uying a brand-new home offers you an opportunity to customize it to your liking. It can be a dream come true and an investment for the future – but don’t forget, it’s also legal transaction. The term “get it in writing” has never been more important in the case of the new-home purchase, since such a document outlines everything your home will have in it, on it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms and conditions between you and your builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon. Since building a home is much more complicated than a resale transaction where the unit and/or property likely already exists, there is
no set Agreement of Purchase and Sale or standard contract for buying a new home. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their new-home warranty program. Builders often prepare their own agreements, so contracts can vary from one builder/ developer to another and from province to province. Before you sign a contract, review it carefully with the builder and ask questions to make sure you fully understand what it contains. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document and an agreed-upon contract, so seeking the services of an experienced real estate lawyer is an important step toward ensuring that your dream home becomes a reality.
Ask those taxing questions Whether from your mortgage broker or financial advisor, the right answers could save you hundreds if not thousands

hen you’re buying a home, particularly your first home, you will need the advice of several professionals: builder, lawyer, mortgage broker or banker, financial advisor and so on. But none of them has the personal stake in the deal that you do. Indeed, it is your transaction, your future and, ultimately, your money. This is why it’s essential to ask questions. Don’t understand something? Ask. Don’t get a satisfactory answer? Ask again. Take this scenario brought to our attention by Alyssa Richard, CEO of ratehub.ca. First-time buyers who are looking to buy together with a buyer who is not a first-timer, can still use the Home Buyers’ Plan to withdraw $25,000 from their RRSP, tax-free, for a down
payment. But they cannot claim the FirstTime Home Buyers’ Tax Credit of $750. “Another surprise had to do with land transfer tax rebates. In Toronto, qualifying first-time homebuyers can claim a total rebate of up to $5,725 for both the Ontario and Toronto land transfer tax. If you’re buying with someone who is not a first-time homebuyer, many first-time buyers assume they can’t claim those rebates. But you can – 50 per cent is yours to claim.” Instead of being able to claim the full rebate of $5,725, you could claim $2,862.50, which of course is better than nothing.” Whatever your own circumstances, take the time to ask those challenging, if difficult, taxing questions. The answers could save you hundreds if not thousands.

Investment-ready communities
are the next step for home building » by bryan tuckey This column often addresses the problems that new-home buyers and the home building industry face.
Bryan Tuckey
is President and CEO of the Building Industry and Land Development Association (BILD) and is a land-use planner who has worked for municipal, regional and provincial governments. He can be found on Twitter (twitter. com/bildgta), Facebook (facebook.com/bildgta) and BILD’s official online blog (bildblogs.ca).
I would like to start proposing solutions that will help overcome some of these hurdles and ultimately make new homes more affordable for the 100,000 people who come to the GTA every year and want to make the largest purchase of their lives. We don’t claim to have turnkey solutions that will unlock the industry and make new-home buying easy. It is a complicated process that requires knowledge, innovation, preparation and, most of all, patience. However, we think the concept of investment-ready planning deserves a serious look if not as a solution than as an innovation that opens up discussion on making new homes more affordable. Ultimately, new-home buyers should know that investment-ready is a concept that would streamline the homebuying process, cut red tape and save them time and money.
Investment-ready means businesses and developers can make quicker decisions on selecting sites, and that would lead to a faster approval process for greenfields, intensification and other projects. Premier Kathleen Wynne announced an investment-ready program last August, calling it “Canada’s first province-wide certified site program.” “It shows companies around the
14 New home guide GTA | february 8 - 22, 2014
world the places in your municipalities that are ready to be developed, giving them some certainty about environmental concerns, utility lines, servicing access,” the premier said at the time. “It means businesses can quickly make more informed decisions and help expansion projects get underway sooner. For municipalities, it provides another tool to promote your communities, attract new investment and foster growth. It does that upfront work that’s so critical.” Investment-ready means businesses and developers can make quicker decisions on selecting sites, and that would lead to a faster approval process for greenfields, intensification and other projects. In fairness, clearing red tape is one of the planks of PC Leader Tim Hudak’s Million Jobs Act. Streamlining the building process is all about cutting red tape to get to outcomes, and investment-ready communities focus those desired outcomes to attract economic investment and building complete communities. Investment-ready planning is also a solution offered up by the land development and home-building industry during the 80-day consultation of the land use planning and appeals system, which ended on Jan. 10. In a document from the Ontario Home Builders’ Association and supported by BILD, we state that investment-ready communities are “necessary to compete for new global investments or changing economic forces.” But there’s a gap between the province and many of its municipalities that has led to implementation delays and extra costs: Official Plans and zoning bylaws often don’t conform to the provincial Growth Plan. To give Ontario an advantage in the global economy and create investment-ready communities, a logical step would be ensuring that municipalities update their local Official Plans every five years and zoning bylaws within three years of an OP update. That will lead to more certainty and fewer building delays, fewer appeals to the Ontario Municipal Board and a stronger economy. And that means less time and money spent by new-home buyers and businesses. I think we all want that.

It was almost one year ago – March 2013 to be exact – that Target Corp. began opening the first of its approximately 125 store openings in Canada. The U.S. retail giant announced in 2011 it was moving north with a $1.8-billion acquisition of up to 200 Zellers store leases, with most of the initial openings coming from renovating existing Zellers locations. While the expansion may not have gone quite as planned, with Canadian consumers not exactly enthralled with Target’s product offerings and pricing strategy, there’s no question the move will continue to have a significant impact on the Canadian retail landscape – particularly as the company builds greenfield outlets in new locations. Now comes news that Wal-Mart plans to spend $500 million completing 35 supercentre projects over the next year. The U.S. retailer says it will spend more than $376 million to build, expand, relocate or remodel stores, as well as invest additional funds on operational improvements. For homeowners and prospective homebuyers, this is all good news – and a very good reason to pay attention. Such major retail developments are a significant influence on land development and housing. When the likes of Target, Walmart, RONA and other major players set up shop, particularly in a new location, it’s a good sign an area could be on the upswing. Like proximity to mass transit, schools and other amenities, being close to shopping is a major attraction for builders and, of course, prospective homebuyers. These features are among the key determining factors to enjoying your home while you live there, as well as for potential resale value in the future. Large retailers and commercial ventures don’t just pop up in the middle of nowhere or in declining neighbourhoods. These companies make careful, long-range and well plannedout decisions in lockstep with municipalities and developers, based on hard data, research and demographic information. This is why major retail expansion is good news: it’s an indicator the economy continues to strengthen; and, for those looking to buy a home, it’s a sign to look out for new or

expanding neighbourhoods and solid buying opportunities. Such retail developments, combined with the associated employment gains and economic and infrastructure improvements, point to new and expanding homebuying options. So, while you’re out there looking for your new home, look around for the big box stores. If they see a bright future for your prospective neighborhood, chances are it will make a sound buying decision for you.

Calculating capital gains tax » by henry choo chong
Q
.I recently purchased a new home from a builder in north Toronto. Occupancy is in November and I expect to complete transaction in March of next year. My sale price was $40,000 more than the initial purchase price. I have never lived in the property. Thus far, it has all been handled by my lawyer. Will I have to pay capital gains tax on this? How much and can I claim the lifetime exemption? Brian, Scarborough

Capital gains tax is charged on the profit realized from the sale of non-inventory assets. Most common assets are stocks, bonds and real estate. Currently, the income inclusion rate is 50 per cent. The taxable inclusion rate has bounced from inception 50 to 75 per cent, to 66 per cent, to its current rate. Therefore, an individual with capital gains must include in his/ her personal tax return, 50 per cent of the capital gain. Yes, this can add up to be a large chunk of change and reduces your actual after tax rate of return on your investment. Where did this tax come from? You say, many countries do not have this! Canadians were first introduced to capital gain tax in 1972. The Canadian government claims this was necessary to finance our social security programs and create a more equitable taxation system. Almost 40 years since and it is still around. Don’t you feel more secure about your social security and equality in our tax system? Some countries such as Belize, Barbados, Cayman Islands, Egypt, and Hong Kong have no capital gains tax. On the other hand, there are many countries with similar taxation to Canada’s such as Bulgaria, Denmark, France, Finland and Iceland. Regardless, if you actually move in or not, you will be subject to capital gains tax on your sale in the year the transaction is completed. Individuals that purchase new or resale homes are treated no differently. Mr. Harper wants his share of the profit.

Using a marginal tax rate of 40 per cent in the example; ›› Capital gains $40,000 ›› Taxable capital gains (50%) $20,000 ›› Tax rate: 40% ›› Taxes payable: $20,000 x 40% = $8,000 Under certain circumstances the lifetime capital gains exemption can be claimed to reduce or eliminate capital gains. An individual that disposes of qualified farm or fishing property and small business corporation shares may claim an exemption up to $750,000. Your particular transaction does not qualify for this exemption. Some other issues you should ponder and discuss with a lawyer and/or tax professional: ›› GST/HST – how will investment be treated on closing? ›› GST/HST – are rebates available? ›› Land Transfer tax – How will this be managed at closing? ›› Is builder okay with this assignment? ›› Any issues with occupancy? Who takes? ›› Have you considered the cost of occupancy period?

More than a third of Canadians contributing to RRSPs well ahead of deadlines: BMO Many Canadians got a head start on saving for retirement this year, according to the fourth annual national Registered Retirement Savings Plan (RRSP) study from BMO Financial Group. More than one-third (35 per cent) of Canadians reported that they had already contributed to an RRSP before the March 3, 2014 deadline. This is up five per cent from this time last year.
Additionally, according to the study: » Sixty-four per cent of those who have already made a contribution have contributed at least $2,000 to their RRSP and 40 per cent have put in at least $5,000. » Forty-three per cent of Canadians reported that they will make a contribution to their RRSP by the March 3 deadline. This is down from the 50 per cent who made a contribution last year. » A lmost two-thirds (64 per cent) of Canadians have an RRSP, compared to 67 per cent this time last year. » One-third reported that they usually contribute the maximum amount to their RRSPs. » Last year Canadians contributed an average of $3,544 to their RRSPs. “It’s reassuring to see that many Canadians are being proactive by 38 New home guide GTA | february 8 - 22, 2014
contributing to their RRSPs well ahead of the deadline. However, according to Statistics Canada the total unused RRSP contribution amount is estimated to exceed $1 trillion by 2018,” says Caroline Dabu, vice-president and head of BMO Wealth Planning Group. “So we encourage everyone to contribute and contribute as early as possible to avoid the difficulties of having to come up with a large lump sum at the last minute.” Dabu adds that using a Continuous Savings Plan (CSP) to make smaller and regular RRSP contributions throughout the year can help alleviate some stress leading up to the deadline. A CSP regularly and automatically withdraws a specific amount of money from an individual’s bank account and invests it directly into his or her RRSP. It eases the cost of investing away from one annual deposit and helps increase savings. RRSP Investing Hurdles The study also examined the reasons why Canadians are not planning to make a contribution to an RRSP this year. These include: » Not having enough money to make a contribution (37 per cent) » Having other expenses which take precedence (33 per cent) » Prioritizing other investments (11 per cent) “It can be difficult to balance all of your financial priorities, whether it is paying down your mortgage, saving for your child’s education or putting money aside for your retirement,” says Dabu. “A financial plan can help you map out all of your financial commitments to help you prioritize. Also, a financial professional can help you understand your options, offer checkpoints to follow your progress, adjust your plan as your circumstances change and work with you to ensure you stay on track for success.”

//THE TAX MAN
The Smith Manoeuvre:
deducting mortgage interest » by George E. Dube
One of the largest expenses we have tends to be the mortgage on our home. Following traditional rules, we are limited to deducting, at best, a small percentage of the interest where we use a home office for business purposes. However, using non-traditional planning, we are able to deduct potentially 100 per cent of the interest costs. Your tax savings will vary based on where you live in Canada, your income

level and the amount of interest you pay. As a quick example, though, with a mortgage of $200,000 at 4.5 per cent, your tax savings could be approximately $3,000 per year. While this may not by itself create financial freedom, imagine receiving these savings year after year – with minimal effort required. Imagine the impact of a higher interest rate or larger mortgage. A popular nickname for describing some of the possible techniques is the “Smith Manouevre,” coined by Frasor Smith. A variety of versions of the plan exist, and vary in aggressiveness and implementation to suit your needs and comfort. With a Supreme Court decision related in part to questions surrounding the appropriateness of interest deduction plans, tax advisors have largely been given the green light to help clients restructure their affairs in an optimal fashion. In its simplest form, these interest deductibility techniques allow homeowners the ability to convert the non-deductible portion of the interest on their mortgage to fully deductible over a period of time. The period is typically several years, however, your financial situation and aggressiveness may dramatically decrease this time. A variety of mortgage products provide the ability to divide your mortgage into at least two segments, which allows you to track the interest expense on these segments separately. Your

total mortgage will typically be set at 75 to 80 per cent of the value of your home. If you are permitted a total mortgage of $200,000 on your home, you may start with the “bad” portion (non-deductible) of the mortgage at this $200,000 and the “good” portion (deductible) of the mortgage at zero. As you make payments on the mortgage, your principal on the bad mortgage will decrease, leaving you additional room to borrow on the good debt. In other words, your total mortgage may still be $200,000, however, it is divided between good and bad debt. So, what do you do with this good debt? You invest. Traditionally, this was

//make your move
Technology on the move » by Chuck Resnick Let’s face it, your electronic devices make the world go ‘round. Being in the moving business, we realize how important those items are to families.
Chuck Resnick is vice-president of marketing and operations, Two Men and a Truck Canada. twomenandatruck.ca
One of the most common questions we get is how to transport electronics safely, especially big-screen TVs. During a move, whether it’s across town or across Canada, it is important to give these items special treatment so they arrive in one piece and in good working order. The best advice we have for accomplishing this goal requires some forethought: keeping the original boxes and foam spacers the electronic items came in. That is truly the safest method for moving them. Of course, people rarely keep these boxes, so there are specialty boxes and crates designed specifically to move big-screen TVs safely. People who do their own packing and moving should be aware of how easy it is to damage one of these units. Spending a few dollars extra to purchase or rent one of these special boxes can make all the difference. Another thing to remember is that most of these television sets are mounted on wall brackets, and moving companies are reluctant to disassemble the wall mounts or assemble them at the other end. Usually, if something is going to go wrong, that’s when it will happen – and again, people rarely keep the installation instructions for the brackets. It’s far too chaotic on moving day to try and find instruction manuals. The best plan when preparing for your move is to take the TVs off the walls yourself ahead of time and have them ready to be packaged properly. Here’s a tip for anyone disassembling electronics for a move: Get your digital or phone camera and take photos of the wiring connections on the backs of the TVs, cable boxes, DVD players and the like. When it comes time to reassemble them, it will be much easier to reference how they were set up originally, saving time, stress and frustration.

44 New home guide GTA | february 8 - 22, 2014
The same goes for stereos and gaming systems. Many teenagers leave their entire gaming systems hooked up until moving day. It’s up to them to disassemble their systems and hopefully place them into their original packaging. If not, the best thing to do is wrap consoles in anti-static bubble wrap and place them into appropriately sized boxes so they won’t move around during the trip. In fact, this is the best way to treat most electronics items. That includes computers – especially desktop units. We have specialty boxes designed specifically for them that can be bought separately. If you choose not to go that route, then surround the unit with anti-static bubble wrap and place it into an appropriately sized box. And here’s a handy tip: pack the associated hardware with the electronic item. For instance, Place your computer’s mouse, keyboard, power cord, scanner and printer cables into the same box. When these items all arrive together at your new digs, you’ll be very glad you did!

Credit & debt management » by Calum Ross
As the credit system continues to evolve in Canada, consumers are getting increasingly confused with a greater variety of credit products from a greater variety of financial institutions. In fact, the average

Canadian gets more correspondence from financial institutions than they do from family and friends combined (what have we come to?). To further complicate matters, institutions are granting credit to consumers at a pace never seen before. The combination of increasingly sophisticated marketing techniques to consumers coupled with more and more available credit truly becomes too much temptation for many people to bear. Consumer debt is a major issue in North America. The concept of keeping up with the Jones has destroyed both people’s financial health and their personal lives. What I am here to tell you is that you don’t need to fall into this trap! Here are some simple guidelines that will prevent you from becoming yet another consumer credit victim: 01 Control spending by knowing exactly where every dollar goes. Tracking your spending habits in detail periodically will enlighten you in ways that you never considered. While doing this on a monthly basis is not realistic, try to do this in detail for at least one month a year. Helpful tip: If you and your spouse spend $3 per day on coffee, this totals $1,095 per year. Depending on your tax bracket, this amount could represent over $2,000 in pre-tax income. Is the free coffee at your office that bad?
02 Watch your liquidity closely. Liquidity refers to your or your family’s ability to pay its short-term debt obligations. Watching what available funds you have to pay upcoming debt obligations is fundamental to avoiding credit problems. Helpful tip: Think carefully before using purchase p rograms that require no payments for a set period. If you can’t afford to pay for it now, should you buy it? 03 Develop a realistic budget and live by it always. A good budget must have specific financial goals with a clearly defined time horizon. Be sure to take into account all of your payments, including loans, utilities and dry cleaning. If you pay for it monthly, it should be allocated in your budget. You can’t be too detailed. Most financially successful people are excellent financial planners. They have investment plans, loan repayment plans and a clear idea of how much time they need before they can purchase big-ticket consumer items. Helpful tip: Also be sure to budget for some kind of treat on a periodic basis. All work and no play often results in failure. While these rules seem fairly simple, they are a little like a diet – easy to start but tough to follow through. Despite popular opinion, material items will not bring you h appiness. While it may not seem like it today, forgoing that purchase to save for your child’s education (or your retirement) may make you feel a lot better in the long run (despite what the c ommercials may lead you to believe). Until next time – happy home and mortgage hunting.

Bedroom
Spend: Mattress and box spring Approx: $1,500 - $3,000
Although it is the least glamourous item to buy for the bedroom, it is the most important. A good mattress will make all the difference in getting your beauty sleep each night. “The mattress should last you at least 10 years,” says interior stylist Paul Semkuley. “Especially when you purchase it with the coordinating box spring – as it absorbs up to 50 per cent of the body’s impact.” Semkuley also suggests getting comfy and cosy in store by laying on it like you would normally sleep, to see if the mattress is a right fit. Whether you prefer a mattress that is firm, made of organic material or one that comes with a pillow top for extra comfort, buy the best one you can afford. Tip: Don’t try to save money by using an old foundation or box spring with your new mattress. A mattress paired with its new box spring work together for all around better support, and keeps the mattress in shape longer. Fact: A study conducted in the U.S., Canada, Mexico, UK, Germany and Japan found that a comfortable sleep surface and cosy sheets and bedding were rated the most important romantic elements in all six countries.

Gourmet Settings Non-Stop Flatware. $50 for 20-piece. Visit bedbathandbeyond.ca
Appliance shopping can be daunting – especially when you are deciding on a big purchase such as a free-standing range (hot plate on top, oven underneath). But this important appliance will make your cooking life easier if you spend a little more on a quality piece that is tailored to your needs. “Having a gourmet range will make a huge statement in your kitchen. It will definitely add value to your home while you live there and especially if you plan to sell your home,” says Semkuley.
Tip: There are plenty of options when it comes to your range, such as gas, electric and induction. Determine which type of fuel you will use based on what you have available and your personal cooking preference.

Living Room Spend: Sofa Approx: $3,500-$5,000
The living room is the main hub of any home. It’s where you will do most of your entertaining and it’s the place you will go to snuggle and watch movies together. It’s important, then, that you invest in a sofa that not only looks good, but is comfortable, durable and functional for your space. Paying a little extra now, means a sofa that will last through the years. “When you have great bones in a sofa, you can always reupholster it, knowing that you will have the comfort that you have enjoyed for so many years,” says Semkuley. 50 New home guide GTA | february 8 - 22, 2014

Bathroom Spend: Vanity and Countertop Approx: $2,500-$4,000
You may think this is an odd pick to invest your money in, but the vanity is a key item for the bathroom. Don’t forget you will be using the vanity every day, multiple times, opening and closing doors and exposing it to moisture. “The most important need of the vanity must be function,” says Semkuley. “Spending more on cabinetry that is made of solid wood will last much longer in a “wet” environment, than those made of a pressed wood compound.”
Tip: Buy a vanity that is proportioned to your space. You may have room for a big vanity but little room for anything else.

Tip: When sofa shopping, look for a sturdy frame, one that does not wobble or creak but sits squarely on the floor. Heathwood Homes offers first-time buyers’ program at
Hampshire Mews in Richmond Hill
Heathwood Homes has announced a unique first-time buyers financing program at its new Hampshire Mews community in Richmond Hill.
For qualified first-time homebuyers, the program offers these incentives: • Heathwood Homes will match the Land Transfer rebate of $2,000. • Purchasers will pay no maintenance fees for two years (a $2,800 value). • Heathwood Homes will contribute 20 per cent of the maximum RRSP amount purchasers can contribute towards their down payment under the Federal Governments Home Buyers’ Plan (HBP) – equal to $5,000. • Purchasers can buy with only five per cent down payment. In addition, Heathwood is working with its customers to fully utilize the benefits of the Home Buyers’ Plan. Depending on their personal tax rates and RRSP eligibility purchasers can receive refunds of $10,000 or more. “At Heathwood Homes, we understand that homeownership is the dream of most Canadians,” says President Hugh Heron. “With this unique first-time buyers’ 52 New home guide GTA | february 8 - 22, 2014
program, we’ll help them transform their dream into reality at Hampshire Mews. By entering the marketplace, they can experience the pride of owning their own home and build equity with their hard earned dollars. We’re very excited about introducing this offer.” First-time buyers are urged to buy now to save, as the program incentives are available for a new home at Hampshire Mews if purchased prior to Feb. 28, 2014, the last day to make an RRSP contribution. Bob Finnigan, COO Housing at The Heron Group of Companies, points out that the value at this community is enhanced by its environmental sustainability. “All 60 of the Urban Towns and Townhomes are being built to Heathwood Homes Green Home Energy Program standards and will be Energy Star, too!” he says. “These involve combining Energy Star features with a wide range of additional green measures designed to lower utility bills, provide better air quality and make a real difference in keeping the planet healthy for generations to come. Hampshire Mews is situated in a well-established neighbourhood on Yonge Street just north of Elgin Mills Road with transit literally at the door. Shops, parks, schools, recreation centres, VIVA, GO Transit and major highways are all easily accessible. The Urban Towns start from just $449,900.

RRSPs:
They’re not just for retirement anymore » by Gail vaz-oxlade With tax season just around the corner, you may be thinking about your RRSP contribution. There was a

time when the only thing an RRSP was used for was saving for retirement, but this is no longer the case. These days, you can use your RRSP as a savings plan for a down payment on a home, among other things. It’s fair to say that the RRSP has become Canadians’ favourite savings account. The problem with RRSPs being all things to all people is that its wider scope, its greater flexibility, its move from a hands-off-don’t-ever-touch-this-money retirement plan to a you-can-use-it-whenever-you-can-justify-it savings account is that the process of identifying your investment strategy has become more complex. Most people say they don’t have enough money to maximize their RRSP and set aside a non-registered emergency fund, which explains the overlap between retirement savings and other types of savings that take place within an RRSP.
The first question to ask yourself when choosing investments for your RRSP is, “When am I going to use this money?” The first question to ask yourself when choosing investments for your RRSP is, “When am I going to use this money?” If you’re using a portion of your RRSP savings as your emergency fund, then keep that portion of the RRSP assets fairly liquid so you can access the money in an emergency. If you’re tapping into your RRSP to buy a home, you’ve got a short- to medium-term investment horizon and must choose investments that suit. So you’ll have to forgo equities in favour of a more-conservative investment portfolio. Since you don’t have the time to wait out the bumps in the road that are part of the equity-investment experience, you have to settle for less return. Being clear on how you plan to use your RRSP dollars is especially important when those dollars are being contributed to a spousal plan or the contributing spouse could find money withdrawn from that plan taxed in his or her hands. The rules for withdrawals from a spousal RRSP state that if money is 54 New home guide GTA | february 8 - 22, 2014
taken from a spousal plan within three calendar years of a contribution, that money could be taxable at the hands of the original contributor, defeating the original income-averaging strategy. Make spousal contributions by the end of the calendar year as opposed to in the first 60 days of the new year, since spousal contributions are measured on a calendar-year basis. If you delay your contribution, you’ll end up extending the withdrawal period by another calendar year. Perhaps the toughest part about using your RRSP for myriad purposes is keeping track of which of your RRSP dollars is for what. Here, consolidation may work against you. Instead, consider opening a separate RRSP for each of your purposes and file your statements based on what you’re trying to accomplish. Separate accounts will not only help you stay focused on the purpose for which you are saving, it will allow you to keep your time horizon in perspective. While the money in your RRSP is yours and you decide how to spend it, don’t sacrifice your long-term goals for short-term ones. It’s easy to get focused on a single objective to the exclusion of all others. To be balanced, look at what you want your savings to do for you long-term, medium-term and shortterm. If you’re saving for a home, instead of putting this year’s total RRSP contribution into your “Home Ownership RRSP,” consider dividing it equally between home ownership and retirement. It will take a little longer to get into your dream home, but when you do, you won’t be behind in terms of retirement planning.

The law of good faith (or the lack thereof) Âť by jayson schwarz
The Supreme Court of Canada has said that good faith is not a requirement by either side in the negotiation of a contract. They went on to say that once the contract is signed there is an obligation to perform in good faith. What does this mean to you, the homebuyer?
Jayson Schwarz
LL.M. is a Toronto real estate lawyer and senior partner in the law firm Schwarz Law LLP. If you have a topic in mind, mail, deliver or fax letters to the magazine or to the firm, email (info@schwarzlaw.ca) and give us your questions, concerns, critiques and quandaries.
01 The most important thing to remember is that if it is not in writing, in the Agreement of Purchase and Sale, it is not binding on either side. 02 It does not matter what the agent says or promises (see 1 above). 03 It does not matter what is written in the brochure or advertised at the sales office (see 1 above). 04 Every Agreement should be reviewed by a lawyer who knows real estate before it is binding. 05 Only your lawyer has a legal, moral and ethical requirement to protect and put you first. 06 Every Agreement should be conditional on the lawyer’s review and the condition must be in writing, and keep it that simple. Some Agreements have condition clauses that are all mumbojumbo and do not let you really change anything. Also, make sure some time for review is allotted and sufficient.
Okay, the Agreement is signed, reviewed, amended and ready. Now what? The parties must thereafter act in good faith to complete the contract in accordance with the terms of the Agreement. Remember, most builders and their sales people are honest, caring individuals who want to deliver a quality product. Just be careful not to bite into the bad apple in he bunch. Happy home hunting!
The most important thing to remember is that if it is not in writing, in the Agreement of Purchase and Sale, it is not binding on either side. 56 New home guide GTA | february 8 - 22, 2014

Analysis of 2013 new-home market reveals low supply, high price gap and a road to recovery A strategic review of the GTA’s 2013 new-home market conducted by RealNet Canada Inc. and the Building Industry and Land Development Association (BILD) reveals near 10-year low levels of new home supply and sales and a near-record high price
“Our analysis of the 2013 housing market data suggests growing evidence that a recovery is underway,” says Carras. The company’s Strategic Review shows monthly sales data collected for the total new-home sales in December pointed to a fifth consecutive month of improved year-overyear results. “New home sales in December 2013 totaled 1,711, up 79 per cent from the previous year,” adds Carras.
gap between lowrise and highrise homes, but monthly sales results that suggest a market in the early stages of recovery. “In a market where the supply of new homes must precede sales, a lack of product, obviously, results in a lack of sales,” says George Carras, president of RealNet Canada Inc. “Simply put, you can’t sell what you don’t have. Our study of the 2013 housing market proved lower supply in the highrise sector due to greater developer discipline, and declines in lowrise supply caused by structural restrictions imposed on the market by government intensification policies.” Among the 2013 figures released in the Strategic Review, RealNet confirmed that 2013 saw the second-lowest number of total sales for the decade, at 28,406. This sales total, which reflects 16,201 highrise units sold and 12,205 lowrise sales, was down 23 per cent from the 10-year industry average, and down 13 per cent year over year. The near-record low number of sales in 2013 was driven by a dramatic slowdown in the number of units introduced to the market. The year saw only 30,054 new units (12,256 lowrise and 17,798 highrise) brought to market, a 22-per-cent reduction year over year, and the second-lowest level of new supply in the last 10 years. “The GTA remains challenged by constrained land supply and an outdated development approvals process which delays the introduction of new inventory into the market,” says Bryan Tuckey, president and CEO of BILD. “Sales of new homes today will define the jobs of tomorrow, and now is the time for the industry, consumers and government to watch the market, and watch it carefully.” Among the conditions identified in the report, 2013 sales totals show that more than half, or 57 per cent, of all newhome sales in the GTA were highrise, however the total ...continued on pg 76

number of highrise units sold was down 13 per cent from 2012, and off 11 per cent from the 10-year average. The 2013 condominium sector also saw average unit sizes reduced by one per cent, to 796 sq. ft., and average unit prices climb by 1.1 per cent to $548 per sq. ft. The 12,205 lowrise homes sold in 2013 represented the second-lowest total in the last decade, with just two sales more than was recorded in the industry’s nadir of 2008, and 12 per cent from 2012. Last year’s lowrise sales figures were down 34 per cent from the 10-year average. The 2013 Strategic Review also confirmed the widening gap between lowrise and highrise pricing, a worrisome trend first identified by RealNet and BILD last year. Prior to 2011, the average gap in prices between singlefamily and multi-unit housing was $75,806. In 2013 the price gap grew to a record $226,016 in September and ended the year at $217,583, a condition Carras calls “extreme.” “This price gap between highrise and lowrise housing is continuing to grow, a market condition that is the result of intensification policies in action,” says Carras. The Strategic Review’s pricing data analysis shows that the Lowrise Price Index was $654,147, up nearly 3.5 per cent from last year, while the Highrise Price Index only climbed by 0.1 per cent year over year, to $436,564. “In today’s market, prices for the types of homes we are building less of (lowrise) are rising, while prices for the more prevalent housing type (highrise) remains flat,” says Carras. “The numbers demonstrate that highrise development has become the market’s last, best hope for new-home affordability in the GTA.” Tuckey adds that there are other factors impacting the industry’s ability to deliver homes that people can afford, noting that, “BILD and the Ontario Home Builders’ Association made a submission to the Ontario government advocating for a land-use planning system as well as the development charges system that provides an opportunity to consider streamlining improvements and ensure that municipalities are implementing provincial policy, while enhancing accountability and transparency.” 76 New home guide GTA | february 8 - 22, 2014

While 2013 proved to be a challenging year with forces contributing to low inventory levels, price increases and fewer product launches, the RealNet Strategic Review does show some positive signs for the sector’s near future. “Our analysis of the 2013 housing market data suggests growing evidence that a recovery is underway,” says Carras. The company’s Strategic Review shows monthly sales data collected for the total new-home sales in December pointed to a fifth consecutive month of improved year-over-year results. “New home sales in December 2013 totaled 1,711, up 79 per cent from the previous year,” adds Carras.

Tax tips for the homebuyer Tax credits to ease the pain of this big-ticket purchase Buying a home is a big investment and a financial commitment – especially as a first-time homebuyer.
Many first-time homebuyers are generally recovering from the first year of moving into their dream home, and all the associated fees, unanticipated closing costs and expenses to maintain the home.
The Home Buyers’ Plan (HBP) is a program that allows you to withdraw up to $25,000 from your Registered Retirement Savings Plan (RRSP) to buy a qualifying home for yourself or for a related person with a disability
There are a couple of tax credits that homeowners should be aware of when filing their 2013 tax returns. The Home Buyers’ Plan (HBP) is a program that allows you to withdraw up to $25,000 from your Registered Retirement Savings Plan (RRSP) to buy a qualifying home for yourself or for a related person with a disability. RRSPs aren’t just for retirement anymore. This plan lets first-time homebuyers access their retirement savings tax-free, to increase their down payment and decrease their mortgage amount – and interest paid. The HBP withdrawal limit is $25,000 – tax-free – for each you and your spouse, for a combined total of up to $50,000 toward your down payment or other home-purchase related costs. In order to take advantage of this plan, your RRSP contributions must remain in the RRSP for at least 90 days before you can withdraw them under the HBP. Generally, you will be required to repay all the withdrawals to your RRSPs within a period 15 years to avoid paying tax on that sum. You will have to repay an amount to your RRSP each year until your HBP balance is zero. If you do not repay the amount due for a year, that amount will have to be included in your income for that year, and you will be taxed. ...continued on pg 82

The HBTC is a federal tax credit available to qualified first-time homebuyers or homeowners who have not owned a home in the previous four years
The Homebuyer’s Tax Credit (HBTC) is a federal tax credit of up to $750 is available to qualified first-time homebuyers or homeowners who have not owned a home in the previous four years. This tax credit was introduced in 2009 to ease the burden of closing costs for first-time buyers.
Do you qualify for the HBTC?
» Neither you, your spouse or common-law partner may have lived in a house that either of you owned in the year of purchase or any of the four preceding years. » If you are a person with a disability or are buying a house for a relative with a disability, you don’t have to be a first-time homebuyer to qualify. However, the home must be purchased to allow the person with a disability to live in a more accessible dwelling or in an environment better suited to their needs and care. » A qualifying home is a housing unit located in Canada that already exists or is being built. » A share in a co-operative housing corporation that entitles you to possess, and that gives you an equity interest in a housing unit located in Canada, also qualifies. However, a share that only provides you with a right to tenancy in the housing unit does not qualify.
82 New home guide GTA | february 8 - 22, 2014
Why the Home Buyers’ Tax Credit is good for Canada The federal government introduced the HBTC to give Canadians some much-needed tax relief. As part of the Government of Canada’s $62-billion economic stimulus announced in the Economic Action Plan, first-time homebuyers can get this non-refundable tax credit to help offset legal fees, disbursements and land transfer taxes. People with disabilities who move to a more accessible home may also qualify for the tax credit. The HBTC makes it a little easier to make one of the largest purchases of our lives – a new home.

Saving for retirement outranks reducing debt in 2014 for Canadians: RBC poll
Reversing last year’s rankings, more Canadians are citing saving for retirement as a top financial priority compared to those who are prioritizing paying off debt, according to the 24th Annual RBC RRSP Poll.
More than half (52 per cent) are now focusing on increasing their retirement savings, with 48 per cent placing a priority on debt reduction, compared to 44 per cent and 54 per cent respectively in last year’s poll. This reversal of financial priorities is even more marked among middle-aged Canadians – those 35 to 54 years old – with almost two-thirds (62 per cent versus 52 per cent last year) focusing on saving for retirement ahead of reducing debt (52 per cent versus 56 per cent). 98 New home guide GTA | february 8 - 22, 2014
“These findings indicate Canadians are more comfortable with how they are managing their debt and this is allowing them to focus more strongly on retirement savings this year,” says Bill Hill, national retirement planning consultant, RBC. “To help ensure those savings will support the retirement they have in mind, we recommend they review their lifestyle and financial goals with a financial advisor as early as possible.” The annual RBC poll also found that RRSP ownership among those aged 35 to 54 has jumped to 68 per cent from last year’s 58 per cent. In addition, one-quarter (26 per cent) of middle-aged Canadians has determined they will need to save, on average, $545,000 for a comfortable retirement. “This is the age group that needs to be planning now for the lifestyle they want to have in retirement,” Hill says. “As Canadians who have already retired know, there is so much more to your retirement years than just the money you think you’ll need. The beginning of each new year is a good time to sit down with a financial advisor to explore all aspects of a successful retirement – you may well find you have more options than you are aware of today.”

Paying down debt the top financial priority for Canadians in 2014: CIBC
A new poll from CIBC by Harris/ Decima finds that paying down debt remains the top priority for Canadians in 2014, the fourth year in a row that debt concerns have topped the list in the annual survey. Poll results also show that immediate financial concerns including managing day-to-day spending and paying the bills have become more important to Canadians in recent years at the expense of longer term goals like retirement planning. Over the last four years of this CIBC poll, Canadians identified the following as their top financial priorities:

”For the fourth year in a row, Canadians have told us their top financial priority is paying down their debt as we enter a new year,” says Christina Kramer, executive vice-president, retail distribution and channel strategy, CIBC. “While the intent to reduce debt is clear, we also know that some Canadians are not yet making the progress they want to on reducing their overall debt levels, which speaks to the importance of having a clear action plan in place to reach your goals in 2014.” Poll findings also revealed that less than half (47 per cent) of Canadians surveyed said they had met with an advisor in the last year. As well, out of those surveyed only six per cent named debt management as a topic of a conversation they would have with an advisor. Kramer noted that while
108 New home guide GTA | february 8 - 22, 2014
the intention to pay down debt remains strong, it can be challenging if you don’t have a plan in place. “Despite being top of mind for 2014, many Canadians don’t think about sitting down with an advisor and having a conversation about how to reduce their debt,” says Kramer. “Trying to do-it-yourself can work for some people, but most Canadians would benefit from taking a broader view of their finances with an advisor including looking at their debt, and then working out a realistic plan to start repaying that debt over time.” This year’s poll results also show a continued trend towards short term financial goals and issues becoming more important to Canadians, while longer term goals including retirement planning have dropped in the rankings. For example, while retirement planning was named by 13 per cent of Canadians as their top financial priority entering 2011, it is now seven per cent entering 2014. Conversely, “paying the bills” has grown steadily since 2011, and was named by eight per cent of Canadians in this year’s survey as their priority for the year ahead. “Managing cash flow and expenses are immediate issues, but you also can’t put off your retirement planning indefinitely,” says Kramer. “The good news is that if you start early you can take small steps towards building your retirement savings while also focusing on your current financial needs.” Advice on delivering on financial priorities
»T alk to an advisor: Most Canadians don’t think about making debt reduction the topic of a conversation with an advisor, but it can help you make progress on paying down debt by looking at your overall financial picture and putting realistic steps in place to reduce interest costs and accelerate debt repayment. » Recognize that your finances are all connected: Making progress on one aspect of your financial goals can lead to an opportunity to improve in others, meaning you don’t have to focus on just one priority at a time. For example, a reduction in debt can free up funds to go towards retirement savings, or to further accelerate debt reduction. Renewing your mortgage at a lower interest rate can generate an improvement in cash flow that can be used to start making RRSP contributions earlier in life which can grow over time. » Don’t lose sight of the longer term: While it is important to address immediate financial needs such as debt reduction, it is equally important to keep future goals such as retirement in sight. Even small contributions today can make it easier in future years to reach your retirement savings goals. » Stick to your plan: Once you have a plan in place, stick to it. If you fall off track, get back to your plan as soon as possible and keep making progress towards your goal.

Follow these steps to see if you’ll qualify for a mortgage on your dream home
01 02 03
Calculate the combined monthly before-tax income of you and your spouse. Divide by three. This figure is the monthly payment you can afford to make on your home. Take the total price of the home and subtract the amount of money you expect to make as a down payment. This is the money you will have to borrow.
04
Refer to the chart on the opposite page. Look down the left column and locate the interest rate you expect to pay. Line this up with the amortization period of your choice. (Most firsttime buyers take the 25-year amortization.)
05
06 07
Add to this your estimated monthly heating costs and monthly property taxes. If this figure is equal to or less than one-third of your gross monthly income (calculated in Step 2), you’ll qualify for a mortgage on your dream home.
Multiply this figure by the amount you need to borrow. Divide by 1,000. » Bear in mind that this is a rough estimate. If you have several other large loans already, you may qualify for less. Also, banks and trust companies vary in their policies. The best way to know what you can afford is to go to the lending institution of your choice andget pre-qualified.

Monarch first. Before the ‘60’s changed the world. Before the Baby Boom began. Before the Roaring ‘20’s took us dancing to the Charleston or out to the movies, Monarch was here. First. For 96 years, families have trusted Monarch for the most important investment of their lives. So choose the one builder who has always been there for Canadian families. And visit Monarch. First.
