uying a brand-new home offers you an opportunity to customize it to your liking. It can be a dream come true and an investment for the future – but don’t forget, it’s also legal transaction.

The term “get it in writing” has never been more important in the case of the new-home purchase, since such a document outlines everything your home will have in it, on it and around it. Your Agreement of Purchase and Sale spells out the terms and conditions between you and your builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon.

Since building a home is much more complicated than a resale transaction where the unit and/or property likely already exists, there is no set Agreement of Purchase and Sale or standard contract for buying a new home. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their newhome warranty program. Builders often prepare their own agreements, so contracts can vary from one builder/developer to another and from province to province.

Before you sign a contract, review it carefully with the builder and ask questions to make sure you fully understand what it contains. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document and an agreed-upon contract, so seeking the services of an experienced real estate lawyer is an important step toward ensuring that your dream home becomes a reality.

Hot markets and cool opportunities Hot real estate markets leave some prospective buyers exploring options to get in

hen buying a new home, many people’s vision involves an expansive property in an excellent location and at a great price – within easy reach of all the amenities you need and where you work.

If you’re lucky, you can achieve all of this right off the bat. More likely, as prices rise and selection is increasingly determined by availability and affordability, you may need to compromise. Instead of a detached home in your number one neighbourhood, you find yourself looking at a semi. If a townhome is not quite within reach in your first area of choice, you may be considering a condo.

This is the exercise more and more homebuyers are going through these days. Want a bigger property, move further out of the city. That used to be the fairly simple equation. Now, complicated by issues such as transit and commuting times, the choices may not be so clear. In and around the GTA, for example, rising land acquisition costs are expected to make many buyers’ number two choice – townhomes – notably more expensive in the coming years. Where to from there? A condo? This may not be a suitable alternative, if you have a family.

The good news is builders are responding to such challenges by increasing their offerings in home type, and in the case of condos, unit sizes. Plenty of homebuying options are out there, and if you do thorough research, you’ll unearth the opportunities.

Three good reasons to think resale WHEN YOU BUY A NEW HOME

Buying a brand new home has obvious advantages – you choose the lot location, elevation, floorplan and, of course, the interior finishings.

Anything you want to make your new home well… yours. Resale potential and what features might appeal to future buyers of your home are likely not top of mind.

But, builders and realtors alike say you should think about resale when you select the inclusions, design elements and decor basics of your new home. It may be your brand new home now, but one day you may choose to sell – and that’s when your personal tastes could affect the resale value of your home.

Consider these insights from the recent Canadian Home Critics Survey from realty firm Century 21: DECOR

In Quebec, for example, 20 per cent of homebuyers (the highest in Canada) dislike decor full of the owners’ personal

touches. Buyers in Ontario rank dated flooring as one of their top decor turn-offs. In Alberta, 28 per cent (the highest in the country) say updated finishings – such as counters, flooring and mouldings – are added features that would persuade them to buy.

ENERGY EFFICIENCY

Canadians overwhelmingly would select a home due to energy efficiency upgrades (41 per cent) over updated finishings such as granite counters or hardwood floors (22 per cent). In Atlantic Canada, 59 per cent rated energy upgrades as the top feature that would persuade them to buy, the highest percentage in Canada. In BC, residents overwhelmingly say energy efficiency upgrades are the number one additional feature that would persuade them to buy a home (41 per cent).

CLEAN, MODERN LOOKS

Ontarians rank dated flooring as the number two home decor turn-off. The number one way to turn off Ontario homebuyers is to not clean the house well (57 per cent), while 18 per cent say old furniture taints their first impression of a home.

If a home has old flooring, it better be sparkling; uncleanliness tops Canadian homebuyers’ turn-off list (60 per cent), followed by dated flooring (40 per cent) and bold paint colours (18 per cent).

Before you apply for a mortgage, there are a number of measures that first-time and seasoned buyers alike can take to ensure they qualify for the best mortgage possible. Reducing your mortgage rate by just one per cent can save you thousands of dollars over the life of your mortgage.

The primary focus for prospective buyers should be to exhibit an ability to manage your personal finances. Lenders look at your debt-to-income (DTI) ratio to determine how much you can afford to borrow. This ratio is calculated by dividing your monthly gross income by the amount you use to pay off debts such as auto loans, student loans and credit card balances each month.

Your ability to manage debt and credit plays a major part in determining what rate a lender is willing to give you or if you even receive a mortgage at all.

Lending institutions rely on your credit score – a three-digit number that reflects the history of how you’ve paid your bills, how much open credit you have and anything else that would affect your creditworthiness.

You should never apply for a mortgage without first getting your credit reports. The primary reason is to ensure there aren’t any errors or discrepancies. Errors on your file can force you to pay a higher interest rate on your mortgage and in some cases even torpedo your chances of getting a loan altogether. You could discover accounts that aren’t even yours, or collection accounts for debts you no longer owe.

Once you’ve confirmed the accuracy

of your credit report, you can begin to take steps to improve your credit score in the months leading up to your purchase.

Thirty-five per cent of your score is determined by your payment history. Consistently being late on your credit card payments will significantly hurt your rating. Do your best to keep the balance on your credit cards under a quarter of the total line of credit. At the very least, pay your credit card bills on time to preserve a respectable score. If possible, pay off the balance entirely and promptly, even if it means using some of your money for the down payment.

The second most important part of your credit score is your level of debt. You should look to pay down student or car loans that may be keeping your score low. Mortgage advisors encourage first-time buyers to limit their major purchases on credit until after they’ve secured their mortgage. You might want to push back that new car until after you’ve bought your first home! As a first-time homebuyer, extending your unsecured credit to the maximum by buying one or more new cars before you get your first mortgage will almost always force you to remain a renter, and have you paying someone else’s mortgage for years to come.

Don’t apply for more credit than you need. Too many open or unused accounts can hurt your chances of getting a mortgage. They can also be a major temptation to “live beyond your means.” Whatever you charge or borrow must eventually be repaid. Don’t dig yourself into a deep financial hole.

Many young professionals who’ve been renting or living with parents don’t have much of a credit history. If this is this case, it might be a good idea to have one or more of your utilities in your own name. While just having your name on an electric or gas bill, telephone, cable or water service won’t establish a credit score, it can still be helpful for a first-time borrower.

The best thing you can do is to get a credit card and use it with the utmost prudence. Simply using it in place of money you actually have on hand, then using that cash to make your monthly payments can go a long way to helping you establish good credit history. It takes time and there are really no shortcuts or tricks that can take you from bad credit or no credit at all to a high score in a matter of months or even a few years. While it is important to initially establish credit, it is even more important to take the time to do the right things to maintain good credit.

Securing a good mortgage doesn’t have to be burdensome or disheartening. If you take the necessary steps to tidy up your financial affairs, you will find all aspects of homeownership, not just your mortgage, to be rewarding.

Renovations and repairs can affect your warranty

All warranties come with limitations and rules, and your new home’s warranty is no exception. The purpose of the warranty is to provide homeowners with protection against defective workmanship and materials. But if you make significant changes to your home through renovations or repairs, you may be forfeiting your warranty rights.

The scenario usually goes something like this: A homeowner notices an issue with his new home and submits a statutory warranty form. Not wanting to wait the 120-day builder repair period, the homeowner completes the repairs.

However, any alterations, deletions or additions made by the homeowner are excluded from your warranty, and Tarion cannot cover such defects.

In addition to performing their own renovations or repairs, there are a few ways homeowners can forfeit their warranty rights, such as failing to properly maintain their home and not submitting their forms on time. These are the most common ways to jeopardize your warranty rights.

WAIT TO MAKE RENOVATIONS

Most homeowners can’t wait to put their mark on their new home by decorating and renovating. Before making any renovations to a new home, read your Agreement of Purchase and Sale.

Builders often include a clause that states you should not finish your basement within the first two years of possession – when you should be watching for foundation cracks or water leaks. If there is water penetration, unless the builder finished the basement, they’re not responsible for the damage.

If renovations damage an item under warranty, the item will no longer be

covered – for example, if you install pot lights and the alterations cause issues with the electricity.

JEOPARDIZING YOUR WARRANTY

Health and safety concerns can cause panic in any homeowner.

This can include issues with heating, plumbing, electricity and your water supply. Homeowners often feel they must take matters into their own hands if the situation is urgent.

This could involve calling a plumber or electrician to get an immediate repair. However, you may forfeit your warranty if you hire a contractor to fix a system that is under warranty.

Once the repair is complete, your builder may not be able to assess if the issue was caused by a defect in construction or installation – both warrantable.

Both your builder and Tarion have emergency contact information and procedures in place to handle these situations, and Tarion has technical representatives available.

So, before you attempt to fix the issue yourself, contact your builder’s emergency number and then Tarion. Only if you cannot reach your builder or Tarion should the emergency condition be corrected.

Homeowners should obtain a detailed written report of the problem, and an invoice that sets out the repair methods used by the contractor, as soon as possible after completing the repair. In these cases, limit the repair to the emergency condition and not subsequent damage that may have been caused.

MAINTAIN YOUR HOME

Owning a new home comes with a responsibility to manage and maintain it. By conducting regular and proper maintenance, you will help to ensure that your statutory warranty rights are protected. Your Homeowner Information Package, provided by your builder and available on Tarion’s website, includes a complete home maintenance checklist that can ensure your home stays healthy.

amilton may be only less than an hour’s drive west along the Queen Elizabeth Way, but it has long lived in the shadows of its big city neighbour Toronto.

Long known as Steeltown, The Hammer and other less-than-complementary monikers, Hamilton has undergone a fundamental transformation that has the city poised for long-term prosperity.

For homebuyers considering purchasing in the area, there are good reasons to consider Hamilton. The city has been cited as among Canada’s most welcoming areas, particularly for first-time buyers.

The Real Estate Investment Network, for example, has named Hamilton as the top real estate investment town in all of Ontario through to 2018. Continuing diversification of the city’s economy, coupled with increased accessibility provided by the transportation improvements, provides a strong economic base, the group says.

Hamilton’s economy will soon be unrecognizable compared to past decades.

manufacturing. Indeed, Hamilton’s economy today is much more diversified than the Hammer of old.

Economic growth in Hamilton is strong. The Conference Board of Canada, in its Metropolitan Outlook – Autumn 2014, forecasts the Hamilton economy to grow just 1.3 per cent for 2014, but will surge by 2.3 per cent in 2015 and 2.2 per cent in 2016. The manufacturing sector is expected to be among the leading contributors.

Hamilton’s housing market will experience steady demand in 2015, according to Canada Mortgage and Housing Corp.

(CMHC). Homebuyers moving to the city, and increasing job creation, support strong existing homes sales, says Abdul Kargbo, senior market analyst for Hamilton and Brantford.

“The housing market will benefit next year from more people moving into than out of Hamilton. These out-of-town buyers and a tight resale market will continue to support house prices,” says Kargbo. “Growing housing demand is leading to residential intensification through infill and redevelopment, with multi-unit

housing rising to 56 per cent of starts in 2015 and 2016, up from 44 per cent in 2011.”

The Hamilton census metropolitan area (CMA) is seeing something of a shift towards higher-density housing, while lowrise starts are seeing more concentration in surrounding communities.

Non-residential projects underway in the region include major expansions in the health care sector, and millions of dollars spent on infrastructure improvements. A new rapid transit system is also being studied, which is expected to further benefit already improving inter-city travel. The city is working with Metrolinx, the provincial body responsible for expanding transit in the GTA and Hamilton area.

Other recent significant industrial news includes Canada Bread’s new $100-million, 375,000-sq.-ft. bakery in the city’s industrial park in Glanbrook, replacing three smaller operations in Toronto.

It is home to the Royal Botanical Gardens, a major tourist attraction and significant local and regional horticultural, education, conservation and scientific resource.

Columbian Chemical also recently announced a major expansion of carbon black production at its plant in Hamilton.

Beyond these industrial expansions, Hamilton is also seeing a marked increase in other types of businesses moving into the downtown area. Much of the employment growth, in fact, is taking place in creative services, education, professional-scientific and health care.

CMHC says job prospects are expected to continue to improve, and Hamilton will likely fare better than other Ontario markets due to its increasingly diverse base of industries, which keep the labour market more balanced.

Thanks to billions of dollars in infrastructure improvements around and within the city, as well as expanded GO Train services, the “new” Hamilton is becoming more accessible as well as desirable. Buyers can acquire more affordable property here and commute to Toronto, or other neighbouring communities such as Burlington, Oakville or Mississauga. An emerging condominium market provides buyers with an even more affordable entry into Hamilton.

Developers see this potential and a number of new projects are underway from all of Losani Homes, Empire Communities,

Multi-Area Developments, New Horizon Homes, Spallacci Homes, Starward Homes and the Vrancor Group, with many aimed at first-time buyers and priced accordingly.

Hamilton also has plenty going for it in terms of culture and entertainment. It is home to the Royal Botanical Gardens, a major tourist attraction and significant local and regional horticultural, education, conservation and scientific resource. The city is also home to the Art Gallery of Hamilton, Ontario’s third largest public gallery.

For sports enthusiasts, there’s the Hamilton Tiger Cats of the Canadian Football League, who in September 2014 moved into the new $150-million Tim Hortons Field, downtown on the site of the former Ivor Wynne Stadium. The Hamilton Bulldogs of the American Hockey League play out of Copps Coliseum, also located downtown, which also serves as a venue for concerts and other events.

If living in the city is not exactly your favour, development is also leading to growth in adjacent areas such as Ancaster, Dundas, Flamborough, Glanbrook and Stoney Creek. Empire Communities, Homes by DeSantis, Losani Homes, Branthaven Homes, Mattamy Homes, Rosehaven Homes and other builders all have communities under way in these towns.

energy consumption and heating costs With cold weather approaching, Canadian homeowners will soon be looking for ways to reduce home energy consumption and heating costs.

With memories of last winter – one of the harshest in recent history – still fresh, many Canadians are taking a more proactive approach to prevent the condensation, drafts and cold floors that are dead giveaways you’re paying too much to heat your home.

And yes, these warning signs surface even in new homes.

“An under-performing building envelope is the main reason why the average Canadian spends unnecessary money on heating costs,” says Jay Nordenstrom, executive director of NAIMA Canada, an association of insulation manufacturers. “A robust building envelope means homeowners decrease their energy needs. This lowers monthly heating bills, along with the associated greenhouse gas emissions, and enhances comfort during catastrophic winter weather.”

Just what is a “building envelope”?

It’s a term to describe the building components that separate the indoors from the outdoors. A home with a modern building envelope – well insulated, properly sealed and well ventilated – can provide shelter during the most brutal weather conditions. It also provides insurance in the event your furnace is disabled by a power outage.

Paying a premium for a house with increased wall and attic insulation, for example, can provide month-over-month payback by lowering energy consumption

and heating costs. These savings vary, however, and are determined by the R-value of your home’s insulation. Higher R-values mean greater insulating power.

New homes offer the best opportunity to ensure a highperformance building envelope, and NAIMA suggests home builders not trade off improvements to the building envelope in favour of mechanical systems.

Renovating a home is another opportunity to improve the building envelope. The most beneficial upgrades include installing appropriate amounts of insulation and weather sealing where drafts and air leakages are occurring, NAIMA says.

Many of these can be done as do-it-yourself projects.

Across Canada, grants and rebates are available from the federal and provincial governments and local utilities, especially for energy-saving renovations.

THREE TO FOUR WEEKS PRIOR TO MOVE DAY 1. Estimate how large a rental truck you’ll need. In general, allow 150 cu. ft. of truck space for each fully furnished room. For example, a 12-ft. truck offers 450 cu. ft. while a 26-ft. truck offers 1,400 cu. ft. for your items.

2. Get the packing supplies you need. Save time by ordering your moving supplies like boxes, labels, bubble wrap and packing tape online early. Sometimes, you can collect boxes at work or ask your local grocery store if they have any you may have.

3. Start packing. Begin with out-of-season and non-essential items. Remember to label boxes clearly. This is also a good time to lighten your load. If you haven’t worn or used it in a year, donate it to charity.

4. Utilize technology. Did you know you can use your smartphone to quickly and easily rent a moving truck with Penske’s new mobile rental option? A few clicks and you’ll reserve the perfect moving truck for your moving day, saving you time and headaches.

TWO WEEKS PRIOR TO MOVE DAY 1. Change your address with the post office. Remember to update your address with other important contacts such as banks, credit card companies, magazines and professional associations.

2. Call service providers and utilities to discontinue cable TV, trash collection, water, gas and electricity. If your move date is flexible, consider scheduling cut-off for a day or two after you move, just in case there is a delay and you still need those services.

3. Ask for help. Get a crew of family and friends to save the date to help on moving day. You’ll need some strong folks to help move boxes and appliances, and some others that are willing to watch children and pets so they don’t get in the way.

ONE DAY PRIOR TO MOVE DAY 1. Finish any remaining packing. Reserve one box for essentials which will be the last box you pack and likely the first one you open at your new destination. Include items like checkbooks, credit cards, IDs, glasses, prescription drugs, house keys and other necessities.

2. Pick up your truck rental the day or evening before the move to save time on moving day. Penske professionals will get you familiarized with your vehicle and help you verify the best driving directions to your new home. They’ll even check the upcoming weather and give you any necessary driving advice.

MOVE DAY 1. Pack the truck. Put the heaviest items on the truck first.

When loading and unloading, be sure to bend your knees and lift with your legs, not your back. Work diligently, but be sure to take breaks and stay hydrated.

2. Leave early in the morning. You’ll run into less traffic and you’ll leave yourself extra time to unload at your destination. Take turns driving and take breaks once every two to three hours.

3. Get help unpacking. After a long drive you’ll appreciate assistance unloading the moving truck. If possible, have friends or relatives ready to help at your destination.

By using this schedule, you’ll have an easy and smooth move without headaches so you can enjoy your new home and look forward to the future.

What do you love most about entertaining?

J: I love to treat people. I love having guests come over and serving

them the best food I can make, putting on the best party I can.

I want people to leave having had a really great time. That makes me really happy.

How can you use existing decor to make a party hosted at home comfortable and stylish?

J: Using your kitchen island as a serving station or buffet

is a great idea. Bring your indoor furniture outdoors, and create an interesting set-up to stage your food (weather pending, of course!).

Tell us about your partnership with LG J: LG approached me about six months ago to be the ambassador

for its new Door-in-Door refrigerator. Given my love of design, food and entertaining, it seemed like the perfect fit. The refrigerator is amazing for entertaining – it can act as a beverage centre, where guests can help themselves!

When it comes to kitchen essentials, what is your favourite item?

J: For a bit of luxury, I would say a wine fridge. I pretty much bought my house because it came with one. I also think a great big kitchen island is so important for everyday cooking, as well as entertaining.

Describe your dream kitchen J: All white with some gritty elements, such as exposed beam, an

industrial chandelier, large windows and open shelving. Oh, and a few French baguettes in a basket on the counter!

If you could cook with anyone, who would it be?

J: My grandmother, she is my muse. We cook together all the time, and she is so inspiring.

You love to entertain and throw beautiful, inspiring parties.

What are your top entertaining tips?

1. Making food ahead of time – it is a huge sanity saver.

2. Use rental companies for tables, chairs, glassware, utensils and linens – it is a lot less expensive than people realize.

3. Being present in the moment. I can spend so much time

preparing and hosting the party, that sometimes I forget to enjoy it. Do your hosting, and then be resolved to enjoy yourself, too!

Where do you look for inspiration when planning a party?

J: My cousin Tori’s blog, fraichenutrition.com – she’s a dietitian and an incredible cook, she inspires me with her euro-rustic approach to food, which I love. And, in terms of decor, I look to Monika Hibbs.

She has beautiful style.

What are the top entertaining trends this season?

J: For decor, an all-white palette is still big this year, but mixed with rustic elements and metals, such as serving food on an antique cutting board. And for food, the mini trend (think one-bite apps) is still going strong!

You are known for your fabulous sense of style.

How do you like to dress when you entertain?

J: When I throw parties, I usually pick a theme and get everyone to dress accordingly – which makes for great, fun photos.

Chilled Caprese Tomato Bites This ideal finger food is a no-cook, little-prep, handmade crowd pleaser created by Jillian Harris and inspired by the LG Door-inDoor Refrigerator. The tomato gives a farm-fresh feel, while the creamed mozzarella adds a rich taste.

Ingredients 1 pint cherry tomatoes, halved 3 tbsp. heavy whipping cream 1/2 pound fresh mozzarella cheese, sliced 6 fresh basil leaves 1 garlic clove, minced

Directions Scoop out and discard pulp of cherry tomatoes.

Invert tomatoes onto paper towels to drain and insert skewer.

In a food processor, combine the cream, mozzarella cheese, basil and garlic; cover and process until blended. Cut a small hole in the corner of a pastry or heavy-duty resealable plastic bag.

Fill with cheese mixture.

Relax, Canada, not only is the real estate market not going to experience a U.S.-style crash, as some pundits continue to predict, but there’s isn’t even going to be any significant interest rate hike in 2015.

This, according to Douglas Porter, chief economist of BMO Financial Group. He suggests the Bank of Canada may, at best, raise its influential overnight target rate by a quarter-point. BoC has held the rate at one per cent for four years.

BMO itself, in its Home Buying Report released in late October, inadvertently stoked the flames of concern. The report indicates the majority of Canadians currently in the market for a home would be forced to change their buying plans in the event of a two percentage point rise in interest rates. Th irty per cent would be forced to reduce their price range and settle for a less expensive home, while another 13 per cent would be priced out of the market.

And this, at a time when prices in the three hottest cities – Calgary, Toronto and Vancouver – are rising faster than family income, further straining affordability.

A two-point interest rate hike is highly unlikely, however.

“The chances of a two percentage point rise in rates in any year these days is remote, and I would peg it as extremely unlikely in 2015,” Porter told New Home & Condo Guide.

“We do believe that at long last rates will begin to creep higher next year, but we are only looking for quarter-point hike by the Bank of Canada.”

Continued rapid price gains in Calgary, Toronto and Vancouver will increase those cities’ vulnerability to a shock – whether economic, interest rate or otherwise, BMO says in the report.

Porter suggests there may be some price cooling in these markets next year, particularly in Calgary and other cities with ties to the oil and gas industry, since oil prices have fallen notably in recent months.

“We would also look for somewhat slower price gains in Toronto and Vancouver, but both of those markets have proven to be amazingly resilient – largely thanks to relentless population inflows to both,” Porter says. “I’m not sure that any other large city could step into the void at the top, and we expect a notably milder national price increase next year.”

But if Canadian real estate has demonstrated anything lately, it is its ability to surprise.

“The dominant story in recent years has been the consistent surprises to the high side by the Canadian housing market.”
