Get it in writing and have your lawyer review your agreement

B

uying a brand-new home offers you an opportunity to customize it to your liking. It can be a dream come true and an investment for the future – but don’t forget, it’s also legal transaction.

The term “get it in writing” has never been more important in the case of the new-home purchase, since such a document outlines everything your home will have in it, on it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms and conditions between you and your builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon.

Since building a home is much more complicated than a resale transaction where the unit and/or property likely already exists, there is no set Agreement of Purchase and Sale or standard contract for buying a new home. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their new-home warranty program. Builders often prepare their own agreements, so contracts can vary from one builder/ developer to another and from province to province.

Before you sign a contract, review it carefully with the builder and ask questions to make sure you fully understand what it contains. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document and an agreedupon contract, so seeking the services of an experienced real estate lawyer is an important step toward ensuring that your dream home becomes a reality.

Ask those taxing questions

Whether from your mortgage broker or financial advisor, the right answers could save you hundreds if not thousands

W

hen you’re buying a home, particularly your first home, you will need the advice of several professionals: builder, lawyer, mortgage broker or banker, financial advisor and so on. But none of them has the personal stake in the deal that you do. Indeed, it is your transaction, your future and, ultimately, your money.

This is why it’s essential to ask questions. Don’t understand something? Ask. Don’t get a satisfactory answer? Ask again.

Take this scenario brought to our attention by Alyssa Richard, CEO of ratehub.ca. First-time buyers who are looking to buy together with a buyer who is not a first-timer, can still use the Home Buyers’ Plan to withdraw $25,000 from their RRSP, taxfree, for a down payment. But they cannot claim the First-Time Home Buyers’ Tax Credit of $750.

“Another surprise had to do with land transfer tax rebates. In Toronto, qualifying first-time homebuyers can claim a total rebate of up to $5,725 for both the Ontario and Toronto land transfer tax. If you’re buying with someone who is not a first-time homebuyer, many first-time buyers assume they can’t claim those rebates. But you can – 50 per cent is yours to claim.”

Instead of being able to claim the full rebate of $5,725, you could claim $2,862.50, which of course is better than nothing.”

Whatever your own circumstances, take the time to ask those challenging, if difficult, taxing questions. The answers could save you hundreds if not thousands.

There is no shortage of benefits afforded to homebuyers who opt for Green building features in their new home. And make no mistake: it is far more cost effective to implement energy saving features in a newly built home than to retrofit an existing house. This creates a

unique point of distinction for today’s new homes as compared to those built as recently as five or 10 years ago. Green technology and its implementation has come a long way, providing homebuyers with an unprecedented wealth of opportunities to reduce their carbon footprint while enjoying significant savings in their utility costs.

INSULATION One of the most important Green upgrades to consider when buying a new home is proper insulation. Heating and cooling can account for nearly half of your home’s energy consumption. Proper insulation will ensure the expensive energy that’s heating and cooling your home isn’t escaping through the windows or roof. To make your home even more of an insulated fortress, you may also consider upgrading your weather stripping and sealant around the doors and windows.

GEOTHERMAL Many of today’s premier builders are pioneering the shift to geothermal energy in their new home and condominium developments. Using 30 to 60 per cent less energy, running quieter and requiring less maintenance than typical HVAC systems, geothermal systems use a loop of underground water piping to transfer heat from the earth below where its cooler to your home.

SOLAR PANELS Solar panels have long been an attractive way to reduce the energy consumption of a home. A solar electric system compares very favorably with other home improvements in percentage of cost recovered, particularly

as electric rates rise. In addition to the energy savings, solar panels constructed with the home’s esthetics in mind can have a visible and positive impression on future homebuyers. They can literally see this is a Green energy home, providing long-term benefits for them as well.

WATER HEATERS Many consumers tend to overlook the expense of heating water for their daily needs, even though up to 20 per cent of each household’s energy budget goes toward it.

Tankless water heaters offer increased efficiency with no decrease in comfort or convenience for homeowners. Instead of a large 50 to 60 gallon tank that heats and stores the water, tankless water heaters use extreme heat to raise the water temperature as it passes though the pipes, resulting in instant and continuous hot water. Tankless heaters last approximately twice as long as traditional tanks and provide energy savings.

APPLIANCES With newly-built homes, everything is new – including home appliances. Kitchens are outfitted with new refrigerators, ovens and dishwashers, often from a series of design options the consumer controls. Most reputable builders are offering Energy Star appliances in their design centres, helping customers select attractive and energy efficient appliances. Wisely investing in upgraded appliances will also help to increase the resale value of your home, too, since appliances can be a major focal point for homebuyers.

MISCELLANEOUS Something as simple as having a ceiling fan installed to circulate warm air from the ceiling to the floor can actually save you 10 per cent on your heating bill.

Excess space in homes no longer has the appeal it once had.

Smaller homes that eliminate wasted space with formal living rooms and/or media rooms that are connected to the core areas resonate with today’s buyers.

For those looking to really reduce their carbon footprint when buying a new home, don’t discount walkability. The ability to stroll to parks, shopping and schools greatly reduces dependence on cars improving both personal and environmental health.

There really is no limit when it comes to finding new and innovative ways to enhance a home’s eco-friendliness.

Everything from air filtration systems, to the home’s orientation to the sun and the color of the roof can constitute as Green upgrades. Options will vary by builder and the development, however many consumers will see dramatic reductions in your monthly energy bills by taking advantage of these features.

And when the time comes to sell your home, you will be able to continue to reap the rewards of today’s Green technology.

udging by population growth alone, Ancaster is the place to be. But there’s much more than that to this thriving bedroom community adjacent to Hamilton. Its historical village of shops, pubs and restaurants and an abundance of recreational walking trails and scenic surroundings and even a tiny, treed roadway known as Lovers Lane make it a picture-perfect community in which to live and raise a family.

Ancaster presents an intriguing dichotomy that offers an old-town atmosphere that contrasts with new-home communities and substantial retail services wrapped within greenspace and conservation lands. Ancaster is one of five

other communities absorbed by the city of Hamilton in 2001. From 1970 to the present, the population has essentially doubled to 33,000. Even in 1823, Ancaster had the largest population in Upper Canada with 1,681 townspeople in comparison to Toronto’s 1,376 and Hamilton’s 1,000 residents.

Located on the Niagara escarpment, the former town offers a 200-year history of industry, agriculture and military.

Ancaster was settled in the 1790s and played a role in the War of 1812. By the 1830s, Ancaster was the commercial centre for the area. In an age before electricity, Ancaster was able to tap an abundance of energy through its mills from streams and

Ancaster’s population began to increase after the Second World War when subdivisions around the village were established. The population increased again with the completion of the Hamilton-Ancaster section of Hwy. 403 in 1968 and the introduction of sewer systems in 1974. True to history, Ancaster offers the most growth of the five communities within Hamilton, and has double the growth rate of the province of Ontario. Ancaster’s population of very young is the fastest growing in Hamilton, a figure attributed to the family-oriented lifestyle and sense of community in this area. At the other end of the scale, there is also considerable growth in the population over 65 given the number of adult-lifestyle communities, retirement residences and long-term care facilities that have been built here.

The original farming community of Ancaster began its metamorphosis from old town to shiny new urban centre decades before amalgamation with a small-town atmosphere that drew families and caused a boom in home building and commercial development. Best known is The Meadowlands, a master-planned community of retail and service-oriented businesses designed to serve thousands of new homes that have been built in the past 20 years in the residential component across the road. At the junction of Hwy. 403, just moments from the QEW, and the Lincoln Alexander Pkwy., this prime position places residents within moments of downtown Hamilton and Burlington, Brantford and Stoney Creek. Commuters are a predominant part of the Ancaster population.

In addition to being at the crux of all of the region’s highways and byways, Ancaster is only moments from the John. C. Munro Hamilton International Airport, which is gaining popularity as an alternative to the busier airport in Toronto. Hamilton now has great links with low-cost air carriers to the rest of Canada as well as charter flights to a variety of destinations.

As part of the amalgamated city of Hamilton, Ancaster also has a labour force in flux with the downsizing and closure of a number of manufacturing operations. But, being a bedroom community, employment in Ancaster isn’t dependent on operations only within the town, but also the opportunities beyond. Residents of Ancaster can be found in the employ of Hamilton’s largest employer – Hamilton Health Sciences and the five hospitals under its umbrella. Other major employers include McMaster University and the public and separate school boards. While not the giants they were a decade or more ago, the manufacturing sector and the steel industry remain prime employers in the Hamilton area. Ancaster’s retail sector is thriving with retail giants such as Costco, Walmart and creeks within a break in the escarpment.

It is located at the end of Mohawk Rd., which, in the 18th century, was one of the most important transportation routes in Upper Canada, making it a strong candidate for capital of Upper Canada.

Unfortunately, transportation was key to economic success in those days. The Desjardins Canal was built in the rival village of Dundas giving lakers access and the railroad was introduced to Hamilton – both drawing industry away from Ancaster and ending its days as a commercial hub.

Fortunately, agriculture ensured Ancaster remained a vibrant community.

It has been regarded as one of the top golf courses in Canada and ranks second on Canada’s list of best golf courses by Scoregolf magazine.

Recreation got an added boost to serve this growing community with the addition of the Ancaster Rotary Centre and Morgan Firestone Arena. It includes a full-size gym, workout complex and meeting rooms. It is surrounded by the Robert E. Wade Park with four baseball diamonds and five soccer fields. Nearby is the Lions Pool, an outdoor pool still enjoyed throughout the summer months.

For more than two centuries, people have been drawn to Ancaster’s beauty and location and there are no signs of that slowing down now or in the future.

New Horizon Homes’ Jeff Paikin Honoured as Royal Bank of Canada’s Citizen of the Year Jeff Paikin, president of New Horizon Homes, was recently honoured by the Hamilton Chamber of Commerce as the Royal Bank of Canada Citizen of the Year for 2013.

The well-known Hamilton area home builder and co-owner of the Hamilton Bulldogs, is helping to spearhead downtown development, and is the driving force behind numerous charitable causes in the Hamilton community.

Among his many philanthropic efforts, Jeff is behind the B’nai Brith dinner, which has raised more than $1 million for organizations such as Shalom Village, the YMCA, Mohawk College and many more. Jeff has also contributed to the development of the Eva Rothwell Resource Centre and the Larry Paikin Literacy Express.

Among the numerous organizations Jeff contributes to, he is an active participant and past chair of the Hamilton-Halton Home Builders’ Association, a founding member of the TigerTown Council and chair of the Transformation Campaign for Hillfield Strathallan College.

More than 200 people attended the recent awards dinner at Liuna Station that featured guest speaker Ken Austin, head coach and general manager of the Hamilton Tiger-Cats.

Paikin thanked his wife and children, business partner, friends, past winners and his parents, who came up from their vacation home in the south to attend the dinner.

One of the largest expenses we have tends to be the mortgage on our home. Following traditional rules, we are limited to deducting, at best, a small percentage of the interest where we use a home office for business purposes.

However, using non-traditional planning, we are able to deduct potentially 100 per cent of the interest costs.

A variety of versions of the plan exist, and vary in aggressiveness and implementation to suit your needs and comfort.

Your tax savings will vary based on where you live in Canada, your income level and the amount of interest you pay.

As a quick example, though, with a mortgage of $200,000 at 4.5 per cent, your tax savings could be approximately $3,000 per year. While this may not by itself create financial freedom, imagine receiving these savings year after year – with minimal effort required. Imagine the impact of a higher interest rate or larger mortgage.

A popular nickname for describing some of the possible techniques is the “Smith Manouevre,” coined by Frasor Smith.

A variety of versions of the plan exist, and vary in aggressiveness and implementation to suit your needs and comfort. With a Supreme Court decision related in part to questions surrounding the appropriateness of interest deduction plans, tax advisors have largely been given the green light to help clients restructure their affairs in an optimal fashion.

In its simplest form, these interest deductibility techniques allow homeowners the ability to convert the non-deductible portion of the interest on their mortgage to fully deductible over a period of time. The period is typically several years, however, your financial situation and aggressiveness may dramatically decrease this time.

Talk to your tax, mortgage and investment advisors to determine whether such a plan can work for you and that you are comfortable with the full implications.

A variety of mortgage products provide the ability to divide your mortgage into at least two segments, which allows you to track the interest expense on these segments separately.

Your total mortgage will typically be set at 75 to 80 per cent of the value of your home. If you are permitted a total mortgage of $200,000 on your home, you may start with the “bad” portion (non-deductible) of the mortgage at this $200,000 and the “good” portion (deductible) of the mortgage at zero. As you make payments on the mortgage, your principal on the bad mortgage will decrease, leaving you additional room to borrow on the good debt. In other words,

your total mortgage may still be $200,000, however, it is divided between good and bad debt.

So, what do you do with this good debt? You invest. Traditionally, this was thought of as an excellent vehicle to acquire mutual funds and similar investments. However, this may be a great opportunity for you to go beyond that and invest in your business.

You may be able to shorten the conversion time of your bad debt where, for example, you have non-registered financial assets that can be sold and the proceeds used to pay down some bad debt. Tax refunds, inheritances, unexpected sources of funds, extra mortgage payments are further ways of speeding up the conversion.

While restructuring must be done properly, your efforts will be rewarded.

Talk to your tax, mortgage and investment advisors to determine whether such a plan can work for you and that you are comfortable with the full implications. Also, work closely with your mortgage advisor as you pay close attention to the features of the mortgage product that you use to ensure you have the required flexibility to accomplish your goals. There are significant differences between the products beyond the interest rates which command your attention.

Saving for retirement outranks reducing debt in 2014 for Canadians: RBC poll

Reversing last year’s rankings, more Canadians are citing saving for retirement as a top financial priority compared to those who are prioritizing paying off debt, according to the 24th Annual RBC RRSP Poll.

More than half (52 per cent) are now focusing on increasing their retirement savings, with 48 per cent placing a priority on debt reduction, compared to 44 per cent and 54 per cent respectively in last year’s poll. This reversal of financial priorities is even more marked among middle-aged Canadians – those 35 to 54 years old – with almost two-thirds (62 per cent versus 52 per cent last year) focusing on saving for retirement ahead of reducing debt (52 per cent versus 56 per cent).

“These findings indicate Canadians are more comfortable with how they are managing their debt and this is allowing them to focus more strongly on retirement savings this year,” says Bill Hill, national retirement planning consultant, RBC. “To help ensure those savings will support the retirement they have in mind, we recommend they review their lifestyle and financial goals with a financial advisor as early as possible.”

The annual RBC poll also found that RRSP ownership among those aged 35 to 54 has jumped to 68 per cent from last year’s 58 per cent. In addition, one-quarter (26 per cent) of middle-aged Canadians has determined they will need to save, on average, $545,000 for a comfortable retirement.

“This is the age group that needs to be planning now for the lifestyle they want to have in retirement,” Hill says. “As Canadians who have already retired know, there is so much more to your retirement years than just the money you think you’ll need. The beginning of each new year is a good time to sit down with a financial advisor to explore all aspects of a successful retirement – you may well find you have more options than you are aware of today.”

Follow these steps to see if you’ll qualify for a mortgage on your dream home

Calculate the combined monthly before-tax income of you and your spouse.

Divide by three. This figure is the monthly payment you can afford to make on your home.

Take the total price of the home and subtract the amount of money you expect to make as a down payment. This is the money you will have to borrow.

Refer to the chart on the opposite page. Look down the left column and locate the interest rate you expect to pay.

Line this up with the amortization period of your choice. (Most firsttime buyers take the 25-year amortization.)

Add to this your estimated monthly heating costs and monthly property taxes.

If this figure is equal to or less than one-third of your gross monthly income (calculated in Step 2), you’ll qualify for a mortgage on your dream home.

Multiply this figure by the amount you need to borrow.

Divide by 1,000. » Bear in mind that this is a rough estimate. If you have several other large loans already, you may qualify for less. Also, banks and trust companies vary in their policies. It was almost one year ago – March 2013 to be exact – that Target Corp. began opening the fi rst of its approximately 125 stores in Canada. The U.S. retail giant announced in 2011 it was moving north with a $1.8-billion acquisition of up to 200 Zellers store leases, with most of the initial openings coming from renovating existing Zellers locations.

While the expansion may not have gone quite as planned, with Canadian consumers not exactly enthralled with Target’s product offerings and pricing strategy, there’s no question the move will continue to have a significant impact on the Canadian retail landscape – particularly as the company builds greenfield outlets in new locations.

Now comes news that Wal-Mart plans to spend $500 million completing 35 supercentre projects over the next year.

The U.S. retailer says it will spend more than $376 million to build, expand, relocate or remodel stores, as well as invest additional funds on operational improvements in Canada.

For homeowners and prospective homebuyers, this is all good news – and a very good reason to pay attention. Such major retail developments are a significant influence on land development and housing.

When the likes of Target, Walmart, RONA and other major players set up shop, particularly in a new location, it’s a good sign an area is on the upswing.

Like proximity to mass transit, schools and other amenities, being close to shopping is a major attraction for builders and, of course, prospective homebuyers. These features are among the key determining factors to enjoying your home while you live there, as well as for potential resale value in the future.

Large retailers and commercial ventures don’t just pop up in the middle of nowhere or in declining neighbourhoods.

These companies make careful, long-range and well plannedout decisions in lockstep with municipalities and developers, based on hard data, research and demographic information.

This is why major retail expansion is good news: it’s an indicator the economy continues to strengthen; and, for those looking to buy a home, it’s a sign to look out for new or expanding neighbourhoods and solid buying opportunities.

Large retailers and commercial ventures don’t just pop up in the middle of nowhere or in declining neighbourhoods.

Such retail developments, combined with the associated employment gains and economic and infrastructure improvements, point to new and expanding homebuying options.

So, while you’re out there looking for your new home, look around for the big box stores. If they see a bright future for your prospective neighborhood, chances are it will make a sound buying decision for you.
