New partnership expands Kansas efforts to save lives Across America’s highways, orange cones and flashing lights serve as daily reminders of the men and women who build, maintain and protect our roads. Yet, work zone crashes and fatalities remain unacceptably high. In 2023, transportation safety advocate Tom Robins decided it was time to take a new approach — one that reached new drivers before they developed bad habits.

That approach became Work Zone Safe, a teen driver education initiative with a mission that "every new teen driver knows there is a face and family behind every flag, cone, and flashing light."

Robins started Work Zone Safe as a singlestate effort in Oklahoma, reshaping how the PAGE 4

next generation of drivers learn to navigate work zones safely as they share the road with contractors, suppliers and first responders. Since its implementation, more than 100,000 Oklahoma teens have completed the course.

KCA recently joined the movement, partnering with KDOT to bring Work Zone Safe to Kansas.

Other states, including Wisconsin, North Carolina, South Carolina, Missouri, and Connecticut, are also partnering with Work Zone Safe to bring the program to their state's teen drivers.

A Different Kind of Approach

Work Zone Safe is designed to humanize highway safety. The program connects teen drivers with the

personal stories of workers, first responders and families whose lives have been forever changed by preventable crashes. Through videos, interactive lessons, and real-world scenarios that share these personal experiences, young drivers learn that work zones aren’t just traffic inconveniences — they’re workplaces filled with faces and families who deserve to get home safely.

Recognizing and Rewarding Safe Drivers

Work Zone Safe also reinforces learning through rewards. Each student who completes the online course receives a certificate of achievement and becomes eligible for educational scholarships.

Since 2021, more than $50,000 in scholarships have been awarded to students who took the initiative to complete the free online course.

Unveiling the Kansas Program

KCA and KDOT unveiled the Work Zone Safe program in October at the Kansas Teen Transportation Safety conference. KCA simultaneously launched Facebook ads promoting the new program to parents of Kansas teens.

To help promote the program in your community, members may visit webuildkansas.com/ workzonesafe to learn more and download graphics that can be shared on their own social media channels. The page also includes lesson plans for teachers, a one-page informational handout and the direct link for drivers to take the free online training program.

The conference draws students who serve as safety ambassadors at their high schools, allowing them to go back to their schools to promote the program to other students.

RATES TO REMAIN STABLE IN 2026

How to further reduce work comp premiums

BY MORGAN DEWEY | THE MILLER GROUP The insurance market has not been kind to most commercial insurance buyers over the last five years, with auto and umbrella coverages leading the charge in rate increases. The one line of coverage brokers and clients have counted on to help offset premium increases has been workers’ compensation.

Workers’ compensation has been profitable for most insurance carriers, with the net combined loss ratio for 2023 and 2024 at 86%. A combined

ratio below 100% indicates that the company is making a profit, while a ratio above 100% suggests the company is paying out more in claims and expenses than it is receiving in premiums.

Why workers’ compensation remains profitable

A few factors have led to continued improvement for workers’ compensation lines. According to NCCI, we have seen annual payroll growth every year since 2000 outside of three major economic events

that happened during that time frame (the DotCom Bubble in 2001, the Great Financial Crisis in 2008-09, and COVID-19 in 2020).

Strengthen safety protocols: Invest in employee training and equipment to reduce workplace injuries.

Additionally, many employers have adopted more robust return-to-work programs, helping injured employees re-enter the workforce faster and reducing time-loss claims. This has helped the lost-time claim frequency continue to decrease over the last 10 years.

Enhance return-to-work strategies: Offer injured employees transitional roles and modified duties to reduce time-loss costs. This keeps your claim dollars low, and there is a big benefit to your workers’ compensation experience mod, helping keep your claims medical-only. Only 30% of the amount will show up in the experience mod calculation if the claim is medical only.

What also helps is that lost-time severity has not seen a big spike while it’s been slowly increasing over the last 10 years. When you compare this to the large legal verdicts associated with general liability and automobile claims, it helps drive home why insurance carriers are excited to write this coverage.

How employers can keep costs down

Because we expect 2025 to be another profitable year for workers’ comp carriers, we don’t anticipate rate increases for clients in most states in 2026.

That said, some states, such as California and Washington, have filed for rate increases due to loss activity.

Even with the positive renewal outlook, there are things you can focus on to help your company keep premiums as low as possible.

Audit open claims: Work with your insurance company and broker to resolve lingering cases to help get them closed and paid.

Maintain a good relationship with employees: Make sure employees feel valued and that the company will do everything possible to help them get back to work as soon as possible if they experience an injury.

Engage with your broker or carrier: Collaborate on strategies to improve your experience modification factor and forecast future liabilities.

In conclusion, as we move into 2026, workers’ comp continues to perform well while other lines of coverage struggle. Rate filings suggest continued stability, and barring major legislative changes or economic shocks, profitability is expected to hold.

Staying engaged with your broker, understanding your mod, and investing in safety and claims management will ensure you’re positioned to benefit in this current marketplace.

Using key indicators to manage performance

BY ERIC THUMMEL | AGH CPAS & ADVISORS As end of the year approaches and financial professionals are working with external auditors on their financial statement audit or review, it is a good time to reflect on the past year. How did your company do? Are profits masking financial leakage in your company?

Benchmarking against your competition

An important gauge is the performance of the best of your competition. This is where benchmarking and key performance indicators come into play by not only reviewing past performance but in PAGE 12

gauging current and near-term issues that can be addressed before they become problems.

Construction Financial Management Association’s (CFMA) Financial Benchmarker and similar information available through other industry associations like the Associated General Contractors (AGC) and Associated Builders and Contractors (ABC) provide great resources. CFMA's Financial Benchmarker has more than 1,400 construction industry related respondents. This means there are likely multiple firms of similar size

and niche upon which to gain some insights. Here are a few items you should be evaluating weekly or monthly.

Construction Key Performance Indicators (KPIs)

Cash on hand. In normal times, contractors tend to have about 20 days of cash on hand. Cash is king and even more so today. The ratio of cash to overbillings should always exceed one, meaning that you have retained enough cash from overbillings to cover the work that has already been billed. If you have used the cash for other items, such as equipment purchases and owner distributions, you may have a cash crunch on the horizon.

Assets. Working down the liquidity chain from cash to current assets, ratios such as the current, quick and high liquidity ratios help measure your ability to meet near term financial obligations. All of these should exceed one, and it is best if the current ratio exceeds 1.25.

management. Are you using them to their full potential? You should be measuring profit fade and WIP by project manager, by estimator and by niche.

Underbillings should be scrutinized while there is opportunity to manage and improve on the related jobs. How much backlog do you have and what level of overhead can it support? Cost cutting may become necessary to maintain profitability.

Additional Steps

There are many more measurements, ratios and ways to analyze your data. Your CPA firm should be very familiar with your business and a key partner in the success and growth of your company. Work with them to evaluate where you have been and how to use key performance indicators to manage through certain and uncertain times.

RELIEVING CONFUSION & CONGESTION

Kansas breaks ground at K-18 and I-70 Interchange Several near-fatal crashes raised concerns about the safety of the current interchange design at K-18 and I-70 in Geary County. Heavy traffic during weekday peak hours and congestion around K-State football games have further magnified the safety risks for drivers.

In response, the Kansas Department of Transportation studied several options to improve the intersection from I-70 eastbound to K-18 northbound, including a flyover bridge design. Construction – spearheaded by King Construction based in Hesston, Kansas – has begun on the $27.5 million in updates.

The two-year, two-mile project includes a flyover bridge that spans over the existing bridge across I-70, additional improvements for the southbound to westbound I-70 onramp, updates to the north access point of the interchange, and the addition of a two-mile auxiliary lane on eastbound I-70.

The existing interchange, including the bridge, will remain open during and after construction. The final design saves the existing bridge, which is in good condition and has significant remaining service life, and allows for movement across I-70.

DBE changes on the fast track

If you work on highway, bridge or transit projects that include federal dollars – and tens of thousands of those jobs are being built nationwide – then you probably can’t remember a time without the Disadvantaged Business Enterprise (DBE) program. (Apologies if you joined the industry before 1983.)

Jobs Act (IIJA) with minimal revisions, just as it has done for decades. Then 2025 brought historic developments in DBE policy. Let’s look at how litigation, changing presidential administrations, aggressive rule revisions, and – of course – politics landed us here.

After more than 40 years, most primes, subs and owners have strong opinions about it, one way or another. Contractors across the country (including DBEs themselves) have debated the program’s effectiveness in benefiting disadvantaged firms, whether it needlessly adds costs to projects, and frustrations about its bureaucratic requirements.

Regardless, Congress reauthorized the program in 2021 through the Infrastructure Investment and

It began with a lawsuit filed in Kentucky two years ago, when a pair of non-DBE firms (Mid-America Milling Co. and Bagshaw Trucking) challenged the program’s constitutionality. The law spawned other litigation over the years, but this suit seemed different. It came as federal courts were casting doubt on similar initiatives related to college admissions and small business assistance, among others. In the fall of 2024, Federal District Judge

Gregory Van Tatenhove advised that he would likely agree with this challenge. It appeared the lawsuit could have much wider consequences once the legal process played out.

The defendants had been the Biden-era U.S. Department of Transportation (DOT), Federal Highway Administration, and their leadership, which stood by the existing DBE program. The inauguration of President Trump on January 20 meant the “new” DOT, led by Secretary Sean Duffy, could take a different direction if it wished. As the saying goes, “elections have consequences.”

On May 28, DOT and the plaintiffs proposed a settlement to the judge. For participation in the DBE program, there would no longer be a “rebuttable presumption” that women, Black, Hispanic, Native, and Asian Americans are socially and economically disadvantaged. The program would continue in law, but with this major revision.

In reviewing and reporting on this proposal, I fully realized how momentous it was. In my office, I have three feet of files on the DBE program dating back to the 1980s. Whether you agreed with it or not, that seven-page document submitted to the judge – if approved – would override many of the rulemakings and policy debates recounted in those folders. were exempt from the shutdown, the Department wanted to review whether the projects’ contracting practices were consistent with the administration’s DBE-related policies. And by the way, those were detailed in a brand new “interim final rule” (primarily a direction to the states) taking effect October 3.

In other words, the changes anticipated from the Kentucky lawsuit were coming right now.

Specifically: All existing DBE firms were immediately decertified. They would be reevaluated based on a “personal narrative” of disadvantage, without regard to gender or race. Other firms could now apply for DBE status as well.

Essentially, the entire DBE program had been suspended and would only be reactivated in a given state once it had completed the reevaluation process. Once restarted, nearly all other aspects of the DBE program would remain for the time-being.

ED MAULER PASSES AWAY Ed Mauler, age 87, passed away October 16. He served in the United States Army and co-founded L&M Contractors in Great Bend in 1971. When his partner retired in 1996, Ed purchased his portion and continued to own and operate the business. He was a longtime KCA member, served on the KCA board of directors, and received a Quilt of Valor for his service to our country. His son, Curt Mauler, serves as president of L&M Contractors.

KEITH HARLAN PASSES AWAY Keith Harlan, a longtime member of KCA and Chairman of A.M. Cohron & Son, passed away August 21. Keith was 87. He began working at A.M. Cohron in 1957 at the age of 19 as a laborer. He worked his way up the ladder from crane operator to foreman to President to Chairman. Putting a face to work zone safety

"Kids these days." It's a phrase that every generation says about the next generation at some point. But, research is showing that young people today have a level of kindness, compassion and empathy that we haven't seen in recent decades. With two sons in their 20s, I have seen that firsthand.

What's the Research Say

In what's been called a "surprising surge of compassion in modern youth," a number of studies are showing the same thing, that there has been a remarkable rebound and growth in empathic traits within our next generation of workers – and drivers.

Looking at scenarios from the perspective of others declined from 1979 to 1999, then showed no significant change from 2000 to 2007. But, perspective-taking significantly increased from 2008 to 2018. Empathic concern showed a similar trend, with a significant decline from 1976 to 1999,

no change from 2000 to 2007, and an increase from 2008 to 2018.

Why It Matters

So, why does this matter for our industry? The data tells us, when it comes to preparing new drivers, we'd do best to take a different approach. Instead of listing off the facts and figures of work zone crashes and fatalities, we need to connect on a level of compassion and empathy.

That's what the Work Zone Safe program does. It is designed to connect teens to the people who work on our highways and bridges, and the families they have waiting for them at home. It brings an emotional component to the responsibility that comes with driving through a work zone, one that we hope will make teen drivers – and every driver – think about the people working on our roadways each time they approach a construction zone.

Nashville artist Jeremy McComb to headline convention Nashville singer and songwriter Jeremy McComb will perform a live concert of 1990s country hits by artists like Toby Keith, Brooks & Dunn, Dolly Parton and Garth Brooks January 29 during the KCA convention.
