LETTERS TO THE EDITOR GROUNDS FOR A LAWSUIT?

HE CIVIL RIGHTS ACT OF 1964 OUTLAWS DISCRIMINATION BASED ON RACE, COLOR, RELIGION AND NATIONAL ORIGIN. Article VI prevents discrimination by government agencies that receive federal funds, calling for that government agency to lose its federal funding.

In its [online] coverage of the Hillsborough Country Commission vote on the Domestic Partnership Registry, Watermark quoted Hillsborough County Commissioner Al Higginbotham referencing his Christian faith as his reason for voting against the registry, stating “In my faith ... I can’t support the unique special status of those outside of married relationships.”

By basing his decision on his religious beliefs and not offering equal protection to those who do not follow those beliefs, Commissioner Higginbotham clearly violated federal law Being reasonably sure that Hillsborough County receives federal funds. I wonder if Commissioner Higginbotham considered the possible consequences of his decision to discriminate based on his religion when he made this comment, or cast his vote. It would be very interesting to see the outcome if a group such as the ACLU or Equality Florida �iled a complaint or lawsuit against Hillsborough Country or Commission Higginbotham based on his religious discrimination.

So, I would hope that Watermark would address this issue in the near future, as it needs to be discussed.

are incensed by the decision from their commissioners to reject a domestic partnership registry that would have protected unmarried couples in the county. Their meanspirited 4-3 vote was doused in prejudice and soaked in re-election campaigning simply because it would have afforded a handful of rights to same-sex couples.

While those commissioners voting against the ordinance didn’t admit to that, their sentiments were clear. Hillsborough County is still an unwelcome place for LGBTs, especially in areas outside of the welcoming embrace of the Tampa city limits. If the registry was strictly for straight, unmarried elderly residents, it would have passed with little discussion.

The Jan. 24 vote shouldn’t surprise those of us familiar

with the history there. This is the county, remember, that banned the recognition of all Pride events after a display of LGBT literature at a library offended then-commissioner Ronda Storms’ senses. This is also the commission that revoked the inclusion of sexual orientation in its human rights ordinance protections in 1995—and has yet to correct that embarrassing decision.

We should feel sympathy for people in Hillsborough County,

regardless of their sexual orientation, for having to live under the leadership of uninformed individuals who only act as if they truly care about the well-being of all of its residents.

Four commissioners became tools of the far-right Florida Family Association, which encouraged its members to email and call commissioners, asking them to oppose the ordinance. Their scare tactics worked, and convinced four people to turn their backs on their own constituencies by rejecting a provision that would make visiting a loved one in a county hospital easier or allowing someone to dictate their own emergency contact person.

Commissioner Sandy Murman said she was �ighting growing government to support her “no” vote. That argument is ridiculous, since the already-existing County Clerk’s of�ice would have handled the registry.

Commissioner Victor Crist showed his complete lack of understanding of the measure when he said a countywide registry would give people a false sense of security, since the registry potentially wouldn’t be recognized by other counties. He also speculated about fraud, since “anybody” could sign up.

Both Crist and Murman added that providing a county program to protect unmarried couples isn’t their responsibility, since legal documentation can be obtained to get the same rights afforded by

a DPR. This was after hearing the story of Janice Langbehn, who was denied access to her dying partner in a Miami hospital despite having paperwork �iled in their home state.

And possibly most embarrassing were the thoughts shared by Commissioner Al Higginbotham, who bluntly said that while he believed we should treat others as we want to be treated, he recognized “thousands of years of precedent” regarding the de�inition of marriage as a one man/one woman relationship. If those are his beliefs, why does he support hurricane preparedness plans, since Biblical teachings show that God uses weather to wipe out populations who misbehave? Who are we to combat weather?

The commission embarrassed its constituency and put the state’s fourth largest county in the “strange news” category with its latest vote.

The vote should also embarrass the City of Tampa and its residents, since the progressive and forwardthinking city is, ironically, the Hillsborough County seat.

If there is a bright side to this debacle, it’s that the Hillsborough County community is again galvanized.

Plans to unseat the four dissenting commissioners have already begun, and seeing the evolution of Mark Sharpe, who introduced the registry after voting in support of the Pride ban in 2005, shows that education can produce results.

With progress on the horizon at the national level—President Obama mentioned Stonewall in his inaugural address and expressed support for marriage equality—it can be frustrating to �ind so much work to be done locally.

But the bottom line is that it must be done, and four commissioners have reminded us of that. |  |

rlando | Since Dec. 13, when the Dr. Phillips Center for the Performing Arts board announced that they would not use the Florida Theatrical Association to present Broadway tours in the $386 million facility, the local cultural community has buzzed.

The impasse seemed insurmountable after both sides dug in their heels with dueling memos.

But DPAC and FTA are talking, and both parties appear hopeful that an agreement can be reached.

“We are in negotiations on a bene�icial partnership that is in the best interest of the Dr. Phillips Center for the Performing Arts,” said Treva Marshall, who handles public relations for DPAC. FTA president Ron Legler con�irmed that the parties are working toward an agreement.

FTA has produced shows at the antiquated Bob Carr Performing Arts Centre for 24 years. Many say they have built the audience that will �ill DPAC’s 2,700-seat Disney Theater when it opens in the fall of 2014. In a Jan. 7 memo, Legler called DPAC’s decision “short-sighted” and indicated FTA would continue to present Broadway shows at a different local venue.

In his Jan. 10 reply, DPAC board chairman Jim Pugh argued that the “dif�icult decision” to self-produce would save $700,000 annually and re�lects a model used by an increasing number of performing arts centers.

On Jan. 22, the Sentinel reported that Orlando Mayor Buddy Dyer and prominent DPAC donors like Disney ($12.5 million) and the Orlando Magic ($10 million) asked the DPAC board to reconsider its decision to disassociate from FTA. The following day, Legler announced that he had secured The Book of Mormon— the hottest ticket on Broadway—to head FTA’s 20132014 season at Bob Carr. |  |

Cleve Acree, a partner with the Unger Law Group, was part of the mass swearing-in.

A Supreme Court lawyer vouches for prospective members, and Chief Justice John Roberts welcomes them before they swear to support the Constitution. AKE BUENA VISTA | One of Walt Disney World’s �irst employees now has 66,000 cast members calling him “boss.”

In August 1971, George Kalogridis scored a job bussing tables at The Walt Disney Company’s new theme park, set to open that October. Now, as of Feb. 1, Kalogridis is Walt Disney World’s �ifth president, taking over for Meg Crofton, who will fully assume her role as president of Walt Disney Parks and Resorts Operations, U.S. and France.

According to his of�icial Walt Disney World bio, Kalogridis, 59, has been with the company for 41 years.

He comes to his new role in Lake Buena Vista from Disneyland Resort, where he has served as president since 2009. Kalogridis’ job titles also include CEO for Disney Resort Paris, vice president of Travel Operations

Kalogridis is a sociology graduate from UCF and was born in Winter Haven. According to the Orlando Sentinel, he and his partner, Andy Hardy, have been together for 12 years. The couple plans to build a home in Golden Oak, a subdivision being developed by Disney World on the northeast corner of the resort’s property. Hardy is a �inance manager with Walt Disney Parks & Resorts global entertainment, according to the Orange County (CA) Business Journal.

Kalogridis’ resume includes the expansion of Disneyland’s California Adventure, a renovation of the Disneyland Hotel and the debut of the “World of Color” Disneyland nighttime show. No word yet on any changes Kalogridis plans to bring to Disney World, which just debuted a $425 million Fantasyland renovation and expansion that doubled that park section’s size.

EESBURG | The American Civil Liberties Union (ACLU) is backing up a Lake County Middle School student in her quest to create a Gay-Straight Alliance (GSA) at her middle school.

On Jan. 23, the ACLU sent a letter to Lake County School Board attorney Stephen Johnson, demanding the district follow through on a request by Carver Middle School student Bayli Silberstein to “confront bullying, educate the school community, and promote acceptance and equality for lesbian, gay, bisexual, and transgender students” via the formation of a GSA. According to the letter.

Silberstein has been asking school of�icials whether her request has been denied and if so, would they provide reasons in writing. The request was submitted in early November,

and Silberstein and her friend have had a conversation with Principal Mollie Cunningham, “who acknowledged the potential utility of the club but indicated that she needed to consult with the school board.”

Rather than denying the request, the letter states that school of�icials are simply ignoring Silberstein.

The ACLU set a deadline of Feb. 1 for the District to respond to the request.

As of press time, the only comment was from Lake County District spokesperson Christopher Patton, who stated in an email, “The request to establish this club at Carver Middle School is currently being reviewed.”

Trans protections in new Pinellas shelter policies Staff Report

LEARWATER | Transgender individuals utilizing shelters in Pinellas County that use federal funding will be better protected, now that the Sheriff’s Of�ice has approved new policies.

The Pinellas County Sheriff’s Of�ice, which runs several of the shelters, and the Pinellas Homeless Leadership Board have both updated their respective policies in a move to protect and extend a hand to transgender residents of the county.

According to a release from the Homeless Leadership Board, any shelter that receives federal funding through the organization are now required to ensure the safety and privacy for transgender people by “providing, among other things, separate shower and police facilities away from the general population and addressing them by whichever gender pronoun they prefer.”

The board of the HLB will offer training to its employees and volunteers to ensure the new policies are followed.

The Sheriff’s Of�ice will follow similar guidelines, and the changes have been lauded by Trans*Action Florida, an advocacy group for transgender rights throughout Florida.

The updated policies from the sheriff’s of�ice require that all transgendered individuals who meet the shelter’s admission criteria will be accepted and under no circumstances denied access based on their gender identity; provide transgendered individuals a separate living area inside the facility but away from residents living in the four established “common” areas. This may include unused of�ice space or a common area blocked off via a portable barrier; transgendered residents may access indoor showers and restrooms upon request and with staff assistance. Outdoor portable toilets are available at all times for individuals not housed in the four “common” areas; staff will display the same respect and courtesy to transgendered individuals as they do all other program residents, and ensure a safe environment; and residents are expected to follow rules.

According to the National Center for Transgender Equality and the National Gay and Lesbian Task Force, nearly 16% of Florida respondents had experienced homelessness as a direct result of their gender identity.

On a national level, that number is 19%. More than half had been harassed by shelter staff and many others were turned away from assistance, according to the study.

Other changes in policy from the Homeless Leadership Board requires that its shelters maintain at least one private bathroom or shower facility and to “make every effort” to provide alternatives if space is an issue. It also requires that case managers conduct interviews in private interviews to maintain con�identiality and that adequate security is provided for those at-risk for bullying based on their gender identity. |  |

AMPA | After hearing from citizens on both sides of the issue, and discussing it at length late in the afternoon, the Hillsborough County Commission voted 4-3 Jan. 24 to reject a domestic partnership registry.

The proposed ordinance would have given unmarried partners— gay and straight—a handful of bene�its typically reserved for married couples.

The measure was introduced

by Republican Mark Sharpe, who said the registry was not a way to rede�ine “traditional marriage.”

The registry, he said, is a necessity in the reality of how today’s relationships work.

But despite Sharpe’s support and arguments from commissioners Kevin Beckner and Les Miller in support of the ordinance, Al Higginbotham, Ken Hagan, Sandra Murman and Victor Crist all voted against the measure. It’s a move that

has galvanized the LGBT community in Hillsborough.

“Once again a majority of Hillsborough Commissioners have put prejudice and ignorance ahead of protecting families,” said Nadine Smith, executive director of Equality Florida. “They voted no on the common sense and basic fairness that has already been adopted in communities across the state.”

Smith added that the organization is already taking proactive steps to ensure there are changes in the county.

“We are working with a coalition of organizations who are calling for a town hall meeting in the coming weeks to continue to push for family recognition,” she said. “They voted no on the common sense and basic fairness that has already been adopted in communities across the state. Their vote to prevent a domestic partner registry in Hillsborough County must not go unanswered.”

The community town hall meeting to respond to the vote is Tuesday, Feb. 5, at 6 p.m. at 1002 E.

The arguments for the domestic partnership are simple, according to Sharpe.

“These rights are fairly straightforward,” he told his fellow commissioners. “The term ‘partner’ may have people concerned, but the rights themselves are fairly basic.”

Those rights would include granting unmarried couples access to each other in hospitals and give them the ability to make medical decisions for one another, for example.

Sharpe said that he agreed with some of those opposed to the registry that attorneys can draft paperwork to offer protections. But added that a registry would simplify the process, lessen confusion and make it less costly.

“If that couple came to us and said I need water or sewer services, we wouldn’t say, “Hang on, are you married?” Sharpe said. “We would provide that basic service.”

A majority of residents who addressed the issue of the registry at the meeting urged commissioners to vote in favor of it. Those who opposed it cited concern over the recognition of same-sex couples and duplicity in the law.

partnership registries) is that it allows for activist judges to rede�ine marriage and cite these types of rules when determining that a state has an interest in propelling same-sex marriage,” argued Todd Marks, a lawyer with Westchase Law. “Sexual orientation isn’t a protected class in the constitution. We shouldn’t undermine the will of the American people.”

But marriage equality and Amendment 2, which prohibits the recognition of marriage equality in Florida, are not the issue, according to Nick Janowsky, who addressed the commission.

“People live in ways that marriage isn’t a choice or an option for everyone,” he said.

“Sometimes it’s a mother who is recently divorced and living with a partner. She needs the support to make decisions for her children.

This is the way people live in modern times.”

After the vote, Janowsky said he is actively looking at ways to unseat the four commissioners who voted against the ordinance, but has not yet revealed who should run against the elected of�icials.

To disregard simple rights to a segment of the population especially upset Zeke Fread, who lives in Hillsborough County with his partner of more than three decades.

“A spineless four-person agenda comes before protecting unmarried couples with �ive basic human rights in the county,” he said. “It’s disgusting. We had only four speakers against the DPR and 10 speaking in favor. Did they listen? I think not.”

The defeat of the registry is the �irst of its kind after a slew of other communities passed registries in their respective

districts. Most recently, Pinellas County enacted a domestic partnership registry, which will take effect in approximately three months. The City of Tampa adopted its registry last year and Mayor Bob Buckhorn signed the ordinance in March. Since June, when the registry became active, nearly 400 couples have signed up for those protections.

A request for comment from the mayor regarding the county’s vote was not immediately returned to Watermark for this story. But when he signed the Tampa ordinance into law, Buckhorn talked about the importance of diversity and inclusiveness in today’s economy.

“When we’re out there looking to relocate companies, that diversity is a strength,” Buckhorn said. “They want to know that if they move their operations to Tampa, their employees—all of them—will be welcomed, celebrated and participating in a community irrespective of race, gender, ethnicity, religion or orientation. That mix makes us better and stronger.”

And a domestic partnership registry is an important tool in maintaining that strength, he said.

“It’s allowing people to be treated with the dignity they deserve irrespective of their relationship,” he said. “It’s about hospital visits, death and burial issues—it’s important that partners be allowed to participate and to make those important life decisions.”

That was despite a study presented by Beckner, who said he commissioned a poll through a public research �irm. In that study, 350 Hillsborough County residents were interviewed and asked if they supported a registry giving same-sex and oppositesex couples protections and bene�its regarding healthcare, emergency contact information and funeral arrangements.

The results of that poll showed 67% of respondents supported the ordinance, while 27% opposed it. Within those results, Beckner said that 76% of Democrats supported the measure and 58% of Republicans did, proving that it was not a partisan issue.

Some of those citizens opposed to the protections included Terry Kemple, president of the Community Issues Council and a long-time anti-LGBT advocate.

“This is an undermining, if you will, of the intent and the spirit of the marriage amendment,” said Kemple, referring to the passage of Amendment 2 in 2008, which de�ined marriage as the union of one man and one woman.

Kemple went on to say that with proper estate planning, any couple can secure the protections they need when it comes to end-of-life issues, especially concerning making healthcare decisions and hospital visitation.

Commissioner Murman agreed with Kemple, saying that end-oflife previsions fall under “personal responsibility” and is not the business of government.

“I feel, bottom line, that this can still be done as a matter of personal responsibility by individuals,” Murman said. “You can go and get a legal document.

This is about process and nothing more than that.”

She went on to suggest that the county’s elder affairs division should take a more active role in preparing unmarried, older couples for these decisions. |  |

While he “deeply appreciated” the viewpoints on both sides of the issue, Higginbotham said that he couldn’t support the registry based on his religious faith.

“My Christian faith teaches me to treat others as I’d want to be treated,” he said. “In my faith and for thousands of years of precedence [sic], I can’t support the unique, special status of those outside of married relationships.

I feel strongly that’s re�lective of many in the community and I won’t support moving forward with this registry.”

The city of Orlando, for example, was No. 4 on a list of cities citing the biggest increase in out-of-state residents relocating within its boundaries in 2012. That could be directly related to Orange County and Orlando ordinances allowing for protections for unmarried partners.

The vote was a surprise to Commissioner Les Miller, a church deacon, who supported the ordinance. As the board’s only African-American member, he said that he has a unique perspective when it comes to discrimination, and he had hoped a registry would have helped right some wrongs he’s seen in the past.

“I grew up in a segregated part of Tampa,” said Miller, who is the oldest commissioner. “A lot of

people depended on government subsidies, and in a lot of those instances people lived together who weren’t married. It was a �inancial issue, especially for the elderly.”

Miller shared stories about older couples who received bene�its following the death of a late spouse who couldn’t remarry due to losing those bene�its.

“Just because someone is elderly doesn’t mean they can’t fall in love again,” Miller said. “Many become ill with the person they love but can’t visit them in the hospital because there is nothing in place that allows them to do this.”

Pastor burns effigy of Obama

Gay couple told to remove pride flag

OYNTON BEACH | A gay couple living in a trailer park said that their landlord forced them to remove a gay pride �lag displayed at the front of their home.

Dave Armstrong told WPBF 25 News when he and his partner into a trailer home a few months ago, nobody complained about the rainbow �lag. Now, however, it’s on the patio �loor.

“I think we’re being discriminated against because we’re a gay couple (who) live there,” Armstrong said.

Armstrong said his partner called him and told him someone had removed the �lag. He said the �irst thing he did was call his landlord.

Armstrong said he was told to display the �lag in the back of the property because some of the other residents had started to complain.

“You know, the snowbirds, I guess, have this upper hand,” Armstrong told the television station.

Armstrong’s landlord said it doesn’t matter to her that Armstrong, who is living on a month-to-month lease, is gay. She said he’s just trying to disrupt the community. |  |

But this time he burned an ef�igy of President Barack Obama during the weekend preceding the inauguration.

As part of “National Burn Ef�igies/Images of Obama Day,” Pastor Terry Jones of the Dove World Outreach Center and his congregation burned a hanging representation of the president on Jan. 19 to protest Obama’s second inauguration. The act was done as a protest, the pastor explained in a press release.

“He lied his way back into the White House, but he does not get a free pass just because he is black,” Jones wrote. “I did not vote for him, he must be impeached, removed, because he is a liar, a deceiver, a murderer and he is

ASHINGTON, D.C. | In an unexpected nod to his LGBT constituents, President Barack Obama referenced historic gay rights riots in his Jan. 21 inaugural address, naming them as a civil rights watershed along with key moments in the struggles for women’s suffrage and racial equality.

During his 2,095-word speech, given on the Martin Luther King holiday, Obama touched on civil rights issues, gun control, education reform and alternative energy.

But what most LGBTs noticed was

the president’s reference to the Stonewall Riots of 1969, which many view as the beginning of the modern-day gay rights movement.

“We, the people, declare today that the most evident of truths— that all of us are created equal—is the star that guides us still; just as it guided our forebears through Seneca Falls, and Selma, and Stonewall,” Obama said from the steps of the United States Capitol.

It was the �irst time a U.S. president has mentioned gay rights in an inaugural address.

The committee shot down the full gay marriage bill by a vote of five-to-four. Rep. Cathy Connolly, a Laramie Democrat and a lesbian, sponsored both bills.

who made new year resolutions are starting to struggle. That’s especially sad considering there are no more important promises than those we make to ourselves.

As a personal trainer (among my occupations), you can imagine I get a lot of questions about nutrition and exercise, but one of the biggest areas where people lack essential knowledge is not in the mechanics—it’s in how to set and pursue a reasonable goal.

Goal setting isn’t complicated, but it is necessary. If you were going on a trip and didn’t know your destination, how would you ever get there? How would you even know in what direction in which to go? You could beat the very best archer in the world at a sport he had practiced his entire life—provided that archer was blindfolded.

Sounds like a silly example, doesn’t it? But how could anyone hit a target they can’t see? How can you reach a goal you do not have?

Do you have a speci�ically de�ined goal, or are you wandering around in a haze of generality? A goal must include change, it must be measurable, it must

have a deadline, and it must be broken down into a series of small steps.

If you’ve set a goal of gaining 10 pounds of solid muscle, that’s not going to happen in one month, unless you’re genetically gifted or using performance enhancing drugs. Instead of setting yourself up for failure, make gaining 10 pounds of muscle your goal in three to four months, then break that number down into smaller, weekly benchmarks.

It’s important to identify what you want. But it’s also important to remember that a “want” is different than a “goal.” Expressing a “want” involves desire, but does not include the plan to accomplish something.

One guideline one might use in setting a more speci�ic goal is the body mass index. BMI isn’t accurate for people with a lot of muscle, but for most, it’s a good baseline measure of what a “healthy weight” might be for you. The other good measure is the mirror. Look at yourself naked and decide how many pounds you think you need to lose, then set a reasonable time to lose that weight, breaking it down into how much you need to lose each week to reach that goal.

A goal I often hear is for someone to be the “�ittest he’s ever been by 50.” While that’s admirable, it’s not speci�ic. Everyone de�ines �itness differently. For some, being �it might mean being able to run six miles per day. For others, it could mean bench pressing 225 pounds for 12 reps. It could also mean just �itting into your current clothing. Here again, goals must be speci�ic to be effective.

If one goal is to run a marathon, it’s important to break it down. For instance, begin running one mile per day, adding a mile every other month. You could be at marathon training distance within two years!

Those wanting to run a 5K or 10K would reach that goal even sooner.

Many forget the importance of diet when it comes to achieving �itness and weight goals. My personal diet, the diet of a bodybuilder, would not be appropriate for someone who wants to do long-distance running. For instance, a marathoner needs a much higher amount of carbs than does a bodybuilder.

Every time you get yourself to the gym, you’ve already surpassed the vast majority of people in this country who aren’t getting any exercise at all.

As a trainer, I would review what you’re eating right now and then recommend changes for weight loss, and to eventually power your mission as a long distance runner.

Remember that every step you take, every weight you lift, every good eating choice you make, moves you closer to your goal.

Remember that every time you get yourself to the gym and do something, you’ve already surpassed the vast majority of people in this country who aren’t getting any exercise at all. Motivational speaker Zig Ziglar once said, “You don’t have to be great to start, but

you do have to start to be great.”

Once you’re in the gym, are you going to be able to lift heavier weights or do more reps on every exercise? Are you going to be able to run longer on the treadmill and increase the height angle? No. You can’t do it all at once.

What you can do is set a goal to improve at least one part of your performance each visit. Maybe you increase your squat weight by 10 pounds or you run just �ive minutes longer. Celebrate whatever advance you make no matter how small.

spirit, my committed feminism and deep distrust of old establishments, after I went to law school I became a fawning, dorky fan of the U.S. Constitution. It’s normal for lawyers to do this.

We see in the Constitution all this promise of equality and justice, even though we know all too well what a problematic document it is and how very bloody its failings have been. We will �ight for it like rabid dogs.

I was, therefore, gobsmacked to hear esteemed constitutional law professor Michael Seidman calling it “an ancient and outdated document” on CBS Sunday Morning last month. I almost threw my cereal at the TV. I refrained, and instead continued to watch while suppressing a twitch. Okay, he made some sense.

His question was: Why are we so beholden to a bunch of dead guys?

Come to think of it, is there really a good reason for the Electoral College or a two-year term for members of the House other than, “Because it’s

My point is, the Constitution isn’t a crumbling piece of parchment; it is, like lawyers are fond of saying, a “living document.”

in the Constitution?” All those provisions have done for us is Bush II and unending campaign robocalls. Even beyond its pragmatic failings, Seidman points to the gun-control debate to illustrate our misguided obsession with what people thought 200 years ago. Instead of discussing the role guns should play in our society today, we get bogged down on what the framers meant in 1790.

One’s opinion on the matter then becomes needlessly elevated to a litmus test about who’s most patriotic, all because of the Second Amendment, written back when guns coughed out a lead gumball.

At this point, forget rational debate.

I can’t really argue with him, but I’m not willing to concede so quickly, especially since this year promises to be a turning point in LGBT rights. There’s no doubt that the Constitution got many things profoundly wrong—for example, the notorious provision that counted slaves as three-�ifths of a person, or the fact that only rich white men got to vote. Whoops.

I also see in it, though, a good faith attempt to be enlightened, to be better. The framers understood that it was inherently �lawed and subject to the prejudices of the times. Thomas Jefferson probably embodied this contradiction as much as any of the founding fathers: he was a seeker of truth and also slave owner.

I make no excuses for this, but he was at least somewhat aware of his failings. He wrote, “I am not an advocate for frequent changes in laws and constitutions, but laws and institutions must go hand in hand with the progress of the human mind….We might as well require a man to wear still the coat which �itted him when a boy as civilized society to remain ever under the regimen of their barbarous ancestors.”

There is nowhere else in our legal canon such a document that allows for improvement to our collective wisdom or marks so well where we’ve been. The three-�ifths provision still exists in the text of the constitution, but it has been superseded by the extraordinary

Chastain (who also stars in Mama, see below) is a CIA agent trying to discover bin Laden’s hiding place. Everyone—including rival operative Ehle and a bunch of shadowy men—feel the leader is holed up in a cave somewhere. Chastain has other hunches that must be substantiated.

She turns to torturer Clarke to glean information from a prisoner, hoping to end years of false leads.

This historical retelling is being called director Kathryn Bigelow’s great follow-up to The Hurt Locker. I disagree. Her Oscar-winning

�ilm had plot, character and theme, comedy and a razor-sharp sense of timing. Zero Dark Thirty is fragmented. The opening sequence is a cliché radio play about 9/11. The �irst twenty minutes is all shaky camera work and an alphabet soup of military acronyms and Arab names. Also, we know how this ends; Bigelow chooses to tell the events in thrilling real-time. She never, however, shows bin Laden’s life or insight into his conviction, so the puzzle is still incomplete.

What is fascinating here is Chastain, trying to remain determined, stomaching the torture to reach her aim. She and Ehle are rare women in a men’s world. Chastain’s understated discomfort earned her an Oscar nomination in a �ilm with some early minor stumbles. |  |

WHEN WERE YOU FIRST AWARE YOU HAD A GAY FOLLOWING?

push the envelope almost too far if we combine our heads. I’m open to the idea. If I establish myself a little bit more, and people start giving me my own due, I would love to work with him down the line.

My friend I grew up with started calling me out and saying, “Dude, I can’t even imagine what people who don’t know you think of you.” It’s not like I’m doing these videos because I’m trying to shock or confuse people. I’m generally drawn toward material that’s just different and unique and is going to maybe surprise people a bit. So I was �irst aware that there was maybe some awareness of me from the gay community when all my friends were telling me there’s all this stuff online and if you Google my name, the �irst thing that comes up is “Dave Franco Gay.” (Laughs)

DO YOU GET ANNOYED WHEN JOURNALISTS BRING YOUR BROTHER UP?

No! I totally understand it. It could be a lot worse. At least he’s a very well-respected guy, and I do love him. We get along very well. But with that being said, it is a little comforting, and I feel slightly relieved, that at least the James questions have been dialed down a little bit.

ARE YOUR ONLINE VIDEOS YOUR WAY OF SHOWING YOUR ACKNOWLEDGEMENT AND SUPPORT FOR THE GAY COMMUNITY?

Yeah, sure—de�initely! I have gay friends and of course I’m comfortable enough with my sexuality that I’m open to doing videos like that. I know a huge audience is going to think that I am gay. I’m just trying to blur the lines, I guess. With my friends who are gay, it’s not like that’s the �irst thing I associate with them.

They’re just another friend, and they just happen to like guys.

WHY ARE ALL THE VIDEOS SO GAY?

There are a lot of very overtly gay things in these videos, but for some reason while I was making them, or while I was even initially thinking of the ideas, I swear to God I didn’t think, “Okay, we’re gonna make another gay video that’s gonna shock people.” The way “You’re So Hot” came about: I worked with Chris on a movie called Fright Night and in between takes we would play this game.

It was a game that he and his buddies played growing up and it just made me laugh my ass off, so when the movie was done and we were back in L.A. I thought to myself, “This would make a really funny short.”

WHAT’S COMING UP FOR YOU BESIDES NOW YOU SEE ME AND WARM BODIES?

That’s a good question. The main overlap is just how hard we dive into it. There’s nothing subtle, I guess, about how we embrace gay culture—and there basically are no boundaries. We both push the envelope.

I don’t know why a lot of what we create deals with that subject matter. It just comes through us for some reason.

HOW DO YOU REACT TO THE GAY COMMUNITY’S EXCITEMENT OVER YOU AND YOUR VIDEOS?

I have to embrace it, right? I love it. At this point, I’m so happy that anyone is even aware of me or is a fan of me. It’s still something that I don’t think I’ll ever get used

to. From just what I’ve heard and what I’ve observed, the gay community, when they revolve toward someone or something or a movie, they come full force and they tell everyone about it.

WITH YOUR UPCOMING ROLE IN NOW YOU SEE ME ALONGSIDE SOME HEAVY HITTERS, YOUR CAREER IS REALLY TAKING OFF. ARE YOU READY FOR A LEAD ROLE? ANY IDEA WHAT YOU MIGHT WANT THAT TO BE?

I’m de�initely ready for a lead role.

My criteria for picking a project these days is just wanting to work with �ilmmakers I admire.

I do want to make my own �ilms one day. I’ve been writing and producing and editing all these Funny or Die videos, and it’s kind of been practice on a much smaller scale. I want to work with guys like Jonathan Levine, who directed Warm Bodies and who I’ve admired for years. I just want to be on set with these guys and see the process and see how they work with actors regardless

of how big or small my role. So, honestly, I would be an extra in all of Paul Thomas Anderson’s movies. I just want to be around these guys.

OTHER THAN BROKEN TOWER, DO YOU HAVE PLANS TO WORK ON ANY PROJECTS WITH JAMES THAT MIGHT HAVE A GAY SENSIBILITY?

I love my brother and I respect him so much, but in general, I have been trying to distance myself from him just in terms of work, because I need to kind of carve my own path at this point. I don’t want to be referred to as “James Franco’s little brother” for the rest of my life. So it’s hard sometimes, because he is creating so many of his own projects and he asks me to be a part of them and I would love to—but at this point, I just need to distance myself from him work-wise.

Down the line, who knows, man. We do work very well together and our sensibilities are very similar, obviously. We might

There are a few things that are in the air that I can’t quite talk about just yet, but I am always pumping out these Funny or Die videos. I do all of them with one of my good friends who I’ve known since childhood, and we have one coming out in a couple weeks.

This one is actually the cleanest one we’ve done. The rest are rated X, but this one’s like a hard PG-13.

Without giving too much away, it’s with an NBA star who’s 7 feet tall and then, of course, myself. I’m not the biggest guy in the world, so it’s this odd couple—the two of us competing in a series of events. It’s still in the same vein and tone as the rest of the videos, but because he’s a professional athlete, he can’t push the envelope as much as I’d generally like to.

I’m always writing something.

I’m working on a feature-length �ilm right now. Two years ago I made a decision to only audition and meet on projects that I’m actually passionate about. I knew it might be the stupidest decision I ever made because I might never work again, but in the meantime, that’s how these Funny or Die videos came out. |  |

ORLANDO Parallel Lives

Starring Maria Ragen, Karen White, Jodi Chase and Michele Simms Feren, the play takes a comic look at the way the universe works. The four actresses will play upwards of 20 characters, ranging from

OVERHEARD THE CUSP OF THE TUSK

HERE’S A SWELL OF LGBTS FLOCKING TO A SOMEWHATNEW NIGHTSPOT IN ST. PETERSBURG THESE DAYS. The Broken Tusk has taken on the identity of an unof�icial LGBT hot spot by sporting everything from karaoke and sports on the �lat screen televisions to drag shows hosted by Jaeda Fuentes and Bitchy Bingo Sundays with Meagan Towers.

The bar opened in October 2012 and hasn’t outwardly marketed itself as an LGBT destination. But it didn’t take long for the community to discover the tiki bar, outdoor

patio and 2,400 square-foot bar. It also doesn’t hurt that bar managers are Levi and Judah Love, two handsome members of our community.

The Broken Tusk is open 365 days a year and is at 4685 28th St. North in St. Petersburg.

UP AND RUNNING

A

T THE END OF 2012, WATERMARK PROFILED BILL KANOUFF ON ITS COVER as one of the most remarkable people of the year. The pro�ile shared Kanouff’s story following a motorcycle accident that resulted in the loss of his left leg. Now, that

story has literally helped him to get up and running again.

Kanouff will debut his new leg Feb. 18 at Telecom Park when he participates in the I Will Inspire 5K run along with other amputees.

He said that he was so excited to learn about the run that he signed up before fully thinking it through, adding that he doesn’t even have the new leg yet!

Kanouff’s determination will no doubt make this run a reality and, even if he’s not able to run the entire distance, we have faith that he’ll make it across the �inish line. He also said he’s informed his partner, Gene, that he’s running in the

5K with him.

The free leg will change Kanouff’s life, and he graciously says that the article in Watermark helped secure the new appendage. We wish him well in the race— and beyond!

Last week Abling returned to Orlando to attend a Jan. 25 gallery show and reception at Quantum Leap Winery (QuantumLeapWinery. com near Virginia and Mills) featuring her artwork. She moved from Orlando �ifteen years ago and lived on a boat, migrating up and down the East coast before deciding that she wanted to paint. She now works from studios in Provincetown and Fort Lauderdale. “I paint

A little investigating is okay

I

MET A HANDSOME, SEXY GUY ONLINE, AND WE’VE HAD A HOT TIME THE LAST COUPLE MONTHS. At the outset he said that he’s married, but that he and his wife have an open relationship. He says he wants to keep our relationship casual, simple, sexual. But we spend a lot of time together—especially for a married guy— and I’m starting to think maybe the whole marriage thing is a ruse to provide him with a convenient out.

He won’t show me a picture of his wife (“You might know her.”) and he’s evasive about details (“I don’t see any point in going there.”) You always say, “Here comes the Truth...” Well, the truth is I feel like I lucked into the hottest down low guy in Orlando. But its weird being with someone that’s withholding so much info. In your book of ethics, would it be okay for me to do some investigating on my own?

—Happy but Confused Dear HBC, As long as you don’t break any laws, intrude into his privacy, or spend too much time on it, I would say that it is ‘okay’ to do some investigating. But that’s not the question you should be asking yourself.

That question is: What the hell am I doing?

First of all, the status of his relationship with his wife—be it opened or closed—is not your concern. But do you really want to get involved in a triangle like that? Is that the best version of you available?

I think not. That sort of arrangement might be �ine for them but does it �it into your moral code?

While you may not be sure he’s telling the truth, it can be safely assumed that the evasiveness and paranoia he’s displaying are red �lags so big it looks like Christo installed them. Okay so he’s hot, and maybe the fact that he’s down low makes him all the sexier, but this isn’t transactional sex we’re talking about.

You say yourself that you’re spending ‘a lot’ of time together. This isn’t the Truth’s de�inition of a fuckbuddy. The Truth knows of people who have had fuckbuddies for years and never even knew their last name.

What you submerged yourself in here is

some brackish, potentially poisoned water.

’M A 51 YEAR OLD OUT LESBIAN...

STABLE, SUCCESSFUL, SINGLE. I’m very close to my local niece and nephew, ages 15 and 10. I recently learned—quite by accident—that my sister and her husband have named my brother and his wife in Texas as guardians of their children in the event anything happens to both of them.

I’m mysti�ied by this because the kids—and their parents—are much closer to me, and I have a beautiful home with plenty of room.

In fact, the oldest has said many times that if they had to move she’d want to stay with me to �inish high school. My guess is that the “straight couple” thing trumps all.

I get along great with all my siblings and don’t want to upset the apple cart. But I’m hurt. Should I risk it and ask?

—Rejected Aunt Dear Auntie Maimed, I understand why you’re upset. But I do think that the key word in your question isn’t ‘lesbian,’ it’s ‘single.’ I think it is perfectly understandable why your sister and her husband would want to establish a guardianship with a married couple, not because they’re straight, but simply because they’re two of them.

The circumstances that necessitate even having this discussion are the same ones that make their decision understandable. Some day somebody might die while the kids are still kids. I’m not saying you shouldn’t speak to your sister about it, if you just can’t get past it, but for the record, I understand where she’s coming from and I think you should too.

Here comes the Truth: Hopefully no one will ever have to raise your niece and nephew except your sister and her husband. If that situation does arise, all hands will be on deck to help out your devastated niece and nephew.

It sounds like you have a strong family. I’m not sure the designation matters as much as the love you all have for each other. Focus on the kids. |  |

Two Tampa teams take top spots at Meltdown

RLANDO | Sixty teams converged on two softball complexes in Central Florida for the 2013 Orlando Meltdown softball tournament Jan. 18-20. Two Tampa Bay teams walked away with �irst place trophies in a tournament dominated by teams from Fort Lauderdale.

The Tampa Hammerheads took �irst in the Open C-Division, and Gay and Confused of Tampa took the top honors in the Women’s Recreational division, .

Every other division’s �irst place trophy went to teams out of the Fort Lauderdale area.

Several other local teams �inished in the top three of their respective categories, but no Orlando team took a top prize at the annual tournament.

In Open B-Division play, the Fort Lauderdale Noize beat the Orlando Voltage for the top spot, while the third place trophy went to the

ALTIMORE, MD. Ravens linebacker Brendon Ayanbadejo hadn’t even slept after Baltimore’s AFC championship game win over the Patriots when he started sending emails asking how he could help promote gay rights at the Super Bowl.

According to the New York Times, Ayanbadejo sent emails to Brian Ellner, a marriage-equality advocate, and Michael Skolnik, political director for Russell Simmons, a hip-hop magnate who is a supporter of gay rights and marriage equality.

“Is there anything I can do for marriage equality or anti-bullying over the next couple of weeks to harness this Super Bowl media?” Ayanbadejo wrote, according to the Times.
