INTRODUCTION
West Granton Housing Co-operative Limited (WGHC) recognises that the use of electric vehicles is increasing and that tenants may wish to install electric vehicle charging points at their home. WGHC supports safe, lawful and properly managed arrangements that help tenants make use of low-emission transport where this can be accommodated without creating unacceptable risk, cost, damage or management difficulties. WGHC owns the properties it lets. Tenants do not have an automatic right to install an electric vehicle charging point or associated cabling, fixtures, ducting, protection, external sockets or other equipment. Any installation is an alteration to WGHC property and must not proceed unless WGHC has granted written permission in advance. This Policy sets out how requests will be considered, the information tenants must provide, the standards that must be met, the ongoing responsibilities of tenants and the circumstances in which WGHC may refuse, apply conditions, suspend or withdraw permission.
2.0
AIMS AND OBJECTIVES
The aims of this Policy are to ensure that electric vehicle charging installations are considered consistently, protect WGHC housing assets, maintain tenant and public safety, support compliance with legislation and technical standards, and make clear that all costs, permissions, consents, inspections, maintenance and reinstatement obligations rest with the tenant unless WGHC confirms otherwise in writing.
3.0
SCOPE
This Policy applies to all WGHC tenants, household members, visitors and contractors where a tenant seeks to install, use, modify, replace or remove electric vehicle charging equipment at or connected to a WGHC property, including houses, flats, common areas, parking areas, driveways, gardens, walls, external fabric and any electrical supply serving the property.
4.0
LEGISLATIVE, REGULATORY AND TECHNICAL FRAMEWORK
WGHC will consider requests with reference to current legislation, statutory duties, regulatory expectations, manufacturer instructions and recognised technical guidance. Relevant requirements include, but are not limited to: The Housing (Scotland) Act 2001, The Building (Scotland) Regulations 2004 as amended, The Building (Scotland) Amendment (No. 2) Regulations 2022, The Electricity at Work Regulations 1989 where applicable, The Electricity Safety, Quality and Continuity Regulations 2002, The Electrical Equipment (Safety) Regulations 2016, The Electromagnetic Compatibility Regulations 2016, Document Name: Created: Owner: Location / Path:

The Electric Vehicles (Smart Charge Points) Regulations 2021, BS 7671 Requirements for Electrical Installations, BS EN 61851, The IET Code of Practice for Electric Vehicle Charging Equipment Installation, Scottish Building Standards Technical Handbooks and relevant planning, Fire safety, Insurance, All installations must be designed, installed, inspected, tested and certified by a suitably competent electrical contractor. The contractor must be appropriately qualified and must provide evidence of competence, insurance, certification, test results and compliance with the current edition of BS 7671 and the IET Code of Practice. They should also hold suitable certification e.g. NICEIC or SELECT. The installer must ensure that the Distribution Network Operator is notified where required and that any supply limitation, load management arrangement, maximum output restriction or consumer unit upgrade is identified before work starts. If the installer identifies that the consumer unit, meter tails, earthing, protective devices or other electrical components require upgrade or alteration, the tenant must notify WGHC and must not authorise that additional work until WGHC has confirmed how it is to be treated.
5.0
OWNERSHIP OF PROPERTY AND TENANT RESPONSIBILITY
WGHC retains ownership of the property, its structure, fabric, fixtures, fittings, common parts and associated land. Any electric vehicle charging point, associated cabling or making-good works approved under this Policy will be treated as a tenant alteration. The tenant is responsible for: Obtaining WGHC’s written permission before any work starts; Meeting all installation, certification, maintenance, repair, insurance, electricity supply, supplier, grant and removal costs; Ensuring the installation is used safely; and Removing the installation and reinstating the property to WGHC’s satisfaction at the end of the tenancy or earlier if required. 5.1
Insurance and Liability
Tenants must ensure that their home contents insurance policy includes adequate coverage for the EV charger, including third-party liability for injury or damage caused by its use or malfunction. WGHC accepts no liability for any damage to the property, injury to persons, or harm to third parties arising from the installation or use of tenant-installed EV charging equipment.

As part of the application process, tenants are required to: Provide evidence of an active insurance policy that includes coverage for third-party liability relating to the EV charger; Confirm that the charger is included under their policy terms; Failure to provide this evidence, or to hold adequate insurance, will be grounds for refusal of the application.
6.0
PERMISSION REQUIREMENTS
A tenant must submit a written request using Appendix 1 before arranging or starting any work. The request must include full details of the proposed installation, including: The proposed charger make, model and rated output; The exact location of the charging unit; The part of the house, wall, external structure, post or other surface to which the unit will be affixed; The precise internal and external cabling route; any drilling, ducting, trenching, conduit or surface-mounted containment; The impact on the existing consumer unit and electrical installation; Whether the consumer unit requires alteration, upgrade or replacement; The proposed protective devices, isolation, RCD and earthing arrangements; Load assessment and maximum demand calculation; Evidence of smart charge point compliance; Parking arrangements; and Any effect on neighbours, common areas, paths, fire escape routes, ventilation, accessibility, factoring arrangements or shared services Evidence of adequate insurance coverage for the EV charger, including third-party liability WGHC may request additional information before making a decision, including photographs, drawings, method statements, risk assessments, evidence of contractor competence, insurance details, manufacturer information, Distribution Network Operator confirmation where required, planning or building standards advice, neighbour consultation evidence and any other information reasonably required to assess risk, suitability and compliance.
7.0
HOW WGHC WILL ASSESS REQUESTS
WGHC will consider each request on its own merits. Permission will only be granted where WGHC is satisfied that the proposal is technically suitable, safe, compliant, proportionate, affordable for the tenant, capable of being maintained and removed, and will not cause unacceptable damage, disturbance, nuisance, fire risk, electrical risk, insurance risk, access restriction, detriment to neighbours or adverse impact on WGHC’s property, planned maintenance programmes or future asset management.

WGHC may refuse permission where the tenant does not provide adequate information, where the proposal affects common areas or shared services without appropriate arrangements, where parking is not allocated or suitable, where the electrical supply is inadequate, where the consumer unit or installation is unsuitable, where the works would compromise safety or property condition, where the proposed contractor is not suitably competent, or where the installation would create an unreasonable management, maintenance or reinstatement burden. As a general position, permission will normally only be considered where the tenant has lawful off-street parking within the exclusive-use curtilage of the property, the vehicle can be parked adjacent to the home, the installation and all associated cabling can remain wholly within the tenant’s exclusive-use area, and no cable, duct, conduit or equipment will cross or obstruct a public footway, adopted road, shared path, communal area or land not controlled by the tenant. Requests involving flats, communal entrances, shared parking courts, remote parking spaces, unallocated parking, on-street parking, listed buildings, conservation constraints, shared electrical supplies or uncertain boundaries will require additional scrutiny and may be refused where WGHC cannot be satisfied that the installation is safe, lawful, accessible, insurable, maintainable and capable of being managed without detriment to others.
8.0
CONDITIONS OF PERMISSION
Where permission is granted, it will be confirmed in writing and may be subject to conditions. Conditions may include: Approved location and cabling route, Approved equipment output, Installation by a named competent contractor, Completion within a specified period, Production of certificates before use, No use of extension leads or domestic sockets for regular charging, No obstruction of paths or common areas, Ongoing maintenance by the tenant, Access for inspection (by officers of WGHC or appointed contractor), Immediate isolation if WGHC identifies a safety concern, and Removal and reinstatement when the tenancy ends. The tenant must hold adequate insurance for the installation, including third-party liability for injury, loss or damage arising from the installation, use, malfunction, removal or reinstatement of the charger. WGHC may request evidence of cover at any reasonable point during the tenancy. Permission is personal to the tenant and property. It does not transfer automatically to another tenant, household, assignee, mutual exchange applicant or transfer applicant. WGHC may require the installation to be removed before any tenancy termination, mutual exchange, transfer, abandonment, eviction or assignation is completed.

INSTALLATION, CERTIFICATION AND HANDOVER
The tenant must ensure that the installation is completed in accordance with the permission granted, manufacturer instructions, current technical standards and all legal requirements. The tenant must provide WGHC with copies of the electrical installation certificate, inspection and test results, building standards or planning evidence where required, product information, user instructions, warranty information and confirmation that the installation has not damaged the property and has been made good to an acceptable standard. The charger must not be used until WGHC has received and accepted the required completion information. WGHC’s acceptance of documentation does not make WGHC responsible for the installation, its performance, electricity costs, future maintenance or any defect arising from the tenant’s alteration. After completion, the tenant must provide at least the Electrical Installation Certificate, inspection and test results, charger make and model, clear photographs of the installed unit and cable route, confirmation of Distribution Network Operator notification where required, installer details and any manufacturer or warranty information. WGHC will retain these records on the property file for future inspection, repair, termination and asset management purposes.
10.0 USE, SAFETY AND MAINTENANCE Tenants must use charging equipment safely and only in accordance with manufacturer instructions. The tenant must not overload electrical circuits, use damaged equipment, trail cables across public or shared areas, create trip hazards, obstruct access, charge from communal supplies, tamper with meters or electrical equipment, or allow the installation to become unsafe, insecure, damaged or poorly maintained. The tenant is responsible for routine checks, servicing, repair, replacement and any periodic inspection recommended by the installer, manufacturer, insurer or relevant standard. Any defect, damage, overheating, burning smell, nuisance tripping, exposed cabling, loose fixings, water ingress or other safety concern must be reported to WGHC and the equipment must not be used until a competent electrician confirms it is safe.
11.0 REMOVAL, REINSTATEMENT AND END OF TENANCY The tenant must remove the charging point, cabling, containment, fixings and associated equipment and reinstate the property to WGHC’s satisfaction when the tenancy ends, unless WGHC confirms in writing that the installation may remain. This applies where the tenant leaves the property, terminates the tenancy, undertakes a mutual exchange, transfers to another property, assigns the tenancy, abandons the property or otherwise ceases to occupy the home.

Removal and reinstatement must be undertaken by a suitably competent contractor where electrical work is involved. If the tenant fails to remove the installation or make good any damage, WGHC may carry out the required works and recharge the tenant for all reasonable costs, subject to the tenancy agreement, rechargeable repairs policy and any applicable legal requirements. 11.1
Future use of equipment at void / relet
If a tenant has complied with all relevant and applicable permission requests and provided all necessary and required documentation as indicated within this policy and the permission request form, WGHC may confirm in writing to the tenant that the EV charging installation may remain at the end of a tenancy.
12.0 UNAUTHORISED INSTALLATIONS WGHC will treat any installation carried out without written permission as an unauthorised alteration. WGHC may require the tenant to stop using the equipment, provide retrospective information, arrange inspection and testing, remove the installation, reinstate the property and meet any associated costs. Retrospective permission is not guaranteed.
13.0 RECORDS, MONITORING AND REVIEW WGHC will keep records of EV charging enquiries, applications, approvals, refusals, conditions, certificates, inspections, removals and end-of-tenancy decisions. Records will support audit, performance monitoring, risk management, rechargeable repairs, future maintenance and consistency of decision-making. The Policy will be reviewed when relevant legislation, Scottish building standards, technical guidance, insurance requirements, government funding arrangements or WGHC business needs change, and otherwise within the review period approved by the Committee of Management.

14.0 EV CHARGERS AT PROPERTY TURNOVER / RELET WGHC do not, ordinarily, provide EV charging points or equipment as part of a tenancy agreement with the co-operative. However, WGHC would not seek to deliberately remove a serviceable piece of equipment infrastructure to the disadvantage of a new, incoming, tenant. Especially, if the new tenant has, or is seeking to use, an electric vehicle. If a property is relet by WGHC that has a previously tenant installed and maintained EV charging point AND the property has had a new Electrical Installation Condition Report (EICR) undertaken during the void period, only essential maintenance of the equipment will become the responsibility of WGHC subject to the following: The EV Charging Equipment will NOT form part of the tenancy agreement, i.e. it will not be stipulated or noted as a fixture or fitting provided by WGHC on the tenancy agreement Only maintenance of a nature to ensure compliance with electrical standards and tenant / public health and safety will be undertaken, along with statutory EICRs etc. Aesthetic or ‘tenant requested’ maintenance will not be undertaken as a standard and could be subject to re-charge in accordance with other WGHC published policies In the event that the actual charging point fails and requires replacement, WGHC will not replace the unit on a like-for-like basis. If WGHC are required to replace the physical charging unit, a mid-range priced point unit will be sourced and installed in compliance with offering value for money whilst being cognisant of any spend on such an item is from one sole source of income, i.e. tenant rent WGHC reserve the right to remove the equipment, without replacement, in the event that it becomes economically unviable to repair or replace it.
15.0 APPEALS AND COMPLAINTS WGHC is committed to valuing complaints and ensures that the organisation benefits from feedback to identify areas for change and improvement. If anyone is dissatisfied with the service they have received because of this Policy, they will be encouraged to use our Complaints Procedure. Similarly, any individuals dissatisfied with decisions made in the operation of the Policy are entitled to appeal against these. The WGHC Complaints Policy details the way in which complaints can be made, the timescales for responding and the appeals process. Anyone dissatisfied with the outcome of their complaint having exhausted WGHC’s complaint procedure has the right to refer the matter to the Scottish Public Services Ombudsman.
