Wesley Market has been running at the Wesley Community Centre since 1994 and is the largest week day market in Auckland.

The Wesley Market is owned and run by the Auckland Council.

We welcome new stallholders.

This booklet provide information, terms and conditions and your application to join the market. We look forward to seeing you here!

PRICES These prices are non-negotiable

REGULAR STALLS Ordinary Stalls - $15 Standard 3m x 3m

Community Produce Stalls - $5 Standard 1m x 1m

CASUAL STALLS Must pay prior to set up

All additional spaces - $10 per 3m x 3m

Health and Safety AT WESLEY MARKET

Providing a safe community market is our priorty

Here at the Wesley Market we are committed to holding the highest health and safety standards for our stallholders and customers. Market stallholders are required to comply with all health and safety legislation, regulations, applicable code of practice and standards as notified by Market Management from time to time. These terms are strictly non-negotiable. You must also identify and report all health and safety risks, near misses and/or incidents or accidents at the Market as soon as possible. Ensure that you have a plan to minimize all potential hazards. Consult the Market if in doubt. If you have any concerns or inquiries please contact Market Management.

Fundraising and Community Projects THINKING OF FUNDRAISING AT THE MARKET?

We support community initiatives and we love to have you here at the market. We welcome all fundraisers, from not-for-profit to schools and community fundraisers.

You are welcome to display or distribute information, or sell items and food.

But before you start - there are some terms and conditions we need you to follow.

We need to know that you are a genuine charity or not-for-profit. Please provide your charitable status (if applicable) to us in your application form.

If you are holding a sausage sizzle or selling any food, the Food Act 2014 prohibits you to fundraise more than 20 times per calendar year unless you have a valid food registration. We have a barbecue onsite for sausage sizzle - but you will need to bring your own food and make sure it is cleaned after every use.Â

Trading

All stallholders are subjected to the Fair Trading Act 1986 and Consumer Guarantees Act 1993 and must abide when trading with customers. Items should also abide to the Trade Marks Act 2002 and Copyright Act 1994. If you breach any law we will deal with you as per the general conditions clause of the enclosed Terms and Conditions which sets out our rights in relation to any breach.

Second-Hand Dealers You are responsible for the origin of the items you sell at the Market. The Police will be notified of any reports of stolen goods.

Terms and Conditions

These Terms and Conditions apply to the Wesley Market ("Market") operated on Auckland Council property at Wesley Community Centre, 740 Sandringham Road Extn, Mt Roskill. By signining an application to have a stall at the Market you agree to be bound by these Terms and conditions, as amended from time to time. Auckland Council reserves the rights to amend or revoke these Terms and Conditions at anytime.

General Conditions 1. If your application is accepted by Wesley Market Management, Auckland Council grants you a nonexclusive permit to occupy a stallholder site (identified by Wesley Market Management) between the hours of 7.30am and 1pm each Market day subject to these Terms and Conditions. This permit is personal to you and may not be sold or transferred to a third party.

2. All stallholders must consult Wesley Market Management prior to set up on Market Day for space allocation and fee payment.

3. Stallholders must be last least 18 years old.

4. You must comply with the directions of Wesley Market Management or any authorised Auckland Council Officer in relation to your stall and the Market. 5. You must provide a constant level of service to the public during the hours and days specified in the application.

6. If, in Wesley Market Management's opinion, there is a serious breach of these Terms and Conditions, Market Management may terminate your permit to occupy a stall and require you and your staff to leave the market. Serious breaches include non-compliance with health and safety or noise requirements, or conduct that brings the Market or Auckland Council into disrepute.

7. For all other matters, a strict three-strike policy applies. You will receive a written warning from Wesley Market Management for non-compliance with these Terms and Conditions. On the third warning in a financial year (1 July - 30 June), your permit to occupy a stallholder site will be terminated, and you and your staff will be required to leave the Market.

8. If your licence is terminated, you may not participate in the Market for such period of future time as Auckland Council decides in its sole discretion.

9. Cancellation of the Market: to ensure the safety and wellbeing of everyone at the Market, Wesley Market Management reserves the right to cancel the Market if it would be hazardous to operate the Market.Â

Set Up and Pack Down The Market is subject to strict Resource Consent requirements which you must comply with as follows: 1. Strictly no noise before 7.00am and noise throughout the Market operating hours must be kept to an acceptable level at all times. You will be asked to leave the Market for non-compliance.

2. All stalls must be packed up and all of your equipment and rubbish removed by 2.30pm.

3. Stallholders may be refused entry after 8am for health and safety reasons.

Payments 1. Stall fees will be as set out in the application form, regardless of the hours you choose to trade at your stall.

2. You must pay your stall fees when requested on the day of the Market.

3. If your stall fees are not paid when requested, you will be refused entry to the Market and/or future Markets.

Additional Costs 1. Auckland Council, its contractors and volunteers are not responsible for any loss or damage to your goods.

You indemnify Auckland Council for any expenses, loss or damage incurred or suffered by it as a result of your actions or breaches of these market Terms and Conditions.

2. Auckland Council reserves the right to invoice you for any costs, losses or expenses that Auckland Council incurs due to the operation of your stall, your actions or your breach of these Terms and Conditions, including (without limitation) amounts arising from: a. Any damage to Auckland Council Property b. Any theft of Auckland Council property c. Extra cleaning, rubbish removal, repair or reinstatement of your stall area which Auckland Council considers is required after your participation in the Market d. Any breach of these Terms and Conditions e. An emergency services call out or fire alarm activation by you for a non-emergency situation, and f. An Auckland Council noise control call out as a result of a complaint about your stall.

3. Cover for loos or damage caused to your goods or property at the Market is your responsibility. You are encouraged to hold sufficient insurance cover relevant to your operation.

Conditions of Sales 1. You must not sell or offer for sale any commodity or service not specified in your application form.

2. Strictly no alcohol, drugs or smoking permitted on the Market site. You must not use or sell any of these substances.

3. You most not allow any illegal activities to take place at your stall or within your control at the Market premises.

4. Stallholders must ensure that any child under 10 years of age helping at the stall is accompanied by a parent or designated caregiver, who is at least 18 years of age.

5. If you play, use or sell commercial recorded music at your stall it is your responsibility to comply with all copyrights and licensing requirements.

Health and Safety 1. Auckland council is committed to holding and promoting the highest health and safety standards. You must comply with all legislation, including the Health and Safety at Work Act 2015, Food Safety Bylaws 2013 and Food Act 2014.

2. If you intend to sell prepared food at the Market, you must have a current Food Control Plan or National Programme on display and must comply with all food and Environmental Health Regulations.

4. You must comply with all health and safety legislation, regulations, applicable codes of practice and standards, Auckland Council health and safety policies and procedures, and any standard operating procedures, including by: a. identifying and reporting to Market Management by health and safety risks, near misses and/or incidents or accidents at the Market b. investigating any health and safety issues reported to you c. having a plan about what you will do if there is a health and safety incident at your stall d. ensuring fire extinguishers or fire retardant blankets are available where you are using flammable material, and e. ensuring all potential tripping hazards are removed or eliminated 5. So far as is reasonably practicable, you must consult, co-operate with and co-ordinate your activities with Wesley Market Management in relation to operating at your stall and the Market.

Waste Management 1. You must keep your area around your stall in a neat and tidy condition, free from rubbish and provide adequate and suitable rubbish receptacles for the use of your patrons.

2. You must remove all rubbish and recycling generated by your stall off site at the end of the Market day without using public rubbish bins. You must leave your stall site and all Market equipment and furnishings, car parks and adjacent premises that you use, in good, clean and tidy order. Additional charges will be incurred if rubbish and recycling is not removed off-site.

3. You must not dispose of cooking oil, hot water and other hazardous waste on grass, berms or in wastewater drainage.

4. Auckland Council may treat unapproved waste disposal as illegal dumping.

Car Parking 1. All cars must be parked in designated areas only.

2. All car parking must adhere to Auckland Transport or NZTA requirements (e.g.: no parking on yellow lines, and 7am- 1pm every Tuesdays and Fridays on parts of Elphinestone Avenue and Gifford Avenue) 3. All unauthorised or illegal parking may result in your vehicle being ticketed or towed.

Furniture and Equipment 1. You may use any Council or community furniture and equipment advised by Market Management strictly for the operation of your stall at the Market, and: a. You are responsible for setting up, cleaning and packing away that furniture and equipment; b. Such furniture and equipment must be returned to the designated Market storage area, ensuring that all fire exits are clear at all times.

2. Auckland Council reserves the right to remove and if not claimed, disposed of any third party equipment or furniture left at the Market venue after 2.30pm on the Market day.

3. Auckland Council is not responsible for any loss or damage to any equipment, furniture or personal items you leave at the Market premises.

Privacy 1. All information provided by you will be collected, used, stored, disclosed and corrected in accordance with the Privacy Act 1993. You have the rights to access their information and request for any personal information to be corrected.

Conduct 1. You are required to operate in a professional business-like manner and cooperate with the Wesley Market management at all times.

2. You must not do anything which brings, or would be likely to bring, the Market or Auckland Council into disrepute. It is a condition of acceptance of your application, that you accept responsibility for the conduct of yourself and all persons involved with application or stall including but not limited to their employees, agents and volunteers ("related parties") in accordance with these Terms and Conditions.

Standards that shall be applicable include, but are not limited to, the following: - Verbal communications of you and your related parties shall be respectful and courteous. You must not use discourteous, harassing, intimidating, threatening, insulting, or abusive language, gestures, etcetera, either in person or by electronic or digital means.

- Honest representation:Â stallholders, and your related parties shall represent products in an honest manner. You must not engage in fraudulent, dishonest, or deceptive practices, which may reasonably upset Market operations, mislead consumers, or damage other stallholders businesses.

- Stallholders shall not disparage the Market, Wesley Market Management or the Market vendors, merchants or their products.

Filming and photography at the Market From time to time there maybe film crew or photographers on site and the Market Management may also take photographs and video of the Market. If you have any concerns about their presence, consent or generally about their actions, please feel free to refer the crew to the Wesley Market Management or any authorised Auckland Council staff.

Many film crew, news journalists and photographers like visiting the Wesley Market as we are a weekday market. Most often they provide an excellent opportunity to promote the market. If you do not feel comfortable being filmed or have any questions, please let us and the crew know.

Parking At Wesley Market No Parking Areas marked in red are enforced between 7am - 1pm every Tuesdays and Fridays on parts of Elphinstone and Gifford Avenues.
