Get it in writing The saying “get it in writing” has never been more important in the case of the new-home purchase, since such a document outlines everything your home will have in it, on it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms and conditions between you and your builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon.

Before you sign a contract, review it carefully with the builder. Ask questions. Fully understand what it contains. Then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document and an agreed-upon contract, so seeking the services of an experienced real estate lawyer is an important step toward ensuring that your dream home becomes a reality. Let us know how it goes. We’d love to hear from you!

Court ruling sets precedent

When the Ontario Divisional Court earlier this month ruled in favour of the Hamilton-Halton Home Builders’ Association, over the Region of Halton, homebuyers and owners may not have taken notice. But perhaps they should have. As our story on page 50 discusses, at issue was the Region’s heretofore practice of disproportionately charging new-home buyers who purchased smaller units, the same fee as larger units. The result? Additional strain on affordability. “This will force the Region and other municipalities to take fairness and reasonableness into account,” Suzanne Mammel, executive officer at HHHBA, told New Home & Condo Guide, Southwestern Ontario. “A

municipality will not be able to negatively affect a specific group my collapsing charges into broader categories to ease administrative issues. It takes the issue of affordability, which is entrenched into provincial planning documents, and gives it weight relative to a regional or municipal policy decision.” Translation? More and more people entering the new home market are buying smaller units, and until now in Halton, they were paying the same development charges as those buying larger, more expensive units. “As our region continues to grow, all levels of government must ensure that the policies that are in place do not undermine housing affordability for Ontarians,” says Mammel.

Explore a

Phelps Homes community for the home of your dreams PHELPS HOMES INVITES you to visit and explore its unique new

home communities in Niagara. Located in the heart of wine country, they offer a range of new home options from adult lifestyle to affordable, family-friendly towns and much more. From Smithville to Jordan and St. Catharines, you may find your dream home in the heart of wine country, surrounded by forested bike trails and close to big city amenities while always being able to enjoy the quieter side of life. Nestled in a quiet residential area near the heart of Smithville is Auburn Trails. Now entering its second phase, you’ll find these bungalows and two-storey homes on country-sized lots of 46and 50-ft. that you seldom see anywhere but in small town settings like this. Not far from downtown Smithville, these homes have been designed to complement the existing charm and small town atmosphere already prevalent in Smithville. Homes range in size from eight bungalow plans starting at 1,511 sq. ft. to nine two-

storey homes that start at 2,207 sq. ft. offering three- and four-bedroom layouts. Priced in the mid $400’s. Set in the midst of the Niagara Wine Region, Smithville is a step away from city lights yet is a convenient midway point between Hamilton and St. Catharines, and 10 minutes to Grimsby and all the amenities available. Residents who have already moved in have easy access to the Leisureplex and the West Lincoln Community Centre and fairgrounds, and various organized sports clubs, schools and places of worship along with the shops and services of downtown and Village Square.

Atwater is Niagara’s premier adult lifestyle community nestled along Twenty Mile Creek in Smithville. It’s just a short drive to the big city amenities and award-winning wineries. The Atwater Collection features craftsman-styled attached bungalows and bungalow lofts. Only a few lots remain, but the good news is the last few homes offer quick closings so you can be living in this lifestyle-oriented community in just a few weeks. These last few homes are priced in the $350’s. Coming this summer is The Kingsway in Jordan Village, a small hamlet on the green banks of Twenty

Mile Creek in the heart of the Niagara wine region. Spectacular bungalow townhomes will be within reach of lifestyle amenities like award-winning wineries, fine art, antique shops, charming boutiques, a luxurious Inn, and outstanding restaurants. Priced in the $400’s. These homes are being released later this summer with closings next year. In the near future, Phelps Homes will be inviting you to take the first step towards affordable home ownership with Stepping Stones at Streamside, an intimate collection of 54 family-friendly townhomes set within the magnificent neighborhood of Streamside on the Twenty in Smithville. Perched atop the Niagara escarpment, and across the street from the new St. Martin Catholic Elementary School, this inviting enclave is just a stone’s throw south of Lake Ontario and the Town of Grimsby. Prices start in the $300’s with closings next year. Later this year, a St. Catharines community of semis and bungalow towns will be released with move-in dates for next year. And don’t forget: what other builders consider as upgrades, are standard in a Phelps home. Interiors are graced with nine-foot ceilings and larger windows providing a light and airy environment. A convenience door from the garage to your home helps to make those weekly grocery trips a little easier to bear while the simple addition like a main floor laundry room takes care of an important detail often overlooked. Combine all of this with engineered floor joists and an engineered roof truss system and you get a testament to the quality craftsmanship and detail found in every Phelps-built home. As a master builder since 1975, Phelps Homes has a long history of personalized home building and they continue to strive to create beautiful living spaces that their homeowners are proud to call home. 6 homebuying tips for first-timers By Wayne Karl

PLANNING TO BUY YOUR FIRST home

and not sure where to begin? Here are six homebuying tips to help you prepare. 1 | Get with the programs There are various government programs available to help you buy a home. Home Buyers’ Plan (HBP): The HBP allows first-time buyers to withdraw up to $25,000 from their RRSP to put toward a down payment on a home. You have up to 15 years to repay the funds. First-Time Home Buyers’ Tax Credit (HBTC): Eligible first-time buyers can apply for the FTHB to help offset the costs associated with purchasing a home, such as legal fees, disbursements and land transfer taxes. The credit can provide up to $750 in federal tax relief. More information on these programs is available at cra.gc.ca 2 | Explore your options First-time buyers can buy a home with as little as five per cent of the purchase price as a down payment – as long as the property is less than $500,000. Anything higher than that, and the minimum down payment for the portion of the price higher than $500,000 is 10 per cent. So, assuming your price range is at that threshold, you’ll need to come up with at least $25,000. At that purchase price, depending on the market you’re in, this could mean you’d then be looking at a townhome, semi-detached or even a condo, instead of a detached home. 3 | Check with the bank of mom and dad If your parents are baby boomers who have had the good fortune of building equity over the years as they paid down their mortgage while the

value of their property multiplied, well… they may be in a position to help. Many buyers are hitting up the bank of mom and dad. In the last two years, 28 per cent of first-time buyers called on the bank of mom and dad to help finance their purchase; from 2010 to 2014, only 17 per cent did. 4 | Become tech savvy Mortgage consumers are becoming very tech savvy. In Canada Mortgage and Housing Corp.’s 2015 Mortgage Consumer Survey, 78 per cent of respondents researched online, with 70 per cent using an mortgage calculator to help determine their payments. And social media is playing a more important role – 20 per cent used sites such as Facebook to learn more, 17 per cent used a mobile device, and of those, 22 per cent used a mortgage related app. And all of these figures are growing. 5 | Befriend a broker or banker Like many things in life, it’s all about relationships. And whether you use broker or a banker to secure a mortgage, you’ll likely come to value the relationship. In the same CMHC

MORE TRENDING ONLINE ypnexthome.ca/news

survey, consumer loyalty strengthened the longer people stayed with their lender. But since we’re talking about money, people are willing to switch lenders to get a better rate and save – a fact which is much more prevalent for bankers than brokers. And because brokers are able to offer products from multiple lenders, as opposed to bankers who offer only the products of their own institution, the market share held by brokers is growing notably, particularly among repeat buyers. 6 | Research, research, research These days, with prices rising as they are and uncertainty in some markets, thorough research is an absolute must. Everything from your target area, desired housing type, builder or realtor, finances, how much you can afford, who you borrow from and the structure of your mortgage – take your time. Take months. Don’t rush anything. Anything.

The Greystones: One-acre custom homes in Greensville WHAT HAPPENS WHEN AN award-

winning, premier custom home builder embarks on a development with a renowned architectural firm atop the Niagara Escarpment mere minutes from the charming town of Dundas? The Greystones is the result. In a marketplace where the average home in the GTA is selling for $1 million, Thomas Cochren Homes is offering this opportunity to live in an exclusive community on the cusp of the city in a custom dream home – on an acre of land – close to all amenities, starting at $1.4 million. This is a one-of-a-kind opportunity for discerning homebuyers to enjoy a collaboration that will result in only 13 custom-designed homes in the quiet

surroundings of Greensville. Forming three cul-de-sacs, The Greystones is taking shape in an area where rolling hills tell their own story, and each of the 11 remaining lots offer their own unique features and topography. Homes will be tailored to their surroundings as is the custom way of Thomas Cochren Homes. Several are perfect for walkout features, while others are ideal for an outdoor pool along with additional outbuildings. A ravine setting for another lot challenges the imagination with a design that could appear to be a single level in front while dropping down several levels in the back with walls of windows to showcase the view. Clients of Thomas Cochren

Homes generally are not new to the homebuilding process. As President Tom Cochren explains, they’ve been through the process once or twice, know what they want and decide a custom approach will enable them to guide their own home creation experience. “It’s the custom touch they didn’t get before,” he says. “We build and design from scratch to give them the home of their dreams – inside and out.” Potential buyers in The Greystones aren’t looking for model homes and a stack of plans to choose from. Instead, says Cochren, “They come out and walk the land several times to get a feel for the area. They want to see the views from all sides, the direction of the sunrise, where the sun sets, where neighbouring homes will be.” Unlike an urban setting, they’ve got 40 to 45,000 square feet of land to work with and a home to design inspired by their needs and this setting.”

According to Cochren, custom homes aren’t restricted to monster homes of 10,000 feet and more. In fact, John Williams of Williams Residential Design will be at your service to design each home at The Greystones and has begun with a collection of prototypes starting at 2,800 sq. ft. to whet the appetite. Arts & Crafts design has inspired the architecture of the homes that will be presented. The Greystones will be just six minutes to Starbucks in Dundas where you’ll also find shops, galleries, parks and even an art school. It goes without saying that Greensville is surrounded by greenspace with Webster’s Falls just down the hill, and the Bruce Trail and conservation areas nearby. Homebuyers increasingly want and expect more energy efficient homes. Thomas Cochren Homes is able to offer Energy Star homes that are 20 per cent more efficient than building

code requirements; and beyond to R2000 (50 per cent more energy efficient) and ultimately Net Zero homes which have 80 to 100 per cent increased energy efficiency. “We strive to build sustainable homes with sustainable building practices,” says Nancy Cochren. This includes a rainwater collection cistern that can be used for irrigation. They also suggest small investments such as under slab insulation and hydronic tubing rough-in for basement floors that can provide greater comfort and pay-off in future energy costs. As a custom home builder, the company knows its major investment is time. Time to meet with clients to address their dreams and desires. Time to draft plans. Time to find the perfect finishes. Time to build and accommodate all of the features of a home built to exacting details. As testimony to that, Thomas Cochren Homes recently received an Award of

Bayview-Wellington Homes in St. Catharines Award-winning builder in a prized Ontario location GARDEN CITY. SHIPMAN’S CORNERS. ST. KITTS. Whichever

you choose to call it, St. Catharines is undeniably one of the most beautiful cities in Southwestern Ontario. Between the lively regattas and countless festivals that take place all year round, its no wonder why St. Catharines is becoming one of the most popular cities south of Toronto to live. After the immense success of Bayview-Wellington’s inaugural award-winning community of townhouses and singles in Niagara, Niagara on the Green, which is temporarily sold out, BW Homes wants to encourage more people to become residents of the beautiful Niagara region, specifically St. Catharines. BW Homes selects only the top neighbourhoods near the best amenities to develop new residential communities. But its not just what is nearby that is important to this Vaughan-based builder

when it comes to new homes – the history is there, too. St. Catharines is located along the Welland Canal, Niagara region’s other waterfront, where residents have gathered to watch ships from all over the world traverse across for decades. Besides this spectacle, St. Catharine’s is next to part of the Welland Canals Parkway Trail, a 42 km long trail perfect for walking, cycling strolling or spending the day at one of the many parks located along the way. As the weather begins to warm, the Garden City justifies why it is so aptly named. Blooming wildflowers, daffodils, crocuses and tulips create a floral path along the canal for both residents and day-trippers to enjoy. Besides the trail, the Niagara region (which includes Niagara-on-the-Lake, Niagara Falls, St. Catharines, and a few more) is home to Casino Niagara, Niagara-on-

And shopaholics can rejoice at the newly opened Niagara Outlet Mall, which offers an enjoyable outdoor shopping experience of brand name stores at great prices. Bayview-Wellington homes are supported by more than a century of collective team experience in construction, planning, development and completion of residential communities. Specializing in highrise condominiums, bungalows, semi-detached homes and estate homes, Bayview-Wellington Homes has been a leader in the home

development industry for decades and has been an integral part of St. Catharines and the Niagara region for years. Bayview-Wellington Homes is proud of the fine living and luxury reputation the company has earned for itself through years of dedication, quality homes and outstanding customer service. City Focus | BRANTFORD

Shaping the future in

Brantford BE IT TELECOMMUNICATIONS,

industry or sports, Brantford has a number of significant historical signposts. Think Alexander Graham Bell, Massey Ferguson and Wayne Gretzky and you have a pretty good sense of where this city of about 92,000 on the Grand River in Southwestern Ontario has come from. Where it’s going, on the other hand, is a matter of building on this heritage, as the local government says, to “Shape the future.” Brantford was long dubbed “the telephone city,” thanks to former resident Alexander Graham Bell making the first telephone call there in 1876. About 100 years later, however, the city was becoming better known as the hometown of a certain phenom who was lighting it up in hockey rinks everywhere, first locally as an amateur, then internationally as a pro.

Today, Wayne Gretzky is without a doubt Brantford’s most famous son, and the town bears his name everywhere, most notably at the Wayne Gretzky Sports Centre, which recently underwent a major expansion. Wayne’s father Walter Gretzky, the best-known hockey dad in the world, still lives in the family home in town. Like other centres in Southwestern Ontario, Brantford enjoys an advantageous location close to Hamilton and Toronto, as well as to Buffalo and even Detroit on the U.S. side. The construction of Hwy. 403 late in the 1990s further eased access to and from Brantford, including Woodstock to the west and Cambridge and Simcoe to the north via Hwy. 24, facilitating even more business and community growth. Geography was a key reason Brantford was an important Canadian

industrial centre for the first half of the 20th century, particularly for manufacturing exports. Located at the deepest navigable point of the Grand River and among key rail lines in southern Ontario, the town was able to expand from an agricultural community into an industrial city. Farming implement manufacturers such as Massey-Harris, Verity Plow and Cockshutt Plow Co. operated foundries in town, leading to growth not only for this sector but for the local economy overall. However, the farm machinery sector fell on tough times in the 1980s and early 1990s, and the bankruptcies of some of these companies had a severe impact on Brantford. In the years since, however, the city has focused on geographic proximity to key business markets and low costs as the main competitive advantages in

36 YPNEXTHOME.CA

SWO 07-02-16_master.indd 36

2016-06-30 11:39 AM

its economic development strategy. Shaping our Future is the theme of the plan, which aims to create a strategic direction for the economic development and sustainability of the community. The province of Ontario has designated Brantford as an Urban Growth Centre in its growth plans, and anticipates high levels of growth over the long term. The strategy seems to be paying off, as the town is ranked in the top 10 investment towns in Ontario, according to the Real Estate Investment Network (REIN), thanks to a strengthening economy and other redevelopment. Only an hour’s drive from Toronto, Brantford is a prime location for those wanting access to the amenities of a larger city without the constant activity and commotion a large city creates, according to REIN. The city is strategically located and offers a variety of housing types, from entrylevel, single-family homes all the way through to larger, multi-family properties. Brantford is just entering the demand curve, and should be a surprise performer in the coming years, the group says. Multiple satellite post-secondary education campuses already located in the city provide a vibrant, younger and growing population base, which is expected to lead to future potential growth of new businesses, as witnessed just north in the Kitchener-Waterloo-Cambridge area. The education sector, in fact, is a central part of Brantford’s rejuvenation. In the past 10 years or so, post-secondary institutions have invested more than $125 million in the downtown area, including a new “academic district.” Wilfrid Laurier University and Nipissing University both have satellite campuses in the city; McMaster University operates a clinical education centre at Brantford General Hospital; Mohawk College and Conestoga College are expanding; and there is a half-dozen or so secondary schools. For residents who love the

outdoors, Brantford’s location along the Niagara Escarpment boasts more than 40 kilometres of natural trails, including a four-season stretch of the Trans Canada Trail, a network that links to Cambridge and Hamilton and provides a great place for hikers, cyclists and nature lovers. Nature also plays a large role in the city’s downtown waterfront redevelopment plan. “The Grand River and its tributaries are the lifeblood and defining image of the city of Brantford,” according to the vision statement of the project. The Waterfront Master Plan is to reinforce the legacy of natural features as well as define new directions that build on the 70 kilometres of trails and hundreds of acres of public space. Further honouring the legacy of its most famous son, and building firstclass amenities for current and future residents, Brantford committed to a major expansion of one of its main recreational facilities – the Wayne Gretzky Sports Centre. Owned and operated by the city, the WGSC is a centre of sports and leisure activity for the community, offering residents and visitors year-round access to a variety of sports activities. The total cost of the project was more than $54 million, with about $15 million coming from each of the federal and provincial governments, and more than $22 million from the city of Brantford. The project was intended to reestablish the Wayne Gretzky Sports Centre as Brantford’s premier facility, and renew pride in Brantford as the Tournament Capital of Ontario. Two of the most popular tournaments – which draw teams from all over North America – are the Wayne Gretzky International Hockey Tournament, held every December for A and AAA teams, and the Walter Gretzky House League Tournament, played in January. “Brantford is hometown to arguably hockey’s greatest legend, Wayne Gretzky, and we take this very seriously,” the city boasts on its

Paris

Historic town of Grand proportions

If you love history and heritage, then the neighbouring town of Paris might also be worth a look. Located just minutes from both Brantford and Cambridge along the Grand River, Paris is affectionately known as the “prettiest town in Canada.” Many towns may lay claim to such a moniker, but one visit to Paris, and you’ll see that in this case it’s absolutely true. Formerly called Forks of the Grand, the town of about 12,000 is located at the junction where the Nith River and the Grand River intersect. Paris was settled by Hiram Capron, who named it for the nearby gypsum deposits, used to make Plaster of Paris. The town is also often referred to as the “Cobblestone Capital of Canada,” citing the unique cobblestone buildings that populate the downtown. These historic buildings host a mix of retail, restaurants, financial and professional services, many overlooking the Grand River as it winds its way through town. Dozens of shops and services, plus the natural scenery of the Grand, offer plenty to do and see. If not daily, community spirit in Paris is on full display during the annual Paris Fall Fair, held Sept. 1 to 5 this year at Paris Fairgrounds. Paris has seen notable population growth in recent years, with Hwy. 403 between Hamilton and Woodstock, and other infrastructure improvements, easing travel within the communities in the area and to and from the GTA.

website. “Coined the Tournament Capital of Ontario, our city has an incredible variety of sports organizations for the young and the young at heart. From minor hockey, football, soccer, lacrosse, baseball, softball and everything in between, the minor sports associations for children and young adults to join in on are near endless.” There are also various sports leagues for adults and seniors. Rich in heritage and poised for future economic and community growth, Brantford is clearly an area in positive transition. Builders seem to agree, as Empire Communities, Surreal Homes and Brookfield Homes all have developments in town. JULY 2 - 30, 2016  |  NEW HOME & CONDO GUIDE SWO  37

Downsizing to your next

Sifton dream home YOUR HOME SHOULD PROVIDE the right amount of space for living comfortably today. However beloved a place may be, eventually, many working people, empty nesters and retirees will take stock of their family or executive homes and conclude they really don’t need so many bedrooms or such big backyards. When you and your large residence have outgrown one another, it’s an opportunity for a fresh start in a new home that enhances the lifestyle you want to enjoy now. “With the resale market so strong, this is a great time to lock in gains made in the family home,” says Barb Owens, a sales associate with Sifton Properties Ltd. “Whether the market goes up or down from now becomes irrelevant – the goal is to take the sure thing and find something else that is suitable to your current and future lifestyle and ride

out any flux that may come.” “The term ‘downsizing’ should be renamed ‘prioritizing’ or ‘recalibrating’ for quality of life and peace of mind,” says Owens. It’s an investment homeowners make in their own happiness that reaps benefits for many years ahead.

Re-energizing your life Preparing for a move jumpstarts motivation to clear out old closets and storage rooms bursting with accumulated clutter, knowing you are casting off unwanted things and

44 YPNEXTHOME.CA

will soon be living in a new, wellorganized place. De-cluttering equals de-stressing, giving a beneficial boost to your emotional wellbeing and increasing your energy level.

Smart financial move Selling your family home and purchasing a condo can free up money to elevate your new lifestyle or put funds into your investment account. When you buy rather than rent your next home, your saved equity will still continue to grow. A condo costs less to clean, maintain, insure, heat and cool, compared to a bigger property. With a condo, you can happily sell your lawnmower and snowblower, leaving yard maintenance to the groundskeeper.

Healthy choice Newly built homes are fresh and clean, with heating, ventilating and air-conditioning systems that improve air quality and increase your comfort. Many find comfort in one-floor, open concept living that allows you to age in place. No worrying about stairs or narrow hallways should mobility ever become an issue.

Intelligent use of space Floorplans that utilize every centimetre and provide ample storage support your desire for organization, flow and style.

Freedom and flexibility Unburdened from the chores that accompany large homeownership,

you have more time for your favourite people and activities. In a condo community, you can feel secure at home and while traveling, knowing your property is being cared for. Manageable in size and beautifully designed, your new Sifton condominium will let you leave behind the burden of too much property and give you the freedom to embrace your next adventure. Find your perfect downsizing opportunity at two distinct condominium communities by Sifton Properties – Evergreen at Warbler Woods in west London and Westwood Village in south London. New-home buyers: who’s watching your back? By Wayne Karl

THERE’S AN OLD JOKE in some circles that new-home buyers spend more time researching their next wireless device than they do a new home. Well, those days are over if you want to avoid a homebuying gong show. New homes and warranty coverage are increasingly in the news, due to rising prices and other challenges. And not all provinces handle new home warranties the same way. In Ontario, the provincial government empowers Tarion Warranty Corp. as the sole new home warranty provider – the primary backer of about 50,000 new homes every year. Not everyone agrees with this approach, saying consumers should have more choice in who provides such coverage. In BC and Alberta, the situation is very different – about a half-dozen companies in each province provide new home warranty coverage. Should your new home warranty be any different than the insurance business, where consumers can contract their own car, home or medical coverage? Or should it be any different than when you buy a new car, and the warranty is provided by the manufacturer, or an affiliate thereof? Interesting questions, right? The importance of warranty coverage became front-page news in Toronto recently when one builder was at risk of being de-registered by Tarion because of concerns over its customer service, high number of warranty claims and financial position. The company recently initiated restructuring proceedings under the Bankruptcy and Insolvency Act (Canada).

of the Condo Act, so condo buyers should receive their full deposit back).

New-home builder and warranty checklist » Is home building the company’s profession? Is home building the company’s primary business? Or is it a part-time or more recent focus? » What is your experience, and how long have you been in business? Good builders are proud of their track record. They will tell you about their background, training and experience. Naturally, such developments worry new-home buyers, whether they’ve just put down deposits or have already moved into their new homes and expect warranty coverage. Ontario new-home buyers should take some comfort in knowing that Tarion has your back. The status of the builder does not affect your warranty rights. “If the homebuyers receive a completed home, they will also receive the three warranties that come with that home – the one-year, two-year and seven-year warranties,” Tarion President Howard Bogach told New Home & Condo Guide. “This is in addition to possible delay compensation. If buyers do not receive their home, their deposits are protected under the warranty up to a certain amount. For freehold homes, it is $40,000. For condominiums, it is $20,000 (condominium deposits are also protected by the trust provisions

» Are they a member of a home warranty program? Warranty programs provide additional protection for the homebuyer’s investment. Ask the builder to explain the details – you want the warranty that best meets your needs for both the short and the long term. » Will they give you references from past clients? Contact past customers to find out how satisfied they are with their new home, and with the company’s after-sales service. » Can you visit the work site? The work site offers many clues about the company and the quality of the builder’s homes. Ask for a tour of a home under construction and a chance to meet the site crew. Advice | FUNDAMENTALLY SPEAKING

HHHBA Divisional Court win protects new-home buyers Smaller unit types will now pay less — keeping them more affordable By Wayne Karl

MORE ADVICE ONLINE ypnexthome.ca/news/advice

NEW-HOME BUYERS in the Region of Halton hoping for a break on rising Development Charges and other fees may have caught a break with a recent ruling from Ontario’s Divisional Court. Ontario’s Divisional Court has ruled in favour of the Hamilton-Halton Home Builders’ Association (HHHBA) over an appeal made by the Region of Halton which would have charged all multiple and apartment residential units the same fee. Prior to this, the Region disproportionately charged new home buyers who purchased smaller units the same fee as larger units, which places additional unnecessary strain on affordability. HHHBA had originally won at the Ontario Municipal Board (OMB) on the Region’s Development Charges (DC) Bylaw, and Halton contested the decision and brought before Divisional Court. “Everyone sees how quickly the price of all homes is increasing,” says Suzanne Mammel, executive officer at HHHBA. “More and more people entering the new home market will do so by purchasing a smaller unit, and they should not be required to pay more for their unit than is fair, while benefiting buyers of larger, more expensive units. We are advocating for the newhome buyer, who is not always aware of how policy changes like this affect housing prices.”

We are advocating for the newhome buyer, who is not always aware of how policy changes like this affect housing prices. The three judge panel found that HHHBA’s positions on affordability and fairness are important mandates of the Region. The panel determined that the Region had failed to justify how its fee structure properly and reasonably divided the costs between large and small units (one- and two-bedroom, versus three-plus bedrooms). DCs are incorporated into the price of a new home and new neighbours pay this fee when they purchase their home. HHHBA note that new neighbours should pay their fair share but should not be additionally charged to make up costs appropriately attributed to larger units. HHHBA originally appealed the Region of Halton’s 2012 DC Bylaw on the basis of two issues: the inclusion of a DC on behalf of conservation authorities, and the bundling of unit types as was heard at Divisional Court on June 7. The OMB and Divisional Court had previously found in favor of HHHBA’s position regarding the inclusion of a charge on behalf of the Conservation Authority (CA). This latest ruling ensures that smaller, more affordable unit types are not unfairly “taxed” by the Region. “This will force the Region and other municipalities to take fairness and reasonableness into account,” Mammel told New Home & Condo Guide. “A municipality will not be able to negatively affect a specific group my collapsing charges into broader categories to ease administrative issues. It takes the issue of

affordability, which is entrenched into provincial planning documents, and gives it weight relative to a regional or municipal policy decision. While policy decisions will be considered, they are not given carte blanche in terms of setting charges.” The ruling could set a precedent for similar situations facing other builder associations and municipalities. “The CA issue was the first taken to the OMB and divisional court,” Mammel says. “At stake was whether a conservation authority is considered a local board under the Development Charges Act. This win is precedent setting in that other CAs which may have desired to go down this path for an alternate revenue stream will no longer be able to. “As our region continues to grow, all levels of government must ensure that the policies that are in place do not undermine housing affordability for Ontarians,” says Mammel. “We have to work together to make sure these policies work together and must do a better job educating the public so that people in the housing market understand the impact of government policy choices on the price of their new home.” Wayne Karl is an award-winning writer and editor with experience in real estate and business. In Fundamentally Speaking, Wayne explores the basics you need to examine when buying property. He can be reached at wayne.karl@ypnexthome.ca or follow him on Twitter at twitter.com/ WayneKarl.
