D in Vadnais Heights. Upon arrival by first responders, Vinson was outside of the home screaming that her children were still inside. She told investigators that she was sleeping and was awakened by her 8-year-old, who alerted her to the fire. She and the oldest child jumped out of a second story window, leaving the other two children inside. Firefighters entered the home and found an unconscious nearly 4-year-old boy in the hallway; they also located a 14-month-old girl in the far corner of the bedroom alert with labored breathing. Vinson and her children were brought to

Vadnais Heights
• A 50-year-old man from St. Paul reported Nov. 30 that his Toyota Tundra has minor damage after another vehicle struck it and drove away in the 800 block of County Road E East. The incident is under investigation. • A man from St. Paul who is an Uber driver reported Dec. 1 being asked to drop off a shoebox containing shoes in the 3400 block of Rice Street and a receipt by a client who did not ride along with him. • A 38-year-old man in the 1000 block of County Road D East reported Dec. 1 that two mail packages, containing hoodies and shoes valued at more than $170, were stolen from his front step. The incident is under investigation. • Deputies arrested a 42-year-old woman from St. Paul Dec. 2 on active warrants after responding to a report of domestic assault in the 1200 block of County Road D Circle E and learned she was wanted by Washington County for third-degree burglary. • Deputies issued a trespassing notice and theft citation Dec. 2 to a 45-year-old woman from St. Paul after she was caught shoplifting nearly $60 worth of merchandise from a business in the 800 block of County Road E East. • Deputies responded Dec. 3 to a disturbance call in the 500 block of Belland Avenue and found
the hospital. The two youngest children were intubated and in critical condition. The 8-year-old was placed on oxygen. According to the complaint, a deputy allegedly heard Vinson tell family members that she had been preparing grease for cooking and must have laid down or passed out. A search of Vinson’s home found a small bottle of tequila and a can of vodka along with an unsecured firearm in a nightstand drawer along with two loaded magazines. A sample of Vinson’s blood was also obtained about four hours after the fire, which found a blood-alcohol concentration of 0.106 as well as a presence of delta-9-THC. The three felony counts of child endangerment each carry a potential sentence of up to five years in prison. Vinson’s first court appearance is scheduled for Jan. 22.

She became belligerent in front of two children who were nearby, aggressively grabbing a deputy’s arm and using profanity. • Deputies issued a citation Dec. 5 to the owner of a Ford Ranger that was parked in a winter no-parking zone in the 700 block of North Oak Drive. • A 24-year-old woman reported Dec. 5 that she lost her wallet in the 4100 block of Centerville Road, although she does not remember where. The incident is under investigation. • Deputies arrested a 28-year-old man Dec. 6 in the 3400 block of Arcade Street for DWI after making the traffic stop because the Toyota Camry he was driving had expired license plates. • An employee at a car dealership in the 3500 block of Highway 61 reported Dec. 6 that someone stole dealer license plates off a GMC Sierra pickup truck. The incident is under investigation.

• Deputies arrested a 34-year-old man from Waconia Nov. 30 after seeing him slumped over behind the wheel of a Chevrolet Traverse in the 1000 block of Meadowlands Drive. After police approached the vehicle, the man drove away at a high rate of speed but slid off the road after hitting a patch of ice. He was then taken into custody on active warrants, and for fleeing and the drug paraphernalia that was found in the vehicle. • Deputies responded Dec. 2 to a report of a blue Mini Cooper parked or stuck in the 5100 block of Milner Street in the caller’s front yard. Deputies responded, could not reach the vehicle’s registered owner and had the car towed. • Deputies took a harassment report Dec. 3 after a 47-year-old woman reported that her neighbor’s children in the 2600 block of Suzanne Circle had damaged her fence while sliding down a hill and slamming into it. • Deputies responded Dec. 5 to a crash near the intersection of Centerville Road and Meadowlands Drive involving a Kia Sorento, DMW X1 and a Hummer. No drivers were injured, and deputies assisted with the exchange of insurance information and arranging towing. • Deputies responded Dec. 6 to a grocery store in the 1000 block of Meadowlands Drive after receiving a report that a 46-yearold man from East Bethel left the store without paying for nearly $15 worth of merchandise. The incident is under investigation.
WASHINGTON COUNTY SHERIFF’S REPORTS YEAR IN REVIEW • In the Case of the Bullying Bulldogs, two pit bulls were reported for harassing the complainant’s horses in the 11000 block of 66th Street N. at 6:52 a.m. June 23. • In the Case of the Bucolic Bear, the bear seen around town was reported now to be in the woods in the 9000 block of 75th Street N. on June 23. • In the Case of the Illuminated Insect, residents in the 10000 block of 67th Lane N. reported seeing lights on near Indian Hills Golf Course Aug. 2 and believed a drone to be surveilling their residence. A quick check of video surveillance footage provided by the golf course showed a large bug flying around. Deputies offered to provide
extra patrols in the area until after midnight for the suspicious bug or other activity. • In the Case of the Contained Canines, deputies took a report on Aug. 31 from the 9000 block of 75th Street N. about finding two restrained dogs. A short while later, deputies took another call from the 9000 block of 75th Street N. about their two dogs missing. The owners were soon reunited with their dogs. • In the Case of the Found Fowl, a chicken was reported for being in the middle of the road in the 11000 block of 60th Street N. on Sept. 22. The chicken had already crossed the road and had returned to its owner by the time
deputies arrived on scene. • In the Case of the Bounding Buck, deputies on Oct. 26 took a report of a deer who couldn’t quite complete the leap and became stuck in a fence in the 9000 block of Justen Trail N.

• In the Case of the Hallucinating Hound, a dog out for a walk with its owner was seen in the veterinary emergency room on March 25 after having eaten something suspicious on the ground near Lincolntown Avenue and Long Lake Road. The upshot of the visit was that the dog had eaten some form of marijuana off the ground. After a prolonged high and illness, the
dog is expected to recover. • In the Case of the Road Rage Raptors, deputies were dispatched out to a scene of two combatants locked in a pitched battle on Edgecumbe Drive on April 22. The eagles were in such an intense fight that their talons were entangled and they couldn’t get free of one another. By the time deputies arrived on scene, the eagles had settled their argument and had parted ways. • In the Case of the Culpable Coyote, a coyote was reported at 11:08 p.m. April 29 for howling on Rose Street and causing the complainant’s dogs to bark. If an immediate family member, two generations up or two generations down, served overseas during a time of conflict, you may qualify. cook up his special salsa and spaghetti sauce to share with everyone. He was an avid outdoorsman, especially fishing for crappies on Wapogasset Lake. During his White Bear Lake school days he participated in community soccer and hockey programs and transitioned to adult league softball after graduation. Drew was a passionate sports fan, especially of the Minnesota Wild, and often a frustrated Vikings fan. Drew had a compassion to love family and everyone he knew. He met the day not seeing strangers but rather seeing friends he had not yet met. His dogs were considered family as well and were always by his side. His spirit shone brightly in all he did. He will be greatly missed by all who knew him. A celebration of Drew’s life is being planned for January 10 from 3:00 pm - 6:00 pm at Meister’s Grill in Scandia. MC’s Taco and Tequila, located in White Bear Township, has closed its doors. Patrick Conroy, president of Muddy Cow, confirmed that the restaurant’s last day was Dec. 31. “We are working with a great tenant at the moment and hoping to have them take over as soon as possible,” he said. Los Ocampo Mexican Restaurant & Bar plans to take over the space in the near future. The business currently has three locations in St. Paul. Press Publications reached out to the new tenant to learn more but did not hear back prior to press deadline.

It feels like such a great gift that they gave us.” Maruyama’s mother, Ellen Maruyama, added, “It’s very sweet … Fleetwood Mac and The Chicks—They play a lot of things we happen to love.” The Chicks and The Wailin’ Jennys serve as The Mothers Band’s main inspirations, Flood said, because of the three-part female harmonies. While The Mothers Band’s style leans towards folk and bluegrass, the trio is unconcerned with sounding unique. “We’re not trying to be different, but I think that’s what’s making us different,” said Flood. “It’s not for the
end result; it’s for the progress.” Sanders believes that part of the progress achieved in the band’s five-year history has been finding a flow. “There’s no, ‘You always have to sing the high part. You always have to sing the harmony,’” she noted. “We’re able to bounce a lot of ideas off each other without fear … give each other healthy criticism and work together on our strengths.” The Mothers Band will soon have studio recordings to demonstrate those strengths, courtesy of MMC. “Touring (MMC) for the first time, I’m in tears,” Maruyama recalled. “You’re telling me that I get to be able to do this? To be able to write something of our own and be able to
produce it and be able to invite 50 of our closest family and friends … Honestly, it’s such an honor.” “(MMC) being local is really amazing,” Flood agreed. “I think we just never expected this to happen. With Devin O’Donnell delivering an overtime goal and Vinny Redpath a quick hat trick, Mahtomedi hockey picked up two wins over the break. The Zephyrs are 5-6-1 and ranked No. 9 in Class 2A. The Zephyrs tripped East Ridge in overtime Dec. 27 at home, the game-winner coming on O’Donnell’s deflection of a shot from the point by Trevor Rogosheske 2:25 into the extra session. O’Donnell had two goals, and Ryker Dunbar and Blake Loida one each, with assists from Redpath, Brock Gutterman, Kaden Gagnelius and
Loida. Ivan Schmitz had two goals for the Raptors (5-7). Zephyr goalie Jackson Chesak made 31 saves. Redpath drilled three goals in the first five and a half minutes at Orono (3-6-3) there Dec. 30, and the Zephyrs went on to win 7-4. Redpath scored at 18 seconds, 2:00 and 5:25, with three assists by Tommy Boe and one each by Brayden Fuerst, Cody Loida and Ryker Dunbar. Goals by Easton DeZelar, Dunbar (power play), Fuerst and Will Seevers gave the Zephyrs a 7-2 lead. Orono (3-62) was 3-for-4 on power plays. Chesak made 32 saves. Undefeated, No. 2 ranked Minnetonka shut out Mahtomedi 4-0 on Saturday, outshooting the Zephyrs 48-13.
GYMNASTICS
Mahtomedi placed second of eight teams in their division of the annual Minnesota Girls Gymnastics Officials Association (MGGOA) meet Saturday at Park Center. With 130.90 points, they trailed St. Louis Park’s 132.925. Five Zephyrs earned medals. Lucy Otto placed sixth all-around (33.375). Placing fifth were Cassia Hartman on bars (8.175) and Otto on f loor exercise (8.925). Addie Eitel was sixth on vault (8.875), Adele Schroeder seventh on f loor (8.70), and Margo Brunner ninth on beam (8.45). Mahtomedi will host a four-team invitational Saturday, Jan. 10.

Carlson placed third at 100, Kyra Kamrath fourth at 118 pounds, Hahn fourth at 124, and Englund sixth at 155.

Firefighters who have completed at least five years of good time service qualify as a member of the Statewide Volunteer Firefighter Plan. “This certainly would help with recruitment and retention,” said Fire Chief Joel Schmidt. The city has one firefighter who is fully vested (with 20 years of service). • Effective Jan. 1, the city will provide time off to eligible employees who qualify for Minnesota paid leave benefits under the new Minnesota law. As a participant in the state program, Mahtomedi will fund benefits through premium contributions payable to the state of Minnesota. The city may pay up to 100% of the non-bargaining employees required premium. • The agreement with the city’s legal firm, Kennedy and
Graven, was initiated in December 2023 and expires at the end of this month. The firm proposed a new threeyear agreement for legal services, and council approved the new agreement with minor revisions. • Every year, each city must conduct a Municipal Separate Storm Sewer System (MS4) presentation and public hearing to retain its MS4 permit. According to the Environmental Protection Agency, stormwater runoff is the leading source of water pollution. An illicit discharge is any discharge into the stormwater drain that is not entirely water, such as paints, soap from car washing or grass clippings. Mahtomedi has not only met requirements but has trained staff to prevent illicit discharges, as well as education through its newsletter and
the annual RITE of spring to engage the public. Members of the city’s public works department have been educated on proper salt use on roadways and have undergone training on MPCA Smart Salt application. • Washington County Sheriff’s Office (WCSO) deputies recently attended a council meeting to update the city on law enforcement activities during the past month. Deputy Gibney took the podium after his return from leave to note that the cold and snowy weather has led to fewer complaints about juveniles on scooters. “Otherwise, it’s business as usual with a mix of calls for service and proactive activities,” he said. The overnight winter parking ban has begun and runs until April 1. Vehicles are not allowed to park on the street from 1-7 a.m. or when there is
more than 3 inches of snow on the ground. Gibney advised the public to avoid vehicle tampering by keeping their cars locked. “If you see something, say something,” he said. “We’re staffed 24/7.” Joining Gibney was WCSO Commander Andrew Ellickson to brief council on ICE activities in the city. “ICE does not reach out to the WCSO, and we do not participate in the raids,” he said. That this proceeding is taken pursuant to law in the name of and on behalf of the County of Ramsey, State of Minnesota, by John J. Choi, the duly elected, qualified and acting County Attorney, at the request of the Board of County Commissioners of Ramsey County, as shown by County Board Resolution No. B2023-052, dated April 4, 2023, a certified copy of which is attached hereto as Exhibit A and made a part hereof. II. That the County of Ramsey also deems it necessary, expedient, and for a public use and purpose to obtain by “quick take” condemnation under the right of eminent domain the permanent easements and temporary construction easements in the lands as described in this Petition, together with all structures, trees, shrubs, grass and herbage to be damaged thereby. III. In the attached Exhibit B, where a “permanent easement” is identified, the interests being conveyed include all rights necessary for the construction, operation, and maintenance of all public right-of-way and utility uses now
known or adopted in the future. Such rights include, but are not limited to, the right: to remove and use all plants, trees, ground cover, and natural growth now existing, or later planted or grown; to permanently grade or alter the grade of the land, and to remove and use all earth and other material not reasonably necessary for lateral and subjacent support; to limit or allow the location, number, and related characteristics of access from the remainder property to the public right-of-way; to store equipment or supplies; to access, both ingress and egress, from the most reasonably convenient rights-of-way; to remove any physical improvements or fixtures that interfere with its use as a public right-of-way; and to exclude from the area any use or improvement that conflicts with the rights conveyed herein. Reasonable and convenient access to the remainder will be maintained. IV. In the attached Exhibit B, where a “temporary easement” is identified, the interests being conveyed include all rights of possession and use, for a limited period of time, necessary or incidental to support the related construction project, including the right: to stage equipment or supplies; to access other portions of the construction project; to make minimal permanent alterations to the grade of the land that do not substantially impact the remainder; to remove (and restore in substantially similar condition) any plants, ground cover, or physical improvements; to access, both ingress and egress, from the most reasonably convenient rights-of-way; and to install any temporary improvements. Reasonable and convenient access to the remainder will be maintained. The term of the temporary easement shall be for 24 months beginning on March 1, 2026, and ending February 28, 2028, or for 24 months from the date when granted pursuant to order of the district court, whichever is later. In addition, the interests identified in this paragraph include the option of the Petitioner to extend the temporary easement for up to two twelve-month terms to be held consecutive to the original term and to each other at the monthly rate determined for the initial term. V. Personal property not specifically identified as being acquired, including, but not limited to, fencing, irrigation systems, pavement, curbing, or signage, or trees, shrubs, plants, or ground covering, is not included in this petition, except to the extent the above rights provide for the removal, replacement, use, or repair of such property. It is the intention of the Petitioner to address any claim of damage related to personal property destroyed, removed, lost, or otherwise damaged, but not repaired or replaced in substantially similar condition, in accordance with applicable relocation laws, including Minn. Stat. § 117.50 - .56 or the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended, and any regulations adopted pursuant thereto. VI. That the purpose for which said interests in land described in this Petition are being acquired is for the purpose of a roadway project on County Road C between Lexington Avenue and Little Canada Road. The project requires acquiring right-of-way at various locations for roadway reconstruction, including new grading, mill and overlay, and the installation of American Disability Act (ADA) compliant improvements where needed. The work may involve updates to roadway elements such as traffic signal, pedestrian facilities, storm and sewer systems, pavement, signage, pavement markings, retaining walls, and street lighting. VII. The taking in this matter is to obtain rights sufficient to support the construction and maintenance of a public highway, including related facilities. Unless specifically identified, pre-existing utility, pipeline, access, and other easements or interests shall remain in full force and effect and shall only be impaired to the extent necessary for the County of Ramsey to construct and maintain a public highway, and related uses, on the land being acquired. For any parcel being taken by this condemnation proceeding that is subject to preexisting utility, pipeline, access, or other easements or interests, the County of Ramsey shall work as needed with the easement holder to adjust facilities to accommodate the construction or to adjust construction plans to minimize related damages. VIII. It is the intent of the Petitioner that reasonable access, in at least one direction, to the main thoroughfare will be maintained for any remaining interest of a property from which a temporary easement is taken. IX. Notwithstanding anything to the contrary contained herein, should tests or evaluations undertaken by or on behalf of the County of Ramsey indicate the possible presence of pollutants, contaminants, or hazardous substances on any of the property described in this Petition, the County of Ramsey reserves the right to defer effecting the transfer of the interest to any of the property as described herein for a reasonable time until the County of Ramsey can evaluate whether it wishes to proceed with the taking, abandon these proceedings and dismiss the Petition as to said property, or otherwise respond to such information. Further, the County of Ramsey reserves the right to recover costs of clean-up and testing and all other damages resulting from the presence of pollutants, contaminates, or hazardous substances on the property described herein, from all potentially responsible parties in a separate legal action. X. That a party wishing to challenge the public use or public purpose, necessity, or authority for a taking must appear at the hearing of this Court at which the County of Ramsey, as Petitioner, shall present this Petition to the Court and state the objection or must appeal within 60 days of a Court order. XI. That the land in these proceedings to be taken are situated in Ramsey County, Minnesota and are more particularly described in attached Exhibit B which is made a part hereof. The names of all persons appearing of record or known to the County of Ramsey to be the owners of said land, or interested therein, including all whom the County of Ramsey has been able by investigation and inquiry to discover, together with the nature of the ownership of each, as nearly as can be ascertained, are set forth on attached Exhibit B. XII. The County of Ramsey hereby moves the court for an order transferring title and possession of the parcels described herein prior to filing of an award by the court appointed commissioners, pursuant to Minnesota Statutes § 117.042. WHEREFORE, the County of Ramsey prays for an order of this Court as follows: 1. Adjudging that said taking is for a public purpose, is necessary, and is authorized by law; and 2. It be further adjudged that the County of Ramsey is entitled to take and hold such property for the public use pursuant to the Notice of Intent to Take Possession, on file with this Court; and 3. Appointing three disinterested commissioners, and at least two alternates, to ascertain and report the amount of damages that will be sustained by the several owners on account of the taking; fixing the time and place of the first meeting of the three commissioners; prescribing their compensation; establishing procedures for the disbursement of funds deposited with the district court; establishing procedures by which commissioners shall hear all allegations and proofs of persons interested herein; and requiring the commissioners to file their report with the District Court Administrator within 365 days from the date of the order appointing the commissioners unless said time be further extended by order of the Court; and 4. Section 549.211 to the party against whom the allegations in this pleading are asserted. /s/ Scott Schwahn Scott Schwahn EXHIBIT A RAMSEY COUNTY BOARD OF COMMISSIONERS RESOLUTION B2023-052 Sponsor: Public Works Meeting Date: 4/4/2023 Title: 2023 - 2027 Transportation Improvement Program File Number: 2023-120 Background and Rationale: To qualify for state and federal funding and to proceed with construction projects, the Ramsey County Board of Commissioners must approve the Public Works 5-year Transportation Improvement Program (TIP). The TIP is a planning document and funding estimates identified in the TIP are reflected in the county’s Capital Improvements Program Budget. Similar programs have been developed each year since 1988. The Public Works department, annually, prepares the TIP using a collaborative process whereby the county solicits projects and input from area municipalities. Project inclusion in the TIP is based on a cooperative dialogue with municipal and state partners, along with technical analysis and consideration of funding opportunities. While funding limits will continue to challenge program delivery, communication and engagement with municipal partners ensures local needs and priorities are examined and addressed to the extent possible. Projects included in the TIP are also looked at through the lens of the Ramsey County All Abilities Transportation Network policy, which prioritizes the most vulnerable users (i.e. pedestrians, bicyclists, people with disabilities, etc.) first. The design, construction, and right-of-way costs identified in the TIP are estimates based on best practices in the industry. The funding landscape for transportation projects can be volatile and the ultimate delivery of the TIP is dependent on future funding levels. Partnering on projects with area communities, bordering counties, the Minnesota Department of Transportation, and other state agencies will continue to be a critical way for Ramsey County to get the most from available funds. Recommendation: The Ramsey County Board of Commissioners resolved to: 1. Adopt the 2023 - 2027 Public Works Transportation Improvement Program. 2. Authorize the County Engineer to prepare plans and agreements for all projects identified in the Transportation Improvement Program, and to issue solicitations in accordance with County policies and procedures and the Minnesota Department of Transportation’s list of “Pre-Qualified Vendors by Work Type”. 3. Authorize the County Surveyor to execute Right of Way Plats and Certificate of Surveys for Highway projects that require the determination of existing right of way for the delineation and /or acquisition of property, for planning studies or disposition of excess county property. 4. Authorize the County Manager to enter into contracts and agreements, and execute change orders and amendments to contracts, supplemental agreements, and agreements related to the expenditure of Transportation Improvement Program Project Funds utilizing County State Aid, Federal, State, and participating funding associated with the construction of the approved projects in the 2023 - 2027 Transportation Improvement Program or a previously approved Transportation Improvement Program in accordance with the county’s procurement policies and procedures. 5. Authorize the County Engineer and County Attorney to acquire temporary easements, permanent easements, fee title, and enter into Limited Use Permits with the State of Minnesota for projects in the 2023 - 2027 Transportation Improvement Program, or previously approved Transportation Improvement Program, by negotiation or condemnation. 6. Authorize the Public Works Director to approve negotiated settlements for up to $100,000 over the county’s appraised value per parcel for temporary and permanent easements and fee title. 7. Authorize the County Manager to approve and execute purchase agreements, settlements, closing documents, Limited Use Permits, and other related real estate documentation associated with County Board approved acquisitions of real property. 8. Authorize the County Manager to approve and execute cooperative agreements and maintenance agreements with cities, counties, the state, and other governmental agencies for their participation in projects listed in the 2023 - 2027 Public Works Transportation Improvement Program or previously approved Transportation Improvement Program. 9. Authorize temporary cash loans from the County General Fund to the Road and Bridge Capital Improvement Program fund and the Wheelage Tax fund for costs of projects listed in the 2023 -2027 Public Works Transportation Improvement Program, or previously approved Transportation Improvement Program, and for maintenance project expenditures occurring before bond or wheelage tax proceeds are received pending receipt of Federal, County State Aid Highway, state and participating funds. 10. Authorize the Public Works Director to submit grant applications for state and federal funding for projects listed in the 2023 - 2027 Public Works Transportation Improvement Program. 11. Authorize the County Manager to accept grants and execute grant agreements agreeing to the grant terms and conditions for the grant award. For grants that so require, the county agrees to be responsible for any additional amount by which the cost exceeds the county’s construction cost estimate and will return to the grantor any grant amount appropriated for the project but not utilized for the project under the terms of the grant agreement. 12. Authorize the County Manager to issue letters of support in place of an official Ramsey County Board Resolution for constituent cities’ grant applications.
