Incumbents, challengers scramble to stay on ballot
Ald. Scott, Ald. Taliaferro face challenges; Ald. Ervin, Ald. Mitts in the clear By IGOR STUDENKOV Contributing Reporter
Two West Side aldermen are facing objections to their nominating petitions while one West Side alderman could once again run unopposed despite entering the race months earlier with a half-dozen challengers. Aldermen Michael Scott Jr. (24th) and Chris Taliaferro (29th) were both facing objections from challengers last week. As of Dec. 20, the status of Scott’s challenges were unknown while Taliaferro’s attorney indicated that two challenges filed against his client were likely to be thrown out and he was optimistic that a third challenge would also be tossed. In the 29th Ward race, Taliaferro and all three of his opponents — Zerlina Smith, Dwayne Truss and Gayinga Washington — face legal challenges. Truss, like Taliaferro, faces multiple objections to his petitions. Yolanda Hoskins objected both the nominating papers of both Truss and Taliaferro. Truss also faced an objection filed by Samuel Lewing while Taliaferro fought off challenges by Verlestel Branch and Anthony Harris. Bruce Washington, the president of Taliferro’s 29th Ward Democratic Organization, objected to petitions filed by Zerlina and Washington. The hearings for all three objections against Taliaferro were held on the morning of Dec. 17. Attorney Pericles Abbasi, who represents both Taliaferro and Washington, said that he moved to dismiss Branch’s and Harris’ objections on the ground that they don’t live in the district. Meanwhile, with Hoskins’ challenge, the hearing officer agreed to a document check. Abbasi said that he was optimistic that it wouldn’t make a difference. He estimated that, out of about 1,900 signatures Hoskins challenged, only 101 will be invalidated. “I’m very confident that Ald. Taliaferro [will remain on the ballot].” he said. As of Dec. 20, the final decisions on Branch and Harris’ objections are pending, with the date of the decision “pending.” On Hoskins’ objection, the record examination and next hearing dates haven’t been set. All of Scott’s challengers, including Creative Scott, Toriano Sanzone, Edward Ward, Larry Nelson, Patricia Marshall and Traci “Treasure” Johnson, faced signature challenges. Inglesa Toney is objecting to
the petition signatures of all challengers, while Sanzone is objecting to Scott’s petitions. Austin Weekly News has been unable to reach either Scott’s office or Sanzone’s campaign office before this issue’s deadline. The hearing on Sanzone’s objection was held on Dec. 18. A follow-up hearing date had not been set by this publication’s deadline. In 37th Ward race, three challengers are facing off against incumbent Emma Mitts. They include Tara Stamps, who faced off against her in 2015, as well as Deondre Rutues and Otis Percy Jr. All three opponents had their signatures challenged by the same person – George McKinley, who is listed as 37th Ward Republican Committeeman on the official website of the Cook County Republican Party. According to Illinois State Board of Elections records, he contributed $200 on June 1, 2012 to the New 37th Ward Democratic Organization, which shares its mailing address with Mitts’ ward office. He received a $700 loan from the same organization, which he repaid in Dec. 29, 2014. A hearing on the objection to Stamps’ petitions was held on Dec. 19. A follow-up hearing was scheduled for Dec. 22. The hearing for the objection against Rutues was scheduled for Dec. 21, while hearing officer Christopher Cohen was set to make a final decision on the objection to Percy’s petitions at some future date. In 2015, the 28th Ward race saw all of the challengers against incumbent Ald. Jason Ervin kicked off the ballot. All five candidates challenging him this time around — Justina Winfrey, Miguel Bautista, Jasmine Jackson, Beverly Miles and Theresa Rayford — faced objections from Gina Zuccaro and Emma Jean Robinson. Robinson also objected to the challengers’ petitions in 2015, while Zuccaro is objecting to some of the candidates running for city treasurer — the office Melissa Conyears-Ervin, Illinois state representative and Ervin’s wife, is running for. DNAinfo Chicago reported at the time that that Robinson served as the chief of staff for former Ald. Ed Smith (28th) and was “paid $11,000 in 2011 as a consultant and to provide meals to Ervin’s campaign.” According to the Chicago Board of Elections, Winfrey dropped her candidacy. Hearing for objections against Miles, Boutista and Jackson were scheduled for Dec. 27 at 10:00 a.m., 1:15 p.m. and 6:00 p.m., respectively. The Cook County Sheriff ’s Office, which has been working in the 15th District since June on its Chicago Initiative, hosted a Sheriff ’s Toy Handout on Dec. 19, at the Academy School for Performing Arts and the Kiddie Korral Academy in Austin. The initiative seeks to decrease crime and increase community engagement. “So far we’ve seen around a 40 percent reduction in homicides and nearly 30 percent reduction in shootings year-over-year,” a spokesperson with the Sheriff ’s office said. “The Sheriff has prioritized community engagement with events at schools, churches and community organizations.” CONTACT: michael@austinweeklynews.com

A nonprofit organization that works with at-risk youth in the Chicago neighborhoods of Austin and North Lawndale has withdrawn its request for $15,000 from the village of Oak Park. The decision by Friends of the Children to pull the request comes after the item was removed from the consent agenda of the Oak Park Board of Trustees meeting on Dec. 10 and placed on the regular agenda by trustees Simone Boutet and Dan Moroney. Boutet said in a telephone interview that she believes it is improper to provide funds to the nonprofit because Village Manager Cara Pavlicek serves on the board of the organization. “I think it’s an improper use of public funds to fund your private interest with public funds,” she said. The item originally appeared on the consent agenda, meaning that it would have been approved by trustees with a number of other consent-agenda items and without discussion. The funding was first included a year ago in the 2018 budget but was removed by trustees. Pavlicek said in a telephone interview that the $15,000 request “falls below the manager’s spending authority,” meaning the funds could have been committed to the organization without board approval, but she brought it to the board for consideration. She believes the request is appropriate because the new organization is working in Austin. Taal Hasak-Lowy, executive director of Friends of the Children, said the request was pulled, in part, over concern that the request would anger Oak Park taxpayers. She and Friends of the Children Board Chairman Tom Abrahamson decided to pull it from the regular agenda. “I think Tom’s general feeling was [that] a lot is happening in Oak Park, so let’s pull this out if this is an issue at all,” she said. Some on social media argued that the request constitutes a conflict of interest because of Pavlicek’s position on the board.

Oak Parker Kitty Conklin, who regularly attends board meetings and has been an advocate for lowering property taxes in Oak Park, argued at the Dec. 10 meeting that Friends of the Children is not Oak Park-based and does not serve local students. “Therefore, to me, there is a very obvious conflict of interest with the funding request,” she told trustees on Dec. 10. Hasak-Lowy said several Oak Park residents are involved with Friends of the Children, and the Austin neighborhood of Chicago “is of special interest to Oak Park.” The nonprofit works to pair caseworkers with at-risk students in economically depressed parts of the city. The mentors follow the students for the entirety of their education to help them achieve their educational goals, she said. Friends of the Children has been active for 25 years but just launched a Chicago chapter in 2018. They started in January with 24 first graders — 16 of which attend Ella Flagg Young Elementary School, 1434 N. Parkside Ave., and the remainder from schools in North Lawndale, Hasak-Lowy said. Boutet told Wednesday Journal she believes it is “a wonderful charity” but added that it is “not within the realm of the village.” She added that she thinks Pavlicek “deepsixed” the funding request. “I’m glad it got removed, but I still think [Pavlicek] should be held accountable,” she said. “If this was a board that was more accountable and where there was more accountability, there would have been a discussion right away.” Trustee Deno Andrews said in a telephone interview that he agrees the village should not fund a program that does not serve Oak Park children but had no ill will toward Pavlicek or the organization for making the request. “I don’t love how it was presented, but I don’t hold it against the village manager for asking because I believe she believes it would be a benefit to the village,” he said. Inside of a petition objection hearing
A challenge to Zerlina Smith’s candidacy for 29th Ward alderman gives glimpse of process By IGOR STUDENKOV Contributing Reporter
In order to run for alderman in Chicago, it’s not enough to be a registered voter who lives in a ward and hasn’t been convicted of a felony. It’s not enough to collect the required 473 signatures from the registered voters who live in a ward. Often, candidates have to prove that at least 473 signatures they obtain are valid. That process happens during objection hearings typically held inside of Cook County’s administration building at 69 W. Washington. Austin Weekly News sat in on a hearing held Dec. 17 to examine an objection filed against 29th Ward aldermanic candidate Zerlina Smith’s petitions. Smith is one of four candidates running for 29th Ward alderman whose petition sheets were challenged. They include incumbent Chris Taliaferro, Dwayne Truss and Gayinga Washington. Most of the objections are fairly run-of-the-mill, with objectors alleging that candidates’ nominating petitions weren’t properly filled out and/or weren’t properly notarized, that some of the people signing the petitions weren’t eligible to sign and that some signatures appeared on more than one petition (by law, a voter can only sign one nominating petition per race). Smith faced one of the more unusual objections, with objector Bruce Washington arguing that a photo posted on her campaign Twitter account suggests that petitions weren’t properly signed and notarized. During Smith’s hearing, several tables were set up, with one hearing officer per table. Due to the sheer volume of cases, there are usually at least two objections being heard at any given time. Members of the public are allowed to sit in on the meetings, but with one caveat. The table is reserved for hearing officers, their staff, the candidates, the objectors and their attorneys. Members of the public have to pull up a chair and sit behind them. In addition to this reporter, Truss hung around for about 15 minutes. As he told Austin Weekly News, he is a stranger to the process and with his own objection hearings scheduled three days later, he wanted to get a sense of what the process is like. Neither Smith nor Washington attended the hearing in person, leaving their respective attorneys, Andrew Finko and Pericles Abbasi, along to argue on their clients’ behalf. Ahead of the hearing, Abbasi, Washington’s attorney, said that he was also representing Taliaferro in the incumbent alderman’s objection hearing. According to the Illinois State Board of Elections records, Washington serves as the president of the 29th Ward Democratic Organization, which Taliaferro chairs in his capacity as a 29th Ward Democratic

During the hearing, Abbasi emphasized that his client was only interested in following the process, noting that Washington didn’t challenge Truss’ nominating petitions because he didn’t see any issues with them. But with Smith, he alleged a number of issues. During the hearing, Abbasi specifically mentioned that some petitions were apparently notarized on Nov. 28, two days after the Nov. 26 filing deadline, as well as the fact that when petitions were filed, they weren’t held together properly, and some petitions weren’t signed and filled out properly. Most notably, he drew attention to the photo posted on Smith’s official campaign twitter account on Oct. 17, which showed a stack of petitions collected by that point, where at least two petitions didn’t have circulator information filled in.
Abbasi argued that this was enough to cast doubt on whether any petitions were signed in time. And if that’s the case, he argued, there was no way to know which circulator circulated which petitions. This meant that there was no way they could be properly notarized, he said. “It suggests that the purported circulator didn’t circulate those sheets,’ Abbasi said. Finko, in turn, tried to poke holes in the objector’s allegations. Most notably, he argued that Washington was making sweeping allegations without evidence. “How has Bruce Washington come to the conclusions that all these sheets weren’t properly notarized?” he said. “How does he know that virtually all the [petition] sheets weren’t properly circulated?” Finko emphasized that signed and notarized petitions are assumed to be valid unless proven otherwise, and he argued that Washington didn’t prove that. Abbasi responded that while they didn’t prove the claim, the evidence they presented “gives us good fact-finding basis.” “Every candidate has sheets that were brought in,” Finko responded. “There is no evidence that anything was improper.” Hearing officer Linda Crane said she was skeptical about the conclusions Washington drew from the photo. “My problem is I can’t see the bottom of [the petitions in the photo], except the first one or two,” she said.”We can picture in our mind every single campaign, where here is a stack of papers. The picture itself is not a smoking gun.” Abbasi said he wanted to subpoena Smith, her campaign manager and all of her circulators. Crane said that she would prefer that he and Finko work out some kind of agreement where Finko gets sworn affidavits from the individuals in question. But while Smith’s attorney was open to the idea, Abbasi insisted on subpoenas. After some more discussion, Crane agreed to hold the document examination to check Washington’s allegations of invalid signatures and improperly filled petitions. And she and the attorneys agreed to a follow-up hearing to review the results of the document examinations and the response to the subpoenas. She also requested that Washington attend the meeting as a witness, something that Abbasi said he had no problem with. The next hearing will be held on Dec. 27 at 10:30 a.m., in the same room. Most of us are against gun violence, but why do so many of us who oppose gun violence support gun violence by giving money to criminals who then use the money to buy guns? Criminals use the money to buy guns in order to kill our neighbors and us. But we support these killers by buying illegal drugs. This corruption facilitates the growth of the drug cartels that terrorize innocent people. Many of those innocent people then flee their own country and turn into migrants seeking asylum in America. Why do few people understand that most of our border problems are caused by selfish Americans who are willing to break the law and give money to criminals for illegal drugs? Why don’t more of us see that this selfishness is funding gun violence here at home and terrorism in several other countries? Why don’t more of us see that everything has consequences? And that most of
these consequences are far reaching. These consequences are far reaching geographically and far reaching down through time and generations. The poor consequence of Americans buying illegal drugs reaches geographically into many other countries. The poor longterm consequences of us buying illegal drugs means that not only do we poison ourselves physically but we poison our next generation, our children to come. Our money spent on illegal drugs buys guns and not homes and books for our children. Our money spent on distractions prevents us and our children from accumulating our own wealth. Then, ironically, our children may turn to selling illegal drugs in order to get money. This may explain the high numbers of our youth being shot or ending up in jail. So, when are we going to connect the dots and break these vicious cycles?
