My wife Shannon and I have a group of friends who, over the years, have formed a dinner club. We take turns hosting at our homes or at a favorite restaurant. No matter where we get together, the result is the same – having a group that can get around the table to discuss ideas, celebrate each other's successes and share challenges makes each of us stronger.

The same is true for our association. Our association's table may be a little bigger than our kitchen table, but banding together through our KCA membership makes us - as individual leaders and as companies - stronger.

It has been personally and professionally rewarding for me to take the next step in my KCA membership these past few years. Not just paying dues and reading the newsletter once in a while, but engaging through committees and eventually through board service has given me a new appreciation and understanding of how critical the KCA is to protecting transportation funding, protecting our livelihoods, and creating a network of friends and colleagues who understand what each other does all day at work.

As we enter that time of the year for New Year's resolutions, I encourage you to think about resolving to increase your engagement with KCA. Here are a few ways to do that:

Our divisions, which meet at convention each year, are also a great way to connect with contractors who do the same type of work you do and who might be facing the challenges or have solutions to share.

Right now, the GOP holds a supermajority in both chambers.

Age. While the majority of legislators are over 50, an increasing number of young people are being elected, particularly to the House where 21 representatives (16%) are under the age of 50, and 16 of those are under 40. In the Senate, six are under age 50 with two of those under age 40.

Gender. A higher percentage of women serve in the Senate than the House. 40% of Senators are women, while 26% of House members are women.

Avery was born and raised in Newton, into a family that has operated a small business in town since 1892. After graduating from Newton High School, Avery went on to the University of Kansas, where he earned degrees in political science and communications.

1. What does your work life involve, besides your work as a legislator?

I work for our family businesses. I am from a family of entrepreneurs.

My great-great grandfather started Anderson Office Supply in 1892, that my grandpa currently runs. He is 91 and is at the store six days a week. I have learned a lot from my family growing up, but having a strong work ethic is towards the top of the list.

ALISON PREMO BLACK | AMERICAN ROAD & TRANSPORTATION BUILDERS ASSOCIATION (ARTBA) Public highway, pavement, and street construction — the largest market sector — is expected to grow at double digits for the second year in a row, reaching $126 billion in 2024 compared to $108.6 billion in 2023, an increase of 16 percent, according to the American Road & Transportation Builders Association (ARTBA).

CHANGES TO DAVIS-BACON:

What We Do and Don’t Know

By now, you may have heard that changes are coming to the regulations concerning the DavisBacon Act (DBA) – the prevailing wage law for direct federal and federal-aid projects. First proposed by the U.S. Department of Labor (DOL) Aug. 8, the new regulations take effect Oct. 23, and the Federal Highway Administration (FHWA) has already published a new Form 1273. Contractors with direct federal and federal-aid projects are affected.

ARTBA submitted comments to DOL prior to the rule’s finalization, pointing out that the draft language was too broad and overly burdensome.

DOL’s final product was somewhat responsive to ARTBA’s concerns and specifically referenced our comments. But it also left a number of gray areas.

For example: 1. The initial proposal expanded DBA coverage beyond active project sites. The new rule narrows the scope of coverage to locations where a significant portion of work is performed, and where the site is established for the exclusive performance of the covered contract.

2. ARTBA raised concerns that the prevailing wages for the time that off-site drivers and materials providers spend on the worksite would be subject to DBA wages even if that time was negligible. In the final rule, DOL allows for “de minimis” exceptions and/or exemptions but as several members have alluded to, there are gray areas and questions about when these exemptions apply.

3. The initial proposal redefined the term “area” for highway construction projects. DOL now allows multi-county wage data to be averaged together to calculate the prevailing wage. This means that rural and urban wage data may be combined.

4. The final rule clarifies the difference between licensed surveyors that are salaried professionals – and not subject to the DBA – and workers surveying on sites. The rule allows for “learned professional” exemptions but the definition of learned professional may vary depending on state licensing requirements.

Additional provisions of note: 1. DOL will be permitted to issue wage determinations when survey data is insufficient.

As a result, wage determinations can be based on factors that may not paint the entire wage picture. DOL can use any number of sources for determining the wage including existing project labor agreements.

2. The prevailing wage will now be set if it’s paid to at least 30 percent of surveyed workers in a given area. This is a change from the current 50 percent and may result in wage rate increases.

3. Prime contractors are responsible for DBA compliance by subcontractors and will be liable if subcontractors don’t pay a prevailing wage.

As the new DBA rule moves to the implementation stage, ARTBA remains in close contact with both DOL and FHWA. If you encounter questions working with your state DOT on this, please contact me so we can seek any answers or clarifications you may need.

IKE AT WORK: U.S. 69 CORRIDOR MODERNIZATION AND EXPANSION PROJECT (69 EXPRESS)

Davids goes to work on 69 Express project As the busiest four-lane highway in Kansas, the 69 Express project is designed to decrease congestion and increase safety for travelers along the U.S. 69 Corridor in Johnson County. An in-depth study undertaken by the Kansas Department of Transportation and the City of Overland Park showed heavy congestion, particularly during rush hours, that slow traffic and create longer response times for emergency personnel. Without the express lanes project, that congestion was expected to increase three-fold by 2040.

The $570 million, design-build project – Kansas' first-ever express lanes project – is being built by US 69 Express Constructors, a joint venture of two KCA member contractors, Emery Sapp & Sons and Ames Construction.

Davids participated in a morning safety meeting then shadowed the crew, running a remote-controlled trench compactor and helping to lay concrete pipe.

As construction progresses, the US 69 Express Constructors team will grade and excavate approximately 1.1 million cubic yards.

“Modernizing US 69 has been a priority since my predecessor’s predecessor," said Davids. "The bipartisan infrastructure law is helping to finally get this project off the ground ... It was great shadowing hard-working Kansans today and I appreciate the KDOT’s work to implement federal resources efficiently and effectively.”

The team will also construct a toll lane in each direction from 103rd to 151st Streets in Overland Park, replace 50-year-old pavement, erect 11 noise walls, and make improvements to the interchanges at 167th Street, Blue Valley Parkway, and I-435 – totaling 151,000 square yards of asphalt paving and 250,000 cubic yards of concrete.

The Construction Anchors team – Robert Drew, Chris Rech, Steve Bohannon and Matt Hendershot – took first place in KCA's PAC Golf Tournament on

Oct. 19. The tournament was hosted by Sand Creek Station in Newton. Local

legislator, Rep. Avery Anderson, was a special guest on the course along with Purple Wave Auction who sponsored the golf ball launcher.

Altogether, the tournament raised $10,000 for the KCA Political Action

Committee (PAC), which is focused on supporting legislators and legislative candidates who support transportation funding.

Working through conflict on the jobsite

Effective, respectful conflict management is an art — especially in an industry as stress-ful as ours. Conflict is often uncomfortable, so actively avoiding it can be an appealing solution. While this tactic may be m ore comfortable in the heat of the moment, it only leads to unexpressed frustrations, unmet needs and superficial harmony. In contrast, going too far in the opposite direction can create a damaging and toxic team culture. (Anyone who has seen a hard hat thrown across a trailer knows what I mean.)

So where is the sweet spot? How do we learn and exemplify managing conflict in healthy and constructive ways?

1. Prepare ahead of time for difficult conversations.

Before engaging in conflict resolution with another person, take time to gather all the necessary information, facts and documentation related to the issue. Be prepared to present your case with clarity and precision.

2. Define your desired outcome.

Before entering a difficult conversation, understand the outcome you hope to achieve.

It could be reaching a compromise, clarifying misunderstandings or finding a mutually beneficial solution. Having a specific goal in mind will help guide the discussion and prevent it from derailing.

5. Maintain respect and politeness.

3. Examine fears and concerns — yours and theirs.

The tension of conflict often triggers underlying anxieties, such as the fear of let-ting someone down, being yelled at or even losing your job.

Reflect on these fears and identify strategies to address them, such as developing strong arguments or seeking support from mentors or colleagues. Thinking through the fears or concerns of others can help you frame your talking points, anticipate arguments or questions and approach the conversation with empathy.

4. Understand the situation from all perspectives.

Get a holistic understanding of the conflict by considering the viewpoints of other team members. On the jobsite, conflicts can arise from misunderstandings, differing interpretations of specifications or limited resources. By grasping the bigger picture, you can approach the conflict with insight and will be better positioned to find common ground.

Even in the heat of a conflict, you need to take care to maintain professionalism and treat others with respect. Emphasize active listening, allowing each party to express their thoughts and concerns without interruption. Focus on the issue at hand rather than attack-ing individuals personally.

Productive feedback and suggestions are communicated in a polite and constructive manner.

6. Know when to disengage.

If tensions escalate, emotions run high or it becomes clear that further discussion is unproductive, it may be necessary to take a step back. Temporarily disengaging from the conflict can provide space for reflection and allow emotions to settle, enabling a more productive approach to resolve the issue at a later time.

By following these steps, builders can enhance their conflict management skills and create an environment where problems are addressed in a healthy and constructive manner. Ultimately fostering better collaboration, improved teamwork and more successful project outcomes.

I obviously hope to have a positive impact in each of these roles. I take the same approach to both of these, which is being the best steward I can be with the funds in front of me. Whether that is taxpayer dollars or contribution dollars, in my role as the Chair of the Transportation Budget committee, we handle billions of taxpayer dollars each year. In my role with the RHCC, we handle contributions from donors to elect and re-elect Republicans all across the state. In both of these roles I do my best to allocate these funds in the best interest of the taxpayer and donors respectively.

What do you see as the driving reason for Kansas to continue to invest in infrastructure?

Recruitment and retention is a growing issue for employers.

How do retirement plans factor into those efforts?

Today’s job market is as competitive as it’s ever been for employers. The number of job openings in the industry today is at its highest level on record. This gives candidates more options when seeking new employment, which in turn allows them to evaluate potential employers on more than just a name or paycheck. A well-rounded retirement plan with a solid matching formula, little or no vesting schedule and great participant support can be a powerful tool to have in those final interviews with candidates.

What are the 3 things an employer should look for in a retirement plan?

There are tons of things that make up a great retirement plan but three of the most important aspects are:

Plan design: Is the plan designed correctly to fit the needs of the employer and employees?

Support: Is the employer getting adequate administrative support? Are employees getting adequate support with their investments?

What are employees looking for in a retirement plan?

The employer match is an important aspect for participants, but not the only important aspect. Participants also want something that is easy to use and understand, as well as support from both the employer and investment provider. Retirement plans can sometimes be difficult for the average person to understand, and having a representative that is dedicated to educating participants on the basics of the plan is very important.

What about smaller employers.

Is it feasible for them to offer a good plan for their employees that doesn’t break the bank?

Absolutely. There is a misconception about 401(k)s that they are very expensive for employers to offer. Depending on the setup and plan design, there can be very minimal cost to the employer.

Last month we topped off KCA's 100th anniversary with a special celebration in the Flint Hills. We gathered at Warren & Susie Harshman's Clover Cliff Ranch for great steaks, great fellowship and the chance to commemorate the centennial year of our organization.

Part of that commemoration was the release of our 100th anniversary video. It's difficult to tell a 100-year-old story in just a few minutes, but we managed to capture the common threads that run through our association and its members.

Those common treads are central to who we are as Kansans, as contractors and as suppliers: Our founders were not scared off by the challenges of starting something new, whether that be their own companies or this association.

"When I look back on it, it must have been such a huge endeavor for them coming back from the war and it’s like what do we do," said Mary Sullivan of Amino Brothers. "They started off with a couple dump trucks and it grew and it grew."

Most started with nothing except a single piece of machinery and a willingness to work. "I was just a little guy, didn’t have the experience, didn’t know if I could do it or not but we took it on and got it done. The KCA got me that job," said Ted Dankert, founder of Dustrol, in the video.

To this day, many in our industry carry the privilege and the weight of perpetuating a family legacy through their company. "If you have a parent that’s worked all of his life to build something for his family and to be able to pass that on ... you sure don't want to disappoint," said Curt Mauler of L&M Contractors.

Most every company has weathered good times and bad, often leaning on the association and their fellow KCA members for support and advice.

"That’s the way the KCA is," said Kip Spray of Venture Corp. "We all help each other at all times."
