The Human Rights Code protects renters against discrimination. You can’t be refused an apartment based on family status, race, religion, gender, and more – but in Alberta and Manitoba a landlord can turn down an applicant based on age.

It’s a bit contentious, because some provinces allow “Adult” rental buildings, where the 50+ crowd can be assured they won’t be getting any young neighbours.

Why some provinces and not all or none? Why should the 50+ crowd be given the right to live free of youthful residents? Does being 49-and-under

equate to a noise level or a lifestyle incompatability with that of a person aged 50+?

While creating an “Adult” community makes sense on some level – wanting a like-minded community that trends towards a quiet and conservative setting, and I’m sure there are buildings in every province that “just happen to have” only adult residents, it is strange that age isn’t universally protected.

villages, the largest of which is Fonthill, the area of Niagara known as Pelham is located to the west of Thorold and Welland, south of St. Catharines, and east of Lincoln.

Taking it easy seems to be the order of the day in Pelham. Other than cyclists, you won’t see anyone here in a particular hurry. The weekly Farmer’s Market on Thursday evenings is a major social event.

The abundance of good Italian food, incredible natural beauty and generous spirit are probably the best reasons to choose this particularly rural part of Niagara, from a city

slicker’s perspective.

Rural and idyllic, Pelham has a very different feel from the busier Niagara communities that surround it. Perched atop the Niagara Escarpment, you can turn onto nearly any side road heading north and catch a breathtaking view of Lake Ontario in the distance. While much of the area is still farmland, dotted with the occasional four-corners hamlet, there’s real suburban growth occurring.

Home to a slightly older population than other parts of Niagara, the dream of retiring to the country is a reality for many folks here. Residents

are down-to-earth, friendly, and extremely proud of the area’s rich history and agricultural heritage. It seems like a place that would be welcoming to newcomers regardless of their origins.

Given its rural setting, it’s no surprise that the best way to get around Pelham is by car. There is Highway 20, and the 406 connects to it as well as the QEW and Highway 3.

The St. Catharines Transit Pelham Rd. route will get you close, and Welland offers a similar not-quite-there service. Bike trails abound, but these are more useful for recreational rides.

Anne Marshall has lived in New York City, Glasgow (Scotland), Greensboro (NC), Toronto, and somehow ended up back in the fabulous small city of Guelph, where she grew up. She loves nothing more than exploring new areas, peering into other people’s apartments, houses and yards.

SHOULD YOU GET INSURANCE WHEN YOU MOVE INTO A PROPERTY? When many renters move into their first property, there are many things that go through their mind. Meeting their roommates, finding their way around a new part of town or newfound independence. The thing that is usually forgotten is insurance for the Unit. It is usually not a priority when moving into a new place and many renters feel insurance is something they can do without.

According to the Insurance Bureau of Canada, about half of all renters do not have insurance. This is even

more prevalent amongst young people. However, insurance can save you a lot of headache and heartbreaks when moving into a new property.

Tenant insurance can be broken down into two main areas: 1. Contents insurance 2. Liability insurance CONTENTS INSURANCE Contents insurance protects your personal belongings,

such as your clothing, furniture or digital devices. This type of insurance usually costs a few hundred dollars and covers your belongings in cases of theft, fires, flooding, freezing or windstorms. It may even bail you out of a simple mistake. For example, you could go on a trip and decide to turn off the heat for a few days. However, while you are away, the temperature drops and the pipes freeze, causing flood damage to all your clothing, furniture and electronic or digital devices. Contents insurance could really ease the cost of replacing your valuables. Be careful, however, as you need to understand the exclusions and limitations in any policy you obtain.

LIABILITY INSURANCE Liability insurance can be even more important than contents insurance. For example, in our flood example above, the flood could leak through the floor and damage the unit and its contents beside or under yours. Even if the landlord has insurance, the insurance company, tenant below, or landlord could go after you for the cost of the damages. Here is another possible scenario: standing on your balcony overlooking the park, sipping a glass of wine, your phone rings; startled you reach for it, dropping the glass, it bounces on the balcony railing and sails into the night. Below a father of eight is walking his dog when the glass smashes him in the head, killing him instantly. The dog runs onto the street and is hit by a car. You face potential litigation of impossible magnitude… Liability insurance will protect you to the extent of the insurance, should these issues occur.

Do not believe that the landlord’s insurance will cover your damages. First, the landlord’s insurance only protects the landlord’s own property and personal liability. Your possessions will never be covered by the landlord’s insurance unless the damage was caused by the landlord. Second, if your neighbour’s property is damaged due to a fire or flood originating from your unit, the landlord could sue you for the damages caused to the neighbouring property. This is evidenced in the case Taylor v Allard , where the tenant was 50 per cent liable for the damages caused to the neighbouring property.

Third, landlords are not responsible for providing alternative accommodation should your unit be involved in some accident. Therefore, having a Tenants Insurance policy that will ease the financial burden of moving and staying in a new place while repairs are being made on

the rental property (provided you bought that coverage).

Lastly, there is case law which shows a landlord can demand that their tenant has insurance. In the 2005 case of Stanbar Properties Limited v. Brooke, the Ontario Superior Court of Justice upheld that tenant insurance coverage, if required in the lease, is enforceable and can be grounds for eviction. Make sure to read the lease to see if the requirement for having tenant insurance is written in the contract.

Insurance may or may not be required when signing a lease, however, it is always a good thing to have.

MY APARTMENT IS A nonstop question zone. I have very limited space, yet still enough space to constantly be asking myself “Why did I buy this? And this? And that!” I’ll admit, when I moved into my first apartment I got a little excited and, despite budget restraintes (zero budget), I went a little crazy with what I considered investments.

It’s not that all the items in my apartment are totally useless. It just took me some time to figure out they don’t all fit with my kind of lifestyle. Still, I like to think I’m not the only one to blame. Seriously, no one could have warned me not to buy any of these seven ridiculous items?

SOUND SYSTEM: Besides the fact I would actually like to be on good terms with my neighbours, a sound system is just not at all necessary for my tiny apartment. Let’s face it, the sound from my iPhone speakers reach from the kitchen to my bathroom just fine.

ELEPTICAL: Everyone who owns a piece of exercise equipment knows they don’t use it half as much as they should. Then there’s the fact I’m constantly bumping into it when I get out of bed in the morning.

KING SIZE BED: About 2/3 of the furniture I assembled from IKEA seemed a lot smaller online then in my actual rental. Now my bedroom looks like it could belong to Shrek.

LUXURY KITCHEN APPLIANCES: Kitchen appliances like a blender, Vitamix, and KitchenAid, I consider a luxury because you have to have the luxury of having a decent amount of counter and cupboard space to be able to use and store any of these items. Do you know how many different produces go into a Martha Stewart smoothie?

DECORATIVE PILLOWS: How many pillows can you fit onto one sofa?

The answer is a lot! The pillows look great. The only thing is I’m constantly looking for space to place all these pillows when it comes the time to sit on the only couch in my apartment. If you haven’t guessed yet - it happens a lot.

LOUNGE CHAIR: Summertime is so short. You better believe I invested in a state-of-the-art lounge chair to make the most of my balcony. The only thing is, the lounge chair is now the only thing that fits on my balcony. Any suggestions on where to store a lounge chair now that it’s winter?

VACCUM CLEANER: I really had the best intentions to keep my rental as clean as possible when I moved in. Of course, that meant I had to invest in the right cleaning appliances. The thing is when you have a small space, ends up your cutting edge vaccum cleaner doesn’t fit under any of the funiture and appliances which take up like 90 percent of your space. Just one more 12 pound item for me to store.

Now, I wonder how much I can sell these items on Kijiji for...

MOVING CAN BE a real chore.

Between apartment searching, paperwork, giving notice and booking movers, you’re probably finding yourself impatient to get it all over with. As excited as you might be to get out of your current place, it’s a good idea to build in a few days of overlap between your old and new lease. Having extra time to clean, pack and tie up loose ends before turning in your keys can help cut down on moving day stress.

But if your old lease ends right when your new lease starts, things can get a little tricky. According to the Landlord and Tenant Board of Ontario, you’re required to be moved out of your unit by 11:59pm on the last day of your lease, and you can take possession of a new unit at 12am on the first day of your lease.

“It’s not ideal to schedule your

move on the exact closing date of your lease,” says Nicole McNeely, marketing manager at Park Property Management. If you’re timing your moves very closely together, make sure to talk to your both your old and new landlords. In some cases, they may have some flexibility to add a couple extra days on your lease or let you move in early, so you and your boxes won’t have to resort to couchsurfing at your great-aunt’s house.

Also, If there’s currently a tenant living in the unit you’re slated to move into, it wouldn’t hurt to confirm with your new landlord that they’ll be gone by the time you’re planning on moving in, to avoid any unwelcome surprises.

In the event you find yourself having to move out and in on the same day, it’s important to be organized. McNeely suggests getting in touch with the superintendent to book an elevator, if needed, and

coordinating with your moving company to ensure your belongings can go straight from your unit into the truck. This way, you’re not wasting time waiting for the movers to show up, or paying extra for your movers to wait around until the elevator opens up.

Being organized also includes being fully packed and ready to go on the day of the move. McNeely estimates that it can take two people at least three days to pack a threebedroom home, so it’s important to give yourself enough time. You may also want to arrange for your mail to be forwarded to your new address, so you don’t miss the delivery of any important items.

Even though moving may never be your idea of fun, keeping these things in mind can help make the process headache-free.
