WHAT YOU NEED TO KNOW ABOUT CANNABIS USE Oct. 17 came and went without much ado – well, except for the fact that the recreational use of cannabis became legal in Canada. You may think this has nothing to do with you; you don’t smoke anything at all and never will. Or you do smoke and are thrilled you are no longer doing something illegal.

But whether you use cannabis or not is pretty much beside the point. As a renter, you live in a community with other people and share common spaces. In order to do so in relative peace and harmony, you have to follow the rules and regulations that have been put in place to ensure residents can live together in an atmosphere of mutual respect.

So what are the rules, if any, for the recreational use of cannabis? Is it okay to smoke in your apartment? What about on your balcony or in the hallway? And if you’re not a cannabis user and the smell and smoke of weed inflames your asthma, is there anything you can do?

Even in these early days of legalization, rules have been put into place. If you do have questions, a good place to find some answers is on page 8 of this issue of Renters Guide.

rent increase guideline for 2019 The rent increase guideline for 2019 is set to a limit of 1.8 per cent. The guideline – in effect from Jan. 1 to Dec. 31, 2019 – applies to most private residential units covered under the Ontario Residential Tenancies Act. This means rental units in apartment buildings, condos, houses, a room in a rooming or boarding house and basement apartments.

Your landlord can raise your rent 12 months after the last rent increase or when you first moved in. However, to do so, your landlord must give you at least 90-days’ written notice before the increase takes effect, and he or she must use an N1, N2 or N3 form. Landlords can only raise the rent once in a 12-month period.

In some cases, your landlord can

ask for a rental increase greater than the government limit, but they can only do so under certain circumstances, and they must first apply to the Landlord and Tenant Board (LTB) to get approval.

Examples of asking for a larger increase include: If your landlord’s municipal taxes and charges have increased significantly or if he or she has done major repairs or renovations (these are called capital expenditures).

Rent increases for special circumstances can’t be more than three per cent above the guideline each year. If your landlord justifies an increase that is more than three per cent above the guideline, the increase can be taken over three years – up to three per cent above the guideline per year. For

increases in the cost of municipal taxes and charges, there is no limit on the amount of rent increase that can be approved.

If your landlord wants to do major repairs, renovations, buy new equipment for your rental unit, or add a new service, you and your landlord could agree to a higher rent increase, but it must be done in writing. The proper form for this agreement (N10) is available from the LTB. The highest increase that can be agreed to is still three per cent above the guideline, but if you and your landlord agree to the increase, he or she does not have to apply to the LTB for approval.

You have five days after signing this agreement to change your mind and tell your landlord, in writing, that you no longer agree to the rent increase.

Up in smoke: Some rules SUrroUnding cannabiS USe Recreational use of cannabis is now legal in Canada. What does that mean for renters? To help answer some questions, the Federation of Rental-Housing Providers of Ontario (FRPO) provides some up-to-date information on how your landlord or property manager are permitted to deal with these issues. review of recenT AcTiviTy:

Some background: There was a flurry of activity leading up to Sept.

26, when the province announced its new rules that will allow cannabis to be smoked wherever cigarette smoking is permitted.

Since then, the government updated its webpage to provide additional details. The “Where to use it” section states: Additional restrictions on smoking and vaping may exist in municipal bylaws, lease agreement and the policies of employers and property owners.

In addition, on Oct. 11, the Ontario Human Rights Commission (OHRC) released a new policy statement on cannabis and Ontario’s Human Rights Code, which confirms that provincial smoke-free legislation prohibits smoking or vaping cannabis for a recreational or medical purpose in common areas of apartments and condominiums. The Commission acknowledges that people can smoke, vape or consume edible cannabis for medical or recreational purposes inside apartments and condominiums unless there are rules or by-laws against it.

1. can residents smoke cannabis in their apartment or condo unit?

Generally, yes. People can smoke, vape or consume edible cannabis in their residential units and balcony or terrace either for medical or recreational purposes, except where laws or rules prohibit smoking or vaping cannabis and tobacco for public health reasons.

Ontario prohibits smoking or vaping cannabis for either purpose in common areas of apartment and condo buildings. Residents can consume edible cannabis for a medical purpose related to a disability anywhere on the premises of their residential building.

2. what happens if cannabis smoke from other units affects people with disabilities like asthma?

Smoke or vapour from cannabis used for medical or recreational purposes might negatively affect other building residents, including people with chemical sensitivities and other disabilities. Housing providers have a legal duty to look for solutions and accommodate the disability-related needs of people who use cannabis for a medical purpose related to a disability, as well as of other people with disabilities who are affected by cannabis smoke or vapour, unless it would cause undue hardship. All parties have an obligation to cooperate in the process of finding solutions.

3. can a landlord or condo board ban smoking in residential units, balconies and terraces?

Yes. There are no laws against banning cannabis smoking or vaping in units, balconies or

terraces. However, a housing provider would still have a duty to accommodate a person who smokes or vapes cannabis for a medical purpose related to a disability, unless it would cause undue hardship. A rule that permits residents to smoke or vape tobacco in their units and balconies but prohibits cannabis use for a medical purpose related to a disability might violate the Code. whAT does This MeAn for renTers?

Your building may transition to become smoke-free, with no cannabis cultivation allowed.

Already many multi-residential housing providers, property managers and condominium corporations have rules, regulations or by-laws prohibiting the smoking or vaping of any substance within a unit. If you are a cannabis user, this is something you may want to check before signing a lease.

JAYSON SCHWARZ Whether you’re buying or renting a condominium, pools are often high on a house hunter’s list of desired amenities. But as a developer, landlord, condominium board or purchaser, before you dive into the deep end, it’s important to be aware of the rules and regulations that govern public pools.

The Health Protection and Promotion Act Regulation 565 Public Pools came into force on July 1, 2018. The regulation did not provide for any transitional time, so all organizations have to be in full compliance. This new regulation governs public pools and their maintenance. The regulation applies to all pools in a condominium or apartment building, with more than six units.

This new regulation sets out clear rules and procedures for the maintenance of public pools.

While the regulation aims to protect public health, it means stricter rules when it comes to the operators of public pools.

These revised requirements aim to eliminate inconsistencies and improve clarity and public safety through testing and recording frequencies, general facility maintenance, first-aid box contents and operator training.

requirement. Pool operators are now required to notify the medical officer of health or public health inspector of their intent to operate a pool in writing at least 14 days before the pool is put into use after construction or after any closure that lasts for more than four weeks.

Rules with regard to on-site posting have also been revised.

The regulation stipulates that the results of any inspections conducted by a public health inspector are to be posted. This requirement aims to provide more open and transparent information to the public and support compliance efforts.

The regulation has also introduced strict rules on operator training. Each pool operator needs to be trained in its operation and maintenance, filtration systems, water chemistry and all relevant safety and emergency procedures.

NEW SAFETY REQUIREMENTS

The Ontario Building Code currently requires that pools with a slope of greater than eight per cent be equipped with the fittings for a safety buoy line. This was following a recommendation that all unsupervised pools, i.e. those

The regulation also stipulates that ground fault circuit interrupters must be tested more frequently and first-aid kits are required to have sufficient quantities of supplies.

NON-COMPLIANCE LEADS TO PENALTIES

Now under the Provincial Offences Act (POA), public health inspectors are authorized to issue provincial offence notices (tickets) for infractions. The fine amounts vary depending on the severity of the infraction.

WHAT DOES THIS MEAN TO YOU?

So how does this affect you, the prospective purchaser of a condominium or renter of an apartment? It means that the pool should be a safer, healthier place. That’s the good news. The downside is that the maintenance costs of a condominium unit will probably need to be increased to take into consideration the cost of implementing the new changes and the maintenance requirements that go along with it. For a renter, it means that a new rental in a building with a pool may have a rent increase.

So before you get in too deep, make sure you are familiar with all of the changes and what the impact will be on you personally.

RepoRt outlines the changing demographic profile of RenteRs The Federation of RentalHousing Providers of Ontario (FRPO) recently commissioned Urbanation, a real estate consulting firm, to research the rental situation in Ontario to shed light on any shifts in rental demand. Urbanation surveyed 12 Renters Guide | Oct. 27–Nov. 10, 2018

FRPO members and analyzed data from Statistics Canada and the Canada Mortgage and Housing Corp. (CMHC).

OvERvIEw

FRPO members revealed that young working adults under

the age of 35 were the fastest growing tenant type, followed by downsizers aged 55-plus.

Couples without children also ranked highest for growth, with most respondents indicating that children under 15 occupied between 10 per cent and 25 per

cent of their units. The strongest growing renter income group was between $60K and $80K, with most new tenants migrating from within the same city. FRPO respondents said generally, they wouldn’t make changes to the mix of units in their portfolios, although some would increase the share of two-bedroom units.

Respondents with properties across a number of different areas in Ontario reported that larger markets have seen a greater increase in higher-income downsizers and renters under 35 compared to smaller markets.

The highest share of growth in renter households between 2011 and 2016 occurred through the condominium market (32 per cent), while purpose-built rentals represented only 20 per cent of the growth in renter households during the five-year period — substantially less than its overall share of the rental stock at 57 per cent.

Driven to new supply, a particularly high concentration of condominium renters was under the age of 35. With more downsizing occurring and tight market conditions leading to significantly higher rents upon unit turnover and within the new stock, there was a relatively high share of renter household growth represented by twoperson households comprised of couples without children and roommates. Almost all the growth in renter households between 2011 and 2016 was concentrated among higher-income households earning $60K or more.

The overall share of one-person households remained significantly higher than the share of one bedroom and bachelor rental units, indicating that many larger two- and three-bedroom units were occupied by one person.

Furthermore, it was found that more than half of renters were spending less than 30 per cent

of their income on shelter. These outcomes may be connected to a disincentive for renters to move under rent control as well as a lack of suitable new supply.

The relatively less affordable Toronto market had a relatively low share of renters represented by households under the age of 35. Conversely, the relatively more affordable Ottawa market had the highest share of renters under 35. Toronto had an above average share of couples with children renters, and also the highest average incomes of more than $60,000. Renters in Kitchener-Waterloo spent the lowest percentage of income on rent, while also having the largest share of single-person households living in two- and three-bedroom rentals. whaT TypE Of hOusING DO RENTERs Occupy?

According to the latest 2016 Census, 57 per cent of renter households in Ontario lived in a purpose-built rental apartment.

The second highest share of rental housing was represented by single- and semi-detached homes at 17 per cent, followed by row homes and condominium units at 10 per cent each. The remaining five per cent of renter households occupied a duplex.

Between 2011 and 2016, condominium units represented the largest share of growth in the overall rental stock in Ontario at 32 per cent. Singles and semis comprised 26 per cent of the five-year growth, while purposebuilt rental buildings were under-represented with only a 20 per cent share of the increase in rental households.

In examining the distribution of renter households by housing type across the five largest rental markets in Ontario, the share

occupying apartments in buildings of five or more storeys was 58 per cent in Toronto, compared to shares ranging between 41 per cent and 44 per cent in Ottawa, London, and Hamilton. KitchenerWaterloo had a noticeably low share of renters in highrise apartment buildings at 28 per cent, with an equal share living in lowrise apartment buildings and other forms of rentals, mainly single-detached houses.

In terms of age distribution, the Toronto and Hamilton markets had 29 per cent and 26 per cent, respectively, of renter households represented by those under the age of 35. The Ottawa market had the highest share of renters under 35 at 36 per cent, as well as the lowest share of renters aged 55plus at 30 per cent. The Toronto market had 40 per cent of renters aged 35 to 54.

The share of single-person renters was 41 per cent in Toronto, and 43 per cent in KitchenerWaterloo. In Toronto, 20 per cent of renters were couples with children while couples without children who rented were most common in Kitchener-Waterloo with an 18 per cent share. Loneparent renters had the highest share in Hamilton (16 per cent) and roommates had the highest share in Ottawa (11 per cent).

RENOvaTION acTIvITy

To get a sense of the quality of the stock represented by the survey respondents, it was reported that more than half of units surveyed undertook renovation expenditures during the last five years to at least 20 per cent of their portfolio. The highest share of units represented by respondents (27 per cent) indicated that at least half of their portfolio had received upgrades.

It’s a family-friendly community on the cusp of gentrification.

While most of the population falls into the Boomer category, young professionals in their 20s and 30s are moving into lofts and condos. They’re attracted to the area for its reasonable cost of living, nightlife options and cultural scene.

HOLIDAY SHOPPING WITHOUT THE

HANGOVER GAIL VAZ-OXLADE

If you want to have a happy holiday that doesn’t leave you holding your aching head when the bills roll in come January, you have to start planning early. The longer you wait, the more you’re prone to give in to stress, make impulse purchases, blow your budget or even buy a lame gift.

Look at your holiday spending as you would any other big-ticket item. While you’re splitting the cost among a variety of expenses, the bottom line is still the same – you’re spending a lot of money in a short period of time.

In the best of all worlds, you would have started saving for your holiday spending in January.

Yup, you would have made it a budget item and set aside $10, $50, $150 a month so when the season rolled ‘round, you’d be ready. After all, it’s way easier to set aside $100 a month than to come up with $1,200 all at once.

This is how I do it, and come August I start keeping my eyes open for “deals” on things I know my friends and family will love.

Failing that, start here, with Gail’s Holiday Spending Plan: Write down the amount you want to spend in each category of holiday expenses. Gifts are only the beginning – don’t forget to account for travel costs, postage and shipping, decorating, greeting cards, entertainment and photos.

List the people you plan to shop for under the gift category, then divide up your budget accordingly.

Limit your budget to what you can afford right now and avoid a financial hangover in the New Year.

If you spend $500 on a credit card at 18 per cent interest, and pay the minimum each month, it’ll take you seven years – and cost $365 in interest – to pay it off. Consider setting a dollar limit on gifts or drawing names among extended family, roommates or co-workers.

Jot down any gift ideas that you might have for the people on your list. Comparison-shop online before heading to the store. (Don’t forget to include shipping costs in your calculations if you decide to buy online.)

A dash of planning and dab of creativity can also help you keep your entertainment costs under control: • Invite guests to bring something to share at a potluck dinner.

• Serve brunch, throw a fingerfood party or host a wine and cheese tasting instead of a fullblown turkey dinner.

• Co-host a party with a pal or sibling, and share the cost.

• Make sure you set a dollar limit

for your soirée. And list the items, ingredients and décor you’ll need and how much each will cost.

Remember, the best gifts don’t have to cost money. If you’re financially challenged this year, offer up your time babysitting, cooking meals, house cleaning, massaging, sewing, knitting, transporting, or whatever else you’re good at. Clip a picture of the service you’ll provide and be clear on how often, as in “I’ll babysit one weekend a month from February to June.” Or better yet, make your own coupon book.

KEEP THE PALETTE BLACK AND WHITE

I love colour, but I wanted to try something different and edgy in my basement. Creating this space has shown me the power of a minimal palette of black and white. The way to keep things interesting is to vary your patterns but within the black and white theme. Think stripes, geometric prints and high contrast cabinetry.

UTILIZE FLOOR-TO-CEILING CABINETRY

Putting in floor-to-ceiling cabinetry is my secret weapon in playrooms. This allows you to hide all the visual clutter and chaos that comes with toys, books, cards and all that fun stuff behind beautiful, 20 Renters Guide | Oct. 27–Nov. 10, 2018

closed storage. You get to close the door on visual clutter, and it is a big reason why I love spending time in this room. I worked with Tailored Living (tailoredliving.com) in this space. They make it so convenient for you to achieve organizational goals.

I wanted high contrast in the cabinetry, so I chose white modern shaker cabinets on the perimeter of the room, and dark drawer fronts on this generous island that allows my kids ample room to spread out and get messy. I used laminate for its durability as well as its accessible price point. To add a bit of sparkle to the space, I added handmade, rustic pulls by Shayne Fox Hardware (shaynefoxhardware.com).

KEEP THE BLACK MATTE

I chose to put a sink in this space, as it’s so practical with my seven little kids. In keeping with my monochromatic colour scheme, I chose Delta’s (deltafaucet.ca) new Esque faucet. And, I continued the matte black with the wall paint colour. I don’t think I would have been as bold to do this if I did not have so much natural light in this space – but I’m so pleased with how this Wrought Iron colour

Whenever I use dark shades, I like using it with a matte finish, as opposed to eggshell or satin. It’s rich and lush and I love its modern look.

We had large individual portraits of my children blown up to fit these inexpensive frames. This might be my favourite element in my basement. We hung them around our TV about three inches apart, and it creates a graphic element that makes me smile every time I enter the room. Keeping things black and white helps the TV blend in.

CREATE A SPACE FOR THE GROWN-UPS

Put years past behind you and make a few simple changes. These tips will help replace the holiday stress with holiday joy.

AVOID GIFTS THAT CLUTTER: Give

gifts that can be consumed rather than those that take up space.

Consider giving candles, gourmet food baskets, vintage wines, fresh floral arrangements, jams and jellies, etc. Gift certificates are also appreciated by those who want to streamline their homes.

CLEAR AWAY THE ‘EVERY DAY’:

For more impact and less clutter, remove your every day decorative items from tabletops and mantles before you display your holiday decorations. You can store them temporarily in the boxes that held your decorations.

HELP FOR THE HOST: Hosting

a holiday soirée this year? Don’t be a superhero – accept help.

Make it a potluck. People enjoy contributing and it makes the meal more interesting. While you’re at it, consider putting your kids to work during the event or hiring students to help out. AVOID MALL MADNESS: Do you get stressed when shopping for gifts at the mall during holiday season? Do the long lineups and limited parking dampen your mood? If you start early, there’s plenty of time to shop online and have your items delivered. Many retailers offer free shipping or other incentives. Another option is to hire a personal shopper. Some major department stores actually offer this service at no cost, so ask.

MAKE IT MEANINGFUL: Connect to what the holidays are really all about – spending time and making special memories with the people you love. As we move into November and December, make time for doing fun things together, like baking cookies, going downtown to see the holiday lights and festive store windows, renting a favourite family movie or going skating at the local rink.

An effective way to make time for these activities is to let go of the need to create the perfect home, buy the perfect gifts, and cook the perfect holiday meal. Perfection is unattainable, no matter how organized and talented you are (especially this time of year).

BE AN EARLY BIRD: Wrap and ship

your holiday gifts to out-of-town friends/family early to avoid rush postage costs and long lineups at the post office.

TRACK YOUR SPENDING:

Consider paying by debit instead of credit when shopping for gifts

to avoid the shock of your credit card statement in January. Another option is to put all your purchases on one credit card and only use that card for gift-buying; with most cards you can track your spending by viewing the balance online.

GUILT-FREE HOLIDAYS: Take a

day to catch up on unfinished business like filing, returning calls, etc. Most of these ‘loose ends’ take only a few minutes, but are put off because they don’t seem urgent.

However, you still worry about getting them done, and it takes up space in your brain. Eliminate these energy leaks and you will be free to enjoy your holidays. Hire help if you need to.

UNDER-DECORATE: If you find

it overwhelming to decorate every room of your home for the holidays, consider decorating one or two rooms you’ll use the most over the season and see how you feel. Chances are you and your family won’t miss the extra knickknacks. You will be especially appreciative when it comes time to take down the decorations and put them away.

JACKIE MARCHILDON When I first started renting, I used to look for prices that included utilities because I didn’t want to deal with setting up hydro and paying another bill. I’ve heard of landlords adding conditions to lease agreements when it comes to all-inclusive rent — for instance, prohibiting space heaters in the winter and/or excessive air conditioning in the summer.

Perhaps you’ve read before that certain clauses in leases are essentially meaningless and in some ways, that is true,

but it is also true that landlords generally have the right to include restrictions.

Landlord and tenant boards often suggest settling disputes before they escalate and I would suggest the same — but it’s important to know your rights when it comes to utilities and rental legislation.
