ecreasing manufacturing of building products in Australia is fuelling an increase in imported building products often from countries with poor or different building standards producing inferior materials. To date such products have included cladding panels, electrical wiring and hot water pipes, which are highly likely to cause losses to property and possibly lives in serious circumstances.

Strata and construction law specialist, David Bannerman from Bannermans Lawyers, says that despite claims that these imported products can meet the various requirements stated, such as, compliance with Australian Standards, these representations are often not true. Knowledge of these short comings does not arise until it is too late and the product has been rolled out en masse.

“Engineers, architects, developers, builders, certifiers and even

importers importing, selecting and installing these types of products can expect to face claims in respect of losses associated with the use of these products.

Such claims, arising in breach of statutory warranties, negligence or claims under the Trade Practices Act 1975 or the Competition and Consumer Act 2010 have the potential of costing tens of millions of dollars of rectification works and compensation,” he said.

Mr Bannerman’s comments are made following recent reports that the use of combustible building materials in an apartment building in Melbourne was a major contributing factor to the rapid spread of a fire last November. While the property was damaged there was thankfully no loss of life.

The bad news is that the remedies for many owners to claim for losses in relation to these products – for breach of statutory

warranties in NSW – was greatly reduced by the NSW Government retrospectively from January 15, 2015.

“In a huge blow to new property owners, in many instances, it has been reduced to two years from the completion of the works or, for strata buildings, two years from the date of the interim occupation certificate or final occupation certificate, whichever is first,” Mr Bannerman said.

“Many people are unaware of this – the message that the NSW government has dudded new home and apartment owners has not gotten through – and many are going to learn the hard and costly way that the NSW Government is no longer looking out for their best interests.

Concerned parties seeking to claim or cross-claim should find out what their relevant statutory time limitations are as a priority by seeking advice from a suitably experienced legal professional.

Youth struggling to buy their first home With average house prices increasing, young people are finding it harder and harder to enter the property market...

How do you feel about the current property market and what are your plans?

ver the past 12 months there has been an obvious increase in house prices around the Sydney and New South Wales area, causing some concern among younger people who are trying to crack into the property market.

According to the Domain Group’s House Price Report, the median house price in Sydney is now $914,056, up 3.6 per cent in the March quarter.

Also steadily rising are the unit prices that increased by 1.2 per cent in the March quarter to $609,800.

Looking at it over the past year, ending in March, house prices have jumped up 16.0 per cent and

unit prices have risen by a solid 9.0 per cent.

Senior Economist for the Domain Group, Dr Andrew Wilson, said Sydney prices are a lot higher than other areas.

“Sydney’s median house price has increased by almost $250,000 over the past two years and is substantially higher than the closest capitals, Darwin and Melbourne,” he said.

However, Penrith residents possibly face an easier challenge with the median house price currently sitting at just over $450,000, significantly less than the inner Sydney areas.

Young people in the local area are certainly weighing up the many options that exist.

Offering young locals a chance Y

oung people wanting to crack into the Sydney market might have their chance to do so with the introduction of EVO Homes in New South Wales recently.

The new housing type, a part of Lend Lease homes, was released on Sunday, April 26 in Jordan Springs as a form of affordable housing, especially to those who are wanting to expand later on.

With built in plumbing systems, footings and pre-approved designs in place, it is said to be easier for expansion later on at a cost-effective price.

NSW General Manager of Lend Lease Communities, Arthur Ilias, said the company received a great response at a first home buyers seminar held in early April.

“The seminar lead us into the launch of EVO homes with great success – around 60 people registered on the night to buy a house and land package,” he said.

“Our main objective was to show these young people there is an opportunity to buy affordable housing in the current NSW market.”

Jordan Springs is the first community to see the new EVO homes in New South Wales with the possibility for more expected in the near future.

“My expectation is to probably continue with the Jordan Springs project and put more there but other options will probably be available too, we will have to see – we are just delighted with the uptake in the first release to start of with,” Mr Ilias said.

The base home features two bedrooms, one bathroom and a single garage and starts off at $489,500.

Home buyers can also purchase the extended version featuring three bedrooms, two bathrooms and a single garage at a starting price of $505,500.
