YMCA helping those with food insecurity in our area

By Loretta Cozart The Cleveland County Family YMCA started the Child and Adult Care Food Program (CACFP) and fed the afterschool children in September 2023.

The CACFP is a nutrition education and meal reimbursement program helping childcare providers serve nutritious and safely prepared meals and snacks to children and adults in daycare settings.

The program currently serves over 275 children in Cleveland and Rutherford counties.

Ruby C Hunt YMCA (Boling Springs) serves 110 children, Kings Mountain Family YMCA serves 75 children, and Jefferson Ele-

mentary in Shelby serves 34 children.

In Rutherfordton County the Forrest Hunt program serves 19 children, Harris Elementary serves three children, MVR serves 9 children, and Rutherfordton Elementary serves 24 children.

The YMCA is currently waiting for approval for Pinnacle, Spindale, and Thomas Jefferson Academy too. They hope the Dover Foundation YMCA location will be on board soon, bringing the number of people served to almost 400 by the end of October.

Food insecurities are a huge problem in our communities and your local YMCA is here for our kids.

Catawba Nation and Developer at odds over casino deal

By Loretta Cozart Developer SkyBoat Gaming is demanding the Catawba Nation pay an exorbitant price to gain control of its trust lands to satisfy National Indian Gaming Commission (NIGC) casino ownership requirements so it can proceed with its planned $700 million casino resort project, new Catawba Nation Chief Brian Harris said.

SkyBoat, headed by businessman Wallace Cheves, was to have developed the casino resort for the Catawba. But in December

SkyBoat and the Catawba were issued Notices of Violation (NOVs) by the NIGC regarding contracts for the casino development.

The NIGC cited the ground lease for the trust lands and other agreements that gave SkyBoat too much ownership control and man-

agement authority over the casino project. The NIGC threatened fines and said the permanent casino could not be developed until the NOVs were resolved. The Catawba Nation was allowed to continue operating its temporary casino housed in modular structures featuring 1,000 gaming machines.

The Catawba have since attempted to cut ties with SkyBoat and Cheves by negotiating to regain control over the trust lands for the casino development. Harris met with Cheves in early October but said the current

offer from Cheves calls for exorbitant payouts to SkyBoat – a one-time $125 million payment and then $6 million annual payments for access to adjacent non-trust land currently housing the temporary casino’s parking lot.

The adjacent non-trust land was acquired by SkyBoat at the same time SkyBoat was working to secure the trust lands for the Catawba, an acquisition that Harris characterized as trying to advantage SkyBoat at the expense of the Catawba.

City’s meter audit Hardee’s to reopen Oct. 23 finds issues

By Loretta Cozart The City of Kings Mountain launched an extensive meter audit in March to verify that every meter in the city was 100% accurate. The audit was performed to cross-check internal operations, field operations, record keeping, billing, and contractors that perform work for the city. Issues were found in both electric and gas billing.

The audit determined that six electric meters were found to have been installed in the field, and a wrong multiplier was applied, causing the affected City to overbill the customers by $62,619.38.

The overbilled $62,619.38 was credited to each business customer in October 2023.

The customers overbilled include Battleground Church of God, $8,667.77; Blackwoods Drive-in, $23,852.55; David Brinkley – Warehouse, $1,461.76; Grace Christian Academy, $10,172.43; Harris Funeral Home, $10, 912.59; O & W Surplus, $7,552.28.

She always showed up early to get a good seat for games and was often an animated spectator on Friday nights. Everyone knew Elizabeth; her countless friends came to her from many places, including her beloved Bible study groups and the church ladies’ trip she looked forward to every year in Gatlinburg. Elizabeth loved gathering with others and was an amazing gift-giver, always insightful and thoughtful with her gifts.

She had an incredibly caring and compassionate heart; she cared for cats, loved people, and cherished her family. The two most important men in Elizabeth’s life were her father and her son, Brooks. She was so, so proud of Brooks and loved his wife, Morgan.

She shared a special bond with her sisters, Laura and Julie, and doted on her niece and nephews. Elizabeth’s warmth and kindness will be missed dearly by all who knew and loved her.

Freddy spent his life as a legendary dirt track racer. He raced nationwide for more than 40 years as #00 and was known as “The Southern Gentleman”. Freddy has 785 career victories. He was a five time dirt track world champion, the only racer to have achieved this monumental victory, a Hav-a-Tampa National Champion and is an inaugural National Dirt late model Hall of Famer. Freddy lived dirt track racing and brought joy to the lives of countless people throughout his career. He was a wonderful husband, father, grandfather, great grandfather and role model. His life will be remembered for generations to come as not only a race car driver, but a friend to the masses and a hero in the eyes of many.

“SkyBoat is holding hostage this casino resort project and all of the economic and quality-of-life benefits for our people and residents of the area,” Harris said. “We need a fair deal so we can realize the full financial benefits of the project, create 2,600 permanent jobs and hundreds of construction jobs, and provide local governments and the state of North Carolina with tax revenue and other investments under our compact.”

Harris noted the NIGC has not approved the planned settlement but certified it was not a management contract as the previous agreement with SkyBoat was deemed to be.

The Catawba Nation’s gaming operations are also now fully compliant with the Indian Gaming Regulatory Act (IGRA). The Catawba Nation’s gaming machine lease is now with an NIGC-approved company that supplies gaming machines to many Native American casinos, ending the previous connection to a company that had political ownership ties.

Tony graduated from Swannanoa High School in the class of 1959, after which he went to work as a signal maintainer for Southern Railway (now Norfolk Southern) for 43 years. He retired from Norfolk Southern in 2004.

Tony was a longtime member of First Baptist Church of Kings Mountain and was an active Mason and Shriner. He enjoyed racing, an active fan of NASCAR and of football and he loved motorcycles.

Tony enjoyed riding his Honda Gold Wing anytime he got a chance, and he and his wife Agnes belonged to Gold Wing Road Riders Association. He enjoyed working outside around the house and loved working with his hands; whittling was a particularly favor-

ite pastime. Tony was a hard worker who modeled a strong work ethic to his children and grandchildren. He wanted everyone to know how much he loved his “personal angel,” Agnes. His loved ones will miss him dearly but honor his tradition to never say “goodbye”--always “see you later.”

He is survived by his wife of 58 years, Agnes Willis, of the home; children: Rick Lee Willis of Gastonia and Tanya Willis Browning of Kings Mountain; grandchildren: Alexandrea Clara Willis and Max Evan Browning; Tony is additionally survived by his two sistersin-law, Reatha Blackwell and Martha Willis, and by numerous nieces and nephews.

“Not long after we reach a fair settlement with SkyBoat we will be ready to put shovels in the ground and begin this long-awaited and vital project,” Harris said.

The Charlotte Business Journal interviewed Wally Fayssoux, an attorney representing SkyBoat, who responded to Chief Harris’ statement saying it is “‘profoundly untrue’ that the developer is the impediment to closing the deal. He said the developer and the previous Catawba Nation leadership agreed to a deal earlier this year. However, the new Catawba Chief Harris is opposed to it.

“Fayssoux said the Catawbas’ previous leadership ‘begged’ the developers to accept those terms and that the National Indian Gaming Commission was on board with the deal,” the article continued.

“Fayssoux said Cheves is still planning to be involved in development surrounding the casino site.

He noted the developer would be happy to plan the projects in coordination

with the Catawbas’ vision for the area.

“SkyBoat worked with the Catawbas for well over a decade to try to win approval for the casino project. The U.S. Department of the Interior placed the casino site into a trust for the Catawbas in 2020 after years of debate surrounding the project. The prelaunch facility opened in July 2021, was expanded later that year, and added a sportsbook last year. The full casino’s construction has been held up by the NIGC for well over a year. “’SkyBoat is ready to close immediately and honor its word and proceed with the deal the Tribe pleaded for it to accept in January,’ Fayssoux said. ‘We sincerely hope the current leadership will honor that agreement and recognize the tremendous benefits of moving forward today. We certainly understand their need as new leaders to carefully analyze the history of the deal so that they can move forward in the best interests of the Tribe and so we will remain patient while they do so.’”

City of KM Special Events’ final concert a huge hit

By Loretta Cozart The City of Kings Mountain’s final concert for the season was held on Saturday, October 14, when Dirty Grass Soul took the stage in Patriots Park at 6 p.m. for a beautiful evening celebrating Fall downtown.

The Main Event Band, along with DJ Drew Fulton,

opened the show cruise-in and pre-show at 5:00 p.m., and all makes and models of cruisers were welcome.

Fans poured in and stayed late to enjoy a beautiful evening celebrating Fall downtown.

Activities included fun for the whole family, including live music, cool rides, and great food.

Pieces of Kings Mountain History I usually write about things I know a bit about; sometimes, these stories LORETTA just seem to COZART write themselves. Sunday, a friend of mine, Trent Thomasson, wrote a Facebook post about the loss of a friend.

He shared, “Freddy Smith and his iconic double-zero were known nationwide. The fact that he was from Kings Mountain made him ours.”

Freddy Smith passed away on Saturday, October 14, after a short battle with leukemia, passing within a month of the diagnosis.

Kings Mountain Herald sportswriter Gary Stewart covered Freddy’s racing career from the start. In 1974, he wrote, “In his second year as a driver, 1969, he captured 34 victories at various tracks across the Carolinas and had one stretch of 17 straight wins. Last year, he drove into vic-

tory circle 15 times.”

“Freddy’s pit crew, headed by his father, Grassy Smith, and his brother, Buddy, is preparing a 1971 Mercury for the Daytona race, and Freddy wheels a ’68 Camaro and a 73 Camaro around most of the local tracks.”

In 1993, Freddy was inducted into the Kings Mountain Hall of Fame.

At the time, he had amassed 700 wins and three World Championships. His friend, Haskell Blackwell, a mechanic, helped Freddy get his start in racing and spoke at his induction.

“The Smith name will last forever in dirt racing,” Blackwell said. “I remember in 1965 when Freddy won his first race at Gaffney. He is one of the greatest drivers anywhere, including NASCAR.” “Smith has such talent that he drives his car at top speed in turns. When other drivers try to follow him, they spin out because they don’t have

Smith’s driving ability.”

“When Freddy’s out walking, he walks so slow,” Blackwell noted, “but when he gets in that race car, he really goes.”

“Smith has been hailed as one of racing’s gentlemen. He always has a big smile on his face and never gets upset with another driver” “His sportsmanship qualities came from his mother, who told him to always do what is right,” Blackwell said. “I always wanted him to run over people.”

Off the racetrack, Blackwell said, “Smith is a very caring and compassionate person. He often visits people in the hospital and always takes time to be friendly to his fans and everyone he comes in contact with.

“Three months ago, I was in the hospital and couldn’t walk and could barely talk,” Blackwell noted. “Freddy came in with his famous smile on his face and said, ‘You’re too tough to let this get you down. We need to

talk about you getting out of here.’ People always talk about Richard Petty’s smile, but his is nothing compared to Freddy’s.”

Smith, who has a quiet nature, accepted his award with humility. ”I appreciate the Hall of Fame for selecting me, and I appreciate the Good Lord for letting me do all of this in racing,” he said. “I appreciate my family. I couldn’t be here without them.”

By 2001, Freddy was a member of the inaugural National Dirt Late Model Hall of Fame Class.

Trent Thomasson wrote, “By the end of his career, Freddy had amassed nearly 800 wins, which easily makes him North Carolina’s winningest automobile race driver,” “His nickname, ‘The Southern Gentleman,’ surely came from his humbleness to always have time to speak with his fans off the track and his mastery of passing without ‘moving’ his fellow competitors on the track.”

It became obvious while writing about

Freddy Smith that words do not do the man justice. He was a gifted driver, yes. But he was more than that. He was a father, husband, and friend who cared about others. He cared about the drivers whom he raced, and he treated them with respect. He was also a man of faith, according to his words.

In the race of life, it is nice to be thought well of, and Freddy Smith was certainly thought well of by everyone. Anyone with those credentials is a winner in my book.

By Loretta Cozart A few weeks ago, Hayne Neisler shared a newspaper article about celebrating the 75th anniversary of the Battle of Kings Mountain in 1855. This is from the Wilmington, N.C. Daily Herald. It is interesting to see how the battle anniversary was celebrated then, compared to today. ‘’ A crowd of over 12,000 gathered at the site of the decisive Battle of Kings Mountain. The ground was white with tents, and tables loaded with plenty of food; the campfires illuminated the forest and sent their curling smoke to the stars.

“The following day, bands of martial music echoed and re-echoed from the distant hills. Early this morning a procession was formed, which wound its way along the base of the battlefield. A prayer was given by Col. J.D. Witherspoon, and the orator of the day was Col. Jonathan Preston, who was described as worthy of the spot and occasion.

“After the speeches, dinner, and barbecue were served up, appropriate toasts were given, and the battlefield was searched for relics of the battle. Several muskets and canteens were discovered, along with uniforms and swords. The festivities were closed by a grand ball at night.

“Two incidents of a melancholy character occurred during the celebration. A citizen of Yorkville came too near one of the sentries stationed by the military companies and, not responding to the challenge, was fired on. The gun was charged with powder only, but the wad caused a very serious wound. A member of the Columbia Artillery was dangerously hurt by the premature discharge of a cannon he was loading.’’

Rotary Spaghetti Supper Cooper’s veto of SB 747 to be held October 27 On October 10, the North Carolina House voted to override Governor Cooper’s veto of Senate Bill 747, a bill that they say will TIM MOORE significantly change North Carolina’s election laws and strengthen the integrity of elections.

ing the deceased, convicted felons, and those who have moved, and closes the sameday registration loophole.

KMPD PSAP commended for zero deficiencies after a state review

By Loretta Cozart During the October city council work session, Chief Gerald Childress praised Lynn Slycord, the Communications Manager of Kings Mountain Police Department’s PSAP, along with her team for achieving a zero-deficiency rating on the state review conducted in August last year. Only four PSAPs achieved this across North Carolina.

PSAPs, also known as Public Safety Answering Points or 911 Call Centers, are responsible for answering emergency calls and dispatching emergency services. Kings Mountain’s PSAP, located at 112 S. Piedmont Avenue, not only serves the city but also handles after-hours calls and can act as a backup for other emergency services within the county.

Chief Childress shared a letter from the NC Executive Director 911 Board L.V. Pokey Harris, who wrote, “Pursuant to Rule 09 NCAC

The assessment revealed no deficiencies; therefore, pursuant to Rule .0216(d), the PSAP will not be subject to another review for three years, making your next assessment due in 2026. Your PSAP will be notified 90 days prior to the next review.

“The assessment team was very impressed with your assessment binder. It was clear you had spent a good amount of time preparing it in advance of our visit, which allowed for one of the most expedient assessments we have conducted.

The assessment team also noted that your binder could serve as a model for other PSAPs to follow when putting their own binder together.

With that in mind, thank you for bringing your binder to the recent PSAP Managers Meeting. Having it there for others to see and review will undoubtedly help them going forward.

City council approves agreement with Davidson Alumni Resource Center

By Loretta Cozart During the Regular Work Session of Kings Mountain City council, they unanimously authorized the mayor to execute a Subrecipient Agreement between the City of Kings Mountain and the Davidson Alumni Resource Center, Inc. for an African American Civil Rights grant with the National Park Service.

The Subrecipient Agreement allows The Davidson Alumni Resource Center, Inc. to apply for a $750,000 grant with the National Park Service. According to Kings Mountain Planning Director Kimberly Herndon, “As the Historic Davidson School is on the National Register of His-

toric Places and the Davidson Alumni Resource Center, Inc. is an established non-profit entity, stabilization, and restoration activities at the Davidson School are eligible to seek funding. The maximum award of $750,000 does not require matching funds.”

The Davidson Alumni Resource Center Board of Directors sought a Subrecipient Agreement with the City of Kings Mountain, allowing the city to submit the application on The Davidson Association’s behalf and serve as fiscal agent for these federal funds when awarded.

Eligible costs under the African American Civil Rights grant include survey, planning, and documentation of historic sites/events: • Preservation projects must range from $75,000 to $750,000 in federal share, of which 20% may go toward pre-preservation costs such as architectural or engineering services. Grant applications that solely involve pre-preservation work must range from $15,000 to $75,000.

• Preservation projects fund physical preservation of a historic site to include historic districts, buildings, sites, structures, and objects. Projects must comply with laws and execute a preservation covenant/ easement.

When needed again, lid still on container, turn upside-down and run hot water on bottom of container. Chili will pop loose.

Mountaineers defeat Cramer 51-3 for eighth win, face a dangerous Ashbrook team away this week Kings Mountain’s Mountaineers shook off some early penalties to roll to a 51-3 victory over Stuart Cramer in their homecoming game Thursday night at John Gamble Stadium.

The offense was chalking up big yards from the opening whistle but three penalties resulted in a Max Thompson punt rolling dead on the Cramer one yard line.

Two plays later with the Purple Storm in a shotgun, the center snapped the ball out the back of the end zone for a safety for a 2-0 KM lead and the rout was on.

The Mountaineers returned Cramer’s kickoff from the 20 back to the Cramer 40 yard line and three carries by Josiah Hill put them in the end zone and Max Thompson’s PAT ran the score to 9-0.

On the second play following Matt Rhom’s kickoff, Eli Lipscomb scooped up a Cramer fumble and took it 17 yards and all of a sudden the score was 16-0.

A sack by Thomas Fair and Jason Melton for 10 yards put the Storm in trouble again and tackles by Currie and Fair forced a punt that put the Mountaineers in business on the Cramer 39.

Hill, who would finish with 153 yards rushing on 14 carries, accounted for all of the yards on five totes, the last one for a yard. Thmpson’s PAT made it 23-0 at the end of the first period.

A tackle by Bryson Brown and Tyler McIntyre after a nine-yard Cramer pass completion forced another punt which Xzorion Lenair returned 23 yards to the Cramer 28. A 25-yard keeper by quarterback Darreon Dixon-Valez on a fourth and 13 gave the Mountaineers a first down at the seven. Two runs

Cramer managed to drive to the KM two yard line and called time out with three seconds left. Drew Crotts kicked a field goal to end the game.

Jeffries finished with 66 yards on six carries and three TDs in his return.

Kings Mountain travels to Gastonia Thursday night to take on a dangerous Ashbrook eleven before returning home the following week to host the undefeated Crest Chargers in a game that should determine the conference championship and a very high seed in the upcoming state playoffs.

VARSITY AND JV GAME DATES CHANGE Due to forecast of rain for Friday, October 20, Kings Mountain JV football game will be held at 7:00 p.m. on Wednesday, October 18 at Kings Mountain High School.

The KMHS Varsity game will be held on Thursday, October 19 at 7:30 p.m. at Ashbrook High School.

KM JVs fall 20-14 at Stuart Cramer Kings Mountain High’s JV football team suffered its first loss against a Big South 3A Conference rival last week at Stuart Cramer, 20-14.

The combination of Micah Byers and Isaiah Branch got the Mountaineers on the scoreboard first, connecting on a 34yard touchdown pass.

Lyric Phonephet ran a

two-point conversion and KM led 8-6 early in the second quarter.

After an Iziah Jones fumble recovery, Phonephet scored on a 10-yard run to extend the Mountaineer lead to 14-6 at halftime.

Stuart Cramer was able to score twice in the second half to account for the final margin.

Devin Hopper had a fumble recovery and Ayven Ingram intercepted a pass for the KM defense.

The Mountaineers play their final home game Wednesday at 7 p.m. at John Gamble Stadium against the Ashbrook Green Wave. They take a 4-1 conference and 6-2 overall record into that game.

KM volleyball opens NCHSAA playoffs October 21 at home Kings Mountain High’s women’s volleyball team remained undefeated in the Big South Conference last week with a 3-0 victory over Forestview 28-26, 2511, 25-11.

Meile Songaila led the way with 12 kills, five serve receptions, a block and nine service points.

Myracle Davis had eight kills and two blocks.

Camden Paysour had 16 assists, three kills and five digs.

Abigail Hedgepath contributed 19 assists and four digs.

Alexa Jones had 17 serve receptions, seven digs, a block, five kills and

13 service points.

In a non-conference battle last week with Legion Collegiate, the varsity ladies fell 25-22, 25-22, 19-17 but the JVs swept their match 25-12, 25-22, 25-19.

Songaila led the varsity with 18 serve receptions, 17 digs, nine kills, nine service points and four blocks. Davis had 10 kills and three blocks, Pasour 28 assists, four kills, 14 digs and thee service points and Jones 14 serve receptions, 10 digs, a block and 11 service points.

Hedgepath led the junior varsity with 19 assists, 10 kills, four digs and 10

service points. Ruby Osborne had eight kills and two blocks, Madi Broome seven serve receptions, eight digs and four service points and Kenzlie Morris six kills, a block and five service points.

The KM teams were scheduled to close out regular season play yesterday at Crest. The first round of the playoffs will be October 21 and the Lady Mountaineers will be at home.

The second round will be played October 24, third round Oct. 26, fourth round Oct. 28, Western Regional championship Oct. 31 and the state championship on November 4.

football team, cheerleaders, marching band, and homecoming court nominees paraded through town, wearing black and gold, preparing for Homecoming at KMHS on Friday night.

To help keep the city safe and attractive, the City of Kings Mountain collects yard waste from residential properties in the city limits on a bi-weekly rotating basis.

The city collects waste resulting from routine residential yard maintenance, including leaves, grass clippings, twigs, small limbs, trimmings, and small shrubs. To continue providing service in a safe, effective, and timely manner, the city needs residents to help by following our policies and guidelines.

Placing Yard Waste Curbside • From Oct 1- March 1Yard waste should be placed at the curb for collection by 7:30 a.m. on your scheduled route day. Raked into a pile and left loosely on the curbside. Do NOT bag any leaves or place them over the curbside into the street (this causes drainage to become clogged). The sidewalk should not be covered when using the area between the roadway and the sidewalk.

Using a vacuum system, the city will only remove yard waste placed on the city’s easement (Reference: In front of your water meter or electric poles).

• From March 1-Oct 1All clippings and leaves must be bagged and placed curbside for collection by hand.

• Yard waste MUST be separated by type. Please take particular care to separate grass clippings and leaves collected by a vacuum truck from branches and trimmings collected by hand.

• Bi-weekly, the city can only collect a single pile of twigs, small limbs, and trimmings from each home. The entire pile may not exceed ten (5) feet long, ten (5) feet in width, and four (5) feet in height. The city shall assist homeowners in removing

larger piles of yard waste in residential areas only, and it must be requested and approved by the Public Works Director and shall be billed at a rate of $50 per half-hour (30 minutes). Prices will be quoted and paid in full before the city performs work. Rates may be subject to change.

Items the city can NOT collect • Limbs exceeding four (4) inches in diameter or five (5) feet in length.

• Stumps, tree trunks, large branches, large shrubs, and other yard waste generated by land clearing and similar activities, such as clearing large underbrush areas from natural or unmaintained areas.

• Tree and shrubbery branches, limbs, and trimmings cut by landscape and tree service contractors or other commercial workmen.

• Yard waste co-mingled with other yard waste or contaminated with non-yard waste like rocks, dirt, sand, gravel, and mulch, which can damage our collection equipment.

The City of Kings Mountain’s policies intend to keep yard waste collection service running safely, effectively, and in a timely manner. It is essential city crews can arrive at your home, safely and quickly collect your yard waste, and move on to other homes. The attached schedule will be adhered to and only altered due to weather or equipment failure. During our heavy season, normally October-January, the route could be approximately three to four weeks. Local layoffs impact families, economy

By Loretta Cozart Coats American is laying off 51 Kings Mountain employees at its Kings Mountain plant, according to the October 11 WARN notices report from commerce.nc.gov. According to the report, the permanent layoff effective date is November 30.

In February of this year, Coats American also laid off 97 employees at their McAdenville plant.

Coats has five North Carolina manufacturing sites in McAdenville, Kings Mountain, and Marion, as well as its corporate office in Charlotte.

They shuttered their plant in Hendersonville last year.

A deeper dive into the report shows the closure of two plants in Gaston County.

• Hunter Douglas Window Designs LLC closed its Bessemer City plant on August 30, impacting 135 employees.

• Keter US Inc. closed its Stanley plant on June 30, impacting 65 employees.

October is Domestic Violence Awareness Month Revival services Oct. 22 You can play a vital role in helping survivors of domestic violence. This Domestic Violence Awareness Month, learn how you can be a better ally for the survivors in your life.

1. Initiate the conversation: Talk with them privately about the abuse.

Don’t force them; let them know it is safe to talk to you.

2. Believe them: Many victims fear not being believed. Express that you hear them and believe what they’re telling you.

3. Listen without judgment: Survivors can feel shame for what’s happened. Don’t judge them for their past experiences or decisions.

4. Validate their experience: Survivors want to be heard. Practice active lis-

tening skills and validate what they are telling you.

5. Ask how they want to be supported: Be sure to ask them what they want and need. Don’t impose your thoughts and feelings on them.

Governor Cooper filed a lawsuit against Republican legislative leaders in Wake County Superior Court on October 10, challenging provisions in Senate Bill 512 that he feels violate the separation of powers established in the North Carolina Constitution. Governor Cooper also requested a temporary restraining order to prevent many of the provisions in Senate Bill 512 from going into effect immediately until their constitutionality is resolved.

Governor Cooper pre-

viously vetoed Senate Bill 512, which takes away the Governor’s majority of appointees on important boards and commissions, including the Board of Transportation, the Commission for Public Health, and the Environmental Management Commission, among others.

The lawsuit also brings a separation of powers challenge to a provision of House Bill 488, which establishes the Residential Code Council.

The Governor’s lawsuit explains that the NC Supreme Court’s precedents make clear that “in order to fulfill the Governor’s constitutional duties and conform with separation-of-powers principles, the Governor must have sufficient control over administrative bodies that have final executive authority, such as the authority to enforce laws and promulgate rules and regulations, to ensure the laws are faithfully executed.” The challenged provisions in Senate Bill 512 and House Bill 488 prevent the Governor from exercising sufficient control over executive boards and commissions that are charged with enforcing laws, promulgating rules, and taking other executive actions in a variety of important policy areas.

CCSO releases Sept. stats

By Loretta Cozart Cleveland County Sheriff’s Office released their September statistics. During the month, there were 9,095 calls for service, 190 arrests, 1,229 papers served, including 388 criminal, 609 civil, and 232 subpoenas.

One hundred sixty-two incident reports were handled: 139 were criminal, and 23 were non-criminal. Eightyone concealed carry permits were issued.

Narcotics seized were 72,092 DU pills, Cocaine 65.9 g, Marijuana 103.9 g, Meth 6,640.2 g, and Fentanyl/ Heroin 16.4 g. The monthly average of inmates handled by the sheriff’s office was 240 males and 40 females.
