Understanding the agreement Buying a new home offers an opportunity to get exactly what you want. It can be a dream come true and an investment for the future – but it’s also a legal transaction.

The term “get it in writing” has never been more important. Your contract outlines everything your new home will have in it and around it.

Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms between you and your developer and/or builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon.

Since building a home is much more complicated than a resale transaction where the home already exists, there is no set Agreement of Purchase and Sale or standard contract. Builders often prepare their own agreements so contracts can vary.

Before you sign a contract, review it carefully and ask questions to make sure you fully understand it. Take it to a real estate lawyer.

Once it is signed, it becomes a legal document, so seeking the services of an experienced lawyer is an important step toward ensuring that your dream home becomes a reality.

When the Ontario government last month announced proposed changes to four provincial plans that would shape how land is used in the Greater Golden Horseshoe — Canada’s fastest-growing urban region and the province’s economic engine – there seemed to be two distinct reactions.

The home building industry was quick to jump all over it. The Ontario Home Builders’ Association and its various regional member groups issued a joint release warning of the consequences.

Together, they offer more than 200 shops and services. There are also three medical clinics, home support services and an ultra-modern hospital. And just 35 minutes away is the city of London, home to two world-class hospital campuses.

Indeed, although the town population is officially listed as about 15,000, the town is a regional hub for business, industry, health care, education, agriculture, government and emergency services which serves an area of nearly 225,000 people.

Not bad for a community dating back to 1825 as a village catering predominantly to the logging and wood processing industries. In the mid-19th century, Tillsonburg took additional steps toward industrialization through further expansion into forest products. In the 1920s, major enterprises included milk and tobacco production and manufacturing of shoes, farm equipment and textiles.

Fast-forward to the 1990s when the current downtown began to take shape with the construction of the Rotary Club Clock Tower, where residents gather to ring in the New Year.

Tillsonburg’s adult-lifestyle residential focus began in 2001, with the Baldwin Place subdivision located on the western edge of the town – a development that will have approximately 300 homes when completed.

Other recent residential development includes the reurbanization of the former railway lands on Bridge Street East, which is the site of Tillson Landing condominium, the first such highrise construction in more than a decade.

Tillson Landing was completed in January 2006.

The Tillsonburg Community Centre was refurbished in 2004 with renovations and expansion of the arena and new recreation and health club facilities. Downtown also recently welcomed Boston Pizza, as well as big box stores such as Canadian Tire, Shopper’s Drug Mart and Staples Business Depot, and an expanded The Source store and Mark’s Work Wearhouse in the Tillsonburg Town Centre Mall.

In terms of the local economy, Tillsonburg has been positively impacted by General Motors’ CAMI assembly plant in Ingersoll, about 20 kilometres north of the town, which opened in 1986. Toyota’s plant in Woodstock, about 30 kilometres northeast, has had a similar spillover benefit for the town.

Other local businesses have also recently expanded, including Siemens Canada.

The area still has a strong agricultural base, with cash crops, hog farming, milk production, tobacco, ginseng and various tertiary crops.

Not content with relying on such history, and with an eye to further diversifying its economy, Tillsonburg is pledging to leap into the future.

The Town of Tillsonburg recently partnered with the Economic Developers’ Council of Ontario (EDCO) to attract international investment.

The efforts seem to be paying off.

Tillsonburg has been recognized for excellence in economic development initiatives at the EDCO Awards, for its Discover Tillsonburg campaign.

This initiative saw local builders partner with the municipality to collaboratively market the community and attract new residential investment.

“The Town of Tillsonburg and the Tillsonburg Development Committee have a goal of increasing residential growth in the community,” says Mayor Stephen Molnar. “Through the Discover Tillsonburg campaign,

we’ve been able to approach the challenge in a fresh way – pooling our resources with the private sector and working collaboratively to make our community stronger.”

Partners in the Discover Tillsonburg effort included Tillsonburg Developments Inc., Hayhoe Homes, Fusion Homes and Landmark Homes.

Deliverables included a new website (discovertillsonburg.ca) and other initiatives.

“While it’s certainly gratifying to be recognized with an award, the real satisfaction comes from seeing the results,” says Colleen Pepper, marketing and communications officer for the Town. “New home starts in Tillsonburg increased 25 per cent in the first year of the initiative, and are up over 50 per cent since the recession.”

“It’s exciting to see the momentum that is building,” says Dominic Bradley, marketing director for Tillsonburg Developments. “Being involved in Discover Tillsonburg has allowed us to leverage our marketing dollars and make strategic investments that benefit the whole community.”

5 ways to boost your down payment

in Canada now costing more than $500,000, many young people need all the help they can get when it comes to coming up with the down payment for their first home.

If you’ve just started saving and are looking for ways to give your down payment fund a boost, the five tips below will help you save more money faster to afford the home of your dreams and leave you with a smaller mortgage.

1. Make a tax-free withdrawal from your RRSP If you’re a first-time homebuyer, you can make a tax-free withdrawal of up to $25,000 tax free from your RRSP under the Home Buyers’ Plan (HBP). This means a couple purchasing their first house together can each withdraw up to $25,000 from their RRSPs, for a total of $50,000 towards a down-payment on their first home. The money must be paid back over a period of 15 years beginning in the second year after you made a withdrawal.

2. Use your tax refund If things such as unused tuition credits, moving expenses or RRSP contributions will net you an income tax refund when you file your taxes, resist the temptation to spend it!

Instead, save it as part of your down payment fund. Your income tax refund is one of the easiest ways to quickly boost the balance of your down payment without putting any strain on your everyday budget.

Cutting your daily coffee from your budget will probably only save you a few hundred dollars per year, which won’t go far if you’re planning to buy a home anytime soon. However, if you’re spending more than $100 a month on expensive cable packages or pricey gym memberships, axing these from your budget and redirecting the cash to your down payment fund will give it a noticeable boost. You don’t have to give up everything to become a homeownership but you should prioritize the goal over non-necessities you won’t really miss.

Your parents raised you, took care of you when you were sick, and prepared you for life. While you may feel bad about asking for a handout, many young Canadians expect financial support when buying a home. In fact, a 2015 BMO survey finds that 42 per cent of first-time buyers actually expect their parents or relatives to help pay for their first home. And 40 per cent of first-time buyers say they wouldn’t be able to afford a home without financial help from family.

For many young people, the down payment for their first home will be the largest sum of money they’ve had to save up so far, so it’s no surprise they find the task daunting. However, with commitment and a plan, you’ll be able to save up the down payment you need in order to afford the home you want.

4. Find a side hustle to fund your goals One of the easiest ways to really ramp up your savings for a down payment is to dedicate an income stream to achieving the goal. If you can find parttime work outside the regular hours of your job or freelancing you can fit in your own schedule, you can use all the extra income you earn towards saving for a house. You might be reluctant to put a few more hours in at a second job if you’re already working full-time, but if working evenings and weekends will make your home ownership dreams come true, it’s a worthy sacrifice.

for painting great looking walls

two choices: you can either stick with the standard “builder beige” or you can refine your painting skills, put on a pair of coveralls and give it a shot.

This is not to say that all new homes are adorned with builder beige, but unless you were able to pick multiple colours in the paint and finishes of your space, chances are your home could probably use a new coat.

I was trained to paint properly way back when I started my design career more than 20 years ago.

Some of you may know that I began as a junior designer at Benjamin Moore Paints. I never dreamed that I would learn so much useful

knowledge about colour and paint.

So before you tackle any painting job, big or small, follow these simple rules for a seamless finish.

1 | Buy a metal cage The cage is the metal handle that holds the actual roller or sleeve.

The better this is, the longer it will last, it won’t squeak when rolling or rust when washed.

This is so much easier, as you can pour almost a full can of paint into the tray which means less pouring of paint and hopefully less mess.

Really soak the roller in the tray so it absorbs the paint.

5 | Avoid tiny strokes in a small area When applying the paint to the wall – do not roll it in tiny strokes back and forth in one small area. Begin by rolling a large “W” on the wall with the roller and then roll the wall fully from top to bottom. This will lie out the paint better and faster.

6 | Apply the recommended amount of paint Apply the recommended amount of paint to the wall. People often try to stretch their can of paint a little farther by not applying as much as suggested by the manufacturer.

There is no value in this as the paint is meant to be applied to a certain thickness to give you the right colour and durability. Too little paint compromises this!

7 | Don’t brush all the edges first Although it is tempting to cut-in or brush all the edges of the walls before rolling the paint on, you are less likely to get a good finish. It is best to brush a little of the edges then roll into that wet paint, and continue this process down the wall.

It takes longer but you will find the coverage of the colour more even.

8 | Always use two coats of paint Yes, you usually need two coats of paint to develop the colour well or to ensure you don’t miss any spots.

There are some brands of paint that suggest you only need one coat, but I have found this to work only with a light colour over another light colour, and when I take my time applying the paint.

9 | Store your paint cans upside down Paint does not “go bad” as long

as it’s not kept in extremely cold conditions. Seal the lid very well (Place the lid on the can, cover with paper, and hammer the lid in place, remove paper) and turn the can upside down in a cool dry area for storage. When the can is turned right side up again, it mixes before you dip your brush in.

10 | Buy a good paintbrush Buy one good paintbrush. Cost can be an issue, but a good brush means you will only buy it once if you clean it after you have done the job. A good brush has “flagged” ends and is angled. Flagged ends look like the bristles are uneven and with split ends. This lays out the paint in a much smoother fashion.

And once you do clean your brush, use the hole in its handle to hang it up to dry. Never leave a paintbrush

sitting in a pot! I use a wire coat hanger turned upside down to dry my brush. (Hook the brush’s handle on the “J” shaped end of the hanger and hook the triangular part of the hanger over a doorknob.)

BONUS TIP Can’t find an opener for your paint can? A screwdriver or keys will work, but if you are Canadian the best thing ever is a loonie or toonie to open the lid of a paint can! It’s always available and super strong for this type of job. Thanks Canadian Mint for the convenient opener!

How to avoid your own moving horror story

WHEN BUYING A HOME, you will

likely consult with a team of trusted professionals — a mortgage broker, a lawyer, perhaps a realtor or builder sales associate and maybe a home inspector. Then, assuming you move ahead with your purchase, eventually you will likely need a mover.

People often don’t consider a mover as an important member of their team of professionals.

However, given the critical role they perform — taking possession, at least temporarily, of all your worldly goods and moving them without loss or damage — it’s a function not to be taken for granted. Not doing your due diligence and taking the time to select a reputable mover can invite untold problems.

Case in point: the following example, which admittedly doesn’t involve a new-home move, but the experience is all too common. So is the lesson learned — unfortunately, the hard way.

I recently contracted a “professional” moving company to carry out a last minute move of five pieces of furniture on behalf of my son, a university student. For a variety of reasons, we decided to hire movers rather than rent a truck.

After calling several firms — including large, well-known companies and smaller, independent ones — I selected a moving company in Whitby, where the pick-up was to take place. Drop-off would be in Waterloo.

We agreed on price ($350) and time 50 YPNEXTHOME.CA

(9 a.m.) — after I was very clear the move would involve an out-of-town destination. All details were confirmed in a “contract” exchanged via email.

The crew was on time for the move the next morning, but almost immediately began talking about a higher rate — $360. Not a huge difference, but it immediately raised my suspicions.

I’ll spare you all the gory details, but it’s important to share the lowlights of what happened next: » The company I originally contracted the job to the night before was inexplicably unavailable to actually do the move the next morning, and apparently passed it off to another firm. » My original contact, who was easily available on cell phone repeatedly the night before, suddenly was nowhere to be found. » Once the truck was loaded, the fee increased to $450. » Upon arrival in Waterloo, the movers said the fee was $500. “It’s taking longer than we thought, and the furniture is heavier.” » “Sure,” I said, “right after I call the police.”

With that, the sordid tale ended.

The job not complete, left for us to move the furniture indoors, now the

victims of one of the top 10 scams monitored by the Better Business Bureau (BBB).

“I could write a thesis on this,” John Levi, president of the Canadian Association of Movers (CAM) told me.

CAM offers consumers the following tips on how to avoid being scammed by unscrupulous movers: » Find reputable movers through the CAM, BBB or provincial government consumer protection agencies » Ask three movers for estimates in writing » Get the terms and conditions in writing » Ensure your goods will be protected for loss or damage » Read customer reviews on movers’ websites and other forums “Consumers have recourse with their provincial government’s consumer affairs department and with the Better Business Bureau,” says Levi. “Both of these avenues are fraught with difficulties and often take many months to come to some form of resolution — satisfactory or otherwise. And often, the mover simply out-waits the consumer.

“It’s far simpler and more effective to engage a reputable mover in advance rather than trying to fix a bad situation after the fact.”

My example, though painful and infuriating, is minor compared to other common horror stories involving similarly unsuspecting clients.

Make sure you take the proper steps — and the time — to protect yourself.
