ar too many people, it seems, have a moving horror story.

Not just tales of damaged possessions, delayed deliveries or unavailable trucks, but far worse instances of outright crime. Moving company ripoffs, in fact, are one of the top scams monitored by the Better Business Bureau (BBB).

After saving for a down payment, paying lawyer’s fees and other costs associated with buying a home, who can blame buyers for wanting to save a few bucks on the one area they likely feel they can tackle themselves, or by hiring a discount mover to do the job on the cheap?

The problem with the latter choice, especially, is the high risk you run in falling victim to the various schemes employed by unscrupulous moving companies. To protect yourself, the Canadian Association of Movers, which holds members to a strict code of ethics, urges consumers to research prospective moving firms: contact the CMA for checklists and referrals, as well as other sources such as Industry Canada and the BBB. Moving into a new home should be an exciting and celebratory experience. Ensure it remains that way by not cutting corners on this last important step.

World on Yonge is a great example of a complete community at Yonge and Steeles in south Markham. The 10-acre, mixed-use project by Liberty Development Corporation is comprised of more than 1,200 condo units in four residential towers, retail shops, office space, a hotel, a landscaped courtyard and two acres of sustainable Green rooftop space.

This community was named BILD’s Places to Grow Community of the Year in the highrise category in 2011.

Liberty has aspired to create a walkable, liveable community where residents can have a lot of their needs tended to by the surrounding buildings on the site plus have quick access to public transit, highways and golf courses.

“Your friends come from out of town, they can stay at the hotel. If they need to shop, they can go to the mall. You want to work steps from home, you work at the office building. If you want to have a business meeting, you can grab a coffee and sit on a park bench for five minutes,” says Marco Filice, senior vice-president and general counsel at Liberty.

“World on Yonge is a true mixed-use community in compliance with (provincial growth plan) Places to Grow 20 years ahead of schedule.”

Out of the site’s 1.6 million sq. ft. of space, about 600,000 is non-residential. Filice says the site will achieve more than 1,000 people and jobs per hectare, nearly five times the provincial targets.

Perhaps the most impressive characteristic of World on Yonge is the Green roof on the three-level retail mall called Shops on Yonge. It is a 1.5-acre greenspace that helps reduce

the heat-island effect of the surrounding buildings and plays a big role in collecting rainwater into a 60,000gallon cistern on the site. This reservoir reuses the water for grass, plants and public toilets, and saves public infrastructure cost.

Filice adds that today’s new-home buyers are impressed with Liberty’s Green initiatives.

“We try to provide a sustainable development, recognizing buyers are attuned to living in spaces that are good for the environment and provide benefits for the community,” he says.

“There’s also two acres of new public parkland on site. Over 40 per cent of the site is either parkland or green roof technology.

“We want to set a proper path for our children so that we have the proper resources in place for the next generation. Maybe this project will inspire others to do similar things. It’s an example of what’s to come for a city that’s growing up.”

Filice says World on Yonge would not be a reality without the support of the City of Markham and Region of York.

The 10-storey Liberty Suites Hotel will open this summer. The last of the residential condos, Parkside Towers, will begin occupancy this fall.

Occupancy is already completed for the site’s two 31-storey towers, the tallest in York Region.

This development is truly a remarkable example of a complete community where you can live, work, play and shop.

Buying a newly constructed home in Ontario comes with the security of knowing you have somewhere to turn if your home has defects or building code violations. Your home’s mandatory warranty is provided by your builder and backed by Tarion.

Although it is often lumped into one warranty for simplicity sake, in actuality, all new homes in Ontario come with deposit protection and delayed closing or occupancy compensation, in addition to three separate warranties. The warranties begin the date the home is completed for possession but end at different times and cover different items.

While it is the builder’s responsibility to ensure he or she builds a home that is properly constructed and free from defects, it is the homeowner’s responsibility to identify any defects within the warranty time frame. The question we are often asked is, “What am I supposed to be looking for?” Just because you own a home, doesn’t mean you are an expert in new home construction. Knowing what to look for and when will help ensure your home’s warranty provides protection when and if you need it.

In the first year, your home’s warranty covers defects in work and materials, ensures it is fit for habitation and is constructed according to the Ontario Building Code. The first year warranty includes almost everything inside and outside your home that was provided by the builder. During the first year, it is essential to keep a keen

eye on the condition of your home, as this is the most comprehensive warranty of the three.

Some of the things you should be looking for are cracks in flooring, drywall or outside cladding, missing roof shingles and all finishings within your home. Electrical and plumbing fixtures are covered under warranty for the first year only, so if there is a light that does not turn on or a faucet that isn’t working properly, this should be noted within the first year. The same is true for heating and air conditioning appliances. Inspect your home’s equipment to ensure it is working properly within the first year.

The two-year warranty protects against defects in materials including windows, doors and caulking to prevent water penetration into the home. This warranty also covers defects in electrical, plumbing and heating delivery and distribution systems and the exterior cladding of the home.

In addition, violations of the Ontario Building Code that affect health and safety are covered for two years.

Within the first two years, inspect your home to ensure there is no water seeping in. Water can enter from many places in your home, but generally the basement is the most common place for water penetration.

Finally, the seven-year warranty covers your home from major structural defects. This includes the failure of a load-bearing portion of your home. You’ll want to look out for major cracks in your home’s foundation or exterior cladding, interior separation of drywall between ceilings, walls and floors, large gaps in interior finishings, or movement in the basement floor. A recent survey by Equifax Canada revealed some rather startling facts – chief among them that many Canadians have no problem falsifying financial information when applying for a mortgage.

By “many,” we mean 10 per cent of respondents. That may not sound like a lot, but considering the implications of these actions, it’s a surprisingly high number.

Indeed, one in 10 Canadians mistakenly believes it’s okay to inflate their annual income when applying for a mortgage, according to Equifax. Nine per cent admitted they hadn’t been entirely truthful on a credit or loan application.

“Make no mistake, lying on your loan application is a type of mortgage fraud,” warns Tim Ashby, vice-president, personal solutions, Equifax Canada.

This is what’s known as first-party mortgage fraud, a growing problem in which applicants misrepresent their financial circumstances by fudging earnings, pay stubs or worse, lying about their employment situation altogether.

Lenders, regulators or police to date haven’t taken this sort of “soft fraud” seriously. Lenders care that the mortgage is serviced and in good standing, and as long as that’s the case, no red flags will be raised.

But if there was a meltdown in the housing market, where, hypothetically, values dropped materially, or mortgage rates increased significantly, and either situation resulted in a spike in homeowners who could no longer afford their homes… These are the potential scenarios, experts warn, that could lead Canada Mortgage and Housing Corp. to further tighten mortgage qualification rules.

Another situation that could have an impact on the mortgage landscape is the investor component. CMHC

recently released its 2013 Condominium Owners Survey, which revealed 17.1 per cent of the condominium owning households in Toronto and Vancouver are investors.

While welcome insight into this otherwise not well known sector of the market, the survey raises two key issues: many observers believe the investor component is actually much higher – something in the neighbourhood of 30 to 40 per cent; and the percentage of foreign investors versus Canadians.

Why does this matter? Purely in a market sense, the fear is that condo investors could be susceptible to a massive sell-off should the market experience a downturn. Secondly, the concern is that some of these investors, at least those taking out mortgages from Canadian lenders, are buying these units without disclosing that they actually plan to rent them out.

This, technically, is another type of mortgage fraud.

The bottom line in all of this?

Equifax and other experts stress that consumers should always be honest with their personal data on applications, and most importantly, borrow only what you can repay.

Summer, without a doubt, is one of the busiest times of the year for homebuyers to jump into (or move around within) the housing market. Depending on the length of the term you chose, if you purchased a home as far back as the summer of 2009, your mortgage is likely going to come up for renewal soon. If they haven’t already done so, your lender will start popping early renewal notices into your mailbox – usually within the last 30 to 120 days of your current mortgage term.

And while the renewal slip makes the process all too easy (you just sign the offer and send it back), it’s not in your best interest to accept this offer.

For starters, the lender who had the best mortgage rate for you before is almost never the same lender who will have the best mortgage rate for you at renewal time. It’s sad – if you’re someone who stays loyal to lenders, that is – but true.

rate – that’s nothing, in comparison to the rates you can find online or from mortgage brokers across Canada.

Unfortunately, lenders market their renewals as being easy and convenient, which is something most consumers are attracted to. But how much would it hurt to later find out you could’ve gotten a full one per cent or more off your rate, if you’d taken the time to shop around and negotiate?

Besides just the mortgage rate, it’s also unlikely that your current lender will be the one to offer you the best mortgage product for your needs at renewal time. Think about it this way: your financial goals from when you took on your current mortgage term were likely much different than what they are today, right? You could be at a completely different stage in your life now. Well, the same can be said for your lender. It’s convenient to stay with your current lender, but the terms and conditions your existing lender offers may no longer suit your needs. Consider all your mortgage needs – the rate and prepayment options – and go with the lender which can offer everything you’re looking for.

One thing to keep in mind: if you don’t renew your mortgage with a new lender before the date your current mortgage term expires, your lender will automatically renew you for another term with them. A week isn’t enough time for most mortgage brokers to switch your mortgage from one provider to the next, so start shopping around early and make sure you find the best mortgage rate/product for you.

Hopefully, you made a profit! The real estate market has been healthy for the past several years and continues to be strong, over the long term. Selling a real estate investment property will generate either a capital gain/loss or a recapture of income/terminal loss.

You will have a capital gain when the proceeds of the sale exceed the original cost of the property. A capital gain must be included in your personal tax return (if you own it personally) and is taxed on 50 per cent of the gains at your personal tax rate. A capital loss occurs when the cost is greater than your proceeds. The capital losses should be included on your personal return and applied against capital gains in that year. Any excess losses can be carried back three years, or carried forward indefinitely to reduce capital gains.

In calculating the capital gain/loss, determining the adjusted cost of the property is an essential factor. The adjusted cost must include not just the purchase price but also other costs incurred that had to be capitalized. As well, the proceeds of disposition are all the cost, including the selling price and adjustments pertaining to the sale of the investment.

In addition to the capital gains/losses, you may have a recapture of income. This occurs when you are taking Capital Cost allowance (depreciation) on the building, in any of the years that it was owned by you. The balance in this account is called the â&#x20AC;&#x153;undepreciated portion.â&#x20AC;?

A recapture of income occurs when the lesser of the proceeds and the cost of the property is higher than the Undepreciated Capital Cost (UCC). The recapture of income is taxed in its entirety at your personal tax rate. Alternatively, a terminal loss occurs when the lesser of the proceeds and the cost of the property is less than the UCC. This terminal loss can be applied in the current year to reduce other income (such as salaries or business income). Any unused amounts can be carried back three years or carried forward.

Good record keeping is essential to calculate the correct gains or losses.

Before you go new-home shopping, visit your bank, trust company or other financial institution to see what amount of mortgage you qualify for.

Take your significant other, if you have one, because everyone’s income and assets help. Once you know how much you can borrow, secure the best rate you can and lock it in for as long a period as possible. Don’t be afraid to negotiate – the banks want and need your business.

Don’t be afraid to shop around for rates and lock-in periods.

You should also visit the sales centre armed with your knowledge and check what mortgage rate and term the builder is offering. Take note that the builder may have brought the rate down to make his package more attractive or forced his bank as part of his deal with them to offer special rates. Remember, if your bank’s offered rate and terms are

close, you may be able to negotiate a better deal with the builder. If you do not take the builder mortgage you may be able to get some leverage in your overall negotiations as the builder may save money by not having to pay his bank for the better rate. Question this and make sure you understand all of the financing details. Regardless of where you go to get financing, get your commitment in writing!

When we walk into that sales centre, all ready to buy our beautiful new home, perhaps the most important piece of the puzzle we need to have is security in our financial arrangements. A tragedy waiting to happen occurs when you sign an unconditional offer, give your hard-earned, harder-saved deposit to the builder and later find out you do not qualify for the mortgage. In other words, don’t buy the home unless you have a mortgage commitment or a conditional deal. This leads us into the next part of the discussion – what happens if it goes wrong?

An Agreement of Purchase and Sale for the purchase of land is a contract, and once it is signed it binds both parties to certain obligations. If either party does not hold up to their end of the arrangement, they can be held liable to the other party for either specific performance or damages.

Firstly, if the purchasers default, they will likely lose their deposit. The builder will then have the option of suing to force them to close the deal and pay all legal fees related thereto, or sue them for any damages the builder might suffer before he resells the condo (for items such as interest, changes and price differential) and legal fees. Sometimes, in a booming market, kindhearted builders will release purchasers who have made a mistake or encountered personal tragedies. But don’t count on it!

The moral of the story is to make sure you have financing or that the offer is conditional for a few days on both financing and review by a lawyer. It is critical you get the right advice, and only a lawyer can provide legal advice – that is the law. When you select a lawyer, find one who cares about you and a long-term relationship.

Moving comes with a mix of emotions that can be overwhelming. You may feel excited to live in a new home, but getting all your possessions moved can be stressful. The key to having a smooth move is staying organized and following a schedule similar to what the pros use.

THREE TO FOUR WEEKS PRIOR TO MOVE DAY 1. Estimate how large a rental truck you’ll need. In general, allow 150 cu. ft. of truck space for each fully furnished room. For example, a 12-ft. truck offers 450 cu. ft. while a 26-ft. truck offers 1,400 cu. ft. for your items.

2. Get the packing supplies you need. Save time by ordering your moving supplies like boxes, labels, bubble wrap and packing tape online early. Sometimes, you can collect boxes at work or ask your local grocery store if they have any you may have.

3. Start packing. Begin with out-of-season and non-essential items. Remember to label boxes clearly. This is also a good time to lighten your load. If you haven’t worn or used it in a year, donate it to charity.

ONE DAY PRIOR TO MOVE DAY 1. Finish any remaining packing. Reserve one box for essentials which will be the last box you pack and likely the first one you open at your new destination. Include items like checkbooks, credit cards, IDs, glasses, prescription drugs, house keys and other necessities.

2. Pick up your truck rental the day or evening before the move to save time on moving day. today it sits at about 187,500 and is expected to exceed 200,000 by 2015.

Even with such progress, Richmond Hill retains its friendly community feel, earning the unofficial motto of “a little north, a little nicer.”

Residents certainly seem to appreciate all the town has to offer: in a 2012 Community Survey, 94 per cent of respondents said they are satisfied with Richmond Hill as a place to live. Eighty-five per cent feel it is a welcoming community, while 78 per cent indicate diversity is one of its strengths.

“The survey results are very positive and are true to our Strategic Plan vision and goals,” says Barrow. “These results show that our residents feel connected to the town and each other.”

LANDOWNERS GROUP PRESENTS FUNDS TO SOUTHLAKE HOSPITAL A consortium of the GTA’s most respected developers and builders recently presented a cheque for $750,000 to representatives of Southlake Regional Hospital Foundation at a special reception at the Town of Aurora Municipal Offices.

Aurora Mayor Geoff Dawe, who was instrumental in organizing the donation, spoke as the guest of honour. Dr. Dave Williams and Neila Poscente accepted the group’s cheque on behalf of the Southlake Regional Hospital Foundation. The funds will be split between Southlake’s Images for Life, a diagnostic imaging technology campaign, and to support the future priority needs of the hospital.

The donation is from the Aurora 2C Landowners Group which is comprised of TACC Developments Inc., including Arista Homes, Fieldgate Homes, Opus Homes and Paradise Homes; Mattamy Homes; Brookfield Homes; Lindvest/ Aurora Glen; Meadows of Aurora (a Christian Seniors Lifestyle Community); Metrus Developments, CountryWide Homes, Greenpark Group of Companies, Royalcliff Homes; and Treasure Hill Homes.

The development of the lands west of Bayview Avenue commenced in 1993 and the area known as Aurora 2C represents the last major residential development opportunity in the Town of Aurora. Rarely have new home developments taken so long to come to fruition. Decades of planning will result in a very special community.

The Town and the builders/ developers of the Aurora 2C lands are committed to incorporating a variety of green design features and building technologies in the Aurora 2C community, including the use of energy efficient systems, environmentally-friendly materials, water conservation measures, improved air quality and more. Ultimately, this community will be a place where new residents can put down roots, establish proud new family traditions and watch their children flourish.

Homebuyers worry about protecting personal data Homebuyers are increasingly worried about protecting their personal data, according to a recent survey by Equifax Canada. A majority of Canadians (79 per cent) are more concerned today about safeguarding their personal information than a year ago.

“Consumers and lenders are certainly becoming more wary of the potential threats related to fraud and identity theft,” says Tim Ashby, vice-president, personal solutions, Equifax Canada. “In the home-buying process, a lot of personal data is on the table when dealing with mortgage brokers, real estate agents, and lawyers among others.”

Most consumers (81 per cent) believe that lenders should be doing more to protect them from fraud and identity theft. The survey, however, also examined how truthful Canadians are when looking to secure a home loan. One in 10 Canadians agreed it is okay to inflate their annual income when applying for a mortgage and nine per cent agreed that they had not been entirely truthful on a credit or loan application.

Make no mistake, lying on your loan application is a type of mortgage fraud,” says Ashby. “Whether you’re a lender or a consumer, data protection and the integrity of the data should be priorities at all times. For the consumer, it’s not just a matter of protecting your information, it’s critical to know what’s on your credit file – especially when looking to buy a new home.”

“Tens of thousands of extra dollars are being spent to service a mortgage simply because people don’t know their credit score,” says Ashby. “Maintaining a healthy credit report by paying bills on time will go a long way in securing a loan at a lower interest rate.”

An Equifax credit score ranges from 300 to 900. Higher scores are viewed more favourably. Most Canadians (71 per cent) have a credit score of 725 or higher, which is considered to be Very Good or Excellent.

Ontarians tops among Canadians

IN TERMS OF PAYING DOWN THEIR MORTGAGES FASTER A new CIBC poll finds there has been a significant decrease in the number of Canadians using today’s low interest rates as an opportunity to accelerate repayment of their mortgages.

Ontario residents, however, are among the tops in the country at taking actions to pay down their mortgages faster.

While more than half of Canadians with mortgages (55 per cent) are taking one or more actions to pay their mortgages down sooner, a similar poll last year found that more than two-thirds (68 per cent) were taking steps to accelerate their repayments. The poll also finds Canadians with mortgages saying, on average, that they will be 58 years of age before they become mortgage-free.

KEY FINDINGS OF THE POLL INCLUDE:

» 5 5 per cent of Canadians with mortgages are taking one or more actions to repay their mortgage faster, down from 68 per cent in a similar poll last year » A mong those taking some action: • 3 2 per cent accelerated their payment frequency (down from 42 per cent in 2013) • 2 8 per cent increased their payment amount (compared to 30 per cent last year) • 1 8 per cent made a prepayment / lump sum payment (15 per cent in 2013) » 5 8 is the average age that Canadians with mortgages expect to be mortgage-free, a small increase from age 57 in last year’s poll “A mortgage is the largest debt most Canadians will take on in their lifetime, and being mortgage-free is an important goal for many,” says Barry Gollom, vice-president, secured lending and product policy, CIBC. “With current low interest rates, this may be an opportune time to make progress against your mortgage – even a few small changes can make a big difference in the length of time it takes to pay off your mortgage and the amount you pay in interest charges.”

Recent research from CIBC shows that Canadians are spending more this year on other items such as home renovations (up 30 per cent from a year ago), and summer vacations (up 20 per cent from last year).

“With mortgage rates remaining relatively stable and at historic lows for the last few years, some Canadians may not be as focused on paying down their mortgages as when interest rates are higher,” says Gollom. “Generally, paying off debt as quickly as possible is a smart decision, but you do need to ensure you’re not focusing on your mortgage at the expense of your other financial plans, or by increasing debt elsewhere.”

Here are some specific examples to show how the savings can add up, using a mortgage of $250,000 (the Canadian average), with a 4.99-per-cent interest rate and a 25-year amortization, and regular monthly payments of $1,453: » I ncrease payment amount: Taking the regular monthly payment amount and topping it up by $147 per month would save you four years and $34,362 in interest on your mortgage. »A ccelerate payment frequency: Most Canadians are paid every two weeks; aligning your mortgage payments with your pay deposit and making accelerated bi-weekly payments of $726 would result in saving four years off the life of your mortgage, and a reduction of $30,970 in interest charges. Combining this with increased payments as above (an extra $74 bi-weekly) would together save you seven years and $57,182. »M ake pre-payments/lump sum payments: Not a lot of families have a few thousand “extra” dollars lying around, but even using your annual tax refund towards your mortgage can make a difference. The average Canadian tax refund is $1,600 – applying that amount to your mortgage each year would reduce the amortization by four years and save you $33,103 in interest. Using all three of these strategies in combination would shave nine years off the life of your mortgage, and result in total savings of $73,785.
