f you’re a regular reader of Renters Guide, you know we offer a variety of information for those looking for a new place to call home. But did you know it is your responsibility as a tenant to know your rights and responsibilities prior to signing a lease agreement?

By knowing the terms of the rental contract ahead of time, you will be well informed and able to determine if the location is the right one for you. Once you choose your location, a landlord should give you adequate written notice when rent or landlord services have been adjusted, and you should be able to discuss any clarifications or adjustments before a new lease is signed.

Many landlords and property management companies do their jobs well and care about the property they own as well as the people who live there. It is in their best interest to keep good tenants. Many go above and beyond. Do you know a terrific landlord or property management team? What makes him or her so great? Let us know. We’d love to hear from you!

f you’re apartment hunting at this time of year, buildings with outdoor amenities like a pool, tennis courts and gorgeous grounds will seem extraenticing. And air-conditioning will probably also top the list. Some communities just seem designed for warm weather and summer living – practically like living at a resort!

While it sounds like fun, take a minute to look at your wishlist before you get too attached to that dream of days by the pool. There’s no reason you can’t have it, but make sure that some of the other important items on your list don’t get missed.

It might seem reasonable to go a bit further away from your ideal location, but once the summer fun is over and the days grow shorter, will the longer walk to the bus stop become annoying, and more of an issue in rain and snow? If you trade-off for no underground parking, will you be upset while cleaning off the car all winter?

If you’re going over budget to attain those extra amenities, make sure it’s worth it in the long run. It can seem perfectly reasonable to make decisions for the ‘now’ but if they come at the cost of what you’ll need later you may regret it.

There’s really no reason you can’t have it all, but it may take some searching. Our

LIFE HAPPENS. PLANS CHANGE. SOMETIMES AN OPPORTUNITY COMES KNOCKING – ONE THAT YOU CAN’T TURN DOWN. One that will take you away from home for an extended but not permanent stay. On first glance the options can seem like a rock and a hard place have come to visit with your lucky happenstance. Either give up your home and pack it all into storage while you go away, and then face finding a new place when you return, or pay rent for an apartment to sit empty while you are RentersGuide.ca gone. The former is a lot of upheaval, especially tricky if you are under lease and are obligated for many more months.

Subletting may be an ideal option. Just as you may need to leave temporarily, there are plenty of people that need a shortterm place to stay. Whether they’re moving here and need a landing spot until they find more permanent accommodations, are renovating and need to vacate their homes for a limited period of time, or are just here, as in your situation, for an extended but not permanent stay, it’s just a matter of finding someone with comparable needs and making arrangements for them to live in your apartment and take over the financial responsibilities. While it can be a great arrangement, technically, you continue to be responsible for your lease even if you are not living in the apartment. Subletting has a legal aspect to it.

Subletting means that a tenant moves out of his or her unit for a specific period of time, but plans to move back into the unit before the end of the tenancy. The person who moves into the unit is known as a “subtenant.”

The subtenant is responsible for paying the rent to the original tenant who continues to pay rent directly to the landlord, and is responsible for complying with everything in the lease.

If you’re planning to leave your unit for an extended period of time but want to return to it, you must ask your landlord’s permission to sublet the unit. You must inform the landlord when you are leaving and when you will be returning. Your landlord cannot refuse the idea of subletting a unit, but they can refuse a specific person if they believe the person is unsuitable. If you need or want to sublet your apartment, you, and not your landlord, are responsible for finding someone to pay your rent while you are temporarily away. It’s best to advise your landlord of your intentions, and provide all necessary details such as the subtenant’s name, phone number, place of employment, etc. The landlord may need to contact the subtenant and/or enter the apartment in case of an emergency.

Subletting is often confused with “Assigning a Unit.”

Assigning a Unit means that the tenant moves out of the unit permanently and transfers their lease to another person. All aspects of the lease stay the same for the replacement tenant. This is the option that you may choose if you have an opportunity that will take you away from your apartment permanently, but you are still under obligation to your landlord for the remaining duration of your lease. What if you receive a job offer in another city, or you have to leave your job to care for a sick parent or child on the other side of the country and have to suddenly give up your apartment and end your lease early. If such circumstances do arise, it would be best to notify your landlord as soon as possible. They may have someone who could be looking for an apartment in the building and would be able to take over your apartment. If RentersGuide.ca not, the situation is similar to a sublet: you would have to get the landlord’s permission to Assign the tenancy, and it would be your responsibility to try to find someone to take over the

lease. You are responsible for paying your rent and maintaining your commitment to your landlord until a suitable tenant to replace you has been found. The landlord has the right to refuse to let this person become a new tenant, but must have a good reason for doing so.

It’s possible that the landlord might refuse the idea of the Assignment or might not respond to your request to do so. If your get a refusal or no answer within seven days of your request, you are then permitted, under the Residential Tenancies Act, to give your notice of termination with an N9 Form instead of assigning your lease, and do not have to fulfill the remainder of your lease term. Your landlord may simply prefer to start a fresh lease with a new applicant instead.

AS YOU SIT BACK IN YOUR LAZY BOY IN YOUR RENTAL APARTMENT, all of the lights go out; who is responsible for the repairs, the Landlord or the Tenant?

Responsibility for repairs and maintenance of the property is an issue that as usual RentersGuide.ca is not black or white, and will depend on the type of repair and maintenance, who caused the damage and whether it was separately dealt with in the lease between RentersGuide.ca the parties.

REPAIRS Generally, a Landlord must keep a rental property in a good state of repair. This means the Landlord must repair anything included in the Lease Agreement, written or oral and supplied by the Landlord to the Tenant (a “Landlord Obligation”). These kinds of things include but are not limited to: • Electrical, plumbing or heating systems, • Appliances the Landlord agreed to provide in lease agreement, • Walls, roofs and ceilings,

• Doors, windows, locks.

Property, like everything else, goes through normal wear-andtear and, as a result, may break down or wear out. When a Landlord’s Obligation does not work properly, the Landlord must repair it or replace it. Tenants should not be responsible for, or become involved in fixing Landlord Obligations, even if minor, unless they have agreed to take over these duties or they (or their guests) were the ones responsible for the damage.

If a Landlord does repair an appliance, or replace a light fixture, he does not have to supply a new or better model. For example, a Landlord could replace a broken dishwasher with an older used model, as long as the used model works.

If a Landlord refuses to make reasonable repairs, such as fixing broken door locks or fixing blocked drains, the Tenant should bring an application for maintenance and repairs to the local authority governing Landlord and Tenant issues.

As a Tenant, you may be tempted to withhold rent to pay for the repairs. However, if you do this without taking the proper procedural steps, a Landlord may apply to have you evicted for non-payment of rent. In residential tenancies there is no right of set off, unless specifically in your lease document. An alternative is as part of your application, most jurisdictions provide for the opportunity to pay your rent to the Tribunal or Court. Try and get that relief and use it as a lever to get the job done.

Remember to put all of your requests for maintenance and repairs in writing to your Landlord. if possible, because by doing so you will be able to prove you made these requests.

This will become important to a Tribunal or Court later, to show the Landlord’s conduct should you make an application to the local authorities.

If the Landlord fails to make the promised repairs, or does not respond after multiple requests, then, an application to your local authorities governing Landlord and Tenant issues is necessary.

MAINTENANCE The Landlord must also keep the rental property clean. This would in include the common areas such as the lobby area, halls, elevator, laundry room, pool and or parking garage, etc.

PROPERTY STANDARDS A Landlord must make sure that rental property meets health, safety, housing and maintenance standards which are set out in municipal bylaws or provincial maintenance standards, such as the building code or fire code. For example, bedrooms must contain a window. Rental units must contain a working smoke alarm. If you feel something in your rental unit is unsafe, notify the Landlord. If he does not fix the problem, call your local municipality property standards office, or Provincial Health and Safety departments, or even your local fire station, and request an inspection of your unit. If the inspector finds RentersGuide.ca something wrong, a work order will be issued to the Landlord requiring the repair to be made by a specified date.

WHEN DOES THE LANDLORD HAVE TO TURN THE HEAT ON? Heat is considered a vital services and the Landlord is responsible to provide heat. If heating is not up to standard, he may be committing an offence.

Generally, the Landlord must keep the heat to at least 20 degrees Celsius during the fall and winter.

The exact dates will be set out in your local Landlord and Tenant Act or the Regulations thereto. You may also contact your local municipal government to find out if your community has bylaws which set the minimum standard for heat.

WHEN CAN THE LANDLORD ENTER THE PROPERTY TO MAKE THESE REPAIRS? Generally, the Landlord can only enter your property if written notice is given. However, if there needs to be an emergency repair, the Landlord can enter without written notice. Examples of emergency repairs would be flooding or a short circuit in the wiring that creates a fire or electrical risk.

Non-emergency repairs include minor leaks in roof or cracked windows. Remember, a regular or minor repair is merely an inconvenience, not an emergency. For more information on when a Landlord can enter your property, see our articles online at www.schwarzlaw.ca.

THE BUSIEST MOVING DAY OF THE YEAR IS JUNE 30TH, according to Two Men and a Truck – Canada that day is particularly popular for several reasons.

Thousands of people in midtown Toronto will make their moves during the Canada Day weekend, which means movers will be going all out to provide the necessary services. It also means that each year, those who wait until the last minute to book moving trucks and/or movers for June 30th are disappointed when they find nothing available.

The school year is over by the end of June, and families with children usually want to wait to move rather than disrupt the kids’ routine. Of course, June 30th ushers in the Canada Day long weekend, which means an extra day to unpack and organize before going back to work.
