It’s a time of year with a lot of anticipation – resolutions, changes, taking account of things. I, for one, don’t like the pressure. What I do like about the arrival of a new year is the idea of a fresh start.

I like to think of January 1st as the first day of a fresh slate. I know it’s arbitrary,and that there’s no magic at midnight, but I like to give myself the break and the encouragement each year. On January 1st you are free of last year, free to make what you want out of this year. From mistakes and missed opportunities to taking chances and tackling your dreams, the year holds opportunity.

And that’s one reason why I find the new year an ideal time to assess your living situation.

THE HERITAGE neighbourhood of Old North London is bounded by Windermere in the north and Oxford Street to the south. The Thames River and Adelaide Street mark its western and eastern borders.

More stately and affluent than the trendy neighbouring areas to the south, Old North London is dominated by institutions, and backs onto the University of Western Ontario’s campus via the famous Richmond Gates. It’s quiet and scenic, a refined escape from all of the excitement offered downtown.

Affluent families with children flock to Old North London. Married couples

without children at home are well represented, and many academics (both active and Emeritus) also call the area home. Given the abundance of high-density housing and proximity to campus, it’s also a very desirable location for students.

The University of Western Ontario and its affiliate colleges offer a host of amenities that locals can access.

Numerous parks add to the ambience of this very green neighbourhood.

It can be a very pedestrian friendly area, but bigger houses mean bigger blocks, and a long walk to places like the supermarket in this heavily residential area, so most homeowners

find cars necessary. Cyclists have access to a good network of bike paths linking various parts of the university to the city streets and parks.

It’s a fairly quiet and upscale neighbourhood, with home prices significantly higher than elsewhere in the city. Take-out establishments catering largely to students offer decent prices, but everything else is going to cost you a little more up here.

Six steps to finding a great rental KNOWING YOUR YOUR RENTAL WANTS and needs before

you start looking will simplify your search. CMHC offers some tips to help you find the right place to call “home.”

1. Identify your rental needs: What’s your budget?

Which neighbourhood do you prefer? How many bedrooms? What amenities are important to you? Make a list of your needs and preferences to help narrow down that great rental opportunity.

2. Ask questions: Have a list of questions ready to ask the landlord. Is parking included in the rent? Utilities?

Ask about the lease and terms. Be clear on any policies surrounding pets, smoking, or anything else that may affect your lifestyle.

3. First impressions count: Make a good impression when meeting with the landlord. Dress neatly and arrive on time. Make the landlord’s job easier by bringing your rental history and references, a current employment letter, and a cheque so you can leave a deposit in case you’re interested in taking the place.

5. Review your lease agreement carefully: When you find a great rental and are ready to move forward, typically you’ll sign a lease. Rental agreements vary, but they generally include the names of the landlord and tenant, the address of the property, the amount of the rent, what is included in that cost, the rent payment due date, the deposit amount paid, the term of the rental period, and details like who is responsible for upkeep.

Ensure all this information is outlined.

6. Take notes – again: It’s time to move in! But before you do, you and your landlord should inspect your new home together. Document all issues so you won’t be held liable for any preexisting damage when you leave. You can even take photos to document the condition of the unit before you move in.

ONE FEAR MOST TENANTS have revolves around the concern of when the Landlord can enter their premises and for what reason. The question is: When and why a Landlord can enter the property, and whether the Landlord needs to provide you with notice. Thankfully, there are rules that govern Landlords on whether they can make unexpected visits to your home. Generally, prior written notice must be given to a Tenant but under certain situations, a Landlord may enter the property without notice.

YOUR RIGHTS AS A TENANT Tenants have a right to privacy, and a right to undisturbed possession from the landlord. The wording used in different Provinces varies between reasonable enjoyment and quiet enjoyment. There are many different circumstances that could lead you to believe that the Landlord is interfering with your quiet enjoyment.

Examples include: a) The Landlord entering the rental premises frequently and without notice or permission; b) The Landlord causing unreasonable and ongoing noise, ie. from repairs construction maintenance etc.; c) The Landlord intentionally removing or restricting services explicitly promised in the rental agreement; d) The Landlord allowing the property to fall into disrepair ENTERING WITH WRITTEN NOTICE Your Landlord – except in extraordinary situations as provided by law – needs to provide written notice that outlines when and why he wants to enter your property.

This must be done at least 24 hours in advance. Unless such notice has been served upon you as provided in your Provincial legislation, a landlord may only enter your property under a few exceptions. Below are some examples of entry with notice: a) Fixing something or to check on appliances that are no longer working b) Making sure the home is safe (such as installing smoke alarms) c) Showing the home to someone who wants to buy it d) Other reasonable reasons stated in the signed rental agreement or provided by law

ENTRY WITHOUT WRITTEN NOTICE a) Emergency Each Province has its own Residential Tenancy legislation that sets out the circumstances when a Landlord can enter without notice. Generally a common thread is that a Landlord can enter the property in the case of an emergency. An emergency is usually defined as something that is both unexpected and dangerous.

A good example would be a fire or flood. In these circumstances, your Landlord does not need to provide notice before entering your property. Repairing something that has broken in your home does not count as an emergency. b) Consent: You can always consent to the landlord entering your property. c) Provision of Services set out in Rental Agreement The Landlord, or his agents, could enter their property for a variety of reasons outlined in the rental agreement.

For example, a housekeeper could enter the property on the agreed times of the rental agreement. These services generally have to be between certain hours of the day.

Check with your local Landlord and Tenant Bureau for the hours of when the Landlord may provide these services.

There are other issues, like moving, when written notice is not required and again, your local authority will set the hours. All in all, neither side can abuse their rights when it comes to this area, as the law is clear that provided parties act reasonably and follow the law. The local tribunal will generally support them.
