Conditions of Sale For Buyers

1. Bidding. The highest bidder shall be the purchaser, subject to the auctioneer having the right to refuse the bid of any person. Should any dispute arise as to the bidding the lot in dispute will be immediately put up for sale again at the preceding bid, or the auctioneer may declare the purchaser, which declaration shall be conclusive.

No person shall advance less at a bid than the sum nominated by the auctioneer and no bid may be retracted.

a. To issue proceeding against the purchaser for damages for breach of contract. b. To rescind the sale of that or any other lot sold to the purchaser at the same or any other auction.

3. Registration. Purchasers shall complete a bidding card before the sale giving their own correct name, address and telephone number. It is accepted by bidders that the supply of false information on a bidding card shall be interpreted as deliberate fraud.

c. To resell the lot by public or private sale. Any deficiency resulting from such resale, after giving credit to the purchaser for any part payment, together with all costs incurred in connection with the lot shall be paid to Bethunes@Webb’s by the purchaser. Any surplus over the proceeds of sale shall belong to the seller and in this condition the expression “proceeds of sale” shall have the same meaning in relation to a sale by private treaty as it has in relation to a sale by auction.

4. Buyer’s Premium. The purchaser accepts that in addition to the purchase price Webb’s will apply a buyer’s premium of 17.5% of the hammer price (unless otherwise stated) together with GST on the premium, effectively totalling 19.7%.

d. To store the lot whether at Bethunes@Webb’s own premises or elsewhere at the sole expense of the purchaser and to release the lot only after the purchase price has been paid in full plus the accrued cost of removal, storage, and all other costs connected to the lot.

5. Payment. Payment for all items purchased is due on the day of sale immediately following completion of the sale.

If full payment cannot be made on the day of sale a deposit of 10% of the total sum due must be made on the day of sale and the balance must be paid within 5 working days.

Payment is by cash, bank cheque or Eftpos. Cheques will be accepted but must be cleared before delivery of goods will be given. Major credit cards, excluding Amex are accepted.

e. To charge interest on the purchase price at a rate 2% above Bethunes@Webb’s bankers’ then current rate for commercial overdraft facilities, to the extent that the price or any part of it remains unpaid for more than seven days from the date of the sale.

2. Reserves. All lots are sold subject to the right of the seller or his agent to impose a reserve.

6. Lots sold as Viewed. All lots are sold as viewed and with all errors to description, faults and imperfections whether visible or not. Neither Bethunes@Webb’s nor its vendor are responsible for errors of description or for the genuineness or authenticity of any lot or for any fault or defect in it and make no warranty whatever. Buyers proceed upon their own judgement.

Buyers shall be deemed to have inspected the lots, or to have made enquiries to their complete satisfaction, prior to sale and by the act of bidding shall be deemed to be satisfied with the lots in all respects.

7. Bethunes@Webb’s Act as Agents. They have full discretion to conduct all aspects of the sale and to withdraw any lot from the sale without giving any reason.

8. Collection. Purchases are to be taken away at the buyer’s expense immediately after the sale except where a cheque remains uncleared. If this is not done Bethunes@Webb’s will not be responsible if the lot is lost, stolen, damaged or destroyed.

Any items not collected within seven days of the auction may be subject to a storage and insurance fee.

A receipted invoice must be produced prior to delivery of any lot.

9. Licences. Buyers who purchase an item which falls within the provisions of the Antiquities Act 1975 or the Arms Act 1958 cannot take possession of that item until they have shown to Bethunes@Webb’s a license under the appropriate Act. 10. The Antiquities Act 1975. Buyers should note some items may come under jurisdiction of this Act and permission may have to be sought from the Ministry of Culture and Hertiage Te Manatu Taonga for their export.

11. Failure to make Payment. If a purchaser fails either to pay for or take away any lot Bethunes@Webb’s shall without further notice to the purchaser, at its absolute discretion and without prejudice to any other

rights or remedies it may have, be entitled to exercise one or more of the following rights or remedies:

f. To retain possession of that or any other lot purchased by the purchaser at that or any other auction and to release the same only after payment of money due. g. To apply the proceeds of sale of any lot then or subsequently due to the purchaser towards settlement of money due to Bethunes@Webb’s or it’s vendor. Bethunes@Webb’s shall be entitled to a possessory lien on any property of the purchaser for any purpose while any money remains unpaid under this contract. h. To apply any payment made by the purchaser to Bethunes@Webb’s towards any money owing to Bethunes@Webb’s in respect of any thing whatsoever irrespective of any directive given in respect of, or restriction placed upon, such payment by the purchaser whether expressed or implied. i. Title and right of disposal of the goods shall not pass to the purchaser until payment has been made in full by cleared funds. Where any lot purchased in held by Bethunes@Webb’s pending i. clearance of funds by the purchaser or ii. completion of payment after receipt of a deposit, the lot will be held by Bethunes@Webb’s as bailee for the vendor, risk and title passing to the purchaser immediately upon notification of clearance of funds or upon completion of purchase. In the event that a lot is lost, stolen damaged or destroyed before title is transferred to the purchaser, the purchaser shall be entitled to a refund of all monies paid to Bethunes@Webb’s in respect of that lot, but shall not be entitled to any compensation for any consequent losses howsoever arising.

12. Bidders deemed Principals. All bidders shall be held personally and solely liable for all obligations arising from any bid, including both “telephone” and “absentee bids”. Any person wishing to bid as agent for a third party must obtain written authority to do so from Bethunes@Webb’s prior to bidding.

13. “Subject Bids”. Where the highest bid is below the reserve and the auctioneer declares a sale to be “subject to vendor’s consent” or words to that effect, the highest bid remains binding upon the bidder until the vendor accepts or rejects it. If the bid is accepted there is a contractual obligation upon the bidder to pay for the lot.

Bethunes@Webb’s have set out the following information for first time buyers and those unfamiliar with auction procedures.

Important: Please refer to full conditions of sale for buyers printed elsewhere in this catalogue and displayed in the saleroom.

Registration All intending buyers must complete a bidding form available from the reception desk

Buying at Auction Floor Bidders Register and obtain a bidder card before bidding on any lot or lots Be aware of the buyer’s premium of 17.5% +GST on the premium, effectively a total of 19.7% , is payable in addition to the bid price.

Make your bids clear, preferably by holding up your bidder card.

If you make a mistake e.g. the auctioneer takes a bid from you at a higher level than you had intended, or you realise that you had bid on the wrong lot, call out to the auctioneer immediately so that the bidding can be adjusted. Waiting until the hammer falls is too late.

If your bid is the highest and the lot is knocked down to you then you have entered a binding obligation to pay for that lot.

Bidding increments are at the auctioneers discretion Bidding will commence at a bidding increment over the second highest absentee/postal bid received prior to the commencement of the auction.

Where no bids have been received bidding will commence at half the Auctioneer’s lot estimate, or at $40, whichever is the higher, at the Auctioneer’s sole discretion Sales Subject to Vendor’s Consent Where your bid is the highest, but still below the reserve, the Auctioneer may declare you to be the “buyer subject to Vendor’s consent” [Subject or SVA]. This means that your bid is held as binding and will be communicated to the Vendor at the earliest opportunity. If the vendor accepts then there is a contractual obligation for you to pay for the lot. If the vendor does not accept, you are released from any obligation, however you will have first right to negotiate with the vendor through Bethunes@Webb’s until an agreement is reached, and Webb’s will not present other offers to the vendor until your negotiations are ended.

Absentee Bids Bethunes@Webb’s will endeavour to ensure that your bidding instructions are executed, but accept no responsibility or liability for failure to do so.

Lots will be bought as favourably as is allowed by bidding in the sale room, other competative absentee bids and any reserve imposed by the vendor. Please note that Bethunes@Webb’s cannot guarantee that another bidder will not be successful at your limit if, in the course of competitive bidding, a floor bidder bids your limit first. Absentee bids are accepted by written instruction which can be sent by fax, email or post to arrive no later than the evening before the commencement of the sale. Preferance will be given to the earliest received absentee bid where identical bids are received. Absentee bids will be executed on the following basis: If your bid limit is equal to or above a reserve, the Auctioneer may open the bidding at reserve on your behalf and will bid thereafter only in response to competition for the lot.

If your bid limit is below a reserve, the Auctioneer may open the bidding at your limit and if there are no further bids in the room may sell to you “subject to vendor’s consent”.In the absence of a reserve the Auctioneer may exercise your bid in advance of any opening bid or may open the bidding on your behalf at a bidding increment over the second highest absentee bid received prior to auction commencement or if no other absentee bids have been received bidding will commence at half the Auctioneer’s lot estimate, or at $40 whichever is the higher, at the Auctioneer’s sole discretion.

Telephone Bids Available for items over $500 and where the auctioneer is able to confirm availability of staff to provide this service. The same conditions as above apply to telephone bidders. Webb’s will telephone the number you have given several minutes before the lot you have request comes up for sale.

If your phone is engaged or we are unable to make contact the auction will proceed without your bidding. Our staff will ask you to hold when we have made contact. They will then tell you that your lot is about to come up. The bids will be relayed to you and you can enter the bidding at any time by making your call. Please note that the bidding at many auctions can be fast and furious. The auctioneer will not favour a phone bidder over and above buyers who are attending the auction by giving them more time to bid. You will need to establish your limit and make sure that you bid clearly and promptly. Telephone bids are only accepted for catalogued sales and on items with estimates over $500.

Pre-Sale Estimates Estimates printed in the catalogue or given verbally are intended as a guide only and can be subject to revision nearer to the time of a sale.

Advertisement for Reed’s Chemist in same vol (1924). An article by the editor concerning the observance (or non-observance) of ANZAC day within native schools, Vol 7, 1922.

Another article, Vol 7, 1921, on Ratana concludes: ‘If Ratana can stamp this evil out he will have done a good work for the Maori, and will earn the everlasting gratitude and thanks, not alone of the Native School Teachers, but of all whose lot it is to work among the Maoris.’ A letter to the members of The Association from Henry G Vine annoucing his departure from the positions of secretary, printer and publisher of the Journal appears on the back page of the September 1923 issue. Another letter from author R A A Sherrin, sent from Costley Home, Epsom, begging for reading matter ‘as we may as well be buried alive [without it]’. Correspondence, Friends’ Ambulance Unit A series of letters between members of a notable New Zealand Quaker family concerning their involvement in the Friends’ Ambulance Unit. Letters from Calcutta and China.

1946. The FAU was originally set up during WWI to provide a channel of service for conscientious objectors, mainly Quakers. Archive consists of 13 letters (11 handwritten, 2 typed). The addressees are chiefly John and Dorothy Johnson of Sumner, Christchurch. 3 addressed to John care of NZ Govt Correspondence School, Wellington. Both John and Dorothy wrote radio talks on their subjects of interest, which for Dorothy included rural sociology. Their son Neil writes from Chengchow, making observations regarding this very subject and reporting back to his ‘Fambly’. He speaks the language, regrets that his American workmate does not. Other letters are from John F Johnson. A typed letter signed

by Christopher B Taylor, Officer-in-Charge, FAU Calcutta, thanks the Johnsons for a parcel of milk powder, and expresses his interest in ‘your “Quaker Relief and Reconstruction Committee” including a bulletin (received) from the “New Zealand Council of Organisation for International Relief Service”’. The FAU was resurrected for WWII. Air letter format, with stamps in situ, plus one on ‘FAU: China Convoy’ letterhead paper (21 x 14cm), this only part of a typed letter. Another stamped envelope from Lanchow without contents. These original letters provide first hand accounts of New Zealanders working in this unique organisation. G+.

Presumed early 20th century. Glass plates approx 21.5 x 16.5cm.

Collection features a composite image with Maori subjects in cartoonish poses flying a Heath Robinson style vehicle. Another of Maori women riding a dragonfly. Maori subject matter also includes: a marae gathering (painted whare depicted), a woman being fitted with roller skates, two women playing golf with makeshift clubs, a dwelling with the name plate ‘Hotal Cicil’, a line of boys performing a haka or similar, a group playing cards, washday and romantic bathing scenes etc. Also various scenic images, portrait of a Pakeha woman under an arbor, anglers with catch etc. Two booklets of select positive images included. Album Photograph album of ‘Snapshots of doings at Cowes Bay’ (Waiheke Island).

Album, Buller A photograph album formerly belonging to the renowned Sir Walter Buller, his name and the title ‘New Zealand Tree-Ferns’ in gilt to front.

Late 19th/early 20th century. 23.5 x 28cm. Full black leather, raised bands to spine. AEG. Binding stamp of J & S. The album features work by the major photographers of Buller’s day including J Valentine and Josiah Martin, as well as various unattributed images, possibly by Buller or an associate. Images various sizes, many 15 x 19.5cm. Many captioned/ titled within image. Mounts foxed, images mostly clear (though some faded). Various loose enclosures including neat magazine clippings and 4 unattributed photographs (poorer condition). Naturalist/ornithologist Sir Walter Lawry Buller (1838-1906) was born in the Bay of Islands, son of the Wesleyan missionary James Buller. From an early age he developed an interest in the New Zealand bush and especially its bird life.

From McLintock’s ‘Encyclopaedia of New Zealand’, 1966: ‘In his talents, energy, and successful pursuit of the full life in business, law, and science, matching an unwavering self-interest, he is the paradox of a Renaissance figure in nineteenth-century colonial society.’ The quality of this album befits a Renaissance man. Provenance: indirectly from the estate of the Rev James Brown, a former professor of theology at the University of Manitoba, Canada, advisedly a descendant of Sir Walter Buller. G+. [33+ images]. Album, Dobbie A jumbo album containing over 200 original prints of photographs used to illustrate various books about New Zealand ferns by Herbert Boucher Dobbie and later Marguerite Crookes.

Presumed early 20th century. 4to. Spine width 15cm. Black cloth with insignia and title (‘New Zealand Ferns’) in gilt to front. Covers soiled, line of dampstaining to front only. ID to 2 leaves. The album mainly consists of larger images of fern specimens (approx 15.5 x 17cm) alternating with smaller detail images. Also photographs of ferns in situ, some featuring Dobbie. Printed captions mounted beneath many photographs (taken from early editions of ‘New Zealand Ferns’), others loose. Loose pages (with images mounted) laid in, as well as loose photographs (one annotated verso in a spidery hand). Pages from a prospectus for the 1921 edition of ‘New Zealand Ferns’ mounted towards end of album, as well as images showing the colour printing process. Also enclosed are matrices on brown card (seemingly relating to pagination/signatures), proof pages from the 1951 edition of ‘New Zealand Ferns’ (uncut), and several sheets of paper printed with Whitcombe & Tombs header etc.

In 1921, H B Dobbie published ‘New Zealand Ferns’, nominally a ‘2nd Edition, Revised and Extended’, presumably of his ‘blue book’ of 1880 entitled ‘New Zealand Ferns, 148 Varieties’. The 1921 edition, illustrated with the fine photographs by F W Birch here presented, and featuring essays and hints on fern collection and cultivation, was an entirely different book from that of 1880. Unfortunately, in his efforts to cater to the general reader, Dobbie used popular but inaccurate terminology in his writings.

This was remedied in the fourth edition of ‘New Zealand Ferns’ (1951), which was ‘revised and edited’ by Marguerite Crookes. Crookes appears as the primary author of the sixth edition (1963), which is described as ‘incorporating illustrations and original work by H B Dobbie’. Japanese A unique collection of photographs featuring a Japanese extended family, one image showing a young academic shaking hands with an equally young military man.

Early 20th century. Subjects appear to be from a high status family.

Many images beautifully presented in tissued card folders. Various sizes, including large group portraits. Photographers include Sugawara, Rapher, Takayama, Takaya, Imanishi, Tsingtaukwan, and Yeghi Art Studio.

Collection includes a school photo album, an image of a grandmother holding a baby, another of seven happy teenagers in matching chequered wraps sitting on a hillside holding a pose for the camera (and seeming 21st century subjects misplaced in time). Candid snaps (one heart shaped), though most images professional and sober. Some annotated (in Japanese). A curious change from the photographic archives usually seen in this country. There is no clear evidence of a NZ connection, though the smiles, celebrations and family milestones depicted are familiar. G+.

Murderer Coloured full length portrait on paper, the subject William Corder, the murderer in the famous case ‘The Murder in the Red Barn’.

The mother of the murder victim had recurring nightmares about the Red Barn. When this was investigated the girl’s body was found and Corder apprehended. Here he appears snub nosed and steely eyed. VG.

The novel was reissued in 1996 and a sound recording was made for the blind in 1993.

A remarkably tidy, splatter-free piece of British culinary history, detailing such delights as ‘Bombarded Veal’, ‘A Ragooe of Sweet breads’, ‘Blamangoes’ and ‘A whipt Sillabub’. Contemporary cloth, lacking back strip. Boards stained. AEG. Alternating printed and blank leaves. The latter fully annotated by hand with recipes, the source of one being Mrs Beeton. The gift inscription facing the title page reads: ‘Mrs Charles Brown with E F Gutch’s kind regards Sept 17 1856’. Beneath this is the signature of L Tobin (‘Xmas 1879’). A recipe ‘for inflammed eyes’ follows. The FEP, annotated in pencil, begins with ‘Ko Whiti whiti / Poroporo’, thence measurements and a biscuit recipe. A tiny sketch indicating how to tell the sex of eggs: ‘if crown at top (male) if at side female’. Also a recipe ‘For Sunburn’. From the preface: ‘It would almost seem a work of supererogation to write a collection of domestic Receipts, whilst there exist the countless volumes that have year after year issued from the press: from Mrs Glass to the Soyer of the present day [etc].’ An annotated recipe for ‘Useful Soap’ ends with the word Australasian, presumably adapting an older recipe to suit the climate.
