Know your builder – and warranty Understand what’s covered and what’s not

I

t was about this time last year that parts of the GTA were left reeling from severe rainfall, flooding and power outages, and homeowners were learning the hard way about home insurance and new-home warranties. Indeed, you wouldn’t dream of buying a new car, TV or other big-ticket item without first inquiring about the manufacturer’s warranty. But when it comes to buying a new home, you should be even more diligent.

Some people may be so excited about their purchase that they’re more interested in choosing finishes than reading the fine print of a sales agreement. Or maybe they assume all builders are created equal, and that certain things are covered, when in fact they may not be. Or it might be a lack of awareness of just how new-home warranties work in Ontario.

Tarion Warranty Corp. is a non-profit company designed to protect the rights of new-home buyers and to regulate builders (see pages 44 and 78). With four main responsibilities – homeowner education, warranty enforcement, builder licensing, and identifying and prosecuting illegal building – it is, unfortunately, a necessary but extremely valuable body. It is also one you should get to know.

Just like for cars or electronic devices, all manufacturers and products are not created equal. Learning about your new-home builder’s warranty – before the time when you actually may need it – is a crucial part of the homebuying process..

Condominium buyers are a unique breed. They know what they want and they are prepared to pay for it. Today, there are plenty of choices and competition in the condo marketplace so shopping around has become a new pastime for many as they seek exactly what they want.

Condo living is a lifestyle and so whether lowrise or highrise, they are often located in high-profile areas of a city – downtown, close to transit and within walking distance of shopping, restaurants and entertainment.

Residents can park the car and walk or eliminate the car altogether. Bike share and car share programs are becoming standard features of condo communities. It’s this type of independence that condo buyers are looking for along with freedom to just lock the door and go without worrying about cutting the grass or shoveling the snow. That’s all looked after.

When considering location, tour the surroundings. Will you be keeping your car or do you need something close to shopping? How close are the schools? Do some homework to see if other developments will be built around you crowding your “perfect” location, blocking your view or cramming your quiet street with cars.

Do your homework about your builder. How long have they been in business? Do they specialize in condos?

What other projects have they built?

Thanks to social networking websites, it’s easier than ever to find buyers of their earlier projects. Ask questions.

Were they happy with the builder’s service? Would they buy from them again, or run in the other direction? Were they happy with their features and finishes? Were repairs made in a timely manner?

A condo is every much an investment as any other piece of real estate. When the construction, features and amenities are top-notch, these things that appealed to you will also appeal to the next buyer. A quality builder has done his homework so you’ll find projects at both ends of the spectrum from those with minimal amenities to offer affordability, to those at the upper end with pools, spas and rooftop terraces that ooze luxury at any cost.

Some condo fees include everything from water, to insurance and cable plus the reserve fund; others may just cover lawn maintenance and snow removal. Building amenities like theatre spaces and pools contribute to higher condominium fees.

Because of the competition, many up-graded finishes are now standard including engineered hardwood, granite countertops, stainless steel appliances and crown moulding.

Like any home, you can opt to pay extra for upgrades, or you can add them on your own later. It depends on whether you want to just walk in or pace yourself and your finances until later. Keep in mind, particularly if your new home is a condo suite, all condominium corporations have varying rules about the type of renovations you can do to a unit – and even the times of day that renovations can take place.

Familiarize yourself with Tarion’s new home warranties and fill out all the appropriate paperwork to keep yourself protected. If you’ve bought a home with an appliance package, learn how long your appliances are covered for repairs and, if necessary, consider buying extended warranties.

It’s impossible to time the housing market, but there are factors you can take into account to decide if it’s the right time to buy for you. Do you have enough for your down payment? Can you secure an attractive mortgage rate?

Finally, can you find what you want in a price range you can afford? If the time is right, then start shopping. There are plenty of choices out there today.

It’s a fact that new homes and condos are not perfect. The home building process is the work of craftsmanship, where many tradespeople collaborate to bring your new home to life.

This is why it isn’t uncommon for a new home to have some imperfections – ranging from minor cracks and squeaks, to more major issues such as water leakage.

Over the years, Tarion has tracked our most frequently asked questions. If you are a new home or condo owner, chances are you may be wondering the same things, such as, is that crack in my basement something to be concerned about, or are those squeaky floors warrantable?

From minor issues to more serious ones, I’ll explain how to determine what you should note on your warranty forms.

CRACKS AND SQUEAKS

Granite countertops have become a much desirable upgrade in many new homes, and it can be extremely frustrating to a homeowner if a scratch is noticed. However, solid-surface countertops can be brittle and easily damaged by impact.

Pay close attention to the condition of your countertops during the Pre-Delivery Inspection (PDI), as cracks are generally only covered under warranty if it can be shown that it existed prior to you taking possession of the home.

If a crack is not listed on the PDI form, it will likely not be covered if listed on a 30-Day or Year-End form since after you take possession of your home, we will not be able to determine whether the crack was caused by the builder or the homeowner.

The same logic holds true for scratches or dents to flooring or other interior fixtures such as a bathtub. Noting these imperfections on your PDI form is a must. If the house is not clean enough to assess such imperfections, request that the PDI be rescheduled so that it is in suitable condition for an inspection.

Notice a crack in your drywall, or a squeaky floor? Most new-home owners think that a new home should not have any imperfections, but that isn’t so. A crack in your drywall, concrete basement floor, or garage floor could all be due to “shrinkage,” caused by the drying of materials. This is a normal and common process that all homes experience. Since this does not have an adverse affect on the condition of your new home, it is not covered under warranty. The same goes for a squeaky floor or stair, which may also be the result of shrinkage. You can still point these issues out to your builder, as he or she may be able to determine the cause, and possibly make a simple repair.

Although many cracks and squeaks are nothing to be concerned about, take note of the width of the crack. For example, a crack in a garage floor that is more than six millimetres in diameter (approximately the thickness of three 44 NEW HOME & CONDO GUIDE SWO | JUL 5 - AUG 2, 2014

WATER LEAKAGE

There is a big difference between water condensation, and an actual pool of water in your home. Many homeowners inquire about dampness or condensation, usually in the basement of their new home.

Depending on the weather outside, condensation may occur in a new home, but should not be cause for major concern. Check the moisture levels in your home to help prevent excess condensation. Reduce dampness by using a dehumidifier or increasing ventilation to the area.

Only actual water penetration through an opening in the wall or floor may be covered by the statutory warranty. In a basement, trickling water leakage should be included on your 30-Day, Year-End and Second-Year warranty forms as the cause will need to be identified.

B

e it telecommunications, industry or sports, Brantford has a number of significant historical signposts. Th ink Alexander Graham Bell, Massey Ferguson and Wayne Gretzky and you have a pretty good sense of where this city of about 92,000 on the Grand River in southwestern Ontario has come from. Where it’s going, on the other hand, is a matter of building on this heritage, as the local government says, to “Shape the future.”

Brantford was long dubbed “the telephone city,” thanks to former resident Alexander Graham Bell making the fi rst telephone call there in 1876. About 100 years later, however, the city was becoming better known as the hometown of a certain phenom who was lighting it up in hockey rinks everywhere, fi rst locally as an amateur, then internationally as a pro.

Today, Wayne Gretzky is without a doubt Brantford’s most famous son, and the town bears his name everywhere, most notably at the Wayne Gretzky Sports Centre, which recently underwent a major expansion. Wayne’s father Walter Gretzky, the best-known hockey dad in the world, still lives in the family home in town.

Like other centres in southwestern Ontario, Brantford enjoys an advantageous location close to Hamilton and Toronto, as well as to Buffalo and even Detroit on the US side.

The construction of Hwy. 403 late in the 1990s further eased access to and from Brantford, including Woodstock to the west and Cambridge and Simcoe to the north via Hwy. 24, facilitating even more business and community growth.

Geography was a key reason Brantford was an important Canadian industrial centre for the first half of the 20th century, particularly for manufacturing exports. Located at the deepest navigable point of the Grand River and among key rail lines in southern Ontario, the town was able to expand from an agricultural community into an industrial city. Farming implement manufacturers such as Massey-Harris, Verity Plow and Cockshutt Plow Co. operated foundries in town, leading to growth not only for this sector but for the local economy overall.

However, the farm machinery sector fell on tough times in the 1980s and early 1990s, and the bankruptcies of some of these companies had a severe impact on Brantford.

In the years since, however, the city has focused on geographic proximity to key business markets and low costs as the main competitive advantages in its economic development strategy.

Shaping our Future is the theme of the plan, which aims to create a strategic direction for the economic development and sustainability of the community. The province of Ontario has designated Brantford as an Urban Growth Centre in its growth plans, and anticipates high levels of growth over the long term.

The strategy seems to be paying off, as the town recently claimed ninth spot in the top 10 investment towns in Ontario between now and 2015, according to the Real Estate Investment Network (REIN), thanks to a strengthening economy and other redevelopment.

Only an hour’s drive from Toronto, Brantford is a prime location for those wanting access to the amenities of a larger city without the constant activity and commotion a large city creates, according to REIN. The city is strategically located and offers a variety of housing types, from entry-level, single-family homes all the way through to larger, multi-family properties.

Brantford is just entering the demand curve, and should be a surprise performer in the coming years, the group says.

Multiple satellite post-secondary education campuses already located in the city provide a vibrant, younger and growing population base, which is expected to lead to future potential growth of new businesses, as witnessed just north in the Kitchener-Waterloo-Cambridge area.

The education sector, in fact, is a central part of Brantford’s rejuvenation. In the past 10 years or so, post-secondary institutions have invested more than $125 million in the downtown area, including a new “academic district.” Wilfrid

Laurier University and Nipissing University both have satellite campuses in the city; McMaster University operates a clinical education centre at Brantford General Hospital; Mohawk College and Conestoga College are expanding; and there is a half-dozen or so secondary schools.

For residents who love the outdoors, Brantford’s location along the Niagara Escarpment boasts more than 40 kilometres of natural trails, including a four-season stretch of the Trans Canada Trail, a network that links to Cambridge and Hamilton and provides a great place for hikers, cyclists and nature lovers.

Nature also plays a large role in the city’s downtown waterfront redevelopment plan.

“The Grand River and its tributaries are the lifeblood and defining image of the city of Brantford,” according to the vision statement of the project. The Waterfront Master Plan is to reinforce the legacy of natural features as well as define new directions that build on the 70 kilometres of trails and hundreds of acres of public space.

Further honouring the legacy of its most famous son, and building first-class amenities for current and future residents, Brantford committed to a major expansion of one of its main recreational facilities – the Wayne Gretzky Sports Centre.

Owned and operated by the city, the WGSC is a centre of sports and leisure activity for the community, offering residents and visitors year-round access to a variety of sports activities.

The total cost of the project was more than $54 million, with about $15 million coming from each of the federal and provincial governments, and more than $22 million from the city of Brantford.

The project was intended to re-establish the Wayne Gretzky Sports Centre as Brantford’s premier facility, and renew pride in Brantford as the Tournament Capital of Ontario. Two of the most popular tournaments – which draw teams from all over North America – are the Wayne Gretzky International Hockey Tournament, held every December for A and AAA teams, and the Walter Gretzky House League Tournament, played in January.

“Brantford is hometown to arguably hockey’s greatest legend, Wayne Gretzky, and we take this very seriously,” the city boasts on its website. “Coined the Tournament Capital of Ontario, our city has an incredible variety of sports organizations for the young and the young at heart. From minor hockey, football, soccer, lacrosse, baseball, softball and everything in between, the minor sports associations for children and young adults to join in on are near endless.”

There are also various sports leagues for adults and seniors.

Rich in heritage and poised for future economic and community growth, Brantford is clearly an area in positive transition.

Builders seem to agree, as Brookfield Homes, Empire Communities and Eastforest Homes all have developments in town.

HISTORIC TOWN OF GRAND PROPORTIONS If you love history and heritage, then the neighbouring town of Paris might also be worth a look.

Located just minutes from both Brantford and Cambridge along the Grand River, Paris is affectionately known as the “prettiest town in Canada.”

Many towns may lay claim to such a moniker, but one visit to Paris, and you’ll see that in this case it’s absolutely true.

Formerly called Forks of the Grand, the town of about 12,000 is located at the junction where the Nith River and the Grand River intersect. Paris was settled by Hiram Capron, who named it for the nearby gypsum deposits, used to make plaster of Paris. The town is also often referred to as the “Cobblestone Capital of Canada,” citing the unique cobblestone buildings that populate the downtown.

These historic buildings host a mix of retail, restaurants, financial and professional services, many overlooking the Grand River as it winds its way through town. Dozens of shops and services, plus the natural scenery of the Grand, offer plenty to do and see.

If not daily, community spirit in Paris is on full display during the annual Paris Fall Fair, held over Labour Day weekend at Paris Fairgrounds – Aug. 28 to Sept. 1 this year.

Paris has seen notable population growth in recent years, with Hwy. 403 between Hamilton and Woodstock, and other infrastructure improvements, easing travel within the communities in the area and to and from the GTA.

SUPPORTS PETER GILGAN EMERGENCY DEPARTMENT

The Peter Gilgan Emergency Department at the South Muskoka Memorial Hospital Site was unveiled during a special reception this afternoon in recognition of the largest single donation from a seasonal resident in the history of the South Muskoka Hospital Foundation.

Peter Gilgan, founder and CEO of Mattamy Homes, made the $1-million gift to set the stage for a $6.5-million capital campaign, of which he has agreed to serve as Honourary Chair, to better connect patients to care through technology. The donation will support much-needed equipment in the hospital and ultimately help to make emergency care better in Muskoka.

A longtime cottager in the Muskoka region, Gilgan’s gift was inspired by the care and courtesy of the staff and physicians that his friends and family members have received over the years.

“I have always been so impressed with the high level of care, kindness and warmth that South Muskoka Memorial Hospital brings to our community and wanted to do my part to help raise awareness and interest in the importance of good community hospitals,” says Gilgan. “They are the front line of care in our province and are so important to the health and well being of great communities.”

The major gift to the SMMH Site is one of Gilgan’s many acts of philanthropy. As a respected and dedicated community leader, he has supported various projects and

organizations ranging from health care to physical activity to higher education and community legacies.

“This gift that Peter has given us today will help further improve the care we provide by helping to ensure we have the leading edge equipment and technology that we rely on,” says Natalie Bubela, chief executive officer at Muskoka Algonquin Healthcare (MAHC).

The role technology plays in patient care and the impact of state-of-the-art tools and equipment cannot be overstated, says Dr. Jan Goossens, chief of staff at MAHC. “Technology is critically important to delivering health care services and saving lives,” says Dr. Goossens. “Having access to electronic health records means that when seconds count, everything we need to know will be at our fingertips.

An expanded telemedicine system means access to specialized care. An automated medication management system means peace of mind for better and safer drug administration, while new Diagnostic Imaging equipment, will give us faster and more accurate ways to diagnose our patients.”

Paul Hammond, chair of the South Muskoka Hospital Foundation, says Mr. Gilgan’s significant donation brings the Foundation’s fundraising tally to $38 million over 28 years.

“A strong hospital has competent and caring staff. A strong hospital has solid infrastructure and up-to-date technology,” Hammond explains.

“Peter, you have helped to make us even stronger and on behalf of everyone who benefits from your generosity, I thank you for that.”

Follow these steps to see if you’ll qualify for a mortgage on your dream home

Calculate the combined monthly before-tax income of you and your spouse.

Divide by three. This figure is the monthly payment you can afford to make on your home.

Take the total price of the home and subtract the amount of money you expect to make as a down payment. This is the money you will have to borrow.

Refer to the chart on the opposite page. Look down the left column and locate the interest rate you expect to pay.

Line this up with the amortization period of your choice. (Most firsttime buyers take the 25-year amortization.)

Add to this your estimated monthly heating costs and monthly property taxes.

If this figure is equal to or less than one-third of your gross monthly income (calculated in Step 2), you’ll qualify for a mortgage on your dream home.

Multiply this figure by the amount you need to borrow.

Divide by 1,000. » Bear in mind that this is a rough estimate. If you have several other large loans already, you may qualify for less. Also, banks and trust companies vary in their policies. What’s in your new-home warranty? Ideally, that’s a question you’ll never have to answer for real – at least not the hard way, be it fi ling a complaint or, worse, proceeding to a claim settlement.

But, life is sometimes not fair, and despite the best intentions of home builders, things do go wrong. To put it nicely – stuff happens.

Indeed, according to Tarion Warranty Corp., nearly every new home built has some form of defect. Such is life when you’re building outside, dealing with the elements and working with natural materials.

In most cases, issues are resolved, and builders large and small are getting better at responding to customer concerns.

Still, there are unscrupulous – or worse, illegal – builders that try to circumvent everything from relatively minor registration fees to taxes, all under the guise of “saving you money.”

But when there’s a problem or issue that needs to be resolved, good luck.

That’s why it’s important to ensure your new home builder is registered with Tarion – to provide the peace of mind that Tarion is backing the warranty, as well as to learn what parts of your new home are covered, for how long and what the steps and procedures are.
