BROKER BLOG WITH DEAN BECKER DUAL AGENCY An unrepresented buyer walks into your open house listed for the past 6 months and asks you to write the contract for the home. Great, who do you represent... Buyer, Seller, or Both? Are you truly a dual agent, doing your fiduciary duty to both buyer and seller? Agency, in a Real Estate relationship, is one person (the agent) is authorized to represent the interests of another (the client) in dealings with customers. A Real Estate agent has fiduciary duties to the client, such as confidentiality, accounting, reasonable care, loyalty, obedience, advocacy, and disclosure. Dual Agency occurs when one agent individually, or two agents within the same brokerage, represent both buyer and seller in a real estate transaction. When a broker acts as a dual agent, either directly or acting through one or two licensees, the broker and any licensees involved in the transaction attempt to serve two clients with conflicting interests. This conflict is why dual agents are required to obtain the informed written consent of the parties before acting as a dual agent. As a penalty, the ADRE may sanction a licensee if the licensee has acted for more than one party in a transaction without the knowledge or consent of all parties to the transaction. For informed consent we use of the Arizona Association of REALTORS® (“AAR”) Consent to Limited Representation Form to assist brokers in explaining dual agency to buyers and sellers, as well as obtaining their informed consent to dual representation. The buyer and the seller acknowledge that the broker now represents both parties and they understand that neither the broker nor the licensee(s) can represent the interests of one party to the exclusion or detriment of the other. The parties consent that the licensee or each licensee represents both the buyer and the seller with limitations of the duties owed, such as: A DUAL AGENT MUST NOT: • Advocate or negotiate on behalf of either the buyer or the seller. • Disclose any confidential information that would place one party at an advantage over the other party (without the informed consent of the other party), such as: - That the buyer is willing to pay more than the price offered;
- That the seller is willing to accept less than the listing price; - That a party will agree to financing terms other than those offered; - The repairs or improvements that a seller is willing to make or that the buyer is willing to forego; - The confidential motivating factors of either party. - The sellers, brokers and licensee(s) are not obligated to disclose that the subject property is or has been: (1) the site of a natural death, suicide, homicide, or any other crime classified as a felony; (2) owned or occupied by a person exposed to HIV, diagnosed as having AIDS or any other disease not known to be transmitted through common occupancy of real estate; or (3) located in the vicinity of a sex offender. A DUAL AGENT MUST: • Exercise reasonable skill and care in the performance of the agent’s duties. • A dual agent would be wise to recommend independent legal counsel. • Deal honestly with both buyer and seller. • Disclose (in writing) to both buyer and seller: - Any information that the seller is or may be unable to perform; - Any information that the buyer is or may be unable to perform; - Any material defect existing in the property being transferred; and - The possible existence of a lien or encumbrance on the property being transferred. There are no easy answers when it comes to dual agency. In a dual agency situation, the licensee(s) attempts to serve two clients, both of whom have an interest in completing a real estate transaction on the best terms possible. Therefore, difficult questions often arise. Can you truly represent a new client with the same unbiased competency and skill as your listing client of the past 6 months?

THERE IS NO STANDARD-FORM NEW CONSTRUCTION CONTRACT THROUGH AAR In 2015, the Arizona Association of REALTORS® retired the Purchase Contract for New Home (with Lot) contract. There is currently no contract through AAR to replace this retired document. So, what’s an agent to do if a buyer wishes to make an offer on a vacant lot where a seller/builder will construct a home for the buyer, but the seller/builder does not have a contract for the buyer to use? Should the buyer's agent write an offer for the buyer using the AAR Residential Resale Real Estate Purchase Contract? The answer is no. Currently, there is no contract available through the AAR that would be adequate to cover all of the considerations for a buyer purchasing a new home from a seller/builder. And, there are several disclosures legally required in a contract for a newly constructed home, which are not in the residential resale contract.
Therefore, the seller/builder should consult with an attorney to draft a contract, which the seller/builder may then use when selling new construction homes. Or, in the event a seller/ builder does not provide a new construction contract for the buyer to use, then an agent should advise a buyer to consult with an attorney to draft a contract to purchase the newly constructed home. Note, the Purchase Contract for New Home (with Lot) was retired by AAR, which means it is no longer copyright protected. However, the document was not updated to comply with Dodd Frank laws. Therefore, a buyer or seller could use the retired contract for new construction homes, but it should be updated by an attorney who is familiar with Dodd Frank Laws. 3 TEXT MESSAGES TO LAND YOUR NEXT REAL ESTATE APPOINTMENT
BY WISE AGENT SMS-based lead generation offers its own set of benefits. Of course, it might not be the go-to method for some industries, but it’s very relevant for the real estate business. Now, there are a lot of strategies you can rely on to grab appointments through text messages, but one that’s often ignored is using the right “pickup line”. As strange as it might sound, there are certain lines that work better than others. Here are a few examples that you can use (or seek inspiration from). Ask About the Best Time to Talk and Link to Your Calendar Customers are busy and the best way to get their attention is by being considerate of this fact. So, instead of being in your face, send a text that starts with “Are you free? Would you like to talk about a listing” or “What time would you be free to meet or talk?” Next, add a link to a calendar next to that pickup line. This is to help the customer mark an appointment date. As for the line, it's effective because it sounds personal. A personal approach can work wonders. Of course, we suggest you also use an automated system to make this work. You don’t want the customer to call you back just to book the date. Let them do all of that on their own. The actual conversation can be had during the appointment.
Offer a Solution Another pickup line is one that offers help. This could be something like “Hey! We’ve got a homebuyer guide that you might find useful. Do you want a copy? Get in touch with us”. The idea behind such a line is that you’re arousing their curiosity with a question and immediately satisfying them with an answer. Plus, you’re offering a solution, which customers love. You’re positioning yourself as a service that can be depended on with regard to real-estate queries. In fact, you can go even further by determining what the customer’s expectations are and sending out a customized guide. This is definitely going to have a desirable impact. Use the Right Language Language matters a lot when it comes to text message marketing. The idea is to look less and less like spam and more like a legitimate business. So, use relevant and appropriate terms. For instance, “Are you interested in buying a home?” is a simple and fairly effective line that is likely to get the customer’s attention. On the other hand, something like “check out this amazing deal!” sounds like plain-old hype. It’s exaggerated and unconvincing.

About Time Alliance was formally established two years ago but she and a few others have been helping people for the last several years. Dawn’s passion was drawn from a family member in need. From there she saw a bigger need to help those seeking a second chance. Dawn found that she was not alone having a family member incarcerated - it was something no one wanted to talk about. With a handful of Volunteers, she started reaching out to women in prison by emailing them and identifying their needs. From there, they follow through with mentoring and supporting them through their release. Since every individual has different needs, they work with them to identify where they can make an impact and work to support their plan. Sometimes it’s simply supporting them through daily struggles and brainstorming how to effectively communicate and deescalate conflict. Some examples include working on interview skills or helping navigate addiction. About Time Alliance has helped people obtain a driver's license, coordinated classes, helped set up email addresses and bank accounts, attended their graduations... anything to assist and support them through the transition. About Time Alliance is currently working with community partners to identify housing and resources. According to Dawn, “95% of incarcerated individuals are released back into our community. We are strong believers in redemption and second chances and most of our program participants become family.” Thanks for everything you do, Dawn!!
