HOPEFULLY DURING YOUR LIFEas a renter you haven’t had to rely on the Residential Tenancies Act too much. If that’s not the case, you’re likely well versed in some part of your rights, but maybe not all of them. Many of us renters rely on hearsay information we’ve picked up over the years and as it turns out, a lot of it is misconstrued or, in some cases, completely wrong. MYTH 1: YOU CANNOT BE EVICTED DURING THE WINTER. One of the classic myths in today’s rental world is that you cannot be evicted during the winter months. In many cities across Canada, that would essentially equate to a six-month period. I admit, I thought this was true. As it turns out, a tenant can generally be evicted at any time as long as the landlord has followed the appropriate procedures outlined in their provincial Residential Tenancies Act. As in all eviction cases, the landlord would need to give the tenant the appropriate notice and the reasons for eviction need to be valid. The number of days of notice varies and because of this and the process in general, you might not actually be evicted during the winter, even if you were handed a notice in December. For example, if you owe rent in Ontario, your landlord must give you 14 days’ notice (only seven days if you pay rent by the week or by the day) to pay the arrears. If you do not pay the arrears before the set date, your landlord can then submit an application to schedule an eviction hearing with the Landlord and Tenant Board. While you wait for a hearing, you can still live in the property. Bonus tip: A lot of people think your utilities can’t be shut off in the winter. While that is mostly true, the laws around this vary from province to province and there are instances to look out for. In Alberta, for example, electricity cannot be fully disconnected between October 15 and April 15, but the electrical company can install a limiter – a limiter allows you to run your furnace and a few lights but nothing more. MYTH 2: YOU CANNOT BE EVICTED IF YOU’RE PREGNANT. Another myth I’ve heard is that you cannot evict

someone who is pregnant or who has small children. Generally speaking, if the pregnant person or parent with children has done something to merit eviction, they can be given notice to vacate the property. That sounds harsh, but if you think about it, if the law dictated that parents with small children couldn’t be evicted, that would mean that a parent with a baby could avoid eviction for years until the baby was no longer considered a small child. That wouldn’t really be fair to the landlord. Of course, when it comes time for the eviction hearing, the case for the parent can still be made and the eviction decision will be made based on specific circumstances. MYTH 3: YOU CANNOT BE EVICTED BECAUSE THE LANDLORD WANTS TO USE THE PROPERTY. Something you hear about often is landlords deciding they want you out because a family member needs to move in. In Ontario, family in this case means spouse, child, parent, spouse’s child, spouse’s parent or a caregiver for any of them. This is 100 per cent within their rights. They need to give you appropriate notice (in B.C., for example, this case requires a twomonth notice) but there is no point in fighting this one as it’s perfectly legal. MYTH 4: YOU CAN’T BE EVICTED FOR HAVING A PET OR GETTING A PET AFTER MOVING IN. Some provinces, like Ontario, have no laws prohibiting pets. In Ontario, you cannot be evicted for sneaking in your pet, unless you rent in a condo that has board-regulated pet restrictions. The caveat is that your pet cannot cause others discomfort. Your pet may be evicted if it’s causing allergic reactions or interfering with the enjoyment of the landlord or other tenants though. In B.C. and Alberta, however, you can be considered in breach of your lease and can be evicted if you chose to disregard the no-pet clause. When it comes to evictions laws, it’s important to know your rights. It’s also important to be a decent tenant – we’ve all heard landlord horror stories, but there are tenant horror stories too. The landlordtenant relationship is a reciprocal one, and a business agreement in the end, so all you can do is hope that you both hold up your end of the contract.

The 2017 rent increase has been released

And it’s...

THE 2017 RENT INCREASE has been released - and it’s only 1.5 per cent. That means, if your rent is going up in 2017 then it can only be raised by 1.5 per cent. Some years have been higher, some lower. This is a relatively low rental increase. It’s interesting to note that as we’re seeing record high prices and pricing increase in the buying and selling of residential real estate, we didn’t see a translation of that to the maximum rent increase allowable, but instead saw something towards the middle of the possible 2.5 per cent. If only our rent could stay the same and never change. It would be nice – but most landlords wouldn’t be happy. The rent has to increase to allow landlords and property owners to have their investments give them a financial return in keeping with current economics. The province of Ontario sets the rent increase each year, basing it on the Ontario Consumer Price Index. It’s basically a reflection of inflation. But even were there to be dramatic inflation, the increase has a cap - the maximum increase is 2.5 per cent. It’s significant to note that there are many exclusions to the rent increase cap. 1. Apartments created after November 1991 2. Commercially zoned spaces 3. Social housing 4. Nursing/assisted living homes 5. Vacant properties 40

If you live in any of these types of properties – whether it be a hard loft conversion, a brand new rental building or a condo that was built in the last 25 years, this one provision of the Residential Tenancies Act does not apply. This provision was removed in order to stimulate development of new rental properties because new purpose-built rentals were lacking, and developers and property management companies needed financial incentives to motivate new purpose-built rental building growth. With this provision, it often encourages those who will be renting longterm to stay in one place, because rent over years – and decades – remains very low, and eventually far under market value. Once a property is vacant, the landlord can set the new rent for new tenants at whatever they feel the market will bear. Even if the old tenants were only paying $500 per month, the new rent could be set at $3000 per month if the landlord feels someone would pay it. Once exception to the 1.5 per cent cap that could potentially cause a higher rent increase is if the landlord or property management were to apply to the Landlord Tenant Board for an increase over and above this cap. The Landlord Tenant Board does grant increases above the guideline, and this is decided on a case-by-case basis with each application. An application can be made for an above-guideline increase for a number of reasons, but the most common are: Signifiant capital expenditures and improvements, an extraordinary increase in taxes and/or utilities, an increase or installation of security services. The increase is based on ‘extraordinary’ expenses over-and-above normal operating and maintenance expenses, as defined by the Landlord Tenant Board. If you’ve ever got questions about your rent and how much it can be raised, you can always contact the Landlord Tenant Board.

WHEN YOU HIRE A MOVING COMPANY, it is important to understand what services the firm can and cannot provide. At Two Men and a Truck – Canada, we pride ourselves on accommodating our clients in every possible way. But there are some requests that pose problems. MOVE HAZARDOUS MATERIALS, CONTAINERS OF FUEL AND GAS-POWERED ITEMS, SUCH AS LAWN MOWERS THAT ARE NOT EMPTIED OF FUEL: This is in accordance with Ontario’s Health and Safety Act and Hazard Materials Act. The law prohibits us from transporting these types of goods. MOVE LIVE PLANTS: Many movers, including our company, have their own guidelines about this. Securing plants takes a level of special treatment that we are not prepared to offer. If customers need advice on how to move plants, we can help them find companies that are equipped to do so. In our experience, most customers move plants themselves. MOVING ANIMALS: Moving animals takes special care, and movers are not willing to take responsibility for pets during a move. You are best to arrange for them to be somewhere else on moving day, and then ease them into their new surroundings yourself. REARRANGE YOUR FURNITURE: Sometimes people ask us to rearrange their furniture at their destination, which adds to the time estimated for your move. We are happy to provide you with this service – for a fee – but it shouldn’t be assumed it is automatically included. MOVE PERSONAL VALUABLES: It makes sense that small valuables such as jewelry, stocks, bonds and cash are items you want to transport yourself. STOP THE CLOCK BECAUSE THERE IS A CHANGE ON YOUR END: We get paid from the time we leave

our facility until the time we return. If you change the parameters of your contract or something unexpected happens on your end to cause a delay, the move continues on as planned, but will likely extend longer than your estimate. MOVE ITEMS LARGER THAN WE HAVE THE ABILITY TO DO: When we see items that are too big and bulky for us to handle, we will let you know. Upright pianos, for example, are incredibly heavy and usually require heavy-duty dollies and a truck with a lift gate. We can definitely help you with any size of piano. Massive walls can also present challenges. We can help you find the right firm to move those specialty items, if required. PROVIDE INSURANCE COVERAGE FOR ITEMS OF EXTRAORDINARY VALUE: Ontario’s Conditions of Carriage requires movers to insure items at least 60 cents per pound. If our coverage does not include antiques or works of art, we can arrange it through our Insurer as long as these items are itemized upfront. Your tenants insurance policy may also have a rider for goods in transit. INSTALL MAJOR APPLIANCES: We are neither plumbers nor electricians. If you require installation of your major appliances, arrange to have those professionals help you during your moving week. LOAD PRE-PACKED BOXES AND ITEMS INTO A U-HAUL OR POD: We do not do “load only moves.” If someone else is driving the vehicle and the goods are not under our control, we can’t take responsibility for the condition of the goods at their final destination. All of the above help ensure that your possessions arrive at the other end in one piece, with the safety of you, your family and the movers in mind. And, that’s our job!

WHAT DO YOU CALL IT? For some it’s “the Gaybourhood,” to others it’s the “Gay District.” In some cities it’s called “the Gay Village” — or just “The Village.” In Montreal, it’s “Le Village gai” or just “Le Village.” It’s a thing. Most cities have one, and though it may have developed out of the need to create a safe haven for the Lesbian, Gay, Bisexual, Trans, Two-Sprit and Queer (LGBTTQ) community to live, The Gaybourhood has flourished into a destination and

home that caters to the community. Throughout the year, most Villages will celebrate their identity with Pride festivities — not just in Canada but also around the world. While there’s no discrimination, and heterosexuals are not excluded from these self-identified communities, businesses cater to gay culture — some more specifically and overtly than others. Lawyers in the village practice law — though they may handle more sexual preference discrimination cases or same-sex divorces than their counterparts in midtown, they also handle legal cases having nothing to do with gender identity or sexual preference. Many (but not all) of the clubs and bars have a certain swagger, a certain style and overtness about them than your typical Entertainment District hotspot might not have — and same-sex PDAs are a common sight and as acceptable as PDAs can be, most of us — LGBTTQ or not

— would agree. But again, it’s not about gender or sexual identity specifically, it’s about a community where it’s safe and beyond judgement to own and express one’s identity. While most cities are changing with the times and the LGBTTQ community is becoming more universally accepted, it wasn’t always the case — and unfortunately still isn’t universal. After recent events in Orlando, it’s clear that it’s a community still requiring some safety considerations and protectiveness in place, as, even now there are definitely attacks on the LGBTTQ community. Most big cities have their Gaybourhood — and enjoy big Pride celebrations each summer, but there are many places in which there is still a stigma for overtly expressing sexuality or gender identity. Some cities may have a growing community without a specific neighbourhood to call “The Village” while still other cities and small towns have no existing culture or establishments. Montreal has The Gay Village – “Le Village” or “Le Village gai,” centred around the Beaudry Metro station. Le Village is well known and well established — with bragging rights to North America’s first recorded gay business. Moise Tellier’s “Apples and Cake Shop” was established on Saint-Antoinne in 1869 — and the rest is a very liberated history and a large community. From August 8 to 14, Montreal is awash in Pride celebrations. From August 15 to 21, flags get raised and rainbows fly high on the hill and throughout the city as Ottawa Capital Pride celebrates the LGBTTQ community. Ottawa’s Gaybourhood is more low-key, less overt — and small – considering this is Canada’s Capital. The official Village is part of Centretown, Bank St., from Kent to O’Connor and James to Nepean streets.

People came from all over the city — and the province — to express their true selves and mingle with like-minded residents in an environment that was safe and protected in the bar that operated in the building on weekends — drag shows and all. In fact, it was a Calgary drag queen who taught me how to lace my knee-high black boots with a quick twist of the wrist (thanks Billy!). Many budding cowgirls were mentored here, and on top of the fun, the food was exceptional! There was definitely a safety issue at a time where gay culture was just starting to get its footing in Cowtown. Pride in the Prairies just occurred. Pride Winnipeg was celebrated May 27 to June 5 in Downtown Winnipeg, and the Saskatoon Pride celebrations ran June 3 to 12. Neither has a very large or established Village, though the community is starting to strengthen. Vancouver has a very well-developed Gay Village — Davie Village. This area loudly and proudly supports the city’s LGBTTQ community. Street signs and rainbows distinguish the sprawling Gaybourhood, and business is bustling! Vancouver will be hosting their 39th annual Pride celebration in The West End on July 31. Toronto has The Church-Wellesley Village — just “The Village” to most. From window displays and the rainbow flags prominently displayed, this Gaybourhood is loud and proud — with Pride celebrations through the month of June— as The City of Toronto has proclaimed June first to July 3 Pride Month. The big parade and party will end the month of celebrations, but the neighbourhood keeps the spirit and sentiment alive throughout the year.

Old Strathcona in Edmonton waved its rainbow flag loud and proud on June 4, though the city lacks its own Village and has very few gay establishments. There is a growing culture, but residents still find adversity and the community needs to come into its own. The same stands true in Calgary, whose Pride parties will be held over Labour Day weekend in September. Though the city lacks a focussed Village, it has a growing culture. Even into the 90’s, there was very little in the way of safe or LGBTTQ-positive spaces for Calgarians. There were a few very places to be completely and comfortably open. I know — I was a waitress in one of the city’s three hotspots — Victoria’s on 17th Ave. It was so low-key that I didn’t realize its nature until one of the owners explained it to me when I took the job. Victoria’s had a completely diverse clientele, from very conservative, heterosexual diners to new transvestites visiting from more remote towns. The “Queens” theme through the restaurant, bar and café was a subverted key
