f you’re a regular reader of Renters Guide, you know we offer a variety of information for those looking for a new place to call home. But did you know it is your responsibility as a tenant to know your rights and responsibilities prior to signing a lease agreement? By knowing the terms of the rental contract ahead of time, you will be well informed and able to determine if the location is the right one for you. Once you choose your location, a landlord should give you adequate written notice when rent or landlord services have been adjusted, and you should be able to discuss any clarifications or adjustments before a new lease is signed. Many landlords and property management companies do their jobs well and care about the property they own as well as the people who live there. It is in their best interest to keep good tenants. ecently I watched a building be demolished. It happened over several weeks. It was about 14 storeys, and I watched the crane claw it down, floor by floor, apartment by apartment. Each time I was in the area I’d take a picture – if you check out my Instagram account @elisakrovblit you’ll see some of the images from early spring in Regent Park.

It was a really interesting process, but I was surprised how much I was drawn towards the building, how small details affected me. It was like peeling an onion. As each wall came down you could see a little bit of insight into each home. Instead of seeing one complete building, as you usually do when you pass by a highrise, you could see each individual unit. It had turned into a collection of individual spaces, and for the first time they were all exposed to the world. I found it interesting to see the colours revealed. Sure, many were typical ‘apartment beige,’ but the personality in the bright purple, deep aqua and fluorescent green felt like I was being let in on a secret – real people with real personalities lived there. Powder blues, Soft yellows, the more subtle hints of colour, they revealed a different type of personality, a different view of life. The people living in this building had been unique individuals, not just a collective ‘renters’ and ‘residents.’ Some homes had big, bold graffiti on the walls. Some had painted ceilings, painted doors and colour choices I was amazed anyone could live with, others had wallpaper of decades gone by. But change is good. The building was in poor repair and is a prime property for redevelopment and modernization. The old will be replaced with new – and more homes, with features and finishes that will be modern – will be fresh canvases for new renters and residents, more paint and personality and history to come.

ONE FEAR MOST TENANTS HAVE REVOLVES AROUND THE CONCERN OF when the Landlord can enter their premises and for what reason. The question is: When and why a Landlord can enter the property, and whether the Landlord needs to provide you with notice. Thankfully, there are rules that govern Landlords on whether they can make RentersGuide.cavisits to your home. Generally, unexpected prior written notice must be given to a Tenant but under certain situations, a Landlord may enter the property without RentersGuide.ca notice. 30

YOUR RIGHTS AS A TENANT Tenants have a right to privacy, and a right to undisturbed possession from the landlord. The wording used in different Provinces varies between reasonable enjoyment and quiet enjoyment. There are many different circumstances that could lead you to believe that the Landlord is interfering with your quiet enjoyment. Examples include: a) The Landlord entering the rental premises frequently and without notice or permission; b) The Landlord causing unreasonable and ongoing noise, ie. from repairs construction maintenance etc.; c) The Landlord intentionally removing or restricting services explicitly promised in the rental RentersGuide.ca agreement; d) The Landlord allowing the property to fall into disrepair

ENTERING WITH WRITTEN NOTICE Your Landlord – except in extraordinary situations as provided by law – needs to provide written notice that outlines when and why he wants to enter your property. This must be done at least 24 hours in advance. Unless such notice has been served upon you as provided in your Provincial legislation, a landlord may only enter your property under a few exceptions. Below are some examples of entry with notice: a) Fixing something or to check on appliances that are no longer working b) Making sure the home is safe (such as installing smoke alarms) c) Showing the home to someone who wants to buy it d) Other reasonable reasons stated in the signed rental agreement or provided by law ENTRY WITHOUT WRITTEN NOTICE a) Emergency Each Province has its own Residential Tenancy legislation that sets out the circumstances when a Landlord can enter without notice. Generally a common thread is that a Landlord can enter the property in the case of an emergency. An emergency is usually defined as something that is both unexpected and dangerous. A good example would be a fire or flood. In these circumstances, your Landlord does not need to provide notice before entering your property. Repairing something that has broken in your home does not count as an emergency.

For example, a housekeeper could enter the property on the agreed times of the rental agreement. These services generally have to be between certain hours of the day. Check with your local Landlord and Tenant Bureau for the hours of when the Landlord may provide these services. There are other issues, like moving, when written notice is not required and again, your local authority will set the hours. All in all, neither side can abuse their rights when it comes to this area, as the law is clear that provided parties act reasonably and follow the law. MANY PEOPLE FACED WITH MOVING THEIR RESIDENCE think that packing is easy – a few boxes from the grocery or liquor store, some newspaper, a roll of tape and voila! In fact, if you value your ‘stuff’ and want it to arrive at your destination in good shape, packing involves much more consideration. This is especially true if you tend to be a bit disorganized at the best of times. Even if you pride yourself on being a stickler for details, you may benefit from a few tips on efficient packing. The number-one thing to remember is to start packing several weeks ahead of your move-out/move-in date. Done well, this process is amazingly time consuming, and packing in a hurry is usually counterproductive. Take your time to think everything through, and start with the items that are not critical to unpack right away. Avoid the overwhelming nature of leaving things to the last minute. Get some decent packing materials. Make sure boxes are sturdy so they will not collapse under the strain. Consider buying boxes from your mover. Rather than using newsprint, which tends to smudge everything it touches, purchase proper all-white newsprint packing paper. At the other end, you can smooth it out for reuse, or save it for the kids for drawing and painting. This paper is substantial and will protect your items while keeping them clean. The last thing you need at your destination residence is to have to wash dishes before arranging them in your cupboards. And speaking of dishes, did you know that packing them on their edges rather than flat can help to prevent breakage? Professional movers usually sell packing materials including boxes that are sized to stack neatly. This saves a lot of headaches on moving day. One of the biggest mistakes do-it-yourself movers make is to over-pack. If you have ever tried to lift a huge carton filled with books, you know exactly what I mean. At Two Men and a Truck – Canada,, we have a simple rule of thumb: the heavier the item, the smaller the box. Another great tip is to wrap small items like knick-knacks in coloured tissue paper before surrounding them with packing paper so that you don’t accidentally throw them out when unpacking. Trust me, it’s easy to do with little things. Over-packing also applies to cramming too much into one box. Remember that as carefully as you pack them, items can shift in transit. If packing is not your thing, your mover will give you an estimate to do the packing for you. Leaving it up to the professionals takes a lot of the worry out of packing. You might want to let your children pack their own toys and games, so they feel important in the move and are assured that their items are coming with them. Be sure to take legal documents, medical records, expensive jewelry and any other pertinent papers and possessions with you personally. Keep in mind that a professional moving company cannot transport hazardous materials such as flammables. Think carefully before you decide to move these potentially dangerous items. Be sure to label boxes on the top and on the sides to make it easier for whoever is distributing the cartons in your new home. Pack an essentials box of things you will need as soon as you move in and label it accordingly. When it comes to moving a lot of items, a little common sense goes a long way.

It’s the little things that count when Living Green Together BY TED WHITEHEAD

AT THE FEDERATION OF RENTALHOUSING PROVIDERS OF ONTARIO (FPRO), we are proud of our established Certified Rental Building Program (CRBP), and the component we added in 2013, called Living Green Together. The new environmental practice standards embrace the best interests of tenants and the environment. When choosing a Certified Rental Building, consumers know they will be living in a residence that has a Property Manager and Staff who take steps to ensure a good quality of life for tenants and who are working to minimize the environmental impact of their daily operations. Our program is called Living Green Together for a reason. We ask tenants in our Certified Rental Buildings to be part of our environmentally responsible community. The small efforts individuals make on a daily basis add up to big energy, waste and water savings. For example, did you know that a tap that leaks one drop of water per seconds will waste more than 25 litres of water in a day? So it is critical to report dripping taps and leaky toilets as soon as possible, so your property manager can see to the repair quickly.

When it comes to waste, be aware that every person in Ontario produces over 5.5 pounds of waste per day. Recycling cuts down dramatically on this figure. As a rental building tenant, you can do your part to help by recycling paper, plastic, aluminum and glass. Remember that one pop can takes 300 years to break down in a landfill site. If your apartment building has an organic waste program then recycling is even better. You may not realize that organic waste in landfill sites helps to produce 38 per cent of Canada’s total methane gas emissions, which are far more potent as a greenhouse gas than carbon dioxide. There are many other ways you can lower your personal carbon footprint, such as recycling batteries, taking public transit when it is available, and replacing disposable items with reusable ones. Taking those cloth bags shopping makes a lot of sense as does purchasing a reusable coffee filter! Again, these individual efforts may seem trivial, but think of it this way: if millions of people each take steps to lessen their water and energy usage and waste production, the overall results are astounding. When we work together, we make a real difference in protecting our environment and creating greener apartment communities. On the subject of water, other positive practices you and your family can embrace are to turn off the tap while brushing your teeth and shaving, shower rather than bathe (shower uses approximately 83 litres of water; a bath around 220 litres), and keep drinking water in the fridge rather than running the tap until it comes out cool. Lower energy bills benefit everyone. For example, use energyefficient light bulbs over incandescent bulbs, and by the way, your mother was right – turn off the lights when you leave a room. Lower your thermostat at night and when you go out, RentersGuide.ca and cook in a microwave or toaster oven rather than firing up your stove. Unplug electrical devices when not in use. This may sound trivial, but on average, 40 per cent of electricity used to power home electronics is consumed while these units are in standby mode. RentersGuide.ca

Tips for LIVING TOGETHER BY JANE HERMAN

CONTRARY TO WHAT YOU MIGHT THINK, there are actually a number of similarities between living with your first roommate, someone you’re involved with romantically, or someone you’ve just met through an ad and are sharing an apartment with in a new city. Your approach should reflect what it would in any interpersonal relationship. Be considerate of the other person’s needs and strive for good communication. FURNISHING: The first issue you’ll need to address if you decide to live with someone is how the apartment will be furnished. One – or both – of you may have furniture. Whose stuff do you keep and whose stuff gets stored or sold? Conversely, you may need to acquire a lot of the furnishings and housewares you’ll need to live in your apartment. You need to discuss in detail how you will make decorating purchases and decisions. If you RentersGuide.ca provide something, and your roommate or a guest damages something, who would be responsible? If you share the costs, who owns what if and when you move on? EXPENSES: As roommates, discuss RentersGuide.ca beforehand how you will be paying your rent. 82

Will one person make the payment each month and the other pay the roommate half the amount? Will the landlord take cheques from each? Or will you use another arrangement? If a last month’s rent deposit is required, it’s easier if each tenant puts up half, in case one person wants to move out before the other one. And moving out should have its stipulations too. Enough notice that nobody is scrambling to find a new roommate and enough notice to change things up with the landlord. There are legal obligations when all parties are listed on the lease. What about your hydro, Internet and cable (and land line, if you have one)? Will one person be responsible for paying all the bills? How will they be split up? If you’re a couple and there is disparity in your incomes, clarify the financial expectations before signing your lease. Are you at the point where your finances are blended or do you want to maintain clear, separate responsibilities and obligations. CLEANING: This is an area that often causes problems when living with someone. One person can be compulsively neat and the other careless and sloppy. Here I think discussing the issue beforehand (especially if you’re looking for a roommate) can help to ensure greater success down the road. Ask your potential roommate how clean you like/need the apartment to be. Clarify at the outset who will clean the bathroom(s) and how frequently; take out the garbage and recycling, or vacuum the living room, and when. Create a chart or a check list and stick to it. Or, discuss sharing the cost of a cleaning service if you need it to keep everyone happy. PERSONAL SPACE AND PERSONALITY: Everyone needs some private space and time. When looking for a roommate, let them know if you are the type of person who has the TV on all the time, if you always have music on or if you need silent time or like to spend your evenings curled up with a good book and a glass of wine in the living room. Do you need quiet, early evenings or are you a noisy night owl? What about guests? Be sure to discuss your lifestyle preferences with your roommate so there won’t be any surprises. For example, do you like to have a lot of friends over regularly, or are you the type of person who goes out after work and tends to come home late in the evenings. Would you be put out if your roommate had their boyfriend or girlfriend over all the time or a friend occupy the guest room regularly? Is it something you often do? Having constant guests can wear on the roommate relationship because a guest will enjoy the living area and use the home without having any financial responsibility. Ground rules are a good idea. FOOD AND INCIDENTALS: This is more of a challenge between roommate rather than those who have blended finances. Will you share the cost of food – and the work involved in preparing and cleaning up meals? It can be highly impractical to have two containers of everything. If you are a vegetarian or have food allergies, it would be pragmatic to cohabit with someone who is sensitive to your situation. Do you share leftovers? Do you have a strict ‘replace what you take’ policy? Are you going to have a ‘communal kitty’ where you each put a specified amount each week to cover the cost of frequently replaced items you share, like toilet paper, dish soap and light bulbs? Decide before issues arise. A secret to successful cohabitation is understanding the other person’s goals and expectations, and also being like-minded on some of the items that RentersGuide.ca could be major issues. Good relationships are the result of commitment, consideration, communication, and compromise. The more you know about yourself, your partner and the realities you’ll face together, the greater your chances of success.

HERE ON RENTAL RANTINGS WE LOVE TO RANT about how terrible our neighbours are. Tall tales of the upstairs neighbours converting their apartments into bowling alleys (well, that’s what it sounds like!), and horror stories about the kid next door who never stopped throwing a ball against a wall are among some of my favourite rants ever heard. But have you ever stopped to think that maybe you’re the bad neighbour? Even if you have the noise in your home under control and you make an effort to carry on polite conversion in the elevator, you may still be doing some things to upset your neighbours. If you’re crunching your teeth together by the end of this column thinking “whoops!” thankfully there’s nothing some cake can’t fix. Brush up on your baking skills because if you do any of these things you’re a bad neighbour: WHAT’S THIS, FREE WI-FI? Wireless internet may be available free of charge at just about every corner café, but stealing your neighbours wi-fi is not a RentersGuide.ca neighbourly right. In fact, you may be going over their bandwidth and costing them extra dollars on their Internet bill at the end of the month. You might never get caught –or you might. Either way, this definitely makes you a RentersGuide.ca bad neighbour.

THE GROCERY STORE NEXT DOOR I’m happy to hear you get along with your neighbour. In fact, you get along so well, you don’t mind popping over to borrow a cup of sugar – and eggs, and milk, and coffee, every other day. Your neighbour is very friendly, but don’t take advantage of their kindness, especially if they don’t ask you for anything in return. Do your groceries at the supermarket and not next door. GOSSIP GIRL Who’s not guilty of a little bit of building gossip? Keeping an open ear in the elevator is one thing, starting an affair rumour in the building is another. Don’t be the building’s Gossip Girl, and let neighbours form their own opinions about other people. In the long run, being a building gossiper just makes you look foolish and untrustworthy. THE DECORATOR Of course you think your Halloween, Christmas, Easter, Passover and whatever other accumulated holiday decorations you have are awesome, but maybe your neighbour doesn’t. Decorate the inside of your home as much as you want, just don’t impose your decorations on your neighbours every holiday season by hanging ornaments outside your door and balcony.
