CC8 Reconsideration of claim

(2) Before making any deduction, the Ministry of Health will advise the maternity provider of the proposed deduction and give the maternity provider: (a) the reason for the deduction; and (b) time to provide written reasons to request that the Ministry of Health reconsider the deduction (these written reasons must be provided by the maternity provider within 10 working days of the maternity provider being advised by the Ministry of the intent to make the deduction). (c) The Ministry of Health will then consider the written reasons (if any) and decide, in its sole discretion, whether to make the deduction as planned or whether it may adjust the time frame for set off deduction, or other alternatives it may consider appropriate.

CC8 Reconsideration of claim

A maternity provider may, within three months from the date on which they receive advice of the outcome of a claim, request in writing that the Ministry of Health reconsider the claim. This clause CC8 does not apply to any set off under clause CC7.
